Australians act to save Nigerian on death row in Indonesia By Ayo Okulaja The Nigerian government’s negligence of Nigerians in foreign prisons has been made bare in the case of one on death row in an Indonesian prison for drug smuggling. Titus Ani has been convicted for smuggling heroin, without, what members of Amnesty International described as “experienced lawyers carefully preparing and presenting his case”. Mr. Ani was charged with the smuggling 350gms of drugs into Bali. He pleaded guilty and was given a life jail term. The prosecution, however, appealed the judgement and his sentence was upgraded to death by the Supreme Court. According to Indonesian laws, Mr. Ani has a chance to appeal the Supreme Court’s ruling. However, he has been in the legal battle for over five years without any proper representation. The Nigerian is now getting legal support at the instance of Scott Rush, an Australian cell mate also on death row in Denspasar, Bali, who asked an Australian team of lawyers that visited him in the prison to help Titus because he had limited legal representation and will be executed unless his case can be well argued in the last appeal. The Australian legal team is led by Russell Thirgood, a partner at McCullough Robertson. The team are working on a pro bono basis to prepare for Titus’ final appeal. According to Mr. Russell in an audio interview posted on the Internet, “Titus fled Nigeria some years ago to Pakistan where he was working in a construction industry till his visa expired and he ended up, in and out of UN refugee camp for a period of time. Towards the end of 2003, he was approached by a drug syndicate who offered him a false illusion of paying him $2000, these drug syndicate gave him a wrong passport and he ended up being caught in Indonesia.” [b]Mr Russell argues that “Titus is not regular drug trafficker and, is being sentenced on a wrong personality as he is not the person on the passport that he is carrying but he is Titus and not Emmanuel from Sierra Leone as the Passport reflects, it was his first time doing a small amount. “The Indonesian law distinguishes between organised crimes and serious drug offenders and a one-off offender. A death sentence should not be passed on someone of Titus’s category” said the former President of Amnesty International Australia. Explaining his team’s progress thus far, the Australian lawyer said, “We have being going about getting a DNA evidence, establishing who he is, from his family in Nigeria and we’ve working with the United Nations to obtain the evidence that he was in Pakistan at a relevant time than being a regular drug trafficker.” According to the lawyers, “they have uncovered evidence that gives them confidence that Mr. Ani has a strong case and has been sentenced on the false premise that he was a regular drug courier and that he was a citizen of Sierra Leone (rather than Nigeria)”. The lawyers hope to use the final appeal called a PK, which will allow the presentation of new evidence, to prove that the Nigerian does not deserve to be punished by death. However, Australian lawyers do not have the right to represent anyone in an Indonesian court. They are, therefore, providing research, and helping to prepare the defence’s argument. They are also helping to raise about $100,000 to pay Indonesian lawyers who are vast in Indonesian law to represent Mr. Ani in court. Australians show support An evening of classical music was organised in Australia on September 20 to raise funds for Mr. Ani’s legal fees. Uzbekistan violinist Attilla Sautov accompanied by the Mueller Chamber Orchestra played at the benefit concert at Claver Theatre, All Hallows’ School, Brisbane. Tickets were sold at $50 for adults, $150 for 4 adults with a $25 concession made available online. The concert was organised by a Brisbane lawyer, Roland Peterson, who attends the same parish as Mr. Rush’s (Titus cell mate) parents, Lee and Christine Rush. “I was touched by the fact that Titus was facing the death penalty alone, and became more involved when he heard of the circumstances that led to Titus being charged,” Australian online blogs quoted Mr. Peterson as saying. “This is his last chance - Titus has one final appeal left before the sentence is carried out,” he said. A Titus Ani foundation has also being set up to solicit for the funds. Mr. Ogebe told NEXT that “we are working on the critical stages of his case at the moment. In fact we are trying to round up some final pieces of evidence from Nigeria in the next week or so.” Mr. Peterson said “The brief has to be done by October and I’m trying to save money by doing some of it myself.” A familiar road Last year, Indonesian authorities executed two Nigerians found guilty of heroin offences - the first drug offenders put to death in four years. The Nigerians, Samuel Iwachekwu Okeye, 37, and Hansen Anthony Nwaoysa, 40, were executed by two firing squads in Nusakambangan Island, off the southern coast of central Java, in June 2008. Mr. Okoye was sentenced to death after he was caught smuggling 3.8 kg of heroin into the country at Jakarta’s Soekarno-Hatta International Airport, while Mr. Nwaoysa was given the death penalty for circulating 3.2 kg of heroin in the country. They were convicted and sentenced to death in 2001. [b]Obi of Onitsha survives kidnap attempt National News Oct 3, 2009 AWKA—The official residence of the OBI of Onitsha and Chairman of the Anambra State Council of Traditional Rulers, Igwe Alfred Achebe was on Thursday night the venue of a fierce gun duel between unspecified number of gunmen and policemen. At the end of the shoot out two of the gunmen lay dead. The gunmen had swooped on the Obi’s residence located in the GRA part of the town for what observers said was either a kidnap or an assassination attempt. Two of the dead were said to be some of the gun men while the third, a woman said to have been felled by stray bullet. She was said to be a beans cake baker in the vicinity. Achebe who will be celeberating his 8th Ofala festival in the ancient town of Onitsha on Monday, was said to have narrowly escaped the trap of the gunmen following the quick intervention of the police. The gunmen who were said to have operated in a Sports Utility Vehicle (SUV) and a Mercedes salon car, drove into his residence at about 8 . 00 pm and tried to force themselves into the house when the men of Special Anti Robbery Squad, (SARS) attached to the Onitsha Area command dislodged them.[/b] According to an eye witness, the gunmen engaged the police in a shoot out before they were eventually overpowered by the Police. The Onitsha Police Area Commander, Mr. John Nwele who confirmed the incident, added that the police recovered the two vehicles used by the gunmen. Some arms and ammunitions, including a rocket launcher with war-head, five AK 45 rifles, 53 loaded live magazines, 14 expended magazines, one giraffe grenade and one bag containing clothes. Anambra State Police Public Relations Officer (PPRO), Mr. Emeka Chukwuemeka said the gunmen started their operation at Neni in Aniocha LGA and drove to Onitsha for the operation. “Actually there was an attempt by some hoodlums to abduct the monarch on Thursday evening, but it was foiled by policemen within Onitsha who gave a hot chase and gunned down two of them,” Chukwuemeka said. The Traditional Prime Minister of Onitsha and former Attorney General of the Federation, Chief Chike Ofodile, SAN) said yesterday that the annual Ofala festival would still hold. “It was the usual rampaging of hoodlums in the city, but this time, they were captured by the police. Libya Deports 734 Nigerians By Paul Ohia and Chinedu Eze, 10.02.2009 [b] As Nigerians on death row in Libya continue to mull over their fate, the country has deported yet another batch of 734 people. THISDAY learnt that some of those returned home were sentenced to life imprisonment but later pardoned by the President Muammar Ghaddafi Government. The North African nation also claims the latest deportees were sent packing for other offences ranging from illegal immigration to criminal activities. The 734 Nigerians were deported in four days through the Murtala Muhammed International Airport, Lagos. Of this number, the last group arrived the country Tuesday, September 29, on the same aircraft. There were 134 people comprising 88 females and 46 males. In addition to those sent home earlier, there are now 1,214 that have been forcefully removed from the country within two months. In August, Libya deported about 330 Nigerians and another 150 later in the month of September. The 150, all male were rteturned in a Libyan aircraft with registration number, SUBME. The sorrowful countenance of the deportees mirrored vividly the horror of their experiences and the tragic pain of being forcefully returned home after their sojourn overseas. They were handed over to the Nigeria Immigration Service (NIS) at disembarkation at the airport. THISDAY learnt from NIS that the deportees, many of whom have been handed over to their families, were removed from Libya because they did not have the required papers for legal stay in the country. Many of them allegedly arrived the country claiming refugee status in order to secure them legal status, after which they would plan to cross over to Europe through Spain. The NIS has condemned the action of these Nigerians, saying that they expose themselves to untimely death in the process of running away from their fatherland. Only recently, a ship full of illegal immigrants capsized off the coast of Spain. Many of the immigrants were Africans, Nigerians included. Libyan government has indicated that it will remove all illegal immigrants from the country. Meanwhile, Miss Glory Paul-Amanze who was interviewed on phone by THISDAY early this week from Jabida Prison in Tripoli said Nigerian embassy officials besieged the prisons to secure the release of those sentenced to life imprisonment and later pardoned. She was now speaking from Ago Palace way in Lagos. “First of all we were told that our sentences have been reduced to 21 years imprisonment but later they came to tell us that we have been pardoned,” she told THISDAY yesterday. Paul-Amanze has been in prison since 2003 and her brother who was sentenced with her, Mr. Nwaokomah Nduaguibe died in the prison. “We went to look for money when Nigeria was getting difficult and we found ourselves in this ugly situation. Please tell everybody to forgive. We do not want to die or our bodies cremated. we wish to see our families again. We beg our dear President Umaru Musa Yar’Adua to come and get us out. We promise to be good citizens in Nigeria. We also urge our kind mother, Dora Akunyili to beg the president on our behalf” Miss Paul-Amanze had told THISDAY early this week. According to her, another death row prisoner, Miss Juliet Okoro who spoke to THISDAY also has been pardoned and awaiting deportation. Okoro had told THISDAY on phone from the same prison that the accusation of murder for which she has been placed on death row since 2000 was forged and her indictment followed no legal representation. The effort to get all Nigerians languishing in Libyan prisons started after the House of Representatives Committee on the Diaspora, Hon Abike Dabiri drew the attention of Nigerians to the issue and the Socio-Economic Rights and Accountability Project (SERAP), a non-governmental organisation (NGO) mandated its lawyer, Mr. Femi Falana to file an application at African Commission on Human Rights ACHR in Banjul, Gambia. ACHR subsequently urged the Chairman of the African Union (AU), President Muammar Ghaddafi to suspend the execution of Nigerians on death row in his country. President Ghaddafi responded to the African Commission’s order for a suspension this week. [b]10 killed as security operatives, kidnappers clash in Abia National News Sep 30, 2009 By Eric Ugbor ABA—TEN Persons in cluding two policemen, a soldier and a pregnant woman were yesterday killed when security agents and kidnappers clashed in different parts of Aba South and Obingwa Local Government Areas of Abia state. This is coming barely one month after hoodlums suspected to be kidnappers sacked the entire police station at Umuobiakwa in the same Obingwa Local Government Area of the state, killing an inmate in their desperation to release one of the suspects held at the police state. The security situation in Aba and the entire Aba South senatorial zone of the state is now source of concern to residents of the area, as activities of hoodlums continues unabated despite stringent security measures employed by the Abia state government to checkmate their activities. Last Sunday, at Nnetu in Aba South Local Government Area of the state, the police on a tip-off confronted kidnappers with their victim and in an exchange of gun fire, in which the police overpowered the kidnappers, three of them were killed at the spot, while the remaining two, who ran into the bush were chased and arrested by the special security squad operating in the state. Unfortunately, the victim of the kidnappers identified as a prominent businessman in Aba, was killed in the exchanged gun fire, while many other residents of the area sustained severe injuries. And just this week, the latest clash at Abayi in Obingwa Local Government Area of Abia state, claimed the lives of two policemen, a soldier, a pregnant woman and three other civilians. When Vanguard visited Abayi, the village was in mourning mood as residents of the area were seen in corners, lamenting the ugly incident that had befalling their village. A traditional ruler in the Village, who preferred his name not to be mentioned, told Vanguard that the incident happened when residents of the area arrested two suspected robbers in the village and invited the police to come and take them (suspects) to their station. Unknown to the villagers, the suspects belonged to a gang and while they were waiting for the arrival of the policemen, other members of the gang got the wind of the arrest and re-enforced and stormed the village. Nigerian anger over China deaths [b]There are some 20,000 Africans living legally in China Nigeria MPs have asked the government to investigate the status of Chinese residents in the country, saying some may be staying there illegally. The demand follows allegations that Nigerians in China, especially those in jail, are being mistreated. The MPs asked the government to reject a request by the Chinese authorities to cremate the bodies of 30 Nigerians who have died in Chinese jails. There are an estimated 700 Nigerians currently in prison in China. The BBC's Chris Ewokor in Abuja says they are mainly charged with immigration, drug or fraud offences. Trade between Nigeria and China is booming and an estimated 20,000 Chinese people live in Nigeria, he says. Violence mars Anambra PDP congress Cover Stories Sep 28, 2009 By Vincent Ujumadu AWKA — THE ward congress of the Peoples Democratic Party, PDP, in Anambra State for the election of the party’s gubernatorial candidate in the state for the 2010 elections was marred, yesterday, by violence with supporters of rival governorship aspirants engaging one another in physical combat. Already, some of the party members are calling for the cancellation of the exercise. Though there was a large turnout of members of the party in almost all the 326 wards in the state as early as 8:00am, information in circulation that the exercise had been shifted from 11 am to 4 pm and that venues of the congress in many wards had been changed, created confusion in many areas. The physical combat by rival supporters was triggered by allegations and counter-allegations that money was changing hands while they were waiting for officials of the congress committee to arrive. For instance, a coordinator for one of the frontline governorship aspirants in Ihiala whose name was given as Afam Onumkwo was thoroughly beaten for allegedly trying to convince some of the party members to vote for his candidate in Ogboro ward 5 in the area. Onunkwo, whose dress was torn to shreds, told Vanguard that he also lost N10,000 cash, his PDP membership card and a mobile phone, though the phone was later recovered. He also complained that some people came to the venue of the congress to say that it was moved from Uzoigwe Primary School which had been their traditional voting place, to St Stephen’s Primary which is in another ward. Coordinator of the Soludo Campaign Organization for Orumba, Mr. Emma Ezume said the change of venue was not part of the original arrangement, adding that his group would not accept the outcome of the exercise if it was not transparent. Places that recorded some kind of violence also included Enugu Nanka Ward 2, Ajali Ward 3 all in Orumba and Nimo Ward in Njikoka local government. At Abagana Ward 1, the exercise commenced at 3 pm and three people were elected there. Kidnappers strike again in Kaduna Cover Stories, Latest News Sep 25, 2009 By Emeka MAMAH Barely five days after the Kaduna state Secretary to the state government Mr,Waje Yayok was kidnapped,another personality in the state barely has been kidnapped by some unknown persons who prayed with him in his mosque. Alhaji Bala Bello aka Alba Bello, was reportedly kidnapped from his Zaria residence at about 9.00pm on Thursday night shortly after the Isha’i prayers. The kidnap is coming agaist the backdrop of failure by the police to find the missing SSG within 24 hours as promised by the state Police Commissioner,Mr. Tambari Yabo Mohammed Wednesday. Already, it was learnt that family and friends of the SSG and other top government officials from Southern Kaduna where Yayok hails from have declared a period of fasting and prayers to ensure his release. Mr. Waje Yayok was officially declared missing by the police on Wednesday after the state government had feined ignorance of his kidn. Family members of Alhaji Bello told newsmen in Zaria that he was taken away by the armed men who dragged him into their Volkswagen Golf three car and sped off after firing some gun shot into the airto scare away people. The kidnappers reportedly joined Bello to pray both the Magrib and Isha’I prayers, after claiming to be seeking for donations from Muslims towards the building of a new mosque. Alarming rate of HIV infections By Sun News Publishing Friday, September 25, 2009 Editorial Index [b]The war against the Human Immuno-deficiency Virus (HIV), the germ that causes the Acquired Immune Deficiency Syndrome (AIDS), has suffered a major setback with the report that Nigeria now records 370,000 new infections annually. The claim by the National Agency for the Control of AIDS (NACA) corroborates the latest report by the United Nations AIDS agency (UNAIDS), which opines that cases of new HIV infections are on the rise globally. UNAIDS affirmed that there are about 45 million new HIV infections yearly and three million deaths. Out of the three million infected people in Nigeria, Benue State has the highest number and the age group that is affected falls between 25-34 years, while Cross River and Ekiti states have eight and one percent infection rates respectively. In Nigeria, the situation is precarious as about only 350,000 out of the three million people with the virus are currently accessing treatment. This represents less than half the number of people that are supposed to be on anti-retroviral drugs put at over 850,000.[/b] Another debilitating factor against the fight on HIV/AIDS, is the inability of some State Action Committees on AIDS (SACA) to transform to agencies. As a result of this, the country might lose World Bank’s funding facilities. According to the Director-General of NACA, Prof. John Idoko, when they are agencies, they become legal instruments of the states and as such the states are bound to fund them. Already, the World Bank has given the June 2011 deadline for states to transform SACAs to agencies or they will not access its loans. Currently, only 15 states have transformed from SACAs and, therefore, have legal status. It is disheartening that after all efforts to stem the spread of HIV/AIDS, the monster is still rampaging with more new infections on a daily basis. What the situation demands is that all the stakeholders should step up action in the war against the pandemic. Since some states are yet to transform their NACAs to agencies, they should do so immediately to enable us continue to access World Bank’s funding facilities. A situation where only 15 states’ NACAs have transformed to agencies in a country of 36 states plus the Federal Capital Territory (FCT) is not good in our fight against AIDS. The time has, indeed, come for NACA to review its strategy. The recent poor result in containing the disease is a demonstration of the failure of current strategies That more and more people are being infected daily with HIV shows that the sensitization programmes are not working as effectively as they should. It is time to re-emphasize abstinence as perhaps the best strategy in combating the scourge since some of the other strategies appear not be yielding the much needed results. Let the AIDS campaign be driven by abstinence as was the practice in most of our cultures before the advent of Western education and lifestyle. People can still be in love without sex. In other words, sex can wait till marriage. Condom use, which is at the heart of the current HIV sensitization programmes and campaigns, appears not to be working effectively in halting the spread of the disease. Rather than halt its spread, it is believed to be fueling the urge to experiment with sex instead of abstaining from it until marriage. Married couples should remain with one faithful partner and shun those behaviours that can predispose them to contracting the virus. Those already infected should not involve in unprotected sex, while those without the virus should engage in health-promoting behaviours that would ensure that they maintain their sero-status. Those with the virus should not think that they have been handed a death sentence. They should understand that AIDS is not the end of life. People with AIDS can, and do, live positively and long too. There is no need to go underground and spread the virus to unsuspecting sexual partners. It serves no useful purpose and those doing so subject themselves to higher risks of being re-infected with greater consequences. Parents should inculcate in their children the right values that would encourage moral upbringing. Above all, let efforts be stepped up on voluntary testing and counselling so that many Nigerians can be aware of their sero-status and adopt behaviour-modification strategy to ensure healthy living.
