This woman is virtually untouchable. She was working and protecting British interest (BPE) while working as minister of petroleum.
Her rise to head OPEC was not by accident. She has the protection of the big boys.

I am not particularly familiar with the facts of this case.

But if, like you mentioned,
1. They initiated the contract, and
2. Contracted the ferrie which occasioned his death;

they still have a good case.

Many times - terms of the contract will contain the conditions for performance and how Any dispute will be resolved - if one comes up before performance.

But - assuming there here are no such provisions in their contract... the general principles of contact law will apply. I would imagine some amount must have been paid upfront. Contracts have been signed - and may be the final payment is tied to some final obligations from Nantes (e.g transfer of insurance policies, documents, etc.).

Where the above applies - and the player - WHO IS THE SUBJECT OF THE CONTRACT - is now dead? then performance of contract is not yet concluded - frustration will apply. This text explains it better;

The Restatement (Second) of Contracts, Section 265, defines frustration of purpose:

Where, after a contract is made, a party's principal purpose is substantially frustrated without his fault by the occurrence of an event the non-occurrence of which was a basic assumption on which the contract was made, his remaining duties to render performance are discharged, unless the language or circumstances [of the contract] indicate the contrary.

Now it is not an argument that the ferrie which killed the player was contracted by Cardiff - the flight was not within their reasonable control; if anything, Cardiff can bear some financial liability (and compensate Nantes - but not for the full balance for the player) - and Cardiff can in-turn pursue the ferrie company to recover their expenses.

I imagine that’s how it will play out if it goes to court. Buh the UK are quite good with out of court settlements/arbitration: especially to respect the dead player.

I just read that Nantes are demanding £15M from Cardiff, just like I suspected. Their argument is that when the plane went down, Sala was a Cardiff player.

I'm not saying the picture is real, but if you look closely, you will see a man wearing PDP cap at the left side of the picture.
I doubt he will put on a pdp crested cap if this was an Apc event like you suggest.

Two weeks ago, Osibanjo made us believe that the president was unaware of the CCT process on the Cjn.
It is very clear the action of the president is in total contradiction of what Osibanjo said. Which makes Osibanjo either a pathological liar or completely unaware of what is happening around the presidency.

It all depends on the terms of the contract - and the law that is stated to apply where a dispute arises. There is a doctrine in English Contract law - doctrine of frustration. It allows the contract to be set aside where performance of an obligation by either party is impossible.

“Frustration is an English contract law doctrine that acts as a device to set aside contracts where an unforeseen event either renders contractual obligations impossible, or radically changes the party's principal purpose for entering into the contract”

It’s simple - they can try to settle amicably and reduce the amount obligated to be paid for the player - which I imagine will Be done in this case. Buh if they proceed to court Cardiff would most likely win the case. Insurance issues comes in as well.

Thierry Henry is not exactly the problem. Monaco should take a second look at Michael Emenalo's position.
As DOF he has badly recruited. Mostly, brought misfits and primadonas to the club. The man he replaced at Monaco, Luis Campos is currently the sporting director at Lille and they are second on the French lig1, a position that should be Monaco's.

Mike Emenalo should be taking the hike if Monaco knew what was best for them.

The momentum (if he performed admirably well) would have been like a hurricane that will breeze the entire country in the final legs of the campaigns.

If not for his own short comings, I reckon he would have gone on with the debate.

Kudos to the Kenyan special forces for their rapid response and surgical precision in taking out the terrorists.

Very typical of the whites to make themselves heros in African affairs. They are already tagging the SBS operative the hero as if he pulled a Rambo and saved the day,taking the spotlight away from the brave Kenyan operatives.

Hopefully, the Nigeria army is taking notes and proactively trains her special forces in urban warfare, especially fighting in densely populated areas.
This things should be a daily routine due to the reality of the times we are in.

I shudder to think if this happened in Nigeria, you will see our military wheeling out their tanks and apcs to blow the damn building down to get the terrorists. Typical naija style.
Civilians, especially those whose loved ones are trapped inside, moving into position with their cutlass and tree trunks to bring the terrorists down.
It will be a total mess.
We have witnessed a lot of botched rescue operations with our fire fighters. It won't be a different situation with the terrorists when they decide to take hostages.

There's a cross fertilization between AL shabab and Boko haram. Some AL shabab terrorists are active in the North East.
Nigerian army must be proactive.

He didn't actually answer the question. He simply gave a history of always contesting election results in the tribunal. Which clearly indicates, he will not do a Jonathan who didn't put a call through and congratulated him without going to tribunal.

Paolo Di Canio played in a very poor team which got relgated, yet he was got a lot of credit.
Juninho Paulista played in a very poor Middlesbrough team but he got his head above waters.

Remember, we are talking about individual performance here. Hegazi really came to the party for Egypt and he was practically Westbrom's best player last season. Go and re-watch their world cup games. Individually, Ekong didn't have a better world cup than him. That's a fact.

Ndidi is a good player, but honestly, I don't think he had a better season than Keita who made Bundesliga best eleven and Europa team.

Bailey made 13 appearances for Man utd last season(2017/2018) and most of it was in 2018, even when he's afforded a chance he plays bad, this season he has 8 appearances, still unconvincing. He wasn't at the world cup. How does it deserve to be on African best XI. Troost Ekong deserves it more, if not for his performances in Turkey, then his world cup and performances at Udinese this season should justify his inclusion ahead of Bailey.

Aurier was bench warming for Trippier throughout last season, are African footballers that bad?

Ndidi is one of the best defensive midfielders in the EPL, check the stats.He should be on the list with Thomas partey and one of Keita or Mahrez should drop out.

First of all, Ekong was not Nigeria's best defender in Russia. You can't tell me he was excellent in any of our group matches in Russia.
Recall his childish grappling of Manzukich against Croatia cost us a penalty in that game. In subsequent games, he was nothing special. So please put world cup performance aside.
The Egyptian centre back, Hegazi should feel aggrieved before Ekong as he was solid for Westbrom last season and was very good for Egypt in the AFCON and world cup qualifiers and even the world cup.

Coming to Ndidi, I don't believe he had a better season than Keita. Note that Keita played up to the Europa cup semi finals for Leipzig and he made the Europa team of the season and Bundesliga team of the season.
You can't say by merit, he doesn't deserve the recognition by Caf.

Truth is that there is a dearth in world class talent from Nigeria,unlike how it used to be in the past. There was a year 6 Nigerians dominated this Caf awards.
Instead of always crying foul, we must dig deep and ask ourselves how we can get back to being the best In Africa.

I don't agree with Ogu. No Nigerian player merits a place in CAF best 11.
Thomas Partey has been a solid player for Athletico Madrid who won the European Cup last season. While Keita made the Bundesliga team of the season with Redbull before his transfer Liverpool.

Talk about Ekong, he played for a modest Turkish club last season and he was not even Nigerias best centre back in Russia.

It is noteworthy that this award is all about Prestige. A low profile player cannot make this kind of list. The competitions players rated, play in matter. Ekong and Ndidi do not play for clubs who participate in European competitions.

Finally, somebody ask Ogu why Abu Treka never won the African player of the year. If not for club profile.

Nigerians used to dominate this list some 20yrs ago with little or no fuss. How the mighty have fallen.

Intellectual/copyright theft is almost a way of life here in Nigeria, from music to literature. It has become an industry on its own. Even in citadel of higher education, Lecturers download and photocopy textbooks, publish and resell as theirs or as handouts.

Back to the topic, I met someone who told me about a slam dunk case just like this one, against then Vmobile. He chickened out because he didn't have the muscle to pursue the case. The judgment of this case will go along way to give confidence to other victims of copyright theft.

Within the next 5years or even less, people will be conscripted right from the streets to face Boko Haram in the front lines.
It's obvious the Nigerian military is tired and weary. Soldiers dread being posted to Bornu. Mobile policemen flee when it is rumored they could be posted to Bornu. It's only a matter of time before civilians are conscripted.
