The Indigenous People of Biafra, IPOB, has asked Justice John Tsoho, the Judge handling their leader and Radio Biafra Director Mr. Nnamdi Kanu’s case, to resign, just as it has asked the National Judicial Council, NJC to force him to resign and discipline him to stop alleged ridiculing the Nigerian legal system by quoting unrelated Ivorian law, a Francophone country practicing a different legal system which does not apply in Nigeria.
IPOB United Kingdom branch after its monthly meeting in a statement signed by its spokespersons Emma Mmezu and Dr Clifford Iroanya, said the Judge in justifying his alleged dramatic u-turn on his previous ruling, before he allegedly “subjected himself to the whims and caprices of the All Progressives Congress, APC, led government of President Muhammadu Buhari, and now appear to be under pressure by the government, ruled that witnesses should be hidden from the court.

Accusing the judge of inconsistency in the way he is handling the proceedings, IPOB said “today the Judge will rule on one thing and tomorrow he changes his mind in the next sitting on the same thing, how can we trust such a Judge”.
“In justifying his dramatic u-turn on his previous ruling, this Judge who appear to be under serious pressure from Aso Rock ruled that witnesses should be hidden from the court. How can we trust a judge that rules one way and changes his mind at the next sitting” they said.
Also the IPOB Media and Publicity Officer, Mr Emma Power, while addressing newsmen after their meeting in Nnewi called on Justice Tosho to resign from the case to save his face and the face of the Judiciary in Nigeria because the world has started mocking Nigeria judges for his alleged inconsistency he has displayed in Mr Kanu’s case.

“You see we respect Nigerian Judges who have shown respect to themselves, and the same thing is happening in their so call anti-corruption cases where court orders are not respected, known laws are being turned upside down by judges like this one, just to impress a government or one person, this will not continue, he must resign so that others will take correction” he said.


Continuing, IPOB United Kingdom called on the National Judicial Council to discipline Justice Tsoho for him to stop ridiculing the Nigerian legal system, especially, on his inconsistent ruling and quoting unrelated Ivorian law, a Francophone country practicing a different legal system to what obtains in Nigeria.
“We know that Nigeria has respected and respectable Judges who does not look at the face of the President or consider the feeling of the Federal Government and the Attorney General and Minister of Justice before they give their impartial and incontrovertible rulings, and for this the Nigerian Judiciary and NJC should maintain the dignity of such judges by disciplining Justice Tosho before he becomes an embarrassment.

“We want to equally tell Him and Judges like him that eminent, respected and respectable Judges does not earn respect by impressing or trying to impress government and President in power but through the incontrovertible and flawless rulings and judgements they give, those who dance to the tunes of government and President in power end up being disgraced by the same government they worked to impress right or wrong” they said.
IPOB called for the dismissing of Justice Tosho before he becomes an international embarrassment to the legal profession in Nigerian legal profession, adding that IPOB and Nnamdi Kanu’s case has become an international legal test case for Nigerian Judges and Tosho will definitely mess Nigeria up.

IPOB alleged that without appealing a court ruling the Judge changed his mind, thereby turning his previous ruling upside down without adherence to the appeal process. Ipob do not have any iota of trust in the capability of John Tsoho to handle such high profile case because of his blatant disregard for rule of law, and his judicious interpretation in this matter is becoming alarming.

“This judge is acting like the prosecuting Attorney rather, than a judge. All over the world reasonable people will be wonder where such judge comes from. We have no trust in his continued participation in this matter and advice the Chief Judge of the Abuja High Court to replace him with immediate effect” they said.

The National Assembly is set to go against President Muhammadu Buhari on the N1.04 trillion fine against the mobile network provider MTN for selling unregistered Subscriber Identification Modules (SIM cards).

President Muhamadu Buhari on Tuesday, March 8, directed that the Nigeria Communications Commission (NCC) should give room for the fine on MTN to be renegotiated.
However, the House of Representative on Wednesday, March 9, insisted that MTN must pay in totality, the N1.04 trillion imposed on it by the NCC in October 2015.
The chairman, committee on communications, Saheed Akinade-Fijabi (APC-Oyo) said that the fine if paid will redefine the relationship between the telecommunications operators and the regulator. He said that the N50 billion paid by MTN as a down payment for negotiations out of court was not adequate to make up for allegedly undermining government’s efforts to tackle security challenges in the country.

“The law is there to serve as deterrent for you not to go against them.” MTN has been trying to circumvent the process and find a way of running away from the law instead of them facing the music.” A member of the committee, Johnson Agbonayinman (PDP-Edo) said that MTN violated sections 19 and 20 of the Telephone Subscribers Regulations under the Communications Act 2010. Section 19 of the Act reads: “Any licensee who fails to capture register, deregister or transmit the details of every individual or corporate subscriber to the central data base as specified in the regulation or as may be stipulated from time to time by the Commission is liable to a penalty of N200 000 for each subscription medium.

“Therefore MTN’s failure to deactivate 5.2million SIM cards should be liable to a fine of N2.8 trillion,’’ Agbonayinman said. However, the Executive Vice Chairman of the NCC, Prof. Umar Danbatta said that the commission was committed to ensuring compliance by telecommunication operators to register all SIM cards in the country. “SIM card registration is a continuous process. There is ongoing registration exercise by all operators and NCC will do enforcement checking to ensure compliance,’’ he said. Meanwhile, he said that NCC was not in receipt of the N50 billion so far paid by MTN.
“I do not know the account where the money was paid into. The commission only received a letter from the Attorney-General of the Federation indicating that MTN had paid the amount into the federal government account,’’ Danbatta said.

In a related development, the Senate summoned the minister of communication technology, Adebayo Shittu and the attorney general and minister of justice, Abubakar Malami, to explain their roles on the reported payment of N50 billion out of the N780bn fine on MTN Nigeria. The chairman of the Senate committee on communications, Gilbert Nnaji announced the invitation of the minister as well as the executive vice-chairman of NCC, Umar Garba Danbatta, the accountant-general of the federation, Ahmed Idris and the chief executive officer of MTN Nigeria, Phuthuma Nhleko.

ABUJA–Minister of State for Petroleum Resources, Ibe Kachikwu has stated that government has not unbundled the Nigeria National Petroleum Cooperation, NNPC yet.

Explaining the development at the oil sector in an interview with State House correspondents after the meeting of the Federal Executive Council, FEC, at the Presidential Villa, Abuja, the minister who is also the Group Managing Director, GMD of NNPC, said that what the cooperation did was reorganization.

He said: “We have not unbundled NNPC. We had a press conference yesterday where I explained this.
What we have simply done is reorganisation.
We have five business entities focused on business: Upstream, Downstream, Refineries, Gas and Power that are there before. “There is also Ventures that capture all our little companies that were not having proper stewardship. They are run by individuals who report to the GMD. The NNPC is still a whole. There is nothing new that has happened.

“I have tried to explain this and I am sure the NNPC workers are members of the family, they will understand. We are going to have a meeting, and they will be made to understand.
Perhaps the engagement has not been good enough. “NNPC has not been unbundled in the sense of breaking up NNPC into distinct institutions. I am concerned. I don’t want the industry shut down. I am sure we are going to resolve the issues very soon”.

ABUJA- THE Senate has begun the process into the probe of the decision of President Muhammadu Buhari to unbundle the Nigerian National Petroleum Corporation, NNPC In a point of Order by Senate Chief Whip, Senator Olusola Adeyeye on the floor of the Senate today, he drew the attention of other Senators to the unbundling of the nation’s agency in charge of the oil and gas sector in the country.

The House of Representatives yesterday gave 48 hours to the Director-General of the Department of State Security (DSS), Lawan Musa Daura to appear before it to explain reasons for their invasion of the Ekiti State House of Assembly complex.
The lawmakers, in adopting a motion by the minority leader, Leo Ogor (PDP, Delta), said such actions by the DSS were in “clear violation of the provisions of the constitution.”


Orog, who came under matters of urgent national importance, said the invasion by the agency to the Assembly complex was “unacceptable” and goes to demonstrate interference of an arm of government.
“If somebody violates the law,” Ogor told the House, “and nothing is done, it gives him the privilege to move forward.
“Therefore, it is important that we summon the Director-General of the DSS to explain where the agency derived its powers to invade and destabilize the activities of the House.
“It is important to respect the rule of law and the sanctity of this institution must remain sacrosanct.”
After the motion was unanimously adopted by the lawmakers, speaker of the House Yakubu Dogara referred the matter to public safety and intelligence committee for further works.

The Cameroonian government has allegedly forcefully taken over parts of Akwa Ibom State not covered by the original judgment to cede part of the Bakasi Peninsular to the Central African country following a decision of the International Court of Justice (ICC) in The Hague in 2002.
More than 350 oil wells and fishing pots have consequently been seized, depriving Nigeria of potential revenues from these assets.

It is reported that the people of Effiat clan in Mbo Local Government Area of the state claim the Cameroon government in a desperate attempt to cede their communities have lured their village heads into accepting Cameroonian citizenship with documents acknowledging their headship.
The Cameroonian government, which has for sometime now claimed some parts of the state, are said to have operated through some greedy village heads whenever the people resisted paying tax to their government.

These village heads are said to have been issued ‘documents of acknowledgment’ with letterheads of the Republic of Cameroon.
Etim Okon, an Indigene of Effiat Clan, in a chat, suspects that the documents issued by the Cameroon authorities are fake, adding that they do this to get the people’s consent and to present the territory as Cameroonian territory as border demarcation between Nigeria and Cameroon is ongoing.

The Cameroonian gendarmes, according to Okon, have taken absolute control of the Akwa Ibom territories, which had never been a part of the islands the Federal Government ceded to Cameroon.
“None of the Effiat 16 villages had been ceded to Cameroon when Bakassi Peninsula was ceded to Cameroon by the International Court of Justice at the Hague in 2002,” he said.
He added, “Effiat is an area in Akwa Ibom State and not part of Cross River, where Bakassi Peninsula became an issue.”
Further investigations revealed that the mangrove island, which hosts 16 villages of Effiat clan in Mbo, is currently under the administrative control of the Cameroon authorities.
It could be recalled that the member representing Mbo State Constituency in Akwa Ibom State House of Assembly, Mr. Samuel Ufuo, last week, presented the issue as matter of urgent public importance to the House, saying that Cameroonian gendarmes terrorise, dehumanise, and deprive the people of their rights and privileges.

The lawmaker noted that a former member who represented the area in the National Assembly, Robinson Uwak, had in January 2015 alerted the Federal Government of the situation in Mbo, but no action was taken since then to demarcate, properly, the maritime boundary between Nigeria and Cameroon as determined by the International Court of Justice (ICJ) during the settlement of the ownership of the Bakassi Peninsula in 2002.
President Muhammadu Buhari, during a visit to his Cameroonian counterpart, Paul Biya, shortly after his inauguration as Nigeria’s president a year ago, assured that the country will continue to abide by the ruling of the ICJ on the Bakassi Peninsula.

He had assured that his administration would ensure the faithful implementation of the Green Tree Agreement, which regulates the ceding of Bakassi to Cameroon.
The state lawmaker maintained that none of the 16 mangrove islands were part of the territory ceded to the Cameroon government by the world court during the Bakassi Peninsula issue.
Ufuo, whose position had earlier been mirrored by Uwak during his presentation to the House of Representatives the previous year, stated with sadness that the affected natives have lost their sources of livelihood.

The Mbo mangrove has approximately 350 oil wells and several Fishing routes believed to be coveted by the Cameroon government.
It was gathered from the record of the votes and proceedings of Wednesday 14 January 2015 of the 7th House of Representatives then led by Mr. Aminu Tambuwal (now Governor of Sokoto State) that the House had made three resolutions on the matter which include setting up an ad-hoc committee to investigate and report within 30 days (beginning from 14th January 2015).

Others were to urge the attorney general and surveyor general of Nigeria to submit all relevant instruments being used in recent delineations by international surveyors as recommended by the United Nations, and to strongly urge the Nigeria government to re-assert its sovereignty over the troubled island with the mandate of protecting Nigerians being maltreated by the Cameroonian gendarmes.

The preceding resolutions, it was learnt, was made after the House received a report on the matter by the then member representing Oron (Oron/Mbo/Okobo/Udung Uko/Urue Offong Oruko) Federal Constituency, Uwak, where it was not only pointed out that the disputed islands were not part of the territory ceded to the Cameroon government by the International Court of Justice (ICJ) during the Bakassi Peninsula issue, but also that the encroachment has led to the loss of about 350 oil wells and gas revenues which ought to accrue to Nigeria.
According to Mr Ufuo, the resolutions were discarded following the electioneering at the time and the subsequent end of tenure the 7th National Assembly in June 2015.

Describing the situation as pathetic, Ufuo said the people of the affected villages are still buying and selling in Mbo and other Akwa Ibom markets, including paying their taxes, boat licenses and other levies to the Akwa Ibom State government.
“Should this annexation by the Republic of Cameroon be allowed to continue after the ongoing demarcation by both countries, Akwa Ibom state and Nigeria as a whole will lose the territory, God forbid, with thousands miles in our coastal water including mineral resources.

“Sadly to note that as a result of the illegal occupation of the islands by the Republic of Cameroon, oil and gas revenues that should accrue to the state and the Nigeria government, employment opportunities to our teeming youths are lost to the Republic of Cameroon.”

Osogbo—Police in Osun State, yesterday, intercepted a vehicle loaded with 14 goats in Ede, headquarters of Ede South Local Government Area, detained the goats, while the driver escaped.

A police source said a team of policemen patrolling Sekona/Nigerian Army Regiment Construction Company Highway saw a speeding red Mitsubishi car, with number plates XF 467 NND at Sekona junction around 1a.m. They ordered him to stop. The driver refused.

It was gathered that the police team, led by one Inspector Ajayi Sunday, chased the driver from Sekona junction to Cemetery Area in Edun-Abon, where the driver parked the vehicle and escaped before the police arrived.

The vehicle and the goats were taken to the station.
Confirming the arrest of the goats, the state Police Public Relations Officer, Mrs Folasade Odoro, said the goats had been detained.
She said the goats would remain in the police custody until the owner(s) showed up, adding that investigation had begun.

A former special assistant to the immediate past National Security Adviser, Sambo Dasuki, Nicholas Ashinze, has sued the Economic and Financial Crimes Commission, EFCC, for allegedly detaining him illegally, demanding N500 million as compensation.

Mr. Ashinze also prayed an Abuja High Court to issue an order declaring his arrest and detention by the EFCC, since December 23, unlawful.
In the suit filed against the commission, the Chief of Army Staff and the Nigerian Army, Mr. Ashinze also asked the court to issue an order preventing his re-arrest.

The EFCC accuses Mr. Ashinze of diverting funds meant for the purchase of arms by Mr. Dasuki.
He was arrested by the commission on December 23, 2015 for his alleged involvement in the diversion of $2.1 billion by the former NSA.
Mr. Ashinze has remained in the custody of the EFCC since his arrest, without been charged to court.

His counsel, Mike Ozekhome, filed a fundamental rights suit before Justice Yusuf Halilu of the Federal Capital Territory High Court seeking his immediate release from the custody of the EFCC and a compensation of N500 million.


He also asked the court to grant him bail on self-recognition, since the other parties to the matter, the Nigerian Army, and the EFCC, were not present at Tuesday’s sitting.
The judge adjourned the matter to March 14.
