He bought a COMMITTED LAND that had been allocated to a PRIVATE ESTATE to develop their own RESIDENTIAL ESTATE.

For those that are unaware of what a Committed Land is, i will give you a brief lesson on it. Lands for sale are either free from Government acquisition, Under Acquisition or Committed Lands.

A LAND FREE FROM ACQUISITION is a very safe land to buy because the Government has not acquired it and has no plans to acquire it in future to do a project. If by para venture the Government acquires it, you will be paid compensation because it was taken from you unannounced and they have already given you the go ahead to buy it and build on it.

A LAND UNDER ACQUISITION IS PART BAD AND PART GOOD. Part bad because the Government has acquired the land for a future Use but due to SPECIAL CIRCUMSTANCES, it might in its infinite wisdom decide to give the Land back to the community but in return you are going to be sanctioned heavily for buying A LAND UNDER ACQUISITION by paying a lot of money to the government to RATIFY OR REGULARIZE THAT LAND before you can get documents to that land.

A COMMITTED LAND IS A BAD LAND. No stories and nothing can change what is coming or passing through that land. A Bridge or Estate or Airport or a project deemed worthy by the Government must take place on that land and no amount of bribery, coercion, pleading, settlement or crying will change the fact that the building on it won't be demolished.

The Omoniles, sellers, agents and surveyor had all hoodwinked him into buying a land that was Fully committed. He told me that they said the land was about to get a Gazette and It was under processing and he was shown some papers to prove it. Little did he know that he was buying an extremely defective land. The survey plan he was shown at first that was owned by the Seller was drawn up in such a fraudulent way that it showed it was "free from acquisition" on the survey plan and the new surveyor he hired just reproduced, copied and pasted the old survey plan of the seller and gave to the client not knowing it was a land belonging to a PRIVATE ESTATE who have been fighting the Baale of that community and Omoniles for selling their estate lands stupidly and Alausa was ready to fight for them too. The Land Bureau at Alausa have resolved to demolish all the houses, fences, foundations and any other structure found in that committed area and the Millions or billions of Naira used to buy these lands or build those houses have been turned into waste.

Now he is asking me what he should do and he would pay anything for me to get him out of this quagmire. So my people what is the way forward because to me his N5Million is gone, The Omoniles cannot be found after they have spent his money to buy Sallah Rams and marry new wives, The lawyer that drafted the agreement is speaking in tongues, The Agent is not picking his calls, The Seller has traveled to Dubai, Surveyor is saying he wasn’t contracted to take coordinates etc. Please help me advise Mr One chance. Besides the Land in question is at Ibeju-Lekki, so those that have lands there that do not know the status of their Land or took a big gamble to buy lands before investigating it, be very afraid because deep down I even thought the area this man bought was not committed. ( I purposely deleted the name of the client, surveyor and Area so as not to rouse suspicion). So don't throw away your life savings and your children's future by dashing Omoniles or fraudulent land sellers your hard earned money. Do a land verification to give you peace of mind unless an unplanned demolition may happen to your beautiful house in future.

P:S: Please i beg you, those that have nothing intelligent to say or are not conversant about landed issues don't derail this thread or post comedic comments to get noticed. It's a very important topic for People interested in owing lands or have bought lands that have problems and its better advised you just skim through it and walk away rather than just post something that is meant to upset other people.

Every time I write an article about the perils of buying a land without doing a search, I get a lot of criticisms, hate mails and spiteful comments from people. Some go as far as saying am a harbinger of bad news or creating mere fictional stories to boost my Land verification business. So I have decided to expose the folly of one client (Name withheld) for attempting to purchase a land without going through due process to verify a land and I will show you the result of purchasing that property.

The first thing that happened was that he called me to inquire about my Omonile lawyer land verification services early this year and I told him everything we do, our cost for investigating it and how we would advise him on whether to buy the land or not based on the information derived both from the seller, their agents and the land itself. The moment he heard the cost of the search as N50,000 he began to criticize me to trying to extort him and offered to pay less and I bluntly refused because of the research gone into fixing the cost of the search and paying all the relevant authorities and interested parties to get the true information. He finally told me it wasn’t worth it and he would go there and investigate himself to buy it and I wished him well in his endeavours since he probably knew more about investigating defective lands in Lagos than me.

After some time he called me that he had purchased the Land for N5Million and I should help him do the deed of assignment. I bluntly refused saying I would never ascribe my signature to a document that I know nothing about especially a land i haven't researched myself. He later asked me to also get a surveyor for him to do his survey plan and i refused to give him one because to me it was a medicine after death approach. He further attacked me for being a charge and bail lawyer that knows next to nothing and told me he would get a surveyor to do his survey plan so that he can build. He continued to berate me for being too negative based on the number of mansions in that environment that were springing up and I wanted to deprive him of not living amongst his class of people and I humbly apologized for being a straight shooter and wished him well in his endeavors.

3 days ago, I noticed he was calling me frantically whilst I was in a meeting and when I responded to one of the calls, he told me he was in trouble and he wanted to apply for his C of O or governors consent so he was advised to do his Land Information certificate and the result of the search is below:

So many uninformed and illegal answers that it makes it difficult to address the problem properly without looking stupid too. Honestly I think Nairaland should devise a method whereby serious and matured people should have the opportunity to respond to important issues and leave the Davido commentators to focus on wiz kid topics.

Before you analyse the issues on the ground, you have to treat it line by line with regards to the OPs story to get to the root of the problem.

1. The OPs father died intestate but he left the papers in Nigera and he PRESUMED they have fallen into the hands of his brother ( Meaning he isn't sure and you have to get the facts right before making an allegation)

2. OP states he has BROTHERS and his YOUNGER BROTHER ( that is one of his YOUNGER BROTHER . . . .we don't know how many they are) sold some of their Dads land without informing the OP. Did he inform the other brothers and did they consent to it? We don't know yet.


3. Where is the land located? Village or city because it with aid in knowing whether a customary way of addressing land issues is to be applied or modern land law rules. Also Did the OPs father marry a wife or wives and are they still alive?

If these requisitions above are properly addressed, it's easier to advise on th next course of action rather than jump into conclusion or formulate answers that either have no bearings to the case nor legal in the eyes of the law

There is one very popular land scam that is extremely rampant in Ibeju Lekki, Ikorodu, Badagry and Agbara that is very common amongst unscrupulous Estate Agents, Surveyors and Very Defective Land Sellers and Omoniles trying to hood wink potential buyers of land and that Rip-off is the “GAZETTE OR C of O UNDER PROCESSING SCAM”.The scam works thus like this:

1. They see that you are interested in buying a land and they notice it through your eyes and emotions that you are falling in love with that land, the topography of the land, dreaming of the potential neighbours of the land and the environment through your numerous kind words of the location and the structure of the land.

2. They know you are ready to pay for the land right now if you agree on a price but they also know that if you are too land savvy, you will ask them for the documents or title the land has and that might prevent you from buying it.

3. They know if they produce a fake land document, you could get in touch with Omonile lawyer to verify the land or someone that is well versed in purchasing land who will discover their fraud.

4. So they choose the easy way out. They will tell you the history of how the land came about and how the Government tried to steal a large expanse of land from the Community but the community protested and the government had to finally give the Omoniles a certain portion of their land back and in return give them either a Gazette or a C of O.

5. These Swindlers will now tell you that for 3 years or so, the community has been trying to get their Gazette or C of O from the Government and they have been processing it seriously and it would soon be out. They will even encourage you to go to Alausa land registry department to go yourself to confirm it. They will give you a file number to go and crosscheck the file personally so that you will see all the payments, fees, paper work and everything needed for the Gazette or C of O to come out but because of the bureaucracy of government officials they can’t do much but they need money to continue bribing the Alausa officials sitting on that file and that is the reason the Seller or Omoniles are selling the land cheap now to use part of the money to obtain the Gazette or C of O and you should take advantage of the cheapness because once the C of O or Gazette is out, the price of the land will quadruple beyond the reach of the Buyers pocket. The moment the prospective buyer hears this wonderfully crafted diabolical fantasy, he swallows it hook line and sinker and proceeds to make payment without confirming the status of that fabulous story. 6 Months down the line after the buyer intends to start building and is anxious to perfect his papers and get his building plan approval, he would still be hearing that same well rehearsed story line

“THE GAZETTE OR C of O IS STILL UNDER PROCESSING”

It baffles me that someone is about to hand over thousands or millions of Naira to a stranger and relies on only his well crafted story to buy the land. If you’re a prospective buyer and you come across this phrase “GAZETTE OR C of O UNDER PROCESSING”, think hard about the following questions:

1. How does the Agent or Seller of the land know it is under processing?

2. Has he been to the land registry to confirm if it's under processing

3. What is the file number and what does the file colour look like?

4. What room is the file being kept and who allocated the file number to that file?

5. Who is the officer in charge of that file and can they give you his number so that you can go and confirm it personally?

6. What fees did the omoniles or community pay for that “GAZETTE OR C of O UNDER PROCESSING” and what copies of receipts or fees do they have to show you. At least since they are to pay for government receipts they should have triplicate copies of the receipts to show you.

7. Who is the surveyor handling the release of the “GAZETTE OR C of O UNDER PROCESSING ”

8. Who is the lawyer or Government official acting on their behalf to get the “GAZETTE OR C of O UNDER PROCESSING ” out in due course

9. When is the expected date or time the “GAZETTE OR C of O UNDER PROCESSING ” is to come out

10.What if the “GAZETTE OR C of O UNDER PROCESSING” is not approved or granted, what becomes of the money or land that you have just committed yourself into? Once you can ask the Agent or Omoniles these questions and they cannot answer it satisfactorily, my brother, use your 2 left legs and waka from that place unless they will just use your money to do Sahara. A word is enough for the Wise.

So the next time you are shown a land to buy and you hear these infamous words “GAZETTE OR C of O UNDER PROCESSING ” , Dont fall Mugu to these People telling you this Bulls**t Anymore. Tell them to provide all the answers to the above questions and provide concrete evidence of the supposedly Land Documents under processing unless no body will pity you when you start to cry in future as your House is being demolished because the land has no papers and still under processing after 10 years.

I have tried to call Mr. Chekiaut repeatedly but no response or the line isnt going through. Nairaland isn't going to condone this kind of behaviour or fraudulent pattern anymore. Mr. Chekiaut i implore you to govern yourself accordingly by returning Ugogal's money or supply the product you were paid to do unless the full weight of the law will befall you. How can you collect money from a fellow Nairalander like you and refuse to deliver up the products she paid for or return her money? This is nothing short of theft and scamming and you have 24hours or you will be blacklisted on Nairaland. I am putting this topic here as a sticky to give you the opportunity to comply and not feign ignorance that you havent read her complaints against you and if other Nairalanders know the whereabouts about Mr. Chekiaut please alert us or get in touch with Ugogal so she can get her money back!

I so hate this practice so much by these quack agents looking for a quick buck and they know next to nothing about the property they are marketing. Mr. Biggs is practically their office extension and they handle all sorts of clients there looking for a simple 2 bedroom flat for N200,000 to a N2Billion property at Banana Island.

The funny thing is that they all have complimentary cards with an official address but they will never meet you at that address. Sometimes they surround you with 2 or more scruffy looking agents all dreaming of sharing your hard earned money as commission. Lets eveb talk about the aspect of you being their driver for one full day. You are the same person that will meet them at Mr. Biggs for a meeting, feed them or buy coke for them, take them around the whole of Ajah or Ikorodu to locate non existent lands or bad properties, still pick up 2 or more agents along the way hereby turning your luxury sedan into a temporary Danfo for one day and at the end of the whole trip, you still have to give them money to go home.

Much as you have a point in advising people to always verify the authenticity of any property they intend to put their money in,please be very specific when you advice them to pay "professionals",who are the professionals you refer to? with your ad clips and with what obtains in Nigeria,most uninformed intending property owners would think you are referring to lawyers.I once had a client,who while sketching his proposed building,I was advising him on the need to observe the required set backs and all that,there was this lawyer of his who was telling him that it wasn't necessary,that developers don't always observe set backs blah blah blah.I quickly shot him down and told him that he was over-stepping his bounds and venturing into territories that he was not competent to speak on.
Truth be told,from that experience and others,I can safely say that lawyers,in their greed to collect agency and management fees as well as commissions from sales of property have ended up usurping the duties of professionals like estate surveyors/valuers,as well as engineers and given calamitous advice to property owners which has put a lot of them in the predicament we're seeing on this thread.

Your right sir, many lawyers are part of the problem too and I won't deny that. I am even dealing with one presently that wants to play the role of an agent, solicitor and contractor at the same time and I detest such attitude. I agree loads of lawyers would have been culpable in the sale of those bad lands and won't feel any remorse whatsoever ever to try to ameliorate the sufferings of these people now. That's why I hardly involve myself in both agency and soliciting and when it comes to territories or departments that am not conversant with, I raise my hands up and tell the client immediately. Am only good at one thing and that's land law and discovering land scams that could bankrupt a potential buyer. Apart from that, I won't claim to be an expert on it and I won't venture into it.

If you have a C of O be rest assured you can be compensated adequately especially if you sue the Government to court if you have the building plans and C of O that emanated legally from the Ogun state Land bureau.

The same agencies that give these approvals are the ones who turn back and call it fake. And the gov is turning a blind eye because he doesn't want to pay compensation. It is ridiculous for you to claim that people who spent millions to buy land and build houses didn't go to government for approval. 1. One your an Ode first class because i don't belong to any political party rather am a Nigerian concerned about the welfare of the citizens.

2. Am not profiting from any body's woes, the deed has been done. Rather am trying to show people that such issues can be prevented in future if they contact people like me to verify their lands. If they had a land verification company to help them point out these bad loop holes that led to their homes being demolished would they knowingly go and build a house near a proposed road projected for expansion?

3. Your daft for saying the Government does not want to pay compensation. If you have read the articles properly above you will see where i wrote the Ogun state Government is ready to compensate people that have duly registered documents and they have told them to bring their papers for evaluation so they can pay them. If you cant read, find your nearest spec savers to buy your self a new 18 inch thick lens eye glass.

4. Also i don't care if it is the FG or state government because i am neither PdP or APC. What is bad is bad and its my job to point out the evils in our land system So that people don't fall victim for land scams or for want of lack of knowledge of our land laws.

Yesterday news filtered round Lagos and Ogun states that a massive demolition of properties by the Ogun state government along Ojodu/Alagbole road at Yakoyo and the Sango/Ijoko road all the way down to Ogba-Ayo is going on presently and you can read more about it on this thread: https://www.nairaland.com/1487783/over-100-building-demolish-ogun.

For those not familiar with this area, its within the Ojodu berger/ alagbole axis sharing boundary between Lagos and Ogun state. The reasons for the demolition is because the road is so tiny and its the cause of the daily traffic gridlock experienced by users of the road connecting Ojodu, alagbole, akute. The Ogun state Government intends to expand the road so that it would alleviate the sufferings of commuters who patronize this nightmarish road but it has been done at a cost that the victims of this demolition will forever count their losses and curse the omoniles who sold these lands to them.

I am quite conversant with this area and i have done some searches for some people before and i warned them about about doing a proper land verification before they buy lands in this area but most of them did not heed my advice and listened to the omoniles because the land was cheap. Now look at it! A proper land verification will show the following concerning this area:

1. The set back of the road is too close to build a house on a major highway and it has already been in Ogun State Land bureau master plan for years to expand this road and anyone that tried to apply for building plan approval in the last decade in this area would be bluntly refused.

2. All of them don't have a valid Certificate of Occupancy showing ownership and possession for the government to compensate them properly. Upon investigation the title documents most of them were parading where receipts from the Omoniles and fraudulent back dated survey plans.

3. I asked some people who were victims of this demolition whether they can trace the people who sold it to them and they said the omoniles and baales of that community have disappeared since they heard the demolition was coming. I asked them what about all the fees they paid to them such as the foundation fees, community fees, community development etc fees that these omoniles collected from them to claim ownership, they told me the Omoniles did not even pick their calls talkless of discussing issues of refund and they are seriously looking for them now to refund their money.

4. They said the Omoniles even promised, swore and convinced them that their forefathers owned the land and they had sent representatives to see the Governor who in turn re-assured them that no demolition would take place and upon a further late hour search from the Land bureau officials from Abeokuta, they discovered it was a lie.

So many beautiful and expensive properties are going down as i type this article. Massive Shopping complexes, Mansions, Petrol stations, family homes. Shops etc and its very sad but it could have been avoided through a simple land verification. Now Millions of Naira have been turned into rubbles. Owners of these properties to be demolished refused to engage professional land verification experts but chose to listen to all these fraudulent agents misrepresenting facts and criminally minded Omonile Land Scammers who have in turn ruined these people's lives. I know alot of people will abuse the Ogun state government for being insensitive to these people by demolishing their homes but then again, is the government wrong for having the master plan to expand the road and for Omoniles to encroach upon it by selling it fraudulently to unsuspecting buyers who refused to do a proper land check? Its a big lesson for all of us not to fall victim of land scams and for us to verify a property before we purchase it.

Thank you. It's shameful how so many people are open to the degradation of their traditional marriage customs, some even considering it "not necessary". Can you imagine? Your own people's marriage traditions (which have been practiced since time immeomorial) are no longer necessary, but the white man's wedding is now more important? Inferiority complex at its worst.

Some may say that it's none of my business how people choose to conduct their traditional weddings, but it is my culture and therefore involves me. What we're witnessing is the degredation of culture and cultural customs; any person concerned with the integrity of his people's cultural values will speak out.

So are you saying if I love my ibo fiance to death and both our families are based in Lagos, her father has a family home in Lagos, all our friends and relatives are in Lagos and it would save us a couple of Thousands or Millions if we choose to do the Traditional marriage in Lagos in her father's compound with all the families of the couple there, No traditional wedding should take place again because we didn't go to Owerri to do it? I should break up with her because I am degrading the cultural custom of an Ibo traditional marriage? If I spend all the money to do party in the village, transport everybody to the village to break kola nut and after the wedding I cannot feed my wife because I have satisfied the cultural rites in the village, will that make sense to you?

yemad10: I would say they are genuine, but they are currently having problems with meeting their delivery obligations. They are being carried away with their little success with Lekki Gardens Phase 1 and are now taking on too many projects at the same time without really finishing one. They now have delivery backlogs. If you are not ready to wait a long time pass the promised delivery date, my sincerely advice is don't make a payment, otherwise you will be highly disappointed. Most of the time the sales girls and the manager (name withheld for now) don't usually pick up calls or respond to emails of customers once your money is collected. I may be forced to post some of my email correspondence with them on this site later, depending on what people say further on this site. It is gradually becoming a 'phonzi scheme' because they are chewing more than what they can bite at the same time. Maximum 100,000. You didn't buy the land from them so they owe you nothing. After you offer them the 100 k and they refuse it, spend that 100k at the police station to arrest them for harassing you. So far the property has a C/o , you have nothing to associate with them.

Stupid pastor! Was he a Virgin before he got married? He shouldn't blame his sexual inadequacies growing up on a young couple who love each other and intend to spend the reminder of their lives together. Does the Cow of a pastor know Jesus even brought a prostitute close to him and didn't condemn her? Who is he to start judging people? If he has children and they had premarital sex will he disown them and wish they become single all their lives because they had premarital sex? He is a silly pastor and am sure if people check very well the bible he carries around all day trying to justify his sermons and doctrines could probably a Chinua Achebe Novel in Paper back disguised as a bible.

Just 1 question I want to ask NANS. If the federal Government accede to ASUU's demands and give them all the Billions they are asking for, will they share part of the Billions with the Private schools they intend to distrupt their academic activities and shut down too?

Am the moderator on the property section and the lawyer that registered SSM Nigeria and would be in a better position to clarify things:

1. Damola is no scammer because I know him personally down to his family home and he is extremely well to do and a very successful entrepreneur that a lot of young people should look up to as a role model

2. Damola smiles a lot but I have learnt 1 or 2 things from him business wise about running a business in a firm way

3. Paykobo has been in the pipeline for years and he has spent considerable funds to turn it into a standard business equal to konga or jumia as an indigenous investor that deserves our support.

4. The fact he advertised for new applicants is solely his prerogative. He can hire today and fire tomorrow if he wants because its his business and will do everything to make it successful. I know some of his staff that have been with him for years and some disgruntled workers he had let go because of low productivity and you don't expect him to keep people like that in his team.

5. I don't think he has scammed anybody by asking you to pay money for the ad or has refused to disclose his identity or work place. Just like every business, if your the right person for the job, you will be hired and life goes on.

6. Finally as for the person hiding under behind the keyboard to derail this thread, state your greviances politely and to the proper authorities If any and stop derailing this thread to poision other applicants. If you have something concrete to say concerning the application process speak out. If its about owning 2 or 3 companies, how does that affect the recruitment process or affect you personally? I own 3 companies and run them concurrently, how is that an issue with the way I pay my staff or advertise for new workers?

X-ray magazine please govern your self accordingly and read rules 2 and 8 of this forum unless you would be sanctioned accordingly. If you say Damola is owing you money state the facts and evidence properly to my email below and I will confirm personally to make sure your properly compensated if truly your being owed but if it is discovered to be false and your on a mission to bring down SSM at all cost based on your trolling, you will be banned.
