Abeg stop demonising my beloved Nigeria, Nigerian law is "primarily" based on UK's "common" law". So in Great Britain, as far as this issue is concerned, the buyer paying after "inspection" has voluntarily waived goodbye to his money. The only legal recourse available to him is to take the buyer to Court with the burden of proof and sue for the losses incurred. But driving an overheated car with 5 warning light on, gives him no leg to stand on and the Court would hold him liable for this magnanimous oversight, meaning that he will not get his full money back in Court. Without dragging this case further, the Buyer deserves a standing ovation for the utmost trust he employed, likewise the Seller's too for his goodwill gesture offer. Hmmm.
Demonising indeed!! You are still talking law, doesn't look like you live in Nigeria?? |
When you are done with being high up in the clouds away-with-the-fairies and you return to planet earth with a bump, put on your thinking cap Sir. This was a "private" sales, not a transaction with a Dealer, which means the onus is on the buyer to carry out the appropriate mechanical and background checks to make sure the car is sound. The buyer waived his "already minute" legal right, the moment he purchased the car without the requisite inspection. And pray tell where he will get the burden of proof to absolve himself of any culpability with all the incriminating emails already weaving their way all over the airwaves huh? And remember the car was roadworthy at the point of sale. Yes, the buyer can sue, but he is not entitled to a full refund, he can only sue for the losses incurred, and then he would also have to pay his Solicitors fees too, thereby still leaving a shortfall in his pocket. So his best bet IMHO is to accept Damola1's offer and chalk it down to experience. Disclaimer: This is only applicable to private sales, before any Dealer starts thinking . . .
And you wonder why Nigerians resolve disputes using some other means![]() Interesting discuss, hope all parties find peace at the end. |
fasbio: hi allDo not go into poultry or any other livestock farming if you are not on ground in Nigeria, do not attempt it no matter what you are told. Poultry requires daily management during which a lot of "under the table games" are played by those managing it for others; you can and will lose your money within a short time. It is a good and profitable business if you are on ground. |
Are you sure? |
Unfortunately, it is about to get worse with the demobilization of personnel from the Escravos Gas project. With over 5,000 jobless youths getting back to town this year, the results is so predictable. |
biachwest: Nigeria government should consider reforming the various security agencies. Employ our graduates to the various department of our security agenciesIt is not about paper qualifications but training, you should ask what kind of training the guy has received since he joined. A political science graduate without necessary training will be worse. |
@ poster, You need better information before you create further confusion, Chevron still recruits both OND and HND holders! A large number of folks on the EGTL plant belongs to this category. I work with a couple of them, it depends on the job owners and not the organization. There is no organizational decision not to recruit these folks but of course you wouldn't recruit an HND holder as a drilling or petroleum engineer, |
engineerd:Yes but softly, softly my brother. There are other evil people that don't wish us well seeking ways to profit from expected misfortune. When handshake goes beyond the elbow, it is no longer greeting but wrestling. The fight against corruption will have to be properly planned and executed using our intellect. |
It makes sense for NLC and TUC to accept this offer in the interest of peace and progress of the country. GEJ listens after all and considering the efforts of the past few days, I believe he did not do badly. |
Beaf:NLC is too small in the scheme of things as regards sabotage of the refineries, you need to talk to an "insider" there to understand. |
. |
Parisgoodman:ESD takes only 1 second my friend, faster than the ND boys can offer. PENGASSAN leaders can be bought but their followership can revolt, it is worse when you don't have leaders leading a protest. |
Fhemmmy:We pray and hope> Fhemmmy:Not a problem. |
Aftermath of NAFDAC failure! Cheap, fake drugs everywhere; only God knows those that are still sane in the country. |
Fhemmmy:You are correct but we also need a change of lifestyle if we will succeed in our personal lives, it is almost similar to choosing between packing lunch or visiting a restaurant for lunch. Sometime you have to make do with your own water that may not be ice cold rather than spending so much on some poor quality water that can kill you despite the bold NAFDAC number on the poor grade nylon used in the packaging. I can tell you that most businesses makes (plenty) money in Nigeria, the issue is that they want to make more, at the expense of the consumer. Take the MTN folks as an example, what has been their profit profile since they started in Nigeria? I am sure they zoomed past their break even point within 2 years! And they refused per second billing until GLO got in as the game changer. I have many examples here, nobody cares about the consumers; it is extreme capitalism worsened in Nigeria due to lack of knowledge and regulations. |
Fhemmmy:Not sure who gave you that feedback but I can tell you it is very true, I visited one of the locations in Iwo town. I missed the opportunities from Osun state govt but I have friends that applied and got some; my alternative plans was successful but came at a huge cost because I wanted to own the land rather than leasing it. |
Fhemmmy:It wont be easy for a poor person to acquire land for farming but there are better opportunities now especially from state governments, Osun state govt has been giving out farmlands to interested people at ridiculous costs but there are also opportunities of cheap leases in the villages especially in the south west. This is from personal experience. Of course there are other challenges with seeds, fertilizer, cultivation, planting, harvesting and storage. These are areas of opportunities for the citizens, imagine if you would invest in planting with the equipment shipped in and made available on rental basis. I can tell you that you will be busy almost everyday of the year, not promising that you will end up as Dangote but you will be able to take care of your family and have extra. |
Fhemmmy:I get what you mean but this is where some business re-engineering will profit us, the time is coming when it wont be that easy to pass the cost to the consumer; pure water is actually a good example, it tanked at N5 for several years and became almost unprofitable until the recent policy. You can see that ideas are already coming up to avoid pure water altogether. |
Fhemmmy:Nah, it wont happen. We really need to start taking the state governors to task. Imagine the SW going back to agriculture, SS on crude oil, SE on technology, North also on agriculture and livestock. We wont even need to import so much, have always believed that Nigeria is a "bomb" if we can do things right. |
Fhemmmy:Not exactly true, the companies are already on diesel generators. Diesel was deregulated long ago, any company using PMS to power generators for industrial production should not be in business. |
I trust Nigerians, they will start carrying ''water-bottle'' around now.
Good for the environment, our health and the pockets too. |
Orikinla:Bros, that N65 cannot work on the long run; just that govt need to repackage the deal and take certain steps before we can proceed with proper deregulation (not subsidy removal). It is better for citizens in each states to start taking up their governors on the monthly allocations and the IGRs, they owe their people explanations. The senate is already investigating the subsidy based on that initiative from Bukola Saraki, the public should put more pressure so they don't drop the ball on this. Overall, it is unfortunate that GEJ is bearing the brunt of the whole issues with the governors waiting in the corner to share the money. There will be less pressure and tension in the system if the governors are performing as they should. A whole lot is wrong with the Nigerian system. I am not a GEJ supporter but I want him to succeed, it is our country for now and we must keep hope alive no matter how bad the situation is. |
But that is not where the Nigerian High Commission is? And no event is listed to hold there on January 14th or is it a one man show by you. http://www.ydsquare.ca/index.php?option=com_jcalpro&Itemid=122&extmode=day&date=2012-01-14 |
That should be the writer's opinion. As much as I believe things could be done differently, I also know that presiding over a complex and dangerous country like Nigeria is not a tea party. One man is attempting to build and even his numerous close associates will be working against him! |
sanguish:She should calm down, heaven is not going to fall, the airline (KLM?) will sort it out knowing the strike affected several people. She should be firm and not succumb to paying anybody, including the airline folks (they might want to play a fast one on her). Although she need not even declare that the visa is expired if she can do online check in and has no checked in luggage. Not sure if going to Ghana is a smart idea or does she have visa to enter GH? The fuel issue should be resolved by Friday (or Saturday). |
A re post, could not modify earlier post. Are we talking about primary and secondary schools here or the universities? Universities, yes but government must continue to fund elementary schools and make them free. A better tax structure will help government achieve this, any public elementary school in any LG has to be co financed (via property tax) by those living there whether they have kids in those schools or not. The people in those LGs must be well represented on the education board that will supervised the management of those schools to keep things in order. Free elementary school contributes immensely to the development of any nation and will help Nigeria improve. Problem is that we always have beautiful ideas that can work but we lack the sincerity that would ensure their implementation. |
Atedo Peterside is talking now on Channels. Very sensible fellow.
I doubt, especially if he spewed the same nonsense like he did few days ago. He was playing some dirty ethnic card then, pretty stupid for somebody who made his money in Lagos! |
leaderone:Actually, going after them will be like standing in front of a fast moving train. Corruption has eaten deep into the fabric of the country such that GEJ will be alone in such venture. You should search for OBJ's comment on Ibori back then and you will get some ideas. |
jascon1:You need to come out of that Chanomi creek where you are hiding so you can update yourself very well. You can't even tell your story properly, we will continue to help you all the same. Now is a good time to bring MEND out so we can have sovereign national conference like some of us have been canvassing. |
Working behind the scene, I guess. |
