akinblog: A senior advocate of Nigeria, Olisa Agbakoba SAN, has written a petition against the acting Chief Justice of Nigeria, Justice Tanko Muhammed.
He made a revelation in the petition, saying that the new CJN should not be in office.
Muhammed was appointed after President Muhammadu Buhari suspended Walter Onnoghen from office.
In the petition sent to on Monday, Agbakoba said: “On 25th of January 2019 President Mohammadu Buhari pursuant to an exparte order of the Code of the Conduct Tribunalpurportedly suspended the Chief Justice of Nigeria, Honourable Justice Walter Samuel Nkanu Onnoghnen and purportedly swore in Hon. Justice Tanko Mohammed as the Acting Chief Justice of Nigeria.
“The Constitution is clear about the procedure for suspending or removing the Chief Justice of Nigeria. The Chief Justice of Nigeria can only be removed on the recommendation of the NJC. SeeSection 153 (1), Paragraph 21 (a) of the 3rd Schedule and Section 292 (1) (a) (i) of the Constitution of the Federal Republic of Nigeria 1999and the Supreme Court decisioninElelu-Habeeb v AGF (2012) 40 WRN 1.
“Hon. Justice Tanko Mohammed is fully aware of the state of law, yet presented himself to be sworn in by the President. Incidentally, Justice Tanko Mohammed was a member of the NJC panel that removed Justice Obisike Orji of the Abia state High Court for accepting to be sworn in as Chief Judge by the Governor of Abia state without the recommendation of the NJC.
“It is a matter of regret that Justice Tanko Mohammed who participated in this process will lend himself to this constitutional infraction. We pray the NJC to determine this petition in line with the decision in Justice Obisike Orji by immediately removing Justice Tanko Mohammed as Justice of the Supreme Court on grounds of gross misconduct which has generated perhaps the most controversial crisis in Nigeria’s judicial history.”

Sirjamo: If all you wrote here are true, why didn't he face the cct and explain himself, instead of obtaining restraining orders in multiple courts? Bro, go and read the CCB Act very well, since he already explained everything as required by law, the case is not supposed to be referred to CCT and he's not supposed to go there too. Aside that, the NJC is supposed to be notified first, according to the law. That was the question Chief Wole Olanipekun, SAN, asked Danladi Umar on the first day of the sitting and Umar got annoyed, meaning Umar was instructed to do anything to get the man removed from Office and damn the consequences |

Tetehjewels: You seem to be ignorant of a lot.
He admitted to not declaring some of his assets by virtues of forgetfulness.
He never corrected the said assets which he first declared.
If he did, there would be no need for all this brouhaha.
In his own writing he admitted this and you still want to say nonsense? You're an illiterate! I can't waste my precious time and energy on you |
Politics › Re: See The Suspended Cjns Letter Admitting Guilt, Claiming Ignorance by id911(m): 12:59pm On Jan 28, 2019 |
You guys don't know anything I swear... The CCB law says when you admit there was a mistake and corrected it as Mr Onnoghen has done since 2016, the case can not be referred to the CCT because he has been exonerated. Do you guys really understand your laws at all?
(i) the code of conduct act allows anyone to make an additional written statement on the assets that were not declared in the forms. Once that is done, the act says the person SHALL NOT be referred to the tribunal. And that's exactly what onnoghen did by declaring those accounts in WRITING. Why was he referred to the tribunal?
(ii) the amounts quoted in those accounts are actually the TOTAL TURN OVER on the accounts not that the physical cash is there. They are releasing information in a wrong way to tarnish the man
(iil) the man has explained in his code of conduct forms the businesses he is into to get that money. He noted he was in private practice before coming into to the bench. He mentioned forex trading etc. It is instructive to note that the government has not accused him of fraud or stealing. Note our vice president was a university lecturer then a commissioner but he has close to a million dollars, close to 100 million Naira, houses in banana island and shares in mtn. Onnoghen has been in private practice before the VP and no one yet has said he stole money. So why resign?
There for if the issue is that of declaration, code of conduct act ( look at section 3 below) has covered the man well

Clerverly: Falana Calls For Justice Onnoghen’s Resignation Channels Television Updated January 27, 2019
Femi Falana, a Senior Advocate of Nigeria, has asked Justice Walter Onnoghen to quit the bench, following the allegations levelled against him at the code of conduct tribunal.
The human rights activist made this call on Sunday while featuring as a guest on Channels Television’s Politics Today.
He said, “The government should as a matter of urgency, lift the suspension on the Chief Justice since the Chief Justice as so much to on his own admitted that he did not declare his assets, he should do the needful by calling it quits”.

Falana said after the suspension has been lifted, the Chief Justice should quit the bench because he has already admitted that he failed in his duty to declare his asset as required by the constitution.
The Senior Advocate further argued that the Executive and the Judiciary arms of government have failed Nigerians with regards to the case of Justice Walter Onnoghen.
He said it was wrong for President Muhammadu Buhari to have suspended Justice Onnoghen based on an ex parte order of the code of conduct tribunal.
He said by so doing the President did not follow due process, stressing that the government must learn to obey the rule of law.
“You can’t fight corruption without following due process,” Falana said.

Sowore has collected a huge amount from APC to do dirty jobs for them including pretending to be a Presidential Candidate in order to deceive and waste votes of those youth who voted for Buhari in 2015 but don't want to vote him again due to his poor performance. They know a vote for Sowore is a wasted vote that should have gone to a major opposition. Nigerians are so gullible

Osinbajo has really surprised me now with his lies. A whole Pastor! Recently on National TV in The Candidate, the man said bluntly that the Person With Disability Bill was still with National Assembly that they refused to pass the bill. The interviewer reminded him the bill has been on the President desk for ages, he said it's not true. Two days later, the copy of acknowledgement letter of the bill sent to the President surfaced on Social Media, out of shame, Buhari hurriedly signed the bill into law but Osinbajo hasn't apologized to Nigerians.
The man also said Buhari was not aware that the CJN was being arraigned in Court but of course, the events of the last few days is unfair to him how he lies without conscience! I could go on and on... |
