Just in: AGF files 4 processes in Industrial Court The Office of the Attorney- General of the Federation (AGF) has filed four processes at the National Industrial Court, Abuja, in the suit opposing the trial of Justice Walter Onnoghen before the Code of Conduct Tribunal (CCT). Onnoghen Justice Onnoghen Peter Abang, the claimant who is also a lawyer, had instituted the suit challenging the jurisdiction of the CCT in prosecuting Onnoghen, the suspended Chief Justice of Nigeria (CJN). At the resumed hearing of the substantive suit on Thursday, counsel to the claimant, James Igwe (SAN) informed the court that the first defendant (AGF), had on Wednesday served him with four processes. N120m Dubai property suit: Court dismisses motion to set side judgment The processes were: notice of preliminary objection, counter affidavit to the interlocutory injunction, counter affidavit to the originating summon and application challenging the jurisdiction of the court. Igwe, however, said that he had responded to all the processes and was ready to proceed with the matter. Counsel to the other parties, however, were not in court except counsel to the AGF, Dauda Lamiri, who told the court that the processes had been served on the other defendants. Igwe further pointed out that there was no communication from the parties as to the reasons for their absence. He, therefore, suggested an adjournment in the interest of justice to all concerned. He equally suggested that all pending applications could be taken on the adjourned date starting with the one challenging the jurisdiction of the court. He said the hearing of the substantive originating summon should be considered next. Court to hear SEC’s counter-claim in suspended D-G Gwarzo’s suit Jan. 30 Igwe said it would enable the court to have either a composite ruling or judgment as the case may be. The judge, Justice Sanusi Kado, adjourned the matter until March 14 for hearing of the substantive originating summon and all pending applications. Kado also directed that hearing notices should be served on all parties and proof of service be kept in the case file. Reports have it that Onnoghen is standing trial at the CCT over alleged false declaration of assets. Joined as co-defendants in the suit are Code of Court Bureau (CCB), CCT Chairman, Danladi Umar, Office of the Attorney-General of the Federation and The National Judicial Council (NJC). Bible dating back 1,200 years seized from smuggling suspects in Turkey Turkish police have seized a Bible thought to be 1,200 years old from a suspected smuggling gang. Six people have been arrested after allegedly attempting the sell the ancient manuscript in the southeastern Diyarbakir province. It was reported last week that more than 12,000 World Cup fans had still been in Russia as of December 31 – the date on which the FAN ID system formally ended. The system allowed fans with World Cup match tickets to enter Russia during the tournament without a visa, as long as they held a FAN ID document. The scheme was deemed a success and extended so that FAN ID holders could continue to enter the country without a visa until the end of the year. The Russian Interior Ministry reported last week that the number of fans remaining in Russia illegally beyond the deadline had been reduced during January, but still stood at 5,500. The Interior Ministry press service provided RIA Novosti with a breakdown of those numbers on Thursday. Nigerians make up the largest group still in Russia, with 1,863 citizens yet to have left. That’s followed by people from Vietnam (911) and Bangladesh (456) – neither of whom were playing at the 32-team tournament. Senegal, who were playing in Russia but like Nigeria were knocked out at the group stage, have an estimated 253 citizens still in the country. The Interior Ministry has said that work to expel those in the country illegally will continue, and is expected to be completed by the end of March. Around 650,000 foreign fans visited Russia during the tournament, according to the ministry. “In the main, they were all law-abiding and left the country in their own time,” migration department head Andrei Kayushin had said last week. The Peoples Democratic Party (PDP) on Monday in Abuja lost its bid to wrestle power from the APC-government of Kayode Fayemi in Ekiti State following the judgment of the Governorship Election Petition Tribunal which pronounced the governor as duly elected. The three-man panel, in a unanimous judgement that lasted almost five hours, dismissed the PDP candidate, Prof. Olusola Olubunmi’s suit for lacking in merit and substance. The tribunal held that the various allegations raised against the election conducted by the Independent National Electoral Commission on July 14, 2018 were not proved as required by law. Ekiti Gov Dispute: Tribunal adjourns for judgment The tribunal specifically said that rather than establishing the allegations of corruption, malpractices, ballot box snatching, non accreditation, over voting and deliberate voiding of votes, among others, the petitioners dumped worthless documents on the tribunal without demonstrating them. Tribunal Justice Suleiman Belgore said that contrary to the claims of the petitioners, Fayemi was duly and lawfully returned as winner of majority votes by INEC. The tribunal held that it was established beyond reasonable doubt that the APC candidate in the election scored 197,459 votes as against the 178,121 votes by Olubunmi to emerge winner of the poll. Belgore held that 71 witnesses were called by the petitioners to testify as against 926 witnesses listed to be invited to testify for them, adding that the 71 witnesses were scanty and insufficient to establish the fact of the various issues raised in the petition. The judge held that calling 41 polling agents as witnesses out of 1,458 polling units was fatal to the case of the petitioners because the 41 agents invited as witnesses were too scanty and grossly few to make any impact in the petition. To worsen the matter for the petitioners, the tribunal said that all the witnesses called by them voted unhindered and never told the tribunal of harassment, molestation, thuggery and other forms of electoral malpractice as alleged by the petitioners. Justice Belgore dismissed the claims by the petitioners that Fayemi at the time of the election was not qualified to stand for governorship election on the ground of his alleged indictment by the Justice Oyewole Commission of Inquiry. The judge held that Section 182 of the 1999 Constitution relied upon by the petitioners to get the APC candidate disqualified had been deleted by the alteration done to the constitution on July 16,2010 by the National Assembly when the alteration took effect. In all, the tribunal held that the petitioners failed to prove that they scored higher number of votes in the election and that they also failed to prove that Fayemi was not validly returned as the winner. Contrary to the law, the tribunal also held that there was no evidence that the agents of the petitioners were forced to sign the result sheets which they did on the Election Day. Justice Belgore, therefore, agreed that the governor was lawfully returned and that the petition against him failed because it lacked merit and was therefore dismissed in its entirety. The PDP and its candidate had dragged the INEC, APC and Fayemi to the tribunal, praying that the election of July 14, 2018 be nullified. They urged the tribunal to declare them as winners of the election through majority lawful votes or in the alternative order a rerun. Justice Walter Samuel Nkanu O, GCON was born on the 22nd December, 1950 at Okurike Town, Biase Local Government Area of Cross River State. Justice Onnoghen walter attended the Presbyterian Primary School, Okurike Town between 1959 and 1965. He later proceeded to Accra, Ghana to attend Odorgorno Secondary School, Adabraka, Ghana between 1967 and 1972 for his West African Examination Council (WAEC) Examination. He was at Accra Academy, Ghana between 1972 and 1974 for his WAEC (A-Levels) before proceeding to the University of Ghana, Legon, Ghana between 1974 and 1977 to obtain his Bachelor of Law Degree (LL.B (Hons)) and graduated with 2nd Class Upper Division. He attended the Nigerian Law School, Victoria Island, Lagos between 1977 and 1978 for his B.L certificate. After obtaining a law degree from the University of Legon, Ghana, he started his career as pupil state counsel at the ministry of justice, Lagos in 1978. He made history in Nigeria on April 11, 2014 when he, alongside some of his colleagues, made a landmark pronouncement in the case of two Igbo women, Gladys Ada Ukeje and Maria Nweke, who argued that they should have equal access as men to the inheritance of their parents. In Igbo culture, women had been disinherited for ages as a result of tradition. The two women sued the men in their families – and finally got justice as the case moved from the lower to the highest courts in the land. By Esther Onyegbula A man whose wife was killed by armed robbers on new year day has revealed that she lost her life while attempting to protect him. According to Mr. Akin who is still mourning the demise of his wife, “my home was invaded by daredevil robbers on new year day. While the operation was ongoing our children were in the church for the cross over service. My wife and I were held hostage by the armed robbers. My wife was killed by the robbers because she stood between the robbers and me. She was pleading with them not to kill me. Unfortunately for my wife, one of the robbers pulled the trigger firing her on her chest. They made away with our phones, laptops and cash sum of two thousand, two hundred naira (N2,200)”. One of the suspects Vanguard learned that on the first of January at about 4am some dare devil armed robbers stormed the home of one Mr. Akin and held the man and his wife Modupe Catherine now late, hostage at gunpoint while their children attended crossover service. Sequel to the sad event, operatives of the state anti robbery squad visited the scene and gathered items of evidential importance which were analysed leading to the arrest of one of the robbers. During interrogation, he gave his name as Isah Shobayo and confessed committing the crime. He later led detectives to arrest one Ogundimu Olalekan who served as their armourer. According to the Commissioner of police, Imohimi Edgal, it will be recalled that the robbers invaded their homes on new year day while their children were in the church for the cross over service. Unfortunately, Modupe was shot as she stood between the robbers and her husband pleading with them not to kill him. They made away with their phones, laptops and cash sum. Through painstaking investigation two members of a daredevil robbery gang that were involved in the murder Modupe Catherine in her home were arrested. They were arrested by operatives of the state anti robbery squad after critical analysis of the crime scene.
