Erm...traditional Yoruba outfits shouldn't be referred to as 'costumes.'. They are traditional Yoruba attire, or outfits, or dressing. An Englishman would not refer to his suit as a 'costume', neither would a Scotsman call his kilt a 'costume.' And I am yet to see an Indian woman call her sari, a costume.

You will remain blessed for this comment.....

I hardly engage people in this of discourse cos one hardly wins, the other side of the argument only view it on the periphery, never is the deep & all encompassing part given an objective look..

I refrain from criticizing successive governments in lagos ( a tinge of bias exists, i won't lie) because there exists a peculiar problem in Lagos & if Nigeria were to be populated with sane & sensitive leaders, Lagos should be getting double allocation...

Census / Opinions / assumptions put us at 180m people & 20m of these people live in lagos.. which means 1 in 9 Nigerians live Lagos, haba nah, there is no infrastructure put in place that will not fail...

Lagos also has a restriction; the Lagoon.... there is only so much that can be done when the Island has been fenced off.... & where is the fund to go over water ??
The lagoon is not a restriction. It is in fact, an asset. But many governors in Lagos have not harnessed its potentials appropriately. Fashola did a little bit, by trying to resuscitate water transport in the state, but what has been done so far, is only a tip of the iceberg.

Cities like Venice, Amsterdam etc., have done a lot to harness the potentials of their waterways. With the kind of funds Lagos has raised through the bond market in the previous years, it should have done a whole lot more to harness the potential of its waterways. undecided

Lagos state has produced more muslim governors. Does that make Lagos a muslim dominated state?
I agree with you, jare. But I am not concerned about the religious background, of whoever becomes the governor. Kogi State is a multi-ethnic state, and the Igalas should support other candidates from any other tribe within the state, so that someone with a fresh perspective that has the capacity to transform Kogi can get into the saddle. undecided

And

1. CHIEF MRS. L. I. FOWLER
(For herself and on behalf of the members/Trustees of the Corona School Trust Council)
2. CORONA SCHOOLS TRUST COUNCIL Respondents

COUNSEL:
T. O. G. Animashaun, Esq. – For the Appellants.
H. A. Balogun, [Mrs.] (with her, O. Idemudia, Esq.) – For the Respondents.

JUDGMENT:

KATSINA-ALU, J.S.C.: (Delivering the Leading Judgment): This appeal is from a judgment of the Court of Appeal (Lagos Division) delivered on the 11th day of December, 1996. The court declared the action instituted by the appellants as incompetent and struck it out. The appellants have now appealed to this court, raising five issues for determination as follows:

"1. Whether the appellants had the requisite locus standi to institute proceedings against the respondents?

2. Whether the appellants followed the proper practice and procedure in suing as next friends in the Lagos High Court.

3. Whether the Federal Attorney-General is the only person able to properly institute an action as contained in the claims before the Lagos State High Court?

4. Whether the Court of Appeal, could properly make a determination of the nature of the trust of the 2nd respondent and the nature of the contract of education on an interlocutory appeal.

5. Whether the court of first instance could properly grant an order for interim injunction during the hearing of motion on notice for interlocutory injunction on the facts before the court."

I shall endeavour to deal with issues 1,2 and 3 together. The resolution of those issues will determine whether there is need to go into issues 4 and 5. But first let me state the relevant facts of this case. The facts which led to this appeal are a bit complex but I find that the court below lucidly narrated them. I shall have to rely on those facts as they appear in the transcript. On 2nd August, 1995, the plaintiffs/respondents took out a writ of summons against the defendants at the High Court of Lagos. Following that, the plaintiffs/respondents (to whom I shall refer hereinafter as the appellants) obtained an ex-parte order of interim injunction made by Alabi, J., against the defendants/respondents (to whom I shall refer hereinafter as the respondents) on 9th August, 1995, restraining the respondents from 'intimidating, harassing, expelling or threatening to expel or in any way victimising and/or disturbing or interfering with any of the pupils of Corona Nursery/Primary School, Gbagada from academic and/or extra-curriculum activities of Corona School or disturbing the legal rights, ingress and egress of the parents of the children of Corona School, particularly members of the PTA pending the determination of the motion on notice."

Leave was granted to the appellants to sue as next friends of their wards. Leave was also given to them to "sue for and on behalf of the class of parents of Corona Nursery/Primary Schools at Apapa, Gbagada/Victoria Island/Ikoyi who oppose the arbitrary increase in fees and the management and maladministration of trust funds." These orders were made in line with five out of six prayers sought for in the motion ex-parte. The other prayer to restrain the respondent from increasing the school fees of N13,600.00 and N21,500.00 payable by Corona Nursery School pupils respectively a session for the 1995/96 session was adjourned to be heard later inter partes......

(f) The proposed increase in school fees for the 1995 session from N13,600 to N33,500 and from N21,500 to N41,500 per pupil for the nursery and primary schools respectively cannot be afforded by the pupils and if the increase are effected, the pupils will be constrained to leave the schools with irreparable damage to them....

.....Now to issues 1,2 and 3. It is clear that the appellants' position is that the Corona Schools are run as charitable educational institutions upon a trust which was created by the constitution of the 2nd respondent. It is said that the schools are expected to provide qualitative education on a non-profit making scheme. It was principally upon that plank, as it appears to me, that the action was brought to seek the various reliefs stated in writ of summons. The court below considered the applicable law to charities and charitable organisations. It came to the conclusion that there is no indigenous law and that the Charitable Trusts Act, 1853 of England applied as part of the received law in this country. It also found that the Charitable Trustees Incorporation Act, 1872 provided for charity commissioners vested with certain powers and duties in regard to charitable organisations.

Under the Charitable Trusts Act, 1853 the said commissioners were empowered to act in the case of any charity to promote its work assigned to it by its trust objects. It was also to ensure that no proceedings shall be entertained or proceeded with in any court unless authorised by the commissioners or taken by themselves or by the Attorney-General. As already said, under the 1853 and 1872 Acts the charity commissioners were vested with certain powers and duties. Similar powers and duties are now vested in the Corporate Affairs Commission under the Companies and Allied Matters Act, 1990 (the CAMA). Section 673(1) of CAMA recognises the incorporation of trust body for educational and charitable purpose, among others. The question is the law to regulate the way they function. That is to be found in the Charitable Trusts Act, 1853 see Halsbury's Laws of England, 3rd edition, vol. 3, pp. 551 -552.

"We respectively (sic) submit that in determining the locus standi of the appellants the Court of Appeal had no need to rely on antiquated English statutes as part of the applicable received law in Nigeria notably the Charitable Trustees Act, 1853 and the Charitable Trustees Incorporation Act, 1872. The applicable law is contained in section 6(6)(b) of the constitution as interpreted by various decided Supreme Court cases all of which are binding on the Court of Appeal under the principle of stare decisis. "

Under that act, the role of charity commissioners (now to be read as Corporate Affairs Commission in Nigeria) and that of the Attorney-General as regards proceedings on charity matters is spelt out....

In the result, I find no merit whatsoever in this appeal. I accordingly dismiss it with N10,000.00 costs in favour of the respondents against the appellants. I will add here that it is desirable for the National Assembly to make indigenous laws on trusts and charities as they have exclusive jurisdiction to do so under item 10 of the exclusive legislative list in the 1999 constitution.http://lawaspire.com.ng/2014/08/dr-o-o-sofolahan-anor-v-chief-mrs-l-i-fowler-anor/

The full length hijab or niqab had never been in use on camps. Just the moderate ones and even at that some Muslim ladies are still harassed in some camps for using it.
I don't know where the OP got that pix from.
I don't see any reason for calling for the ban of hijab, once the hijab is moderate and won't hinder their activities on camp. The BH part is no point at all since corp members don't use niqab or long hijab in the first instance
Why should the hijab be allowed in NYSC Camp when it was not originally part of the uniform, in the first place?? Is there anyone who can categorically say that he went through a university for five years and does not know what the approved regulation uniform for youth corpers looks like?? shocked

Why do people always twist things to suit themselves?? The short hijab which your people are canvassing for, is even knee-length and it covers up the whole upper part of the body, including the NYSC Tee-shirt and the logo. It poses a risk just as much as the long one, since it covers the entire waistline where suicide bombers can strap their dynamite sticks and bombs.

So what is the point of even wearing the NYSC uniform anyway, or even attending camp?? Just drop out and refuse to go for NYSC because you dislike the uniform and you cannot cover it up with a hijab. undecided Anything other than the short hijab ending at the neck area like those worn by the foreign muslim police officers, is just a security risk in this era of BH threats.

Hijab is part of our females dress code and there is nothing anyone can do about it not even nysc.
Then please do NOT go for NYSC. Every graduate already knows what the stipulated uniform approved for NYSC participants, looks like. So how can you come into camp and decide to change it on your own, by insisting that a hijab should be incorporated into your mode of dressing, at the camp?? I don't understand it. huh

NYSC was set up as a para-military organisation, and it carries out man o'war training drills in camp. How can you participate in such drills wearing a long ankle-length hijab, without tripping over your own feet?? shocked Or should they cancel the drills, just to please you? shocked

Even female muslim police officers abroad are only allowed to wear the short hijab that covers the neck/shoulders, and not the one which covers the entire body. The security situation in the country is tough enough, without people making it more difficult due to their refusal to follow instruction.

NYSC Camp will only last for 21 days. Why can't people forego their own self-centred wills to wear a particular item of dressing, just for the sake of safety?? Holiness or Purity is a conduct or behavioural feature. Does the lack of a hijab make any Muslim woman less holy?

NYSC › Re: Should Hijabs Be Allowed In NYSC Camps? by laudate: 1:10pm On Nov 27, 2015
These people need to be sensitive to the security situation in the country. Why promote unnecessary security risk by putting on a hijab?? Female suicide bombers have been known to strap dynamite and bombs around their body, while concealing it under a hijab in order to cause havoc. Even in their uniforms, the female corpers still appear decent. undecided

What the Director-General of NYSC banned was the long ankle-length hijab. Why are these chaps getting it wrong?? Even in the British Met Police, it is forbidden to wear long, ankle-length hijabs covering the whole body. Only the short ones that cover the sides of the neck, is allowed. It is also the same for the female muslim police officers in the US. sad

NYSC- is even supposed to offer some kind of para-military man o'war training. Do you know how clumsy it would be to carry out those exercises wearing a hijab?? Afterall, those female corpers and their parents knew that NYSC was compulsory before enrolling in it and they knew what the requirements of the uniform were. So why are they protesting, now?? huh

Point of correction.... Corona is over 60 years old. It was THE SCHOOL of the 70s, 80s and 90s. You need to have known how popular it was in the 70s and 80s. It had very few competitors way back then, unlike now.

mfm04622:
How is Corona School related to humble beginning? Only children of the rich attend that school
Corona was not always an elitist school. Yes, it had a very high standard of education, great facilities, expatriate teachers etc, but in the 70s and 80s it was quite affordable. Children of many civil servants attended the school back then, because the fees were quite low.

Different arms of Corona school were located in Ikoyi, Victoria Island, Yaba, Apapa and Gbagada. A new one has been added in Agbara, Ogun State as well as in the Abijo area of Lekki in Lagos. In the past, the Corona School Trust Council that ran the entire set of schools got a large chunk of its funding from donations made by non-governmental organisations, companies and wealthy individuals. undecided

As the economy became less buoyant, those donations dropped and the Trust Council was now forced to charge high rates to keep afloat. A number of parents withdrew their kids from the school and even took the Trust Council to court to protest the high school fees. Anyway, the school's management won the case and fees have remained high at Corona, since then. sad
