Ambrose Ali may have been pardoned by the Gowon military government in connection with the pardon granted Awolowo over his treason conviction. I don't know if Ambrose Ali was also convicted for treason or lesser charge alongside Awolowo.

The question to ask is if Ambrose Ali was ever convicted in any criminal case prior to the July counter-coup.

The pardon granted Ali posthumously was for his conviction for corruption by a Military Tribunal in 1984.

A former Deputy National Publicity Secretary of the All Progressives Congress (APC), Comrade Timi Frank, has made more startling revelations about the ongoing looting that is capable of sinking Nigeria.

Comrade Frank made the revelations via his verified Twitter handle on Saturday as he described the cabal running the government as a profit making bunch whose only interest is to loot the treasury dry.

Sir, what do you make of this administration’s established propensity to always put the cart before the horse, in making major polices that should be backed by law. What is becoming the norm at the federal and state level is, pronounce the policy first, then scramble around for the enabling law?

The  nation was under all manners of military dictators for close to three decades.  Even though civil rule was restored 21 years ago, the leading characters in the democratic  structures are either former military rulers or those who had served under them. In fact, there was a time the President, the mnister of defence, minister of police affairs, national security adviser, chief of staff and chairman of the ruling political party were all retired generals. So, the civilian government was a quasi military regime. Even though the number of former military rulers has been reduced the mindset of the political and security chiefs has not changed. Public officers are still sacked with immediate effect while people are detained for months or years without trial. The Buhari administration has never hidden its disdain for the rule of law. In some interviews President Buhari has expressed frustration with the slow speed or the accountability prerequisite of a democratic dispensation. The regime has openly justified disobedience of court orders under the pretext of defending national security. It does not seem to appreciate that the security of the State is maintained under the rule of law. Even when the regime was compelled to release Omoyele Sowore and retired Colonel Sambo Dasuki from illegal custody last December based on court orders. it came out to say that it was an act of compassion or generosity. With such praetorian mindset the regime does not consider the legal implications of its actions and policies. Since the dramatis personae in power believe in the rule of might, the government is bound to take decisions without the backing of the law. We are ruled by individuals who believe in the rule of rulers and not in the rule of law.

You no longer sue government for illegality and unconstitutionality of actions, with the same frequency of the past, unlike your mentor, late Gani Fawehinmi, who didn’t stop taking government to court until his death. You appear to have mellowed into advocacy and jurisprudential guidance. Why?

I am afraid your information is not correct. Recently, a bunch of paid lumpen elements staged a protest against me in Abuja for purportedly using the courts to blackmail the federal government. Can you believe that? The fact is that due to increasing wave of official impunity of the government, I have filed  more cases in court than ever before.  Unlike in those days when all our public interest litigation cases were dismissed for want of locus standi the situation has changed due to our persistence and doggedness. We have recorded some huge success in using the instrumentality of the law to challenge official impunity in the country. For instance, our law firm won the case over the right of every child to free and compulsory basic education at the expense of the State. We have won the case to have the People’s Bank restored.  We have won the case that stopped a contractor from collecting cerpac fees from all expatriates in Nigeria.  We have won the case against the regulation banning  police women from marrying suitors of their choice without written permission of a commissioner of police. We won the case against obtaining police permit for rallies and demonstrations by aggrieved citizens and groups. At the same time we have lost many cases while others are pending in courts. One of the cases which we lost at the federal high court has to do with the right of Nigerians to basic health. The case was struck out due to lack of locus standi.  We are pursuing the appeal in view of the threat posed to the health of all citizens by the coronavirus pandemic. In many instances, our public comments and those of others have forced governments to reverse certain illegal policies and unpopular programmes. In such circumstances, we have refrained from going to court.  I am sure that is what you mean by saying that I have resorted to advocacy and jurisprudential guidance.

The presidency of Major General Muhammadu Buhari rarely yields to advocacy and plea, which possibly explains the refusal to withdraw soldiers from COVID-19 regulations enforcement duties despite the killing of innocent Nigerians with their guns. How does one tune the ears of a government like this to the voice of reason?

Whenever the people have persisted in their demand or agitation the regime has been forced to change its position.  For instance, the regime had supported the State Security Service in the illegal incarceration  of Mr. Omoyele Sowore. But when the demand for his release in and outside the court was intensified the regime caved in and released him. Colonel Sambo Dasuki, who had been held for four years was also released. Even with respect to the coronavirus pandemic the regime had said that President Buhari would not address the nation. But when the demand continued the President had to make a broadcast. The soldiers  will be withdrawn from the streets if the pressure is mounted on the regime. While Covid 19 has claimed 6 lives the securify forces have killed 13 people. But for the lockdown I would have rushed to court. I am sure you would recall that I got the federal high court to restrain the armed forces from subjecting Nigerians to the so called positive identification parade last year.

Your regular interventions in public matters suggest two things: it is either the government operators are naive in the matter of constitutional democracy or they just want to be deliberately unconstitutional in their ways. Are dangerous precedents not being set sir and is this not a pointer to the quality of men being elected into public offices?

I have found that many actions of governments are not borne out of mischief. They are based on sheer ignorance. You may call it political naivety. That is what is playing out in the United States where President Donald Trump exhibits such degree of ignorance mixed with arrogance. Contrary to the Linconian definition of democracy as a government of the people by the people and for the people, bourgeois democracy is generally a government of oligarchs or cabals. The crisis of governance is more problematic in a country like Nigeria where democratic structures are weak and the people are not conscious of their rights. With respect, we are largely ruled by ignorance and incompetence. And you know that power mongers who are ignorant are incompetent. Hence they resort to impunity. That is what leads to corrupt practices  in the criminal diversion of public funds, rigging of elections and setting up of a government without regard, in utter breach of constitutional or statutory guidelines.  No regime can change the status quo without involving the people in governance.

The West, particularly, America, returned a damning verdict on the 2019 poll, indicting the military heavily. Since this administration appears to always step out of line in the matter of military deployment, what are those concrete steps, in definite terms, that could be taken by stakeholders before a degeneration would lead to a catastrophe?

The West should not  be the barometer for measuring credible elections in Nigeria. Many local organisations have meticulously exposed the monumental fraud that was perpetrated during the 2019 general election. The most disturbing aspect of the fraud was the use of armed soldiers by the ruling party to intimidate voters. Under the Jonathan administration, the APC filed three cases against the use of soldiers in elections. The APC won the three cases. Little did we know that the APC  was looking for power to use armed soldiers to rig elections like the PDP for whom an election was a do or die affair. The dangerous trend is going to continue unless the Electoral Offences Tribunal is set up to deal with the riggers and manipulators of elections.  More importantly, politics has to be redefined so that political parties can be positioned to serve the interests  of the people.  Right now, politics  has  become a cheap avenue for self enrichment and self aggrandisement. It has nothing to do with  public service.

 Have you seen enough transparency in the distribution of palliative at the federal and state levels, particularly the open money-sharing venture of agents of the central government?

The federal, state and local  governments were not prepared for the kind of emergency that the nation is going through. The  mechanism put in place for reaching out to the people under the Special Adviser on Social Investment, Mrs Maryann Uwais, has been abandoned  by those who wanted to abolish the programme. The cash transfer policy of the federal government was ridiculed by the media, neoliberal ideologues in the government and the private sector people.  Some of the business tycoons who are indebted to the  Asset Management Corporation of Nigeria (AMCON)  to the tune of over  N5 trillion have questioned why a loan of N10,000 should be given out to a rural person. Those who ran commercial banks aground and plunged the country to toxic debts conspired to scrap the People’s Bank. Even though the federal high court has ordered the federal government to restore the bank the neoliberal handlers of the economy have continued to frustrate the revival of the bank. But the same people are now contributing to the fund being packaged by the federal government to cushion the negative impact of the coronavirus pandemic on the poor and vulnerable segment of the society. Having abandoned the people the governments cannot effectively manage the palliative. The process of distributing the process cannot be transparent because the government is administered on the platform of opacity and secrecy

If recent reports of the success recorded by Chadian troops against the Boko Haram terrorists are anything to go by, then it would be taken that the Chadian forces used a new approach that had never been seen before. 


Codenamed “Operation Boma Wrath," Chadian troops were said to have launched an attack on the terrorists, following an attack on their military base on March 23 by Boko Haram in which 98 Chadian troops were killed. 

The revenge attack was adjudged a success because the Chadian troops killed many of the insurgents, destroyed five of their bases and many of their bunkers where its top commanders were hiding and recovered thousands of weapons from them.


Few of the surviving insurgents were said to have ran to Nigerian territories to escape been killed.


But if the Chadians had this  offensive strategy against the Boko Haram terrorists who have been taking refuge in their territories for several years why are they unleashing it only now? 


The answer is not farfetched. Chad did not use any new approach in military warfare. 

That it decided to come out against the insurgents now has more to do with the relationship between the Chadian president, Idriss Deby Itno and the insurgents.


Long before now, Chad had been engulfed in internal crisis for many years and many of its rebels frequently found themselves in Northern Nigeria.


Driven by hunger but with guns and other weapons at their disposal, they wreaked havoc on several Nigerian communities, seized their food supplies and extended their heinous criminal activities to highway robberies. They were known as Kwanta Kwanta due to the language they deployed in their operations.


With the advent of the Boko Haram, especially with the killing of Mohammed Yusuf, top commanders of the sect that were seeking revenge against the Nigerian State were mopped in by the Chadian rebels and in no time the latter surrendered to the command of the Boko Haram because it had more resources and an identifiable structure.


Chad therefore became an important operational base of the terrorists with the knowledge of the Chadian goverment.


The Chadian President had used this relationship to his advantage to demand financial support from Nigeria before.

But the relationship between Boko Haram and Deby went sour in recent times mainly because the Boko Haram were no longer economically useful since nobody was paying to have them kept at bay as was the practice during its early days and secondly, they were becoming a nuisance to their host communities. 


The recent killing of the Chadian troops by Boko Haram broke the proverbial back of the camel and the Chadian government had to turn its gun on the terrorists.


The swift manner the exercise was carried out however raised the questions about the  approach used which saw the Chadian troops waking up one day to round up the terrorists in a singular attack.


Some say this is because the attack was led by the Chadian President himself and would want Nigeria to emulate that.

Those advancing this line of thought forget that about the same time that the Boko Haram attacked the Chadian troops killing 98 of them, the theater commander of the Operation Lafiya Dole, Major General Olusegun Adeniyi was also ambushed by the insurgents and would have been killed if not for the deployment of superior military strategy that gave the insurgents a bloody nose.


It is recorded that the Boko Haram suffered so much in that attack that they abandoned a large cache of their weapons and fled.


But days after the Nigerian soldiers outmanouvered the insurgents routing them out in their numbers,  only a little media attention was given to it unlike the Chadian episode. 

The truth is, apart from needless propaganda, Nigeria has fared far better in military operations than the tiny African country, hence has nothing to learn from Chad.

Even judging by the two incidents, it is clear which side gave a good account of itself as far as responding to attacks is concerned.


While Chad was humiliated by the killing of  98 of its finest fighters, said to be the equivalent of its strike force, Nigeria lost only two soldiers in the ambush before reconnoitering to take on the insurgents and blowing them away.

It is obvious that the Chadian military strategy and approach to counter insurgency differs from that of Nigeria in many respects and it would be a great disservice to Nigeria for anybody to suggest that Nigeria should adopt the Chadian approach in its fight against the insurgents. 

One, there is not even a clearly laid out strategy that has cast Chad as having an upper hand in the fight against insurgency. 

In the history of warfare, before any strategy could be said to be superior, it must have  produced the same results over and over again. 

This is not the case with the Chadians as what we have seen is a one off tit-for-tat mission that managed to succeed..

But the danger in playing the defensive or counter offensive like Chad has done in an asymmetric warfare like the one involving Boko Haram is that the insurgents are allowed to make their pick of targets before they are replied.

This could be counterintuitive as the insurgents while taking the time to plan and launch attacks would not always assemble in a place waiting to to be struck. 

Another thing is that allowing the terrorists to converge at a particular place before taking on them.would be at a great cost to the civilian population along their camps who would be made to bear the brunt of their sustenance and the many humiliations that come with it.

The fact of the matter is that Nigeria is far ahead of Chad and other countries in the fight against insurgency.

Nigeria has been the leader on many counter insurgency operations across the continent including the multinational joint task force currently fighting the Boko Haram.

The Nigerian Chief of Army Staff, Lt. General Tukur Yusuf Buratai has been leading the fight from the front since he was so appointed in June 2015.

He has personally participated in drills and other military exercises with fighting troops, talked and interacted with them directly  and led operations in the theatres of war.

His presence at many operations has served to inspire troops and boosted their confidence in the battle field. 

Apart from that, the Chief of Army Staff  has been able to win the war by adopting tactics and strategies that suits particular geographical locations which he is quite familiar with.

Troops confidence has further  been boosted with the keen interest he has shown in the improved welfare of soldiers and instilling in them a high sense of patriotism.

Chad on the other has had a pact with the insurgents which went sour and were driven by rage of betrayal by an estranged accomplice. 

Nigeria however is driven by patriotism and the need to save humanity from catastrophe and disorder. 

The two countries are not in the same category. 

Nigeria is doing well in the fight against insurgency and has nothing to learn from a one off operation.

Q: How does 5G work?
A: Like 4G LTE, 5G is also OFDM-based and will operate based on the same mobile networking principles. However, the new 5G NR (New Radio) air interface will further enhance OFDM to deliver a much higher degree of flexibility and scalability. 5G will not only deliver faster, better mobile broadband services compared to 4G LTE, but it will also expand into new service areas, such as mission-critical communications and connecting the massive IoT. Q: When is 5G coming out?
A: 5G should be available in 2019. 3GPP (3rd Generation Partnership Project, the standards body that is helping define 5G) made a decision to accelerate the initial phase of 5G NR (New Radio) – the new global 5G standard – to begin in 2019.

It is important to note that initial 5G NR deployments will focus on enhanced mobile broadband (eMBB) use cases to boost capacity and provide an elevated mobile broadband experience (faster speeds, lower latencies, etc.).

As with previous generations of mobile networks, it will take time to proliferate the new 5G network. 4G LTE will continue to grow and serve as the anchor of the 5G mobile experience (via multi-connectivity) for many years to come by providing Gigabit data rates outside 5G coverage areas.

Q: How much is 5G?
A: 5G doesn’t have a price tag yet.

A key 5G objective is to lower the cost-per-bit (data cost) compared to 4G LTE, by leveraging new and wider spectrum in higher bands including the mmWave range.

This could potentially allow mobile operators to continue offer unlimited data plans even with increasing data consumption. This can also enable new use cases and make more applications economically viable for broader adoption in a 5G network. For example, 5G can help to proliferate immersive augmented and virtual reality, which is possible today with 4G LTE but may be limited by network capacity and data costs.

Q: Who is working on 5G?
A: 5G is being driven by 3GPP, which is the standard body that also oversaw the development of 3G UMTS (including HSPA) and 4G LTE standards. 3GPP is a group of companies across the entire mobile ecosystem, all working on 5G. It ranges from infrastructure vendors and component/device manufacturers to mobile network operators and vertical service providers. Qualcomm Technologies is at the heart of the 3GPP, driving many essential inventions across all aspects of the 5G design, from the air interface to the service layer.

We expect the impact of 5G will be much greater than previous network generations. The development requirements of the new 5G network are expanding beyond the traditional mobile networking players to industries such as the automotive industry. That is why 3GPP is seeing a surge of new members that cut across a wide range of industries. It will take close collaboration among 3GPP members to make 5G a reality.

Q: What is the difference between 4G and 5G?
A: There are several differences between 4G vs 5G:

5G is a unified platform that is more capable than 4G
5G uses spectrum better than 4G
5G is faster than 4G
5G has more capacity than 4G
5G has lower latency than 4G

While 4G LTE focused on delivering much faster mobile broadband services than 3G, 5G is designed to be a unified, more capable platform that will not only elevate mobile broadband experiences, but also support new services such as mission-critical communications and the massive IoT. 5G will also natively support all spectrum types (licensed, shared, unlicensed) and bands (low, mid, high), a wide range of deployment models (from traditional macro-cells to hotspots), as well as new ways to interconnect (such as device-to-device and multi-hop mesh).

5G uses spectrum better than 4G
5G will also get the most out of every bit of spectrum across a wide array of available spectrum regulatory paradigms and bands — from low bands below 1 GHz, to mid bands from 1 GHz to 6 GHz, to high bands known as millimeter-wave.

5G will be significantly faster than 4G, delivering up to 20 Gigabits-per-second peak data rates and 100+ Megabits-per-second average data rates.

5G has more capacity than 4G
5G will support a 100x increase in traffic capacity and network efficiency1.

5G has lower latency than 4G
5G has significantly lower latency to deliver more instantaneous, real-time access: a 10x decrease in end-to-end latency down to 1ms1.

Q: What is 5G Wi-Fi?
A: 5G Wi-Fi isn’t a thing.

5G is the next-generation mobile technology defined by 3GPP (3rd Generation Partnership Project) – the standard body that also overlooked the development of 3G UMTS (including HSPA) and 4G LTE standards.

Wi-Fi is defined/standardized by IEEE and promoted/certified by the Wi-Fi Alliance, not 3GPP.

A 5G user will be able to seamlessly use 5G, 4G, and Wi-Fi since 5G will interwork both with 4G and Wi-Fi, allowing a user to simultaneously be connected to 5G New Radio (NR), LTE or Wi-Fi. Similar to Wi-Fi, 5G NR will also be designed for unlicensed spectrum without requiring access to the licensed spectrum, which allows more entities to deploy 5G and enjoy the benefits of 5G technology.

The Presidency has berated the senators who called on the President , Major General Muhammadu Buhari ( retd . ) , to address Nigerians in a television broadcast .

The Senior Special Assistant to the President on Media and Publicity , Garba Shehu , said in a statement that such calls were nothing but cheap politics .
The Presidency further stated that this was the time for all Nigerians to unite against COVID- 19, adding that this was not the time to attack the ruling All Progressives Congress .

The statement read in part , “ We also plead with Nigerians not to see this most peculiar of times as one to be politicised or seen as an opportunity to regurgitate grudges against the government or the ruling All Progressives Congress. North, South, East , and West – all Nigerians must unite to fight this plague, irrespective of religious or ideological affiliation .

“In this regard , populist advocacies such as the one accusing the President of ‘ complacency ’ simply because he has not made a television address by ranking members of our respected parliament are cheap and sensational . These are not the times for populism and cheap politics .”
According to the Presidency, palliatives including the reduction of petrol pump price from N 145 to N 125 per litre were in place to cushion the effect of the pandemic.

It also stated that N 1. 1tn fund had been approved by the Central Bank of Nigeria to assist businesses.

The Senate had on Wednesday called on Buhari to address Nigerians on the coronavirus in the country.

It also urged the Federal Government to shut down all international airports except the Lagos and Abuja airports for easier monitoring of the disease .

The lawmakers asked the President to suspend the issuance of visas on arrival at the borders so as to check the spread of the pandemic .

As of Thursday , there are twelve confirmed cases of COVID-19 in Nigeria .

Buhari said the Ministry of Humanitarian Affairs, Disaster Management and Social Development was established last year to also harmonise all humanitarian activities in the region for greater effectiveness apart from its mandate to develop humanitarian policies and provide effective coordination of national and International humanitarian interventions, among others. “As a result of the mindless actions of the terrorists, many of our compatriots have been killed, maimed, or displaced from their communities. This necessitated the efforts of this administration to develop immediate interventions and measures to alleviate the sufferings of those affected, and to ensure their proper resettlement,” he said. Buhari, who hailed local and international partners for their assistance over time, assured them of continued government commitment.

It is no longer news that Comrade Adam's Aliyu Oshiomole the National Chairman of APC was removed from office today through an Interlocutory Injunction granted by an Abuja High Court and he is restrained from parading himself as the National Chairman of APC based on suspension from his Etsako ward in Edo State. I do not want to comment on the APC Constitution vis a vis discipline of a National Officer which is an issue before the Court as the matter is subjudice.

I have received a lot of calls and messages that I should volunteer my opinion with regards to this matter of Interlocutory injunction which purported to have removed Oshiomhole from office and I wish to succinctly do that as follows:

I have taken my time to look at the processes filed to achieve the removal and I have also seen a copy of the Notice of Appeal filed by Oshiomhole against the said ruling.

By nature of Interlocutory order, the purpose is to preserve the res i.e the subject matter of a case. In legal parlance it is said to the purpose for the granting of Interlocutory Injunction is to maintain status quo ante belum. This means injunction is meant to preserve the state of things as at when the matter was brought to court so as not to over reach the court and the other party.

In this case, when the matter was brought to court, Oshiomole was the Chairman of APC why its ward is claiming to have suspended him as a member. It means therefore that the purpose of any Interlocutory injunction should have been to preserve that state of affairs pending the determination of the main suit already pending in court.

In the case of Green v Green (1987)-LPELR (1338) SC, the Supreme Court talked about Purpose for the grant of an order of injunction in the following:
"An order for an injunction cannot be made in vacuo. The aim of an order of injunction is usually to protect an established legal right. If the substantive right had not been established, as in this case, it will be, and it was, very wrong of the learned trial judge to grant the injunction sought against the defendant, Accessorium non ducit sed sequitur suum principale (the accessory right does not lead, but follows its principal)."
Per OPUTA J.S.C. (P.7, paras. C-E)

I am also aware that it is an established principle of law that a court should not pronounce on live issues that will touch on the substantive issues in a case at Interlocutory level.

In this case, the aim of those who approached the court is to remove Oshiomhole from office at the end of the matter and it is part of their prayer before the court. It is therefore illegal for the court to have removed Oshiomhole at the Interlocutory stage in this case.

See the case of UBN PLC v ASTRA BUILDERS (WA) LTD (2010) LPELR- 3383 SC where the Supreme Court has the following to say on Whether Court can pronounce on substantive matters or issues in the course of interlocutory proceedings:
"It should be noted that the appeal originates from the exercise of the discretion of the trial court either to grant or refuse the grant of the application in issue. It is equally important to note that the application being interlocutory the law is that the court should not decide the substantive matter at the interlocutory stage of the proceedings."
Per ONNOGHEN J.S.C. (P.35, paras. B-D).

In this case, the FCT High Court has decided the substantive case at the Interlocutory stage and this in my opinion is wrong and will not stand at the Court of Appeal.

I am aware that Oshiomhole has now Appealed this interlocutory order at the Abuja division of the Court of Appeal. That is the right thing to do and haven done that, Oshiomhole can effectively resume his office any moment from now as if nothing happened, parade himself as National Chairman and carry on as the National Chairman and he will not be in contempt of court. This is because a party that has filed an Appeal against an Interlocutory order cannot be guilty of contempt of that order especially where it is obvious that the Court granted the order without jurisdiction like it obviously did in this case.

In the case of Group Danone & Anor vs Voltic Nigeria Ltd (2008) LPELR-1341 SC the court have this to say:

"Firstly it is settled principle of law that where a Defendant in a cause challenges the validity of an order directed against him either by way of an appeal or other application, he cannot be proceeded against for contempt of that order unless and until the issue of its legality is settled one way or the other."

Now that Oshiomhole have challenged the order on Appeal, he can go back to his office without committing contempt of court.

Generally speaking, I am of the opinion that the FCT High Court with all due respect to My Lord has no jurisdiction to entertain this matter because the matter is an internal affairs of a political party and a court should not determine a political question according to Supreme Court.

Those who are happy that Oshiomole has been removed from office and are dancing Asonto and Shakushaku only have a temporary relief as Comrade Adams Oshiomole will be back earlier than expected in a more consolidated form as this action will certainly fail and will not achieve anything in the end.

Though it is a temporary set back for Comrade Adams Aliyu Oshiomole but he will certainly survive the onslaught! This process cannot remove him from office based on law except if there is anything behind and different from Legal process which I am not privy to but if it this one based on law, it will certainly fail and collapse! This is my humble opinion.
