Chief Emeka Ihedioha has prayed the Supreme Court to set aside the judgement it delivered on Jan. 14, 2020. NAN reports that the Supreme Court on Jan.14 nullified Ihedioha’s election as Imo governor and declared Hope Uzodinma of the All Progressives Congress (APC) as the winner of the March 9 governorship election in the state. Ihedioha, who was the PDP candidate in the election, made the request in an application he and the Peoples Democratic Party (PDP) filed at the Supreme Court through their lawyer, Chief Kanu Agabi, SAN. They brought their application pursuant to Section 6 (6) of the 1999 Constitution as amended and Section 22 of the Supreme Court Act, 2004. He said that the apex court was misled into giving that judgement, describing the apex court judgement as a nullity, and asked that the decision be set aside. Ihedioha and the PDP claimed that Gov. Uzodinma and his party fraudulently misled the apex court into holding that 213,495 votes were unlawfully excluded from the votes they scored in the governorship election held on March 9, 2019. They said that Uzodinma, while under cross-examination, admitted that he was the person, who computed the result that gave him the 213,495 votes alleged to have been excluded from his total votes in the election and not INEC. According to them, “The fraudulent nature of the additional votes was demonstrated by the fact that the total votes cast as shown in the first appellant/respondent’s computation was more than the total number of voters accredited for the election and in some polling units more than the total number of registered voters. The fraud was also demonstrated by the fact that the result computed by the first appellant/respondent showed only the votes of the first applicant and the first appellant/respondent without specifying the votes scored by the other 68 candidates who participated in the election.” They further argued that the judgement, “which is a nullity ought to be set aside because it was given per incuriam, meaning the previous court judgment failed to pay attention to relevant statutory provision or precedents. “That the judgment is a nullity having been delivered without jurisdiction.” They also said that by Exhibit A1, the total number of voters accredited for the election was 823, 743 while the total valid votes cast was 731, 485. Also, as part of their argument, was that the inclusion of 213, 695 votes for the first appellant/respondent, made the total number of votes cast at the election to be more than the total number of votes accredited for the election. The applicants, among other grounds, argued that the majority judgment of the Court of Appeal dismissing Uzodinma’s petition as incompetent continues to subsist as the appeal against that decision was not considered by the apex court. The applicants, among other grounds, argued that the majority judgment of the Court of Appeal dismissing Mr Uzodinma’s petition as incompetent continues to subsist as the appeal against that decision was not considered by the apex court. The Supreme Court had on January 14 nullified the victory of Ihedioha, who was earlier declared the winner by INEC. The apex court declared Uzodinma winner of the election in a unanimous judgment of the seven-member panel, read by Justice Kudirat Kekere-Ekun. The court agreed that results in 388 polling units were unlawfully excluded during the collation of the final governorship election result in Imo State. Kekere-Ekun said that with the results from the 388 polling units added, Uzodinma polled a majority of the lawful votes and ought to have been declared the winner of the election by the. The court, however, did not provide the details of the new votes scored by each of the candidates after the addition of the results from the 388 polling units. The Federal Government on Tuesday sought the approval of Senate for concessionary external borrowing of $22.8 billion (dollars) for development of infrastructure across the country. The Minister of Finance and National Planing, Mrs Zainab Ahmed, made the presentation on behalf of the federal government, when she appeared before Senate Committee on Local and Foreign Debts. Ahmed said the loan sought for was segmented into seven concessionary loans from multilateral institutions. She said the loans which was part of the 2016 to 2018 external borrowing plan was designed to enhance productivity of the economy via development of roads, railway lines, electricity projects, agriculture among other sectors. She said the loan sought for involved states and and federal government, noting that the state governments would be responsible for their own repayments. According to her, the loan will also assist in provision of soft loan for Small and Medium Enterprises (SMES) in the country and ultimately improve employment generation in the country. Ahmed said what Nigeria had was a revenue problem and not debt problem, noting that the nation’s revenue profile was sustainable. This, she said was evidenced in the nation’s debt to Gross Domestic (GDP) sustainability ratio which stood at 25 per cent . She said, if the loan sought for was approved and disbursed, the nation Debt to GDP sustainability index would be 20 per cent . This, she said was below the World Bank threshold of 55 per cent. She said the government was making frantic efforts to address the revenue challenge facing the nation. Also present to defend the external borrowing plan of their states before the committee were officials of Kogi, Kaduna and Katsina governments. The Ministers of Works, Babatunde Fashola; Gbemisola Saraki of Transport; and Lai Mohammed of Information and Culture were also present to defend the borrowing plans of their ministries. The Minster of Federal Capital Development Territory Mohammed Bello, also appeared before the committee to defend external borrowing plan request for the FCTA. Chairman of the Committee, Mr Clifford Ordia, said seven of the agencies of government were yet to respond to request of the committee to defend their borrowing plan request. He said the delay on the loan approval was caused by inability of the agencies to respond to the invitation of the committee. (NAN). The crisis in the nation’s sea ports appeared to be worsening by the day as some importers’ efforts to get their containers cleared from the ports in Lagos were hampered, thereby causing serious commotion at the ports. Owing to the congestion, vessels waiting to berth cannot access the ports for the discharge of cargoes. Daily Trust learnt that some vessels have arrived Lagos anchorage over one month ago but cannot find space to berth. Lamenting the problems created by the congestion, the General Manager, PTML Terminal, Tin Can Island Port, Lagos, Tunde Keshinro, disclosed that overtime cargo abandoned at the terminal since 2016 had taken up more than 30 percent of commercial space in the terminal. He explained that the ugly situation was accentuated mainly by the inability of the Nigeria Customs Service to auction them. The industry expert made the disclosure when a team of the International Monetary Fund (IMF) led by its Mission Chief to Nigeria, Amine Mati, visited the terminal weekend. He explained: “Since 2016, we have been struggling with 30 percent of our space locked up under abandoned cargo because Customs is not auctioning and that is a serious concern for us no matter the capacity we have. “I am a terminal operator and what I sell is my space. How quick and fast I’m able to turn around my space determines the profitability of the business. So when certain portion of the space is locked up, that already will limit the productivity it can take. “However, within these constraints, the vessels are regularly coming in, they don’t delay outside and we are able to deliver within acceptable framework for the ship owner,” Keshinro added. The PTML Terminal General Manager said the absence of clearing agents and failure to take delivery of cargoes during the weekend was also affecting operations at the terminal. He said, “We deploy online payments, the Customs also deploy online payments, but it is not all the banks that are giving this value of online payments, these are areas that the banks need to expand. “If you go to the examination bay on Saturday, nothing is happening. If I am discharging on Saturday and there is no opportunity to do further activities on the cargo, I am going to get it locked down till Monday or Tuesday and there is going to be an imbalance. We want the other agencies to work in the real sense of 24 hours operations, not just on paper”, Keshinro added. The South East Zonal Chairman of the Miyyetti Allah Cattle Breeders Association of Nigeria (MACBAN), Alahaji Gidado Siddiki, has alleged that four of his members were killed, and over 138 cows belonging to them were missing in clash between herdsmen and farmers in Anaku and Ifite-Ogbaru communities in Ayemelu LGA of Anambra State. He disclosed this yesterday, while speaking to Daily Trust in Awka, the Anambra State capital. He gave the names of the herders as Mobani Hassan, Abdulrahaman Abdullahi, Rabiu Hassan and Bahago Ilu. According to him, it started in late December 2019, when one of the deceased, Mr. Mobani, was hacked to death alongside his cows when he was accused of grazing on somebody’s farm land. “Also on the January 26, 2020, three members of the group were also killed in a similar manner by the youths of the community, and 138 of their cows are missing. I think what is currently happening in the communities now is a deliberate act in the side of the leaders in the area for not cautioning their subjects, because of the hate for Fulanis” “People hate us now because they erroneously believe that the president is backing us as a Fulani. This is not the first time somebody is the president of the country and their people were not wiped out,” he said. On the issues of abduction, destroying and grazing on people’s farm land by the Fulanis ,he said there was no reported case of a Fulani man or any other tribe abducting any person in the state, adding that since there is an order that any Fulani that destroys farm land should pay, they should explore the channel. The Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami (SAN), has debunked media reports that he advised against the prosecution of the Malabu oil deal and Senator Danjuma Goje’s cases. In a statement by his aide on media, Dr. Umar Gwandu yesterday, Malami said he never stated anywhere or advised anyone or authority that there was no prima facie case in the Malabu matter contrary to claims. He said he had unequivocally maintained that all persons indicted by the EFCC’s investigation report as regards the OPL 245 (Malabu) be prosecuted in accordance with the relevant laws. Malami explained that despite his position as the chief law officer of the country under Sections 150 and 174 of the 1999 Constitution, he had never interfered with their operations. He said his office would continue to pursue the Malabu cases instituted in Italy, the case against JP Morgan in London, and other Malabu-related cases in Switzerland and Netherland. On the N25bn corruption case involving former governor of Gombe State, Danjuma Goje, which was withdrawn by the EFCC, Malami said he did not have a hand in the withdrawal. The AGF has called for a balance between media freedom and government control, explaining that “no country in the world operates an absolute media freedom.” Speaking while receiving a delegation from the Daar Communications Plc in Abuja yesterday, he noted that the regulation of the media was to ensure peaceful co-existence and guard against falsehood, fake news, hate speech, mistrust and other and other vices that could divide the country. The National Security Adviser, Babagana Monguno, yesterday described the nation’s current security situation as unpredictable. Addressing reporters after an emergency National Security Council meeting chaired by President Muhammadu Buhari, the NSA also said the security challenges were multi-dimensional: “internal, external, diplomatic, economic and defence-related” He said all hands must be on deck and that to address the situation. Asked how the meeting assessed the current security situation on a scale of “stable”, “critical” or “improving”, the NSA said: “Sometimes, it could escalate. Sometimes, it would go down. So, there is no perfect answer to that. If I tell you that it has improved and as we walk out of this place and something might have happened, there might be an explosion somewhere. “These are things that are not predictable. These are things that you cannot actually determine; that is the nature of this type of conflict we are facing.” Monguno parried a question on the Wednesday’s resolutions of the National Assembly calling on Buhari to ask the service chiefs to resign over rising insecurity. He said the National Security Council decided to take a closer look at issues “that will help us not just at the federal level or at the state level, but right down to the local government level. The National Chairman of the ruling All Progressives Congress (APC), Comrade Adams Oshiomhole, on Tuesday said the decision of the leadership of the House of Representatives not to fill the vacant position of Majority Leader was an indication that his colleagues were optimistic that Alhassan Ado Doguwa would be re-elected again. Oshiomhole said this when Governor Abdullahi Umar Ganduje-led APC members in National Assembly to pay him a solidarity visit in his Asorokoro office in Abuja. Doguwa was re-elected at the re-run election conducted last Saturday to continue to represent the people of Doguwa/Tudunwada federal constituency of Kano state. “Let me say that from the reaction of your colleagues, the Speaker was in Kano, the Deputy Leader, was also in Kano and it was for nothing that they chose not to fill that position because like members of your constituency who elected you, they were also waiting to re-elect you. “I believe that God gave you a second chance. That the Speaker was in Kano means that he holds you in high esteem. They deliberately decided not to fill the vacancy and just like us, they were confident that the people of your constituency will return you to the House. I don’t think I should say more than that,” he said. Oshiomhole, who described Doguwa as a loyal member of the party whose contribution to debates on the floor of the House had been of immense benefit to the President Muhammadu Buhari-led administration, renewed APC’s faith in the judiciary. He dismissed the view that the APC was losing ground to the opposition due to the crises in some state chapters, stressing that Doguwa’s victory underlines the acceptability of the APC by the electorates in Kano state. Governor Ganduje, while speaking earlier, said the visit was to present Doguwa’s Certificate of Return and his application to seek the position of Majority Leader again. “We are here today to present to you the Certificate of Return of Alhassan Ado Doguwa who was also the House Leader. This certificate is very important to us because it is a certificate that is carrying two caps. One, it is carrying the cap for him to be the member of National Assembly and the other cap, he was the Majority Leader and now he is an applicant. By the grace of the Allah, our National Chairman I hereby present you the certificate,” he said. Ganduje, who thanked Oshiomhole over the reception, said the APC retained two out of three House of Representatives’ seats and four House of Assembly seats during the rerun election. Also speaking, Doguwa, who thanked Ganduje and Oshiomhole over the role they played in his re-election, expressed his loyalty to the party. He pledged to take up the responsibilities of the House Majority Leader if considered again. Read more: https://www.dailytrust.com.ng/house-majority-leader-apc-endorses-doguwa-again.html |
