A 37-year-old estate agent, Bosun Shoyoye, who allegedly stole N5 million was yesterday arraigned before a Lagos Magistrate’s court at Igbosere. The defendant, who resides at Imedu Awoyaya, in Eti-Osa Local Government in Lagos is facing a two-count charge of conspiracy and theft. The prosecutor, SP Eshiet Eshiet, told the court that the defendant committed the alleged offence in September at Ibeju Lekki area of Lagos State. He further told the court that the defendant stole the N5 million from one Adebayo Adegbola under the guise that he was a reputable project manager, and that he had handled several estates projects for several people, which he knew to be false. According to Eshiet, the offence committed was contrary and punishable under Section 312, 267 and 285 of the Criminal Law of Lagos State, 2011. However, the defendant pleaded not guilty to the charge and the magistrate, Miss Olanike Olagbinde, granted him N500,000 bail with two sureties in like sum. The case was adjourned to December 15 for mention.

Tiri Gboosas for all the dumb answers i have read on this Thread. A very simple answer to this question is that a power of attorney is not a good root of title and it only lasts for 12months while a deed of assignment conveniently transfers title to you because it contains the parties to the transaction, the amount, location and description of the property, covenants among the parties, indemnity clause(s) and signature of the parties executing the contract.

If anybody comes to my office to sell a property brandishing a Power of attorney as the title to the property i would tear it into pieces and fling it out of my window.

And to think few months back APC sponsored an Article in the Economist labeling GEJ as an Ineffectual Buffoon despite the fact he handed over Africa's Largest Economy to Kemi Adeosun but under 15months she and her band of clueless APC government have destroyed the very fabric of existence of Nigerians with her bad economic policies. GEJ handed over to her $1-N215. This morning its $1-N425. Kemi Adeosun is the real economic ineffectual buffoon and she is completely clueless on how to get us out of this recession.

Buhari himself cannot hide from this malaise plaguing Nigerians now. As soon as he took over government, he did not rally the country together to improve the economy. Rather he spent the first 6 months empowering anti pdp social media critics to abuse and blame GEJ meanwhile the economy was crumbling with no ministers, no economic team or special advisers to help stem this rot. Everyday it was one stupid story or the other about how "minister A stole $20billion or Commissioner B hiding $80billion in his toilet" and his social media agents were making fun of everyone in PDP while the economy was tanking right under his nose. He did not provide any kind of economic marshal plan to move Nigeria forward but was busy playing Ludo with the CBN governor banning forex today, restricting forex tomorrow, banning importation of everything without granting manufacturers any option on how to do it themselves rather it was a competition to win the award of "who can blame GEJ/PDP the most". By the time Buhari selected Ministers to hit the ground as promised in their campaigns, the economy was already finished with no one to guide it properly.

Today all of them in APC both on social media and in Government have realized that they have messed up and Nigerians are turning on them. Its now they realize they are in power and are feebly trying to fix the damage they caused which would be very difficult because they were not prepared to govern in the first place talk less of being expert managers of the economy. Now they have stopped spreading silly propaganda about who chopped Nigeria's money and changed it to " e go better". Even Lai Mohammed's mouth is feeling the recession too because he has no new lies or fairy tales to dish out to Nigerians anymore. Nigerians don't deserve these kind of ineffectual buffoons in APC running our Government.

You are dealing with traditional rulers, obas, baales, police and Lagos state land officials who benefit from these crisis as their daily bread and butter in exchange for votes and stability in Lagos. This is not the first time they have set up a task force or passed a law to deal with omoniles. From Badagry to Epe they all do the same thing. Who do you think empowered them to to collect Foundation fees, Roofing fees etc from unsuspecting owners of land? Who do you think colludes with them to trespass on lands claiming various family names to get money from ratification? Who do you think deliberately refuses to issue C of Os or Gazettes to communities to cause confusion. This is just a red herring. Omonile issues are bigger than the Lagos state government. This is a matter the federal government has to step in and treat like Boko Haram or Militants before we get any headway. Omoniles are Terrorists of the South West that kill people economically.

People should remember he is Nigeria's democratically elected president and only through an impeachment, resignation or ballot box can we get rid of Buhari but definitely not through his death. Nobody should be that callous. Criticize him based on his silly policies but pray for him as a human being to live longer and change his ways.

The area is simply an Investment opportunity for Nigerians to invest and own lands near a Refinery at the free trade zone Ibeju Lekki. This place is going to be like Apapa in the next 3 to 5 years and its best for those who have small pocket change to buy lands there so your children would not insult you in future why you don't own lands in that area when their classmate parents bought it years back at a very cheap rate. Last year it was going for N500K per Plot, now its going for N1 to 1.5 Million.

The only snag i have about this place is that now that the omoniles know development is coming there at a rapid pace so they are getting more fraudulent and reselling government or other people's lands to unsuspecting buyers. So you have to shine your eyes. All in all Well done to Dangote for opening up that place and please don't be like my parents who scoffed at the idea of buying Lekki Lands 20years ago because it was Bush only to regret it today. Be a land owner and invest there for your children. Me i don buy my own. Na you remain wink

That's not true. The PDP NWC in Port Harcourt has just sworn in Senator Markafi as Caretaker PDP Chairman and Senator Ben Obi as Caretaker PDP National Secretary for 3 months until the new PDP Convention takes place after 3 months.

The aim is to elect a permanent Chairman and National leaders in 90 days to help conduct and organize a new PDP Convention and not as Contestants. The aim is to prevent what happened today when Ali Modu Sheriff wanted to transmit from a Caretaker to a permanent chairman.

This is a very good development for PDP. Ali Modu Sheriff was a stain and i am glad PDP has decided to come together to rebuild the party.

I happened to be one of those that worked as MTN adhoc staff during the sim-reg itch. Now when we were told that our contract had expired on 28th of Feb, well some persons left, but I and few other, abt 3 of us decided to keep working , though we were told we will nt be paid anymore.

Is there anything else to say? How would a contract be extended when you weren't offered a new one? You are working for free and You would not be employed. Employment comes from MTN Head office not the branch you are slaving yourself. Better move on and look for a new job.

Make Fuel scarce for 8months.

Make Nigerians very Frustrated.

Make them buy it at exorbitant prices from 150-250 Naira per litre.

Make it very difficult to even get the fuel even at that price.

Make them beg for black market fuel at N300 per Litre.

Continue to blame Gej and Pdp for the fuel Scarcity.

Make FX scarce. Make people queue for hours and ignore their cries and pains.

Tap into a typical Nigerian's excessive calmness, patience and dislike to queue and suffer.

Promise them Fuel Scarcity would end May 7th.

Re-Introduce the Fuel Scarcity on May 9th.

Make people start begging Buhari/APC to ‪#‎endfuelqueues‬.

Send Buhari to the U.K on May 10th to disgrace us and tell the whole world "Yes Nigeria is Fantastically Corrupt" to deflect attention on what is going back home.

Increase Fuel price from N97 to N145 on May 11th without considering the masses or providing any palliative to cushion the effects of the massive inflation that would result from it to further impoverish Nigerians.

Lie to Nigerians that NLC and all the Governors and Senators are in support. ( Meanwhile its not true)

Change the narrative that ‪#‎OccupyNigeria‬ 1 wasn't about reversal of Fuel subsidy under GEJ but because they didn't trust GEJ to do it well because he was corrupt.

Promote a lot of Social media activists and APC fans living outside Nigeria to tell the world why the new fuel subsidy removal is the best thing to happen to Nigeria since Fried Rice and Chicken because they trust Buhari.

Forget to remind Nigerians that since we do not have 24 hours light, we rely on Generators to run businesses and homes.

For example i spend 20 liters daily on my car to shuttle between Mainland and Lekki. I suffer at least 2 hours of Traffic inside heat so the A/C must be on. If i buy Fuel now for N145 per litre, that means i spend N87,000 a month on Fuel in my car. (Where i wan see am?)

When i get home i must buy at least 10 litres every day for the home Generator. That's N43,500 in a month Making a total of N130,500 a month on Fuel. Let me not add the 20liters per day i buy to run my office generator o!

I have not added cost of food, Fashola's (aka Minister of Darkness) new high increment in Nepa bills, taxes, food, inflation on every damn thing and miscellaneous expenses.

Why then would Nigerians not be Fantastically Corrupt to survive when Buhari's Government only understands Increment, taxes, tolls, pain and suffering and the minimum wage is N18,000 per month while they rejected just 2 weeks ago to increase workers wages. APC lied that if Buhari wins the election, Fuel would be N40 per litre. Little did we know they meant N145 per litre. Every single thing Buhari met in May 2015 has increased 100% just under one year.

We could live with his bland and vapid economic policies but why compound it with an 80% increase from N86 to N145? This is beyond heartless and cruel. Nobody deserves this kind of wickedness. Even convicted Murders don't deserve this kind of suffering talk less of hard working Nigerians.

Since May 29 2015 almost everyone i know has complained that Business has been bad and their wallets are getting slimmer. No economic improvement or sign of better things to come. Rather its one propaganda or the other about how Minister A chop money or Governor F Stole $100 billion meanwhile the hard working Nigerians who have nothing to do with it are getting hungrier everyday and starving because there is no economic blue print but out of the blues ..BOOM!!! N145 per liter. Pay it or jump into the Lagoon.

To you guys abroad supporting the wicked policies of Buhari on twitter or Facebook, don't think you are exempt from it. The families/relatives you left behind in Nigeria are going to suffer it too and you would be getting daily calls from Nigeria for you to send Western Union because "Hunger they catch them". The money you intended to use to do something good or feed your family would finally end up in a petrol station in Lagos till you finally get fed up.

NLC over to you. We would join you whenever your ready to shut Nigeria down with #OccupyNigeria 2 to make Buhari reboot his brain and reverse his archaic and medieval 1984 economic policies.

If it is a Biafra issue he would lam blast them and detain people indefinitely , he would call Niger Deltans Pipeline vandals and send the military to Deal with them, he would call Nigerians corrupt at home and criminals abroad but when it's his Fulani herdsmen murdering innocent souls round the country, he would choose to negotiate and discuss with them at the background.

No leader would wait for 72hours to halt murderers from wiping out communities. Only Buhari would stand aside, keep mum and allow social media uproar to grudgingly make him call his Fulani homies to order. If he criticized GEJ for being too slow to act as regards the chibok girls kidnap, how is he different as regards these Fulani Terrorists killing people anyhow because of Cows?

If he has acted sensibly after the Agatu massacres, we won't have had these Enugu Murders. It's just sheer irresponsibility on the part of Buhari. Anyone here defending him for allowing these murders go on because he is an unabashed Buhari supporter but insulted GEJs poor handling of Bokoharam is a hypocritical lunatic.

Absolute nonsense. What of American hiphop artists that sing Thrash but make millions selling such nonsense. When Nikki Minaj sang 'Anaconda', did you complain about the lewdness and ridiculousness of the song? I am sure you had it on your play list and bopped to it everytime you put your earphones into your ears. Does that mean Americans should be blamed for the low quality of the message of the song and should be bashed for liking it? What about people like Jay Z, Tupac, Biggie, Lil Wayne and a host of gangstar rappers that sing songs about shooting nigg**s, ghetto violence and calling women Bitches? Should the American consumer also be blamed too?

Bottomline is that music these days is all about commercialization. People invest in these artists and they expect to get their returns back. People pay for studio time, music videos, producers, directors, cd printing, managers, dj, vjs, lawyers, managers etc and its costs a lot of money to produce a single song. If at the end of the day they have to sing low quality songs that people like to get their returns so be it. Are you the one feeding their families or paying for all the things i listed above? Please free Olamide and Davido. As long as people are ready to dance "Shoki and Aiye" all the day long, Nigerians are fine with the thrash they sing.

Besides with all the fuel scarcity and Hardship Nigerians are facing daily, who wants to listen to melodious Dare Art Alade Song now to add to my sorrows? I would rather listen to a thrashy "shakiti bobo" song that would make me forget my problems.

What are Buhari supporters trying to defend here? The Lagos-Calabar Railway was NEVER INCLUDED in the Budget presented. So why would you remove something that was never there in the first instance? Even if you discuss it privately with Amaechi and all the NASS members, as long as it wasn't in the initial padded Budget, there is no need to spread lies that it was removed or SS/SE Senators did not fight to get the railway included in the budget. It was never included in the first place. All these lies and propaganda must stop. Its getting to much and it reeks of desperation of an unpopular government.

If the budget wasn't initially padded from the beginning to steal billions of Naira secretly, all these back and forth of the budget won't be there in the first place. The sheer level of corruption and mind boggling sums of Money that was to be voted and padded to these Ministries is unbelievable coming from a Government claiming to to fight an Anti corruption war and we thank the NASS for exposing these corruption Buhari wanted to unleash on the Masses through his first Budget presented in December 2015

I also saw a picture of Buhari and Osibanjo studing the new budget and APC media stupidly made it viral as if they were doing us a favour. Have they forgotten so soon that Buhari just 4 months ago presented to the NASS and whole world the most fraudulent budget ever in the midst of media noisemaking, pomp and pageantry. Buhari presented that corruption ridden budget HIMSELF and called it a "BUDGET OF CHANGE". When the budget was discovered to be a fraud, sham and www.budgetit.com exposed their hypocrisy, Buhari secretly withdrew the Budget which led to issue of the missing budget. Today APC and Buhari are now pretending as if they did not present a budget of yams but are patting themselves on the back for reviewing the new budget before it is signed.

Buhari is like a student who presented his homework to his teacher and the teacher discovered he cheated and returned his homework back him to redo it but this time, he is letting the whole world know he is redoing his home work and should be applauded for it.

Properties / Court Remands Lekki Gardens MD, Contractor In Custody by lawyer(m): 5:59pm On Mar 11, 2016
The Ebute-Meta Magistrate Court has remanded the Managing Director of Lekki Gardens, Mr. Nyong Richard, and a contractor, Odofin Taiwo, in police custody for their role in the collapse of a five-storey building in Lekki, Lagos.

The building, which was under construction had collapsed on Tuesday, killing 35 people and injuring several others.

Magistrate, Mrs. Afolashade Bokotu, ordered that Richard and Taiwo, who were brought to the court in handcuffs earlier today should be kept in police custody at the State Department of Criminal Investigation, Yaba for the next 30 days, pending the conclusion of police investigation.

I said this in a previous thread and i am reposting what i think about Lekki Gardens. If we truely want to fight corruption, it should start with people like Richard Nyong and his band of greedy murderous Developers.

I have chosen not to talk about Lekki Gardens a long time ago when i investigated them and found so many illegal things they were doing. They used aggressive marketing to sway people to buy their substandard carcasses and made billions from them. They knew Nigerians like awoof and took advantage of their greed. A cursory inspection of their houses was glaring enough to see that these were substandard shell structures that violated so many rules of building but people chose to follow the cheapness and bonanza in exchange for pain.

Apart from the defects in their title and arrogance of the management when you tell them to produce documents to validate their claims, their contract of sale is nothing to write home about. It makes you a slave to the management and you can do very little about it. Thier service charges and outrageous bills made life very difficult for the subscribers and they have very poor customer service. Its all about the money.

I had a client who contracted me to investigate a property he paid for and what i discovered made me shudder at the magnitude of fraud and negligence practiced by Lekki Gardens behind the scenes. The company is more like a ponzi scheme where they advertise properties to buy into Phase 6 but they have not finished completing the houses paid for subscribers of phase 2. They use the money obtained from future subscribers to finish up the early subscribers and before they get to phase 6, they would have started marketing Phase 14. Its all about aggressively getting your money.

Those who had issues with them know the problems they are still encountering to get a refund. They have stringent clauses in their agreement that makes it very difficult to get a refund once you pay and it could take months or years before you see a percentage of it.

Lekki Gardens was a good idea but the greed of the promoters has led them to this quagmire. How can you remove the seal of the Government to stop work and continue the construction and expect to go Scot free? Underhand tactics and violations of building laws is a trade mark of Lekki Gardens. For those still subscribing, it best you struggle to get your money out now fast because the future looks bleak. For those who were thinking of buying into their schemes, better look else where unless your money would be used to settle the impending class action and wrongful death suits.

The death of the 30 people should not be washed away. This is not a case of fraud or negligence. People died because of their underhand tactics to get money at all cost.

Typical Omoniles. All brawns and no brains. They would do everything to cheat you out of your money illegally but when they finally get the money they would spend it on frivolous things such as marrying new wives or spending it lavishly in beer palors. Some are so stingy with the money that they would hoard it from their immediate family and friends. Worst part of it is that despite the huge sums they make from land transactions either legally or illegally, they still live like poverty struck hobos in shanties. You hardly see them building good apartments or sending their kids to the best school. To them it's operation chop everything finish today and beg tomorrow for more. That's why they are the most dangerous people to deal with and you must be very careful when dealing with them.

Last week I met an Omonile who duped over 20 people at Ibeju a Lekki near the free trade zone. He resold the lands to different people who refused to take possession and made over N36million in 3 years. When the buyers discovered he duped them, they arrested him and he confessed that out of the N36million, he gave only N40,000 to his elder sister. His elder sister thought he sold only one land for N400,000 and he was giving her 10% of her share. His immediate children had no idea their father sold their inheritance without their consent and upon further investigation we discovered that he even resold his late wife's grave and used the money to marry 4 new wives.

The bottom line is that before you deal with an Omonile or these kind of people, make sure you investigate them properly because they would just chop your money and would never refund you. They are heartless scallawags that would turn your life savings into tissue paper if you don't verify them and the lands they claim to own.

Hello Lawyer, don't know if this is the right thread to ask but let me just shoot my question.
Please how can an investor protect him or herself from real estate developers that build blocks of apartments and directly sells to the public in units? Most time the apartments are expected to be finished in a year or two but in an event where unforeseen circumstances occur and the project cannot be completed like, death of the CEO, delays in raising the needed funds within the stipulated periods thus costing in building increases or maybe outright fraud. What can be done to protect yourself/money against these situation.

Everything needed to protect yourself is in the Contract of Sale. There are certain covenants that must be adhered to irrespective of the following disasters you have highlighted above to protect you. Before you sign the contract of sale, get your lawyer that is well versed in Real estate matters to vet it for you to include or remove clauses that would be beneficial or destructive to you.
