Bros,

Avengers are the "cowardest" and the weakest of the lot. They only know how to sneak in and blow pipelines or shoot and runs away. When the Military swooped in on them after dealing decisively with them in Magboro, they quickly beat retreat. The operation crocodile smile crept in on them and they saw a glimpse of what to come, they now shamelessly concede to negotiations.

Why has virtually every eminent Nigerian they've nominated to represent them at negotiation declined?

I can tell you they have been doing that over 20year+. They took control of a state, have a "government" of their own not subjected to the state government. The 1999 constitution guarantees freedom of worship, freedom of association as well as freedom of movement. Any law or announcement by any person that goes contrary to the provisions of the constitution is null and void. Let the government take them to court for associating under the IMN banner and let us see which court and under which basis the organisation would be declared as illegal. The government of the day is simply involved in extrajudicial killings which they will ultimately answer for. Everything El-rufai has done so far is purely illegal. It has been a further futile attempt at covering the massacre of innocent nigerians and the dumping of their bodies in mass graves. They know that the day of reckoning will surely come. The government hope that by continuing to persecute these people, they will cow them into dropping their demand for justice against the massacre.
1. The constitution DID NOT guarantee "freedom of procession". please show where the constitution guaranteed that
2. Any "freedom" stated is subservient to the maintain of peace and security in the country or state.

My problem is that this government doesn't understand the sensitivity of international politics in handling issues like this. The very moment Shiites was banned, the govt opened herself as immortal enemy to Iran. We need to be very careful here. I think overzealous religious folks like El RUFIA and PMB should tread very carefully here. When people accused PMB of been a religious fanatics, this Shiites ban has proven it once again.

The govt can't afford to be fighting boko, Avengers, Peaceful IPOB, Herdsmen and now the most lethal amongst them, IRAN all at the same time.Wisdom is key here.

Politics › Re: Arrest Warrant Issued To SSS To Search And Arrest Judges (photos) by mapet: 9:03am On Oct 13, 2016
comos:
The Chief Justice of Nigeria, Justice Mahmud Mohammed met with president Muhammadu Buhari at the presidential villa on Sunday night by 11pm, a Source has told LeadersNG.

It was revealed that the main reason why the CJN met with the president was the arrest of two Justices of the Supreme Court by operatives of the Department of State Services (DSS) over allegations of corruption.

We were told that a furious Justice Mohammed wanted to know why the president sanctioned the abduction of two justices of the Supreme Court in the middle of the night from their homes. It was also learnt that the CJN confronted the president about the motive of the arrest since he had earlier reported to the president about an attempt to bribe the two arrested Justices by one of his ministers, Rotimi Amaechi sometimes in January, 2016.

According to the source, sometime in January, 2016, the Minister of Aviation, Rotimi Amaechi in the company of a serving Director of the DSS had approached the two arrested Justices of the Supreme Court – Justices Sylvester Ngwuta and John Okoro at the home of Justice Ngwuta at the Judges’ Quarters in Abuja to help compromise the Election Tribunal Judgement before his Lordships. They brought the sum of $2million dollars to achieve this. After speaking with both Justices for over an hour on the matter, they called the de-factor president and childhood friend of the president, Alhaji Mamman Daura on the phone who pleaded with the Justices to help as Mr. Amaechi was representing the president on the matter.

It was also revealed that after going back and forth on the matter, the Justices refused to collect the money and later reported the matter to the CJN. The source further stated that the Chief Justice of the Federation that same week reported the matter to the president. Although we learned that president Buhari denied ever instructing Mr. Amaechi to approach any of the Justices and assured the CJN of an investigation into the matter, no investigation was ever carried out to the knowledge of the CJN.

The CJN was heard to have told the president in a very frank manner that all Justices of the Supreme Court know why Justices Sylvester Ngwuta and John Okoro were arrested and that they believe the president wants to undermine the judiciary.

The source also added that president Buhari was on the defensive throughout the meeting claiming he was not properly briefed by the DSS and that he didn’t know the identities of the Justices involved. The president promised the CJN that the Justices will be released by the DSS.

The National Judicial Council is currently meeting now on the matter.

You will recall that on Saturday, the DSS in what it called a “sting operation” in five states across the country, arrested seven judges, including two Justices of the Supreme Court, and five judges of the Federal High Court.

The right thing to do was to petition the NJC and after there are sacked by the NJC ,go after those indicted.

We must never promote tyranny over any guise. There is also a very strong possibility that these men are innocent and the presidency is only going after them for ruling against them
1. First off, you lie shamelessly. Buhari was NEVER in court for certificate forgery.
2. Secondly you demonstrate ignorance of the law. The DSS does not need to go through the NJC to investigate and arrest judges deemed to have committed economic crimes and offenses that threatens the security of the state. I challenge you to quote the section of the law that says the DSS should go through the NJC. The NJC is simply an administrative organ of the judiciary with no powers to do beyond recommendation.

It is better you understand how the law works than just perpetuate ignorance

Yes the government may have been a tad bit extreme in the way it went about arresting these corrupt judges.
But who can say he or she doesn't know that 99% of cases concerning elections, fraud, and human right abuses have not been ridiculous since 1999?
You would see a politician like Saraki or Tinubu get accused of fraud with clear facts yet the cases would eventually be treated like any other regular everyday case and the accused party always goes Scott free except he or she has earned the wrath of the government previously.

How do we grow as a country then? How?
Before alot of you start saying why didn't he follow due process...remember if he does these same judges will influence the outcome.
Lets all be 100% HONEST Nigeria CAN NOT BE PURGED OF CORRUPTION IF WE FOLLOW THE REGULAR CHANNELS
And you all know this:
The police os corrupt
The army , airforce and navy are corrupt
The DSS is corrupt
The FRSC is corrupt
The NDLEA is corrupt
The Customs is corrupt
The Fire service is Corrupt
The Doctors are corrupt
Teachers are corrupt
The Pastors are corrupt
The Layers and Judges are corrupt
The EFCC is corrupt
i could go on and on! Ane we all know this to be true! So when you have every arm of governance corrupt how do you honestly persecute the head of any of these firms and think one would get a correct response?

I honestly feel for Buhari.
How do we grow as a country when everywhere you turn you meet stumbling blocks to change? Do we all give up and wait till a foreign power decides to invade us to kills us off and take over our resources? Or do we use unique measures to try to tackle the crippling corruption?

The truth is, outside of radical moves like this that Buhari is using the only way out would be to revert to Military rule and let them execute the corrupt politicians. But then you would see United Nations Nato and such threaten to invade us and try the Military president for war crimes.
The honest harsh truth is Buharis radical approach is the best we have for now.

If you say no let him resign and honest people rin for political positions, i say to you do you think these corrupt cabals will allow an honest person work? Look at Okonjo Iweala, see how GEJ strangled her till she couldnt work! her mum was mysteriously kidnapped and remember after her mum was also mysteriously found she totally stopped criticizing the buffoon and started doing all she was told, it doesn't take a genius to know what happened there.

MY TWO CENTS
what are you saying sef?? huh

Anyway, you are neither a lawyer nor a Judge. No sound person who has had the pleasure of interacting with the court process with respect to cases, make such claims.

A judge is designed to be Unsentimental, unemotional and as much as possible restrict himself within the scope of reliefs sought in his court; no matter what the stakes are. That is why lawyers are meant to be skillful in both arguing, examining and presenting a case to provide maximum benefit for his client.

Meaning, if you accuse someone in court to be guilty of fraud in court - who can actually be found guilty of manslaughter - it is not the place of a judge to tell you; "this fraud case wont work based on the circumstances sorrounding the case, try manslaughter". He will simply declare the person not guilty and go and sleep. it is the place of your lawyer to examine all angles and advise on best courses of action.

Sometimes, it may even involve not going to court.

It also means that you must be socially and financially bouyant to retain the services of a lawyer to handle your case.

I once had the opportunity to review the charge sheet of a political figure that was 3000 pages - you can't pay me to read any more than 500 of those pages, I go just tire - but a lawyer will receive cash to read all over 3000 pages and summarize and prepare a defence.

The Judge will examine both 3000 pages charge sheet revealing how many count charges and the instances of each count plus documented evidence attached and the x number of pages of defence plus documented evidence attached and make a decision.

So if your lawyer is not well motivated socially and financially, he will not put much effort to read and prepare, he will just speed read and not read in closer detail like his mates who are well paid and that could affect your defence.

And that is why a politician will steal billions and escape with a smack on the wrist from a Judge - because he has the millions to pay a lawyer who has read the matter over and over and knows which technicality to rely on - while a small thief who can only afford to pay coins to lawyers - that may not even fuel the car(s), not to talk of pay school fees - who will just speed read and just do what they can while still using corner of eye to look for politician or better client that will pay better money.

You think Femi Falana was able to pay Falz school fees when he was going to school by defending the poor??

Some of these big law chambers charge as much as #1,000 to #10,000 per hour per lawyer that they assign to handle your case on working days - and a case could stretch for as much as years. Houseboy whey thief money from Oga bedroom can he afford that??

Plus court cases no cheap like that Oooh!! A friend of mine who is late now, was asked to cough up #1.8million just to file a case at the court of appeal over a land dispute he lost at a lower - I come dey wonder, why you no use the money buy another land ni? undecided If to say the people pay am that money for the land, e go dash them the land, carry one of e fine daughter give the guy as bonus seeh cheesy - it is well.

Even if you find, a big law firm handling such cases, they do it pro-bono (free of charge) just as a way of giving back to society and marketing/advertising their services/skills to the rich who may be watching.

That's why you see lawyers like Keyamo and Falana and the rest of them making comments on issues, dey quote all manner of laws and making arguments upandan, they no really care. Them dey sell market; that's all.

But all around the world, lawyers make it big defending the rich and not the poor.....

When Late Gani Fawehimi lauched the Building for his chambers, it was worth #500million. Whether na democracy e dey defend, abi na poor man, abi na rich man e be dey defend make we know..........

The only thing I perceive the Judges are guilty of - which 99percent of police men on the street may be guilty of, which amounts to blackmail and that's why the Judges will protest is this - Judges are designed to live very solitary lives away from society; this is to help them avoid clash of interest as much as possible.

I cannot be playing golf with someone and sit over a case involving him or a case involving my inlaw or a staff of my company and expect to be impartial.

The law regulating their practice requires that they limit themselves from engaging in any other form of commercial activity besides their work..

A judge owning a law chamber or registered businesses pushing for government contract is a complete no no!! The same way a police man driving a danfo bus when he is off-duty is a no no. That why DSS is ranting that they found money in their houses.

Its blackmail and if you look closely, 99% of their cases DSS are claiming they collected money from are poliitical.

The Judges cannot make a defence before the NJC that they own thriving businesses, even though all of them including the Chief Justice of Nigeria do. And that's what DSS is using to blackmail them.

So when people talk about corruption and corrupt judges, what do people really know about Judges?? Do they have family members who are Judges?? They don't, else they would understand what DSS has done wrong.

Even if a judge is corrupt, to point of collecting cash is very very difficult; in short almost impossible. It is a lot easier/understandable to say that a Judge did something in return for a favour.

A case in point, the second to that last CJN, retired a particular judge - I can't rememeber the name but even if I did I won't want to mention it now, considering the current atmosphere - and reviewed some of that Judges cases.

That judge was priviledged to have someone write a biography of/about him - he was close to retirement by some years - esama of Benin kingdom, Chief igbinedion went and paid like #6million at the book launch. The judge didn't even attend the launching.

Many months laters, a distant relation of the Igbinedion family had a case in this man's court and received a lighter sentence - he was charged with some form of fraud along with some other persons - the lawyer representing the Co-accused, whose client got heavier sentences, petitioned the NJC and the CJN and not only was that Judge retired but judges were banned from having their Biographies done while they were still on the bench and that case was reviewed.

So sometimes, things like that could happen. It could be mistakenly - remember some of these judges have a lot to read they are quite old - some may be deliberate but the manner DSS did it was unlawful and that is the truth.

It is equally blackmail because the Judges themselves cannot even sue them without permission from the NJC. They don't have that right, it is that bad.

So they are sitting ducks, una whey dey talk for here. No surprise if Buhari/osibanjo/Lai mohammed dey kneel down dey beg them for background while DSS and ignorant Nigerians dey shout "Corruption fighting Back" without understanding the dangerous precedence this matter will set for the Judiciary.

In any case the battle line has been drawn, only CJN can mediate and beg his Judges not to retaliate, because with the way DSS is going, they have the upper hand. And you know skilled judges in this country are few - judges sef in this country are few - so you can't afford to be sacking judges anyhow.....

Plus! Why has DSS refused to give an official press briefing and is choosing to speak through "A Top intelligence officer" of the DSS??

We all knew maryln oga during Jonathan's time; who is confirming these things officially to the press??

Do you remember?? When Dasuki was taken to court, the EFCC tried to apply for a secret trial when they wanted to called witnesses for the prosecution.

The judges refused on the grounds that what EFCC offered as the facts of the case as well as the witnesses were already on the pages of newspaper and it was no secret and denied a motion for a secret trial.

Instead of this case to proceed, DSS arrsted and re-arraigned Dasuki on grounds of National security in another court - which could prompt a secret trial if a motion is moved - and DSS has refused to release him for prosecution witnesses to be called and the EFCC trial to proceed. You see how blackmail and technicalities works??
For someone accusing another.....yet you came up with a load of crap!!!
1. A judge is NOT designed to be unsentiment, unemotional........... He actually has that as a responsibility. The moment he goes out of line, he's supposed to get the boot and be prosecuted.
2. You need not be socially and financially bouyant before lawyers and judges do their constitutional duty. Where da fvck did you conjure that crap from. Judges are paid from the taxes of every Nigerian and as such is mandated to adjudicate according to the dictates of the law for both the common man and the rich.
3. You try a lot to explain what you don't understand. Judges are trained to go through every facts of argued cases and interprete in line with the law. The number of pages and financial motivated arguments of lawyer is irrelevant. A judge is employed and paid to read those "3000 pages" THAT IS IS JOB and nothing special
4. It is unfortunate that you cannot comprehend how lawyers make money. This is simple to decipher, but you turn logic up it's head. I'm not suprised, you're simply an uninformed "spectator". Lawyers do legitimately make good money. for example aside litigation, Lawyers are on retainer-ship with coys and also publications. Gani made legit millions from Weekly Nigerian Law report publication, before other lawyers saw the opportunity. The desk that published the weekly law report grew to be a publishing coy on its own
5. I'm suprised that you cannot establish the nexus between lawyers defending the poor and shoring up their profile to attract big investors. Festus Keyamo started out as a defender of the poor, especially during the days of Abacha. That brought him to lime-light especially when he challenged Daniel Kanu (the Youth Earnestly Ask for Abacha crook) to a national debate. Later on Oil communities started soliciting his services and one day Chevron became his client.

Just straight British education all through, and I have hommies who would blow her out of the water with their mountain of qualifications from a diversified pool of education.
I am not in the finance game, but comparing where I am to where she is education-wise, I am not far-off. And I have the advantage of age.
......Yet she's the minister of finance and you are who?........a statistic on NL grin

For your mind now you are making sense. abeg move one side my friend. rubbish. constitutional lawyers have been condemning the act. stay there and be forming na me sabi pass. rubbish, talking about Uni in Abacha's days. I dont have a problem with arresting the judges but not in an illegal manner. the NJC is where this should have originated from. Jibrin has been crying night and day with evidence no one has even invited him. You pretend to know yet you know nothing. mtshewww
1. This is what happens when you send your brain on holiday and allow people to do thinking for you. You're young (I hazard a guess), you should be smart to think and not just gobble up things because "constitutional lawyers" says this or that. I asked you a simple question. Show us in law what sections of constitution or Act was contravened by the DSS.

2. The NJC is where this should have originated from? Sometimes some of you lot just throws gaffes without seeking facts. The laws are clear. The DSS needs no permission of the NJC before carrying out investigation and subsequent arrest of judges found to have contravened the law and such within the remit of the DSS. In my assumption that you're too laid-back to read beyond headlines, let me quote of the "constitutional lawyers" interpretation

is it mandatory for law enforcement agencies to go through the disciplinary instrumentality of the NJC before taking actions against the erring judicial officer?

There is nothing in the provisions of Paragraph 21 of the Third Schedule to the Constitution that precludes law enforcement agencies from investigating, arresting, detaining or prosecuting a judicial officer in Nigeria for alleged corrupt practices or for other sundry offences. It is my view that a contrary interpretation will have the inescapable effect of conferring an extra-constitutional immunity on judicial officers.https://www.thecable.ng/crackdown-judicial-officers-separating-law-sentiments

Did you read the press releases from the DSS.
I am asking for where in law the DSS needs the permission of NJC to carry out arrest of Judges, you're asking me press release. Where in the constitution or Acts or any legal interpretation

Your talking a lot but ain't saying anything.

The point is that the DSS is wrong.
How? Show which part of the law they broke. Show which section of the constitution or Acts they contravened
