Surrogacy is a process where a woman assists another woman because of her inability, to bear in her own womb an egg that has been fertilised by the sperm of the husband/ partner of the owner of that egg or it is a process where a woman allows her own egg to be fertilised by the sperm of another woman's husband and it is later implanted in the womb of that man's wife. This, however, is not permissible. This is because the womb and egg of a woman has a lot do with a woman being the mother of the baby. Similarly, the sperm has a lot to do in the declaring the baby an illegitimate child. The Prophet, sallaa Allahu alayhi wa sallam, says, ( لا يحل لإمرء يؤمن بالله واليوم الآخر أن يسقي ماءه زرع غيره) (It is not lawful for someone who believes in Allah and the last day to water what another man has sown with his water...) This means the sperm of a man has a lot to do with the child, likewise the egg and womb of a woman. As for IVF, this is permissible according to the resolution of the Fiqh Academies if handled by reliable doctors who won't tamper with and manipulate the sperm and eggs. However, some scholars such as al-Albaani go against this. |
Question 395 As salaam alaekum warahmatuLah wabarakaatuh Please ask sheikh this question, may Allah reward him with good and increase him in beneficial knowledge. Can a deposit (commitment) be collected from a customer before the arrival of a stipulated good? Though the good will be purchased due to the fact that the customer requested for it. If the answer is affirmative, can the customer be charged some amount in case he defaulted on arrival of the good? JazaakaLahu khairan [9/5, 7:26 AM] Ustadh Abdulghani Jumat: Wa alaykum as-salaamu wa rahmatullahi wa barakātuhu. Praise be to Allah; may the blessing and peace be upon the Messenger of Allah. To proceed: There are four types of buying and selling methods. They are, one, instant exchange of the two items ( i.e, the comodity and the money or another item), two, instant delivery of the money and deferment of the delivery the goods ( bai'u as- salam), three, instant delivery of the goods and deferment of the money ( bai'u al ajal), and finally the deferment of both of them ( bai'u addayn bi addayn). As for bai'u as-salam, there must be full delivery of the money i.e, the should be full payment of the price of the commodity in advance as a part payment makes it take the ruling of the fourth type, i.e, bai'u addayn bi addayn the ruling of which is ribaa. However, if full payment is made from inception but the delivery of the goods with their descriptions is delayed to a known future date, then this type of transaction is permissible like the first and the third types if all other conditions of buying and selling and met. Hence,it is not permissible for the selller to take part payment from the buyer for goods that are not presently available in his shop or so. Rather, he is going to get those goods later in the future. This is ribaa. As for the fourth type of buying and selling, i.e, concluding a binding contract to buy the goods or sell the goods if brought by the seller, this is not binding as there is no comodity yet while the money is deferred ( i.e bai'u al ajal), nor has the buyer made full payment in advance while the goods are deferred. ( i.e, bai-u as-salam). Hence, the contract is not yet binding on both of them. It is only regarded as a promise which is not legally binding according to the Fiqh Academy and most schollars contrary to al- Qardaawi and some others. Note: The Fiqh Academy based on the view of majority of its members, says the mutual promise to buy and sell the item if brought is not considered a sealed contract. However, if the seller has incurred some loss in bringing the item, the intending buyer who has promised to buy will then be forced legally to buy it or pay only the amount the supplier has lost after he( the supplier) has sold it to a third party. This view, however, is rejected by some members such as Dr Rafeeq al-Misri, Muhammad al-Ashqar et al. In addition scholars such as al-Albaani, Ibn Baaz, al-Uthaimeen and many others are also vehemently against this and consider it to be ribaa. As for the supplier requesting from the intending buyer a commitment fee ( haamish al-jiddiyyah), some scholars see it as permissible on condition that it is not regarded as part payment lest it becomes ribaa as explained above. Na so person com see one aboki wey dey sell shayi and egg oo. Person com go closer to go price 2 eggs o. Omo, the aboki say na #60 for 1 o. 2 go com be #120. Na so person com quickly do 1+1, so this aboki go sell one crate of egg for #1800.... SubhanaLlahi Al Atheem. If he eventually com do like 3,4,5.... crates in a day, how much he go com be? Let's say na 4 crates only he dey sell per day, him go don make like #800×4= #3200 for just single day. Hmmm..., for 6 days in a week, how much that one go com be, then in a month, how much he go com dey make. No forget say other tinz still dey one side apart from the egg o like noodles, shayi, bread,.... All in all, him go dey make like #100k cool cash at least per month. Most times, no be shop him go rent o. Never forget say this person no get any degree o and he's making his cool halal cash on a monthly basis. Coming back to our brethren, there are many ways you can easily earn a living in an halal way. Just try as much as possible to put that ego aside and do something meaningful rather than going upandan to seek for office job. Driving is another opportunity to quickly earn a living if you are cool headed. A lot of people are out there looking for trustworthy people to give their cars for Ubers and the likes. As a good believing Muslim with sound creed and Islamic knowledge, it is not befitting to be spreading this kind of reports amongst the Muslims not to talk of the non Muslims. Don’t be deceived by the ranking and compilations made by one Michael Hart by making our Noble Prophet Muhammad صَلَّى الله عليه وسلم Number 1 on the list. Allah has indeed made him the best of mankind and that is enough for us to accept and no doubt about it. In a situation whereby a Kaafir is made number 2 and other Prophets of Allah are below kufaar of different types is totally unacceptable in all manners. Muslims should therefore reject compilations like this as it contravenes our belief and methodology. We do not distinguish between the Prophets of Allah not to talk of making kufaar above them in ranking. Anyone who believes in ranking like this may be treading the path of Kufr if care is not taken. We pray Allah سبحانه وتعالى guides our hearts to what is right and bestow on us the ability to follow it. |

AlhamduliLlahi Rabil A'lameen wa Solatu wa Salam a'la RasuliLlah. I was privileged to be part of the guests that attended an _"House Warming Rites"_ of a fellow Muslim few hours ago. The so called _House warming_ was well attended by other Muslims also. The _koko_ of the matter is that the owner of the house might have thought or might have not thought he would get a home so soon but as Allah wished, he was granted. This is a House that everyone of us will own one day, either soon or later. This is also a House that only the people who worked assiduously when they have the strength will enjoy the goodies of such House. How are you and me taking advantage of the time we have now to work in order to be part of those who will enjoy the serenity of the House. Never forget that The Creator Himself created Life and Death in order to test us, who amongst us will be of best good deeds. We still have the opportunity now to decide how we want the House to be. Is it the one that will be made spacious or the one that will be made so tight than we can ever imagine. The time is now to be mindful of our acts of worship especially in line with the teachings and practices of our Noble Prophet Muhammad صَلَّى الله عليه وسلم and particularly according to the understanding of our pious predecessors. May Allah forgive all dead Muslims. It also happened that one of the luckiest person also became a Landlord yesterday. Learnt he had been a Kaafir all his life and he was just able to accept Islam just a week to his death. We pray Allah forgives them all and also grant us the best of ends. اللهم اختم لنا بحسن الخاتمة ولا تختم علينا بسوء الخاتمة. |
الحمد لله رب العالمين والصلاة والسلام على رسول الله صلى الله عليه وسلم. We pray Allah سبحانه وتعالى accepts our Ibaadah and grant our supplications. Wishing us a blessed Eid. Earlier today shortly after solat ul Eid, I had the privilege of meeting one of our noble Mashaykh حفظه الله ورعاه in Makkah. A mere visitation turned an avenue for a great and beneficial Naseehah. I found it to be most beneficial Naseehah that I cannot alone benefit it all, reason for sharing some of the benefits to us. May Allah continue to bless and protect Him for us upon goodness. In explaining the the verse 28 of suratul Hajj by another of our Mashaykh in one of the sittings of learning. He explained part of the benefits of going for hajj may include both worldly and hereafter gains. He proceeded saying meeting some of the Mashaykh at Hajj or Umrah also serves as part of the benefits of pilgrimage. May Allah continue to bless all of them for us upon goodness and grant the dead ones amongst them Mercy. Below are some of the Naseehah I gathered from him. Sincerity (Al Ikhlaas) So many Muslims today do not know the importance of it in our lives. Be dutiful and responsible to your wives and children. Only Allah gives rizk. Wives to uphold the laws of Allah irrespective of how unfavourable it may look to them. Women should fear Allah and be contented with their husbands according to his best ability. Women should work but change their orientation that they must be economically stable in case husbands die. What guarantees husbands will die first? Parents should strive to be pious and righteous servants of Allah and leave the future for Allah. He cited the Story of Nabiy Musa and Khidr when they assisted the two young orphans whom their father was a righteous servant of Allah. He also described that wives are of 2 categories as described by Allah in the same verse of Surat Nisah. (4:34) Men are the protectors and maintainers of women because Allah has made one of them excel over the other, and because they spend out of their possessions (to support them). Thus righteous women are obedient and guard the rights of men in their absence under Allah's protection. As for women of whom you fear rebellion, admonish them, and remain apart from them in beds, and beat them. Then if they obey you, do not seek ways to harm them. Allah is Exalted, Great. That no man should dare touch the first category unjustly. because Allah is greater than anyone and He can deal with such men accordingly. The second category already requested for what they experience as advised by the same verse. Women are to make their choice, where do they want to belong. Women should fear Allah in all aspects of life and do not be self-centred. A lot of women especially widows/divorcees/unmarried amongst us need to be under husbands again in order to have the right feelings at all time. Financial assistance only is not enough. He cited the lives of the early generation of Muslims, before a widow would finish her Iddah, proposals would have been waiting for her. Our widows today do not only need our financial assistance but to be fully back under husbands also. Women should endeavour to assist husbands to attain Allah's love not His punishment. Some Muslimahs will not mind their husbands committing Zinah but will go against him taking another wife. Women who want their husbands to love them should give a lot of respects to their husbands. Co-wives should give respect to themselves as no one is senior or junior. Love is not just a mere speech but actions. All gatherings of knowledge should be taken serious and not a social gathering or market place. Students of knowledge are advised to review their intentions at all times. Ikhlaas first in any situation. One may possess these 4 things but the 5th is the most important; 1. Knowledge 2. Experience 3. Age 4. Wisdom 5. Ikhlaas Always respect Scholars who are knowledge based, those who always defend the Shariah and not their personalities no matter what. Only Allah that grants Attawfeeq One may be poor and still achieve a lot in life. Being trustworthy is paramount. Never take what doesn't belong to you at any point in time Whatever is yours will not miss you Always depend on Allah in all situations Never cease to say what pleases Allah at any point in time or wherever situation you find yourself. Opportunity may close at any time but Allah will always provide a better option if you truly depend on him Do whatever you want to do to please Allah and not to please His creatures in detriment to Allah's injunctions. Your huge salary you earn doesn't guarantee success while your low salary or low income you earn doesn't guarantee you failure. Attawfeeq is only granted by Allah Loss of an item doesn't mean is the end, endeavour to pray over it, perhaps Allah will grant you what is better These are the few benefits that can be remembered from the little time spent with the noble Sheikh.
