Smartchoiice:
....NO LAW PROHIBITS THE ESTABLISHMENT OF OPERATION AMOTEKUN —

Chief Afe Babalola SAN
Chancellor ABUA
Bamofin Oyo

January 16, 2020

THE Attorney General of the Federation was reported to have declared the regional community security outfit (Amotekun) illegal.

I disagree with the Attorney General. On the contrary, it is absolutely constitutional and legal.

The issue of Amotekun is an issue of Public Safety and Protection of property.

There is no law in Nigeria which prevents citizens from being able to secure their lives and properties.

Indeed without protecting the right to life and property, no other right can be exercised as one has to be alive to enforce other rights as guaranteed in the Constitution.

The Nigeria Police does not enjoy exclusive jurisdiction when it comes to the protection of lives and property.

As a matter of fact, in many parts of Nigeria, various outfits such as Civilian JTF, Hisbah Police, Vigilantes have been performing the duty of protecting lives and properties.

There is nowhere in the Police Act where a citizen is prohibited from being vigilant to protect his life or property either personally or together with other citizens.

Citizens of Nigeria have always enjoyed a right to effect what is known as a citizens arrest where any person is found to have committed an offence before handover to the police for prosecution.

In addition, private citizens also may in certain circumstances prosecute persons who have committed crimes.

Thus in Part V of the Criminal Code Act S.275 which provides as follow: “it is lawful for any person who witnesses a breach of the peace to interfere to prevent the continuance or renewal of it, and to use such force as is reasonably necessary for such prevention and is reasonably proportioned to the danger to be apprehended from such continuance or renewal, and to detain any person who is committing or who is about to join in or to renew the breach of the peace for such time as may be reasonably necessary in order to give him into the custody of a peace officer or police officer…”.

A communal reading of sections S.272/273 Criminal Code will reveal that: a person may arrest a person who has committed an offence and prevent his escape.

Neither the constitution in Sections 214-216 nor the Police Act in Section 10 gives the Police an exclusive duty to secure lives and properties.

All the above support the establishment of the Amotekun which has been established to give an official teeth to the provision of the Criminal Code which allows private citizens to arrest and detain offenders and bandits and to hand them over to the police.

Given the provisions of the Criminal Code in Sections 272-275, the right of citizens to arrest any person for committing an offence is legal and may be exercised individually or communally.

In any event, the regional community security outfit known as Operation Amotekun cannot be set aside by oral pronouncement by the Attorney General or any other body.

Only the Court of Law can declare the establishment illegal.

The Presidency is making a huge mistake.
This was what led to the military coups in the past.

They turned a blind eye to Hisbah police. Why open it on hearing Amotekun.

It simply means islamization is real. See as they are killing Benue indigenes on top their own lands o. Why kind of madness is it?

Very soon, they will claim ownership of all lands in Nigeria.

What is the difference between Catholicism and traditional?

Catholics do masquerades, drink beer, carry newspapers to church, don't read bible but depend on whatever the priest makes of the bible, have baby mamas.

Romance / Re: My Fiance Is A 2-Minute Man & We Are Set To Do Our Introduction. Please Help by Kirinwa: 1:27am On Jan 17, 2020
Miffia:
Hi everyone... Good Afternoon

I will keep this brief and short.. Ignore any typographical error, please.

I have this boyfriend, we've been dating for years now. The thing is, he doesn't last long during sex, he's a 2 minutes man, as you people call it. There was a time, we had sex, less than 1 minute, yes, I mean less than a minute, just 3 or 4 thrusts and he released. He was shocked, sad and disappointed, I was shocked too. I was even the one cheering him up, not to be sad, that everything will be okay, that's not his fault, he just wore his cloth and left.

This is someone I want to marry, we will soon do our introduction and wedding, and I don't want our sex life to be boring, we are not enjoying s*x at all, and I don't want to cheat on him... We love each other so much.

Please, anybody that has experienced this before, or know how to stop it should advice me on what to do, its not making me happy neither is my boyfriend happy too

Your advice will be appreciated.. Thank You.

Lol. Just wore his clothes and left?

Sounds more like a customer than a fiance.
Besides assuming he doesn't marry you. How many more men will you sleep with before marriage

Family / Re: Ever Been Betrayed By A Close Family Member? How Did You Get Over It. by Kirinwa: 5:37pm On Jan 16, 2020
Madisonsqua:
Please pardon the epistle, I'm a family guy who put my family first in all my decisions due to my upbringing and position in the family....my father single handedly provided and trained the 4 of us through school as my mum never had a job due to recurring illness......I moved overseas few years ago and settling down wasn't easy. But one thing my father kept telling me even before I got my first job was to invest back home.....after paying up all the loans I incurred from funding my travel, I saved hard and invested all my savings in a few plots of land running into millions. To secure the land I was advised to do the fencing just to mark my territory as Im not ready to develop it yet.

I respect and love my immediate family so much that I can't go a week without talking or skyping them. Dad is a senior pastor in one of the Pentecostal churches that preaches holiness and righteousness which was the basis of my trusting him....but he completely betrayed my trust when I sent some money to commence the fencing....

P.s I've not been selfish to my family. I spent close to a million on gift and their welfare that same year...and even promised to get them a car as soon as I can afford it...

Instead of commencing the project, he decided to spend the money on a car just because he couldn't wait. The worst part of it was that he warned my 3 younger siblings not to tell me about it until he's able to get back the money. Which they knew might never happen....But I got to know from an outsider after 6 months.

Whenever I asked my dad about the project, his excuse had always been the rain stopping them from commencing, not knowing the money was gone. When I confronted my siblings, they confessed he had warned them not to tell me. Then I confronted my mom who later confessed and apologized....till today my father hasn't call to explain anything to me. Instead he chose to be mad at his wife for confessing to it and even raised his voice when I questioned him.

Since that incident few months ago, the relationship between us has gone so cold and we barely talk anymore....he hardly call and I don't call him either....I had forgiven him but I can't forget. I'm so discouraged now that I don't see myself sending any more money in the nearest future. I don't even care about the land safety anymore...this is affecting me mentally, I wish to just let go but I can't....I feel taken advantage of by someone I trusted the most in this world.

Please for those who had been in this situation before what would u advise.......I feel like the strong and priceless connection I had with my parent is gone due to one person's decision.

Truth is you don't get over it, if getting over it means sending him more money or trusting him.
