Police smash robbery gang …Arrest indicted herbalist By CHRISTOPHER OJI & TUNDE RAHEEM Thursday, November 5, 2009 •Suspects Photo: Sun News Publishing More Stories on This Section Police in Ondo have smashed a seven-man robbery gang, which was believed to have been terrorizing residents of the state. Members of the gang, which comprised a renowned witchdoctor in Akure, are being quizzed at the State Anti-Robbery Squad (SARS), section in Akure, the state capital.
The witchdoctor, Ajayi Komolafe, told Daily Sun that someone brought some members of the gang to him for his prayers. He said: “I am a witchdoctor, known all over Ondo State. One of my clients, Okpe, brought some people to me. The young men came for prayers for success in their business endeavours.”
He said when he consulted his oracle, the type of business the young men were engaged in - armed robbery were revealed to him.
According to him, he prayed and gave them some ‘success charms’. He said he continued to pray for members of the gang but they failed to show appreciation. For instance, members of the gang once shared their loot in his shrine and gave little amount of money. “I watched them, as they shared the large sum of money. They only gave me a paltry sum of N5, 000.” He said one day, he decided to challenge the gang for giving him little amount of money, considering the fact that he was responsible for their successes during robberies. “Immediately I challenged them, Okpe told me that I was a healthy man, without deformity, that If I needed money, I should join them during next operation.” He said after Okpe’s challenge, he decided to join the gang in the next operation. He said: “I actually went with them and we were successful and I got N15, 000. After the second operation, I got N25, 000. I made more than N60, 000, from the fifth operation.” On how he was arrested, Babalawo (herbalist), as he was fondly called, said it was one of the members, who joined another gang to rob that implicated him. “The boy did not come for prayers and ‘fortification’ before he went for the robbery operation. Besides, he failed to inquire from the gods whether his star was compatible with his new gang,” he said. Another suspect, Olayinka Adebayo (aka Last born), believed by the police to be the leader of the gang, said contrary to the belief, the gang was led by one Frayo (at large). He was angry with Babalawo, describing him as a fake witchdoctor. “He assured us that police would never arrest us, yet, they arrested us, telling us where and how we operated, ” he said. He said members of the gang respected Babalawo, adding that he disappointed them. He revealed that Frayo and the assistant leader of the gang, ECOMOG, were based in Lagos. “They were operating in Lagos, before police chased them away. They started operating on the Lagos-Ibadan expressway. I met them in a party and informed them that my friend, Jelly, and I were also operating in Kwara State, before we were chased away last year.” He said when he moved to Akure, he invited Frayo and ECOMOG. “We were succeeding until three months ago, when police changed their strategies. We became afraid and Okpe advised that we should consult a juju priest.” He said after receiving assurances from babalawo that they were not going to be arrested, they decided to try their luck in Akure. “So, we robbed the Chief Security Officer (CSO), to the state government. We snatched his car and service pistol. That was our greatest undoing, as police arrested us.” The Police Commissioner, Mr. Donald Iroham, who paraded the suspects in Akure recently, warned that Ondo State was now too hot for criminals, especially, armed robbers. [b]In a commando-style operation, no less than 20 armed men Friday afternoon in Awka, capital of Anambra State kidnapped millionaire businessman and chairman of Pokobros Group of Companies, Chief Paul Okonkwo, heightening the spectre of violence which has become the lot of the state since the beginning of the year.
Okonkwo’s abduction came less than 24 hours after the wife of a prominent politician in the state and former governorship candidate, Chief Ifeanyi Nwokoye was kidnapped in the same Awka, and four days after dare-devil armed robbers swooped on Nnewi, killing at least eight persons after serially robbing a chain of banks.
And penultimate Monday in Umuawulu, a few kilometers from Awka, suspected assailants had chased a former chairman of Awka South council, Chief Chukwudi Okafor, into the local Catholic Church before emptying over six magazines of bullets on the politician. He died instantly.
advertisement The upsurge in violent crimes in Anambra State, particularly kidnappings, has forced several residents of the state which reportedly has the most number of millionaires in Nigeria, to relocate their families. For many families, Asaba, the capital of Delta State, is said to be the destination of choice, for now.
Eyewitnesses told Pointblannews.com that about 4 pm, a band of fully armed youngsters in SUVs had trailed Okonkwo from his Pokobros Hotel on the Enugu-Onitsha expressway and blocked his jeep on the same expressway.
“They literarily plucked him out of his jeep into theirs before speeding off through Zik (Nnamdi Aziiwe) Avenue. When they encountered some traffic snarl, these boys opened fire causing serious confusion as people scampered for safety. Funny enough, they passed the state Police secretariat, the Prisons headquarters unchallenged before heading for the road to Agulu,” offered an eyewitness.
Sources close to the multi-millionaire politician and businessman, Nwokoye, told Pointblanknews.com that the wife of the businessman, who was in Italy to inspect a consignment of sanitary wares, was abducted as she made to drive into her mansion.
“Two boys were sighted loitering, but they didn’t look sinister. As soon as madam drove in, they rushed into the compound, gun in hand, and ordered her into their car which they had cleverly concealed near our gate. Oga is on his way back to negotiate with the kidnappers so that he can, at least, have his wife back,” the source narrated.
A very successful clearing and forwarding agent, Chuwudi Okafor, who had fallen out with Governor Peter Obi, had hinted close associates that he was set to dump Obi’s All Progressives Grand Alliance (APGA) for Peoples Democratic Party (PDP).
“Amuluonyenaego (Chukwudi) had approached on the eve of his death that he was interested in the Awka Federal Constituency seat, and that he was set to declare for PDP. I encouraged him to go and register in his ward, and he agreed. We agreed to see again the next weekend. That was the last we saw,” lamented a PDP chieftain.
With the police have yet to make any arrests on Chukwu’s assassination, pressure is said to be mounting on Governor Obi to come out clean on the matter. “We strongly believe that Amuluonyenaego is a victim of state-sponsored terrorism. How come he was killed after falling out with Peter (Obi), and just days before declaring for PDP?” quizzed a PDP chieftain.
And in Isuofia, Okonkwo’s village, accusing fingers are said to be pointing the way of a former Governor of the Central Bank, Professor Chukwuma Soludo. The former bank chief has for years been locked in a battle for supremacy with Okonkwo, culminating in Soludo balkanizing the town and rechristening his own part Isu Anioma. Okonkwo remained Oji (Prime Minister of) Isuofia.
So worrying is the frequency and ease of robberies and kidnapping to the people of the state that a legislator from the state told Pointblanknews.com that “most of us have found out that it is cheaper to relocate your aged parents and children than to pay ransoms.”
He lamented that the Peter Obi administration appeared confused whilst the security situation in Anambra state spirals out of control. He claimed that there have been at least 60 high profile kidnappings in the state since the beginning of 2009.
“Peter Obi is busing fighting his deputy and her son, Emeka. He is trying to maintain a false mien that all is well, when most of his aides are disorientated and resigning in droves. Armed robbery has peaked, and we now top the chart in kidnapping, a hitherto unknown phenomenon. In addition to other negative attributes, like drug trafficking and fraud, that foreigners have attached to Nigeria, witch-hunting in its original form seems to be sticking on us courtesy of Cross River State and Akwa Ibom State, two states that used to be one until September 23, 1987. One wonders if the fraud and drug trafficking tags are not heavy enough for us to be seen as witch hunters all over the world. In the foreign media, there are gory stories and pictures of children, including toddlers, who have been bathed with acid and hot water. Some have six-inch nails driven into their heads. Some were burnt to death or even buried alive. The luckier thousands are whipped and driven away to roam the streets. These children are labelled witches and wizards by so-called pastors, prophets and bishops. Reports have it that there are more churches in Nigeria than schools and hospitals combined. Given the severe competition among these churches to win members that will guarantee the survival and wellbeing of these churches, many of their operators become desperate and devise many illicit means to survive. [/b] All over the country, pastors label children and adults witches and wizards, but it seems this problem has taken a dangerous dimension in Cross River and Akwa Ibom. Children are tagged witches and wizards that have caused their parents and siblings such misfortunes as deaths, miscarriages, loss of jobs, financial straits, lack of marriage, lack of success in life, drug abuse, sexual escapades, drunkenness, etc. These unfortunate children are subsequently tortured until they “confess” and then disfigured, driven away or even killed. It is inexplicable that an area which had contact with Western education and Christianity decades before most other Nigerians did so could allow itself to be deceived by desperate con men and evil merchants who call themselves “pastors” and “prophets.” Let us assume, for the purposes of argument, that a child is discovered to be possessed by evil spirits, what would Jesus Christ or his apostles do to the child? Jesus Christ or Peter or Paul would immediately cast the evil spirits out and set the child free. That was what Jesus did to Mary Magdalene, and she became one of his most dedicated followers, even having the honour of being the first human being to see the risen Christ. If Christians don’t use the Bible as their standard and reference point, I wonder how they can be called Christians. These fake men of God have no iota of spiritual power and cannot cast out any evil spirits, so they resort to casting children away. It is surprising that such fake pastors and prophets are not exposed and punished for not only exploiting the public but also endangering the lives of children. This is a national embarrassment. When foreigners talk about it, they do not even mention Cross River and Akwa Ibom; rather they mention Nigeria. We now have the image of “child killers” in the world. This must be curbed forthwith to avoid more damage. I call on the governments of the two states to pass a law that makes it an act of murder (or attempted murder) for any pastor, prophet, evangelist, fortune teller, seer, diviner, parent, guardian or anybody, for that matter, to call any child or person a witch or wizard or act in any way to suggest that any child or person is a witch or wizard. The penalty for such should not be less than life imprisonment. And the parents and guardians of children who are currently homeless or living in children’s homes as a result of this inhuman labeling should be traced and arrested for prosecution immediately, unless they pledge in writing, supported by reputable guarantors, to keep the children under their roof and cater for them without any discrimination whatsoever. It is bad enough that many religious groups are exploiting the faith of worshippers to fleece them, but molesting children in this horrendous way is a heinous crime that should be frowned at and attacked frontally. There should also be a strong campaign to the locals to make them believe less that their ill fortunes are caused by external forces. It may be difficult, but it is achievable. From North to South and from East to West, the problem of this nation is not caused by witches and wizards but by terrible leadership and stealing of our national wealth. And the more our religious leaders like the great prophets of old condemn rather than condone our corrupt leaders, the more they call our leaders to order rather than give them front-row seats and pray for them, the more our country will be freed from maladministration and embezzlement and the consequent poverty, ignorance and under-development that hold our people down. Just like kidnapping that has made foreigners afraid to come to Nigeria and fellow Nigerians exiles in their own country, this witch crisis is another sore point to our image as a nation. And it needs to be tackled frontally with every weapon in our arsenal. Supreme Court angry, dismisses Omehia's suit against Amaechi From Lemmy Ughegbe, Abuja
"THIS (Omehia's) application is clearly misguided and ill-advised. But it affords us the opportunity to warn counsel to desist from bringing frivolous application before us. If a court has the jurisdiction to hear a case, it follows that it has the jurisdiction to be wrong or right in its judgment. This application is clearly an abuse of court process and it is accordingly dismissed".
With these words from Justice Iyorgher Ignatius Katsina-Alu, the seven-man panel of the Supreme Court dismissed, with finality, an application filed by Chief Celestine Omehia, praying it (Supreme Court) to set aside its judgment of January 18, 2008, whereof it declared Rotimi Chibuike Amaechi as the governor of Rivers State.
But before the apex court reached that decision, a melodrama ensued between Omehia's counsel, James Ezike and the obviously displeased panel of Justices as to the merit of the application, as neither side was ready to shift grounds on the matter.
While Ezike prayed the court to give him fair hearing before reaching a decision, the panellists were not in such charitable mood to hear his (Ezike's) application, praying them to reverse themselves almost two years after the judgment had been delivered.
"This court is the final court in this country, we have a duty to make sure that justice is done. When we give our judgment, nobody can re-open it. Your mission here today is futile. Nothing will come out of it," Justice George Adeshola Oguntade.
In his own reaction, Justice Katsina-Alu held: "This your application is a serious professional misconduct. We gave our decision two years ago. Whether you like it or not it is our decision. Your coming here now is contemptuous. If we sit here from now till December, you will get nothing. Rather, we may award punitive cost against you."
For Justice Walter Sam Onnoghen, the only forum open to Omehia was with God.
"Even if we are wrong our decision is final. You may appeal to God. You brought this application in contempt of court. You can go and appeal to God," Onnonghen declared, throwing several people in court in fits of laughter.
But Ezike was unbowed as he bravely argued on why he should be given fair hearing on the application.
"My lords, I have come to seek justice and that is why I am here. Justice demands that you hear me out," he submitted.
The more it looked like the panellists had turned deaf ears to his entreaties, the more he continued to argue his case.
Although he conceded that the court had the jurisdiction to hear Amaechi's appeal, which led to the judgment, he submitted that the court departed from its jurisdiction by venturing into lawmaking when it held that only political parties could sponsor and canvass for votes in an election.
Justice Onnonghen interjected by saying: "Okay, since you agreed we had jurisdiction to hear the matter, we have decided wrongly or rightly. We are the final court in the country. So you may appeal to God."
In his response to Onnonghen, Ezike said, "The final decision is yours, but the lesson of history is different."
At this stage, Justice Katsina-Alu threatened to call in the police to arrest the lawyer. He said: "If you are not careful, I will call in the police to take you out."
Again, a relentless Ezike replied, "I will take the medicine as a man. All I have asked for is to be heard, then you decide."
With the ruling foreclosing the application's fate, Justice Oguntade took liberty to admonish lawyers to stop bringing frivolous applications to the Supreme Court.
He told Ezike to always avert his mind to the prevailing circumstances that led the court to give the judgment it gave in the Rivers State Governorship election tussle.
He said, "We gave everybody the opportunity to contest the election, but some people in the Presidency said no. When we ordered that Ifeanyichukwu Ararume was the candidate of the Peoples Democratic Party in Imo State, the party rather than comply with the order, expelled him from the party to frustrate the judgment of this court."
In its judgment delivered on October 25, 2007, the Supreme Court declared Amaechi as the PDP candidate in the polls and that he was the duly elected governor of the state, thus displacing Omehia as governor.
But Omehia, in his latest application filed by Ezike, argued that the reason given by the court on January 18, 2008, for its decision was a nullity because it lacked the jurisdiction and was incompetent to do so.
He contended that the said judgment of the court amounted to a special repeal of Sections 177, 178 (iii) and 179 of the 1999 Constitution, adding that a judgment which deemed a candidate who had not contested an election as having won and lost same was unconstitutional, null and void and of no effect.
According to the former governor, the reasoning of the court in its judgment of the case where it stated that "it is only a party that canvasses for votes, and only a party that wins an election," was an act of judicial lawmaking, which is a fundamental encroachment on the powers assigned to the legislature under the principle of Separation of Powers.
According to him, the provisions of Sections 177, 178 (iii) and 179 of the 1999 Constitution and Sections 33(i), 34(i) and (iii), 35, 36, 37(i) 38, 39 51, 54 (iv), 64 (i) and (ii) 65, 70, 71, 76, and 103 (i) of the Electoral Act 2006 clearly express the intention of the legislature that the candidate who contests, wins or loses election. Omehia averred that the Supreme Court, by its findings referred to, actually made new laws.
The former governor further argued that the decision of the court where it declared Amaechi as the winner of the election in which he allegedly did not contest was not based on any fact, available evidence, law or precedent but on its decree that "it is only a party that canvasses for votes that wins an election."
Omehia, therefore, asked the apex court to make an order restoring the parties to their status quo as of the day preceding the date of the judgment (October 24, 2007). |
