The Peoples Democratic Party, PDP, has requested the Court of Appeal sitting in Calabar, Cross River State, to dismiss its appeal lodged against a judgment of the Federal High Court, Uyo, which sacked Mr. Albert Akpan from the National Assembly and declared Mr. Bassey Etim as his lawful replacement.

The party said the judgment of the Federal High Court sitting in Uyo, which sacked Akpan from the Senate for not being its authentic candidate for the 2015 Akwa Ibom North-East senatorial election, was not against its interest, hence unnecessary and ought not to have been filed in the first place.

In the notice of discontinuance of the appeal, PDP told the appellate court to “take notice that the appellant (PDP) hereby withdraws all the processes, including the notice of appeal and the brief of argument filed by the erstwhile counsel for the party.”

The decision of PDP under the leadership of Senator Ahmed Makarfi to withdraw the appeal, it was learned, was in the spirit of ongoing reconciliation in the party as it prepares for the 2019 general elections.

UN groups hails decision

In a riposte, a United Nations human rights and election monitoring group, Peoples Right to Life Development Foundation, PELDEF, commended the Senator Makarfi-led PDP Caretaker Committee over the withdrawal, saying it amounted to promotion of internal democracy and respect for court judgment.

PELDEF said: “We must commend Senator Makarfi-led PDP Caretaker Committee for taking this positive step in withdrawing the appeal filed by the party against Etim, who the court declared the winner of 2015 Akwa Ibom North East senatorial district.

“Both Akpan and Bassey are members of PDP family. It was expected that PDP should not have filed such appeal in a matter between two members, especially after the court had entered its pronouncements on issues submitted before it.”

The judgment

A Federal High Court sitting in Uyo had on February 27, 2017, in a judgment, sacked Akpan from the National Assembly, ruling that he was not the valid and bonafide candidate of PDP, which won the 2015 general election for the Akwa Ibom North-East senatorial seat.

The high court, in the judgment on a pre-election dispute between a former member of the House of Representatives, Mr. Etim and Senator Akpan, over who was the authentic candidate of the party for the senatorial seat, specifically held that Akpan had wrongly and illegally represented the Akwa Ibom North-East Senatorial District in the National Assembly for 628 days.

A United States based global rights group, Center for Justice in Politics has urged the Nigerian senate to ensure justice by respecting court orders in respect of the Akwa Ibom North East Senatorial seat in the Upper Chamber.
The group which visited Nigeria on a fact-finding mission in respect of the controversy surrounding the refusal by the Senate President, Dr Bukola Saraki to inaugurate Hon Bassey Etim as a senator representing Akwa Ibom North East Senatorial District as ordered by a competent court of jurisdiction.
The issue had assumed an international dimension following a United Nations rights group, People’s Right to Life Development Foundation (PELDEF) request to the Congressional Black Caucus of the United States of America Congress to ban Senate President, Bukola Saraki and ten other principal members of the senate from entering the United States of America over failure to obey a four-month old judgment of a Federal high Court, Uyo which directed Saraki to inaugurate Hon Bassey Etim as the senator representing Akwa Ibom North East Denatorial District.
A statement by Bassey Etim’s media adviser, on Tuesday said that PELDEF had also copied dozens of global rights groups including Centre for Justice in Politics, with focus on legislative procedures and fighting for political justice.
The statement reads in part: “The US rights group which visited Nigeria on the fact-finding mission has, however, expressed shock over its findings, saying Saraki and the principal officers of the senate deserved to be banned from entering the US, apart from other necessary sanctions.
“The position of Centre for Justice in Politics was contained in a letter dated July 17 which represents an abstract of its executive summary report.
“The letter which was addressed to the National Secretary of PELDEF which earlier petitioned the Congressional Caucus of the US, Comrade Ali Abacha, was signed by its Vice President (Operations), Gabe Harrison.”
The letter reads in full: “As you may know, our organization, The Center for Justice in Politics (Center4JIP), is a non-profit organization based in the Atlanta area of the USA. We are primarily engaged in legislative procedures training, fighting for political justice and political consulting, in developing countries.
“This is to first acknowledge receipt of your letter, dated July 7, 2017, with the accompanying supporting documents.
“Secondly, we want to inform you that after reviewing all the supporting documents and confirming the authenticity of the High Court ruling in Uyo and the Certificate of Return issued to Mr. Bassey Etim by Nigeria’s Independent National Electoral Commission, we agree that the failure to swear in Mr. Etim to the Senate is unjust and a blatant abuse of power on the part of Nigeria’s Senate President, Mr. Saraki.
“Consequently and as contained in your letter to the Black Congressional Caucus, we will disseminate this information to other like entities to secure a ban on Mr. Saraki and others from entering the USA.
“We will take other steps to seek redress for this abnormally and you will be kept abreast of our actions going forward.
“Thank you for being our partners in our struggle for justice in politics, especially in developing countries, like Nigeria,” Harrison signed off.
PELDEF said Saraki’s excuse to delay inauguration of Etim four months after a competent court of jurisdiction had so ordered was laughable because the same Saraki-led senate had obeyed similar order from the same court of jurisdiction and status to swear in senators from Kogi State

The Akwa Ibom State Police Command has said there was no bank robbery in Uyo, the state capital on Tuesday. The position of the security agency was made known by the Force’s Public Relations Officer in the state, DSP Chukwu Ikechukwu. He said there was a clash between rival cult groups at Abak Road close to where banks are located, stating that the police only stepped in to restore order.



Reports on the social media have it that there was a foiled armed robbery attempt at Sterling Bank, Abak Road branch where a woman lost her life after being hit by a stray bullet.


Mr. Aniefiok Udonquak, a journalist with Business Day narrated his near-death experience via a facebook post.


“Face-to-face with death


Coming face-to-face with death today as armed robbers raided a bank and being caught in the cross-fire was one terrible experience that would not go away soon. It was as if I was at the front line with the police and the robbers exchanging fire, an operation fire-for-fire indeed. . I had gone to transact business somewhere near where the attack was taking place and suddenly a barrage of gunshots rang out. At first, my colleagues and I dismissed the noise from the gunshots saying it was not something serious, but when it persisted and we saw the entire stretch of the road being deserted and people running for their lives, it dawned on us that it was no joke. As the gunshots continued, mobile policemen posted to the banks stepped forward to engage the robbers in a gunfight, I saw policemen advancing towards the epicentre of the armed robbery attack and my breath almost failed me. After the exchange of gunshots had died down which lasted more than 30 minutes, I got to know that one lady was hit by a stray bullet. Living the tell the story after such a scary encounter is nothing but God's special mercy”, said Udonquak.

This evening, there was a robbery incident along Abak Road in Uyo, Akwa Ibom State. A young lady in a commercial bus was hit by a stray bullet. The driver of the commercial bus reported the incident at the Uyo Area Command of the Nigerian Police Force. Information has it that before the lady could be revived, she died.
The twist to the story is that the driver of the bus is now being detained at the Uyo Area Command of the Nigerian Police Force.


I ask the question: What crime has the hapless driver committed to warrant his being detained by the Police. The Police should look into ways of solving the robbery case instead of throwing innocent people into unnecessary detention.


I hope the brand new Commissioner of Police is aware of this and immediately orders the unconditional release of the driver and his vehicle.
