Like I said before, the Tribunal lacks the power to determine the eligibility of a candidate and since APC's defence are based mainly on the eligibility of Atiku to contest the election and the competence of his petitions, should the Tribunal trash them as expected, it will make APC vulnerable to a flawless and sweet Atiku victory.

What are the chances of APC succeeding in its objections based on the ground of Atiku's Nigerian Citizenship?

Before we delve into answering this critical question, let us consider the relevant section of the Constitution of Nigeria that has to do with the Court that has the jurisdiction to determine the question of a person's citizenship in Nigeria. This is so because it is trite law that jurisdiction is the life wire to any proceedings in any court or tribunal. Any proceedings or judgment, no matter how good or how well conducted by any court or tribunal without jurisdiction is a nullity, as one cannot build something on nothing and expect it to stand.

Having said that, the question now is: Which court has the exclusive jurisdiction or power to determine the question of citizenship of any person in Nigeria?

In response to this question, let us consider the provision of section 251 (1) (i) of the the Constitution of Nigeria, 1999 as amended.

Section 251 (1) (i) of the Constitution provides and I quote:
251 (1): Notwithstanding anything to the contrary contained in this Constitution and in addition to such other jurisdiction as may be conferred upon it by an Act of the National Assembly, THE FEDERAL HIGH COURT (F.H.C) shall have and exercise jurisdiction to the exclusion of any other court in civil causes and matters relating to:
(i) Citizenship, naturalisation and aliens, deportation of persons who are not citizens of Nigeria, extradition, immigration into and emigration from Nigeria, passports and visas.

Now in view of the above provision of the Constitution, the questions that beg for answers are:

(1) Which court has the exclusive jurisdiction to determine or decide a person's citizenship in Nigeria?

ANS: The Federal High Court (F.H.C).

(2) Has the F.H.C ever been called upon by APC or anybody at all to decide or determine any question bothering on or relating to Atiku's citizenship in Nigeria?

ANS: No.

(3) Going by the provision of the above section of the Constitution, does the APC, the Election Petition Tribunal or any other person or institution has the power to declare or pronounce Atiku or any other person a non-citizen of Nigeria?

ANS: No, because doing so will amount to usurpation of the power or jurisdiction of the F.H.C.

(4) Can the Election Petition Tribunal now exercise the power to declare or pronounce Atiku a non-citizen of Nigeria?

ANS: No, it cannot.

In view of the above questions and answers, it is my humble submission that it is very wrong for APC to, at this stage, declare that Atiku is not a citizen of Nigeria, especially in the absence of any F.H.C judgment to that effect, and then uses it as a ground to question or challenge his qualification to contest the Presidential election. It is also very wrong for APC or any person at all to bring up the issue of Atiku's citizenship for the first time at the Election Petition Tribunal. This is because doing so is akin to asking the Election Petition Tribunal to determine or decide on Atiku's citizenship in Nigeria based on the evidence before the Tribunal. Unfortunately, the Election Petition Tribunal has no jurisdiction or power to determine that question in view of section 251 (1) (i) of the Constitution.

Based on the above, I further submit that APC or any other interested person should have, first of all, proceeded to the F.H.C to challenge Atiku's qualification to contest the Presidential election based on the question of his citizenship in Nigeria. They should have even done that before the election took place, because an issue of that nature is a pre-election matter which the Election Petition Tribunal has no jurisdiction to determine. But this they failed to do. Therefore, APC's objections to Atiku's qualification on question of his citizenship is most likely going to fail, reason being that:

(1) They lack the power to declare Atiku a non-citizen of Nigeria without a supporting F.H.C judgment to that effect.
(2) The Election Petition Tribunal lacks the jurisdictional competence to decide or determine the question of Atiku's citizenship in Nigeria. It is only the F.H.C that has the exclusive jurisdiction to do so going by the provision of section 251 (1) (i) of the Constitution of Nigeria.

A simple historical research reveals that Atiku was born in Jada Town of Adamawa. Adamawa was old Gongola State, which was created on 3rd February 1976 from Adamawa and Sardauna Provinces, together with the Wukari Division of the then Benue-Plateau State. Gongola was on 27th August 1991, divided into two states - Adamawa & Taraba.

Northern Cameroons became the Sardauna Province of Northern Nigeria on 31 May 1961, while Southern Cameroons became West Cameroon, a constituent state of the Federal Republic of Cameroon, on 1st October 1961.

Alhaji Atiku Abubakar GCON, was born 25th November 1946 in Jada Village (part of Adamawa), NOT part of the Sardauna Provinces which could have made him a non-Nigerian at birth!

To recap; the present Adamawa State used to be Gongola State. Gongola State was created out of: (1) Adamawa; (2) Sardauna Provinces from the old Northern Cameroon; and (3) Wukari Division of the then Benue-Plateau State. Jada, where Atiku was born in 1946 was NEVER part of Northern Cameroon, as it was located in Adamawa province and not any part of Sardauna Province. If Atiku had been born in any part of the Sardauna Provinces, then he would not have been born a Nigerian at birth BUT that is clearly not the case!

In fact, the people of the old Sardauna Provinces, are now under Sardauna Local Government, South East of Taraba State. These are the people from the old Northern Cameroon, who became Nigerians in 1961.

You may also want to note that the Old Northern Nigeria had 19 Provinces as follows:

1. Bauchi
2. Benue
3. Borno
4. Kano
5. Katsina
6. Plateau
7. Taraba
8. Niger
9. Adamawa
10. Kaduna
11. Sokoto
12. Gombe
13. Jigawa
14. Kebbi
15. Kabba
16. Nassarawa
17. Yobe
18. Zamfara
19. Ilorin.

You will not find Sardauna amongst the old Northern provinces, as Sardauna was part of the Northern Cameroon until 1961. People who historically came from Northern Cameroon, are found in Southeast Taraba State today. Jada was part of the old Adamawa province, listed no. 9 above, and was never part of old Northern Cameroon!

Lawyers acting for the APC could have spent time researching on Wikipedia before rushing to embarrassingly showcase their poor knowledge of history.

And if anyone of them, or their supporters think Wikipedia is not a reliable legal research engine, I refer them to the case of EDWARD NKWEGU OKEREKE v. NWEZE DAVID UMAHI & ORS, SC.1004/2015, decided 5th February, 2016, where the Supreme Court of Nigeria held as follows:

"According to Wikipedia, the Free Encyclopaedia, the INEC card reader is a portable electronic voter authentication device. Designed, specifically, for the accreditation process for the authentication of eligible voters before voting, the machine was configured to read only the PVCS of a particular polling unit and can only work on Election Day, Wikipedia, the Free Encyclopaedia, (last accessed on January 30, 2016)". Per NWEZE, J.S.C., at P. 36, Paras. A-B.

They should also see the case of PML (NIG) LTD v. FRN (2017) LPELR-43480(SC), Per AUGIE, J.S.C., at Pp. 52-56, paras. A-F, where the Supreme Court referenced Wikipedia thus:

“Now, double jeopardy is a procedural defence that prevents an accused person from being tried again on the same or similar charges and on the same facts, following a valid acquittal or conviction - see Wikipedia…”

Atiku Abubakar, presidential candidate of the Peoples Democratic Party (PDP), has denied hiring a US lobbyist firm to advance in his bid to take over power from President Muhammadu Buhari.

In a statement on Wednesday, Atiku, a former vice-president, said the reports of the alleged contract is a handiwork of the All Progressives Congress (APC).

Atiku is at the presidential election tribunal to challenge the declaration of Buhari as winner by the Independent National Electoral Commission (INEC).

According to a report by Centre for Responsive Politics (CRP), Bruce Fein, former justice department official and his firm Fein & DelValle PLLC registered as foreign agents of PDP and Atiku on March 24.

The report said the firm is expected to “encourage Congress and the executive to forbear from a final declaration and recognition of Nigeria’s February 23, 209 presidential election until outstanding legal challenges to the initial government of Nigeria assertion that incumbent President Muhammadu Buhari was the victor are impartially and independently resolved by the supreme court of Nigeria without political or military influence, intimidation or manipulation.”

But in the statement issued on his behalf by Paul Ibe, his spokesman, Atiku dismissed the report as “total fabrication” by the APC, adding that it “didn’t come as a surprise to us because lying has become their only bragging rights of competence.”

The statement added that “since Atiku resisted pressure not to go to court, the APC has been behaving like a cat on hot bricks because the outcome of the 2019 elections has exposed and shattered the facade of their dubious integrity.”

“The APC are behaving nervously like a thief living under the fear of being exposed and shamed; they are now using fake news against Atiku instead of focusing on defending themselves in the court,” the statement read.

“For a party that has broken the worst record in election rigging, the APC doesn’t have any iota of integrity to be taken seriously by anybody.

“Atiku’s court case has become their biggest burden because it exposes their integrity as a sham, and instead of defending their stolen mandate in court, they are now using fake news to divert public attention from the historic electoral heist they have committed against Nigerians.

“No amount of diversionary propaganda and fake news campaign by APC will stop Atiku Abubakar from continuing the court action he started to reclaim the stolen mandate.”

Atiku is my own personal fuss. I don't have sufficient confidence that him privatising our goose that lays our golden eggs is a good idea. And neither do I think Nigeria is knowledgeable enough to sell it competently at the moment, nor do I think we Nigerians know enough to allow it to be sold at the moment, and once it's gone, it's gone.

Privatisation is the solution. Just not by Atiku, or yet.

There is no reason to conclude that nnpc will be profitable from the argument you posed with Aramco. Some might point out that not privatising like Aramco should make nnpc profitable, but since they are both not privatised, and one makes profit while the other doesn't, then perhaps privatisation is irrelevant.

Except, where Atiku is concerned, it is very relevant! Who would he sell it to if not his cronies, or has he not got form? What happened to all the other companies he privatised? Is there any reason privatised nnpc would not end up the same way? Or do you just not know Atikus's record regarding privatisation?

Could anyone provide some please, if there's any.
Is our power sector, telecommunication sector and even banking sector privatised faring better now? Hundreds of thousands of jobs were created through the privatisation of the telecommunication sector alone.....so what's the fuss here?

I have already explained my position up there. The issue is NNPC 's performance under Buhari is becoming abysmally low therefore privatising NNPC at such a time like this as advocated for by Atiku and like minds is key and germane to the survival of the government parastatal.

Currently, Saudi Aramco's refining capacity is 5.4 million barrels per day (860,000 m3/d) (International joint and equity ventures: 2,500 Mbbl/d (400,000,000 m3/d), domestic joint ventures: 1,900 mpbd, and wholly owned domestic operations: 1,000 Mbbl/d (160,000,000 m3/d).)[41]

Saudi Aramco's downstream operations are shifting emphasis to integrate refineries with petrochemical facilities. Their first venture into it is with Petro Rabigh, which is a joint venture with Sumitomo Chemical Co. that began in 2005 on the coast of the Red Sea.[10]

I don't support Buhari (God forbid) and I don't support Atiku. . But here's my take: With what happened to the judiciary before the election (the Ononghen brouhaha), can any reasonable person expect to get justice from the judicial systemhuh When there is no justice for the Chief Judge of the country, those who are not fools know there is nothing there for them, unless of course the judges pull a last minute swing at the final level (assuming there are multiple levels of adjudication in presidential elections) and hand Atiku justice (assuming he did win as the "server claim" he's made suggests). Any move before the final adjudication level by the judges can invoke the wrath of the "Next Level of Suffering" gang.
While I share your sentiment on the game plan of this useless APC government by forcefully making sure Onnoghen resigns, you must understand that evidence is what the law needs to act on, therefore, when evidences are in the magnitude and convincing, justice will tilt towards the smart one. Law is based on evidence and not on facts. What Atiku has is evidence, what Buhari parades around is "mechanical facts"! Just hang on, it won't be long.
