On a serious note, the judge's ruling is absurd. Quite ironic that a judicial organ would administer a prejudicial measure. You can't commit suspects presumed to be innocent to jail for three months without bail - under the guise of adjourning hearing on their bail application. This is not a terrorism or murder case. |

Nigeria's legal system needs a massive overhaul. What exactly is this guy's offence? He had consensual sex with a 20 year old adult woman. Prior to the act, was there conclusive psychiatric evidence indicating that the woman was mentally incapacitated, and if there was, why was she not confined to an appropriate institution or facility for mental health care? Is ther a medical document certifying this woman to be mentally incapacitated and therefore unable to give volitive consent to sex? How exactly can this be proven to be a rape case? All kinds of simple legal arguments backed by existing laws can be used to throw this case into the thrash can. Sometimes I am ashamed of my country and Africa in general. No be only technology and infrastructural development oyinbo take pass us. Basic jurisprudence is a problem in this part of the world. One would hear that a man was arrested in Ajegunle for impregnating a married woman(even though they both had a consensual relationship) , while another man was arrested in Ojuelegba for taking a picture of a policeman collecting bribes. Where do these things feature in any of our laws as offences for which arrests or prosecutions are possible? Very primitive society. |
