Lekan Sote After a long silence, Kemi Adeosun resigned as the Minister of Finance last Friday. Many had expected that she would have provided forthright information to enable the fair-minded to determine her motive, or error of judgment, in obtaining a fake National Youth Service Corps Exemption Certificate on time. Alas, it was delayed. This delay shows the poor quality of her public relations handlers. She also didn’t seem to have a good legal team that should have given a clinical assessment of her status, and prescribed an appropriate legal position. This reminds one of the argument of some management experts who insist that personnel is key to the success or failure of any enterprise. Nigeria’s public service is replete with those who occupy positions – the same way air just occupies space – and have no clue of what is expected of them. Section 2(1)(a,b) of the NYSC Act requires a Nigerian graduate to serve “if, at the end of the academic year 1972-73, or… at the end of any subsequent academic year, he shall have graduated at any university in Nigeria… or, if, at the end of the 1974-75 academic year… or subsequent years, he shall have graduated from a university outside Nigeria.” Vide Section 13(3), “Any person who fails to comply with or comply with, or contravenes, or causes, or aids, or abets another to contravene any provision of this Act… (is) liable to a fine of N5000, or imprisonment for a term of two years, or both to fine and imprisonment.” Section 2(1)(a,b) also provides that “Every Nigerian shall… make himself available for service for a continuous period of one year from the date specified in the call-up instrument served on him.” They could however, be exempted under certain conditions. These conditions, in Section 2(2)(a,b,c,d), are: if the Nigerian “is over the age of thirty… has served in the armed forces of the Federation or the Nigeria Police for a period of more than nine months,” works with the intelligence services, or “has been conferred with National Honour.” Though born outside Nigeria, Adeosun is a Nigerian vide Section 25(c) of the Constitution: “Every person born outside Nigeria, either of whose parents is a citizen of Nigeria,” or Section 26(2)(c), which provides that “every person of full age and capacity, born outside Nigeria, any of whose grandparents is a citizen of Nigeria.” For clarification, Section 31 of the Constitution states that “A parent, or grandparent of a person shall be deemed to be a citizen of Nigeria, if, at the time of the birth of that person, such parent or grandparent would have possessed that status by birth, if he had been alive on the date of (Nigeria’s) independence (on 1st October 1960)…” Constitutional experts should clarify Section 29(1) that requires “Any citizen of Nigeria, of full age, who wishes to renounce his Nigerian citizenship, shall make a declaration in the prescribed manner for the renunciation.” Section 28(1) of Nigeria’s constitution prescribes that “A person shall forfeit his Nigerian citizenship if… he acquires or retains the citizenship or nationality of a country, other than Nigeria, of which he is a citizen by birth.” If Adeosun renounced her Nigerian citizenship, she may not have served as the Ogun State Commissioner for Finance, and Federal Minister of Finance. Section 147(3) provides: “The President shall appoint at least one Minister from each State, who shall be an indigene of such State.” Also, Section 192(2) requires governors to reflect the diversities prescribed in Section 14(4) in appointing commissioners. Sir Darnley Alexander, a former Chief Justice of Nigeria, was a citizen of St. Lucia in the Caribbean. Can the privilege granted by Nigeria’s judiciary to Sir Darnley as a Commonwealth citizen be granted by other arms of government, whereas Section 131 of the constitution says, “A person shall be qualified for election to the office of President (of Nigeria) if he is a citizen of Nigeria by birth?” Adeosun explained: “I was born and raised in the United Kingdom… My visits to Nigeria, up until the age of 34, were holidays, with visas obtained in my UK passport. (However), I obtained my first Nigerian passport at the age of 34!” So, as a British citizen, she was ineligible to serve, unless she retained her dual citizenship. Her “associates” and the NYSC staff should have told her that being British made her ineligible to serve, and she therefore didn’t need exemption! The NYSC not only qualifies you for employment, it is a statutory requirement of citizens only. Section 13(2)(a) of the Act says, “Any person who, under the provision of this (Act) is not eligible to participate in the service corps, so participates, or attempts to participate, is guilty of an offence.” It appears Adeosun opted not to be an expatriate, but become a Nigerian and undergo the NYSC, and her counsellors took advantage of her. Musician Orlando Owoh said, “For a wise man to die in the backyard of a foolish man, there must be reasons.” Adeosun put herself into needless agony by being too trusting and undiscerning. She failed to interrogate the process through which she was to obtain the exemption, in order to take a logical and sensible decision, and thus became an unwitting victim of a compromising culture and value system. But if the rumour is upheld that the veracity of her NYSC Exemption Certificate surfaced when she was being confirmed as minister by the Senate, and it was deftly downplayed, then she had what happened to her coming. If she was complicit in such criminal conspiracy, she should not wince, but chin up. And the Human Rights Writers’ Association of Nigeria that suggests she should not just be allowed to walk away, but have the law books thrown at her and her confederates is right after all. This should deter others, and provide an opportunity to test the laws. Former President Goodluck Jonathan’s social media Man-Friday, Reno Omokri, urged President Muhammadu Buhari not to sweep (Adeosun’s) forgery under the carpet. Maybe, it is now morning to poke those governors, ministers, and legislators, who the rumour mill suggests were born, or at least bred, overseas, and absconded from serving. And those senators, and officials who were allegedly aware of Adeosun’s inadequacy, but chose to compromise, for financial considerations, should be herded into gaol for this blatant rape of due process. However, it is now being said that Adeosun was a sacrificial lamb, victim of high wire smear politics aimed at President Buhari. Well, the response to that is no more than a sorry for Adeosun’s failure to look well before leaping. Now that Adeosun has done the needful, some think that President Buhari must now slay the dragon of the allegation that Obono Obla, his Special Assistant on Public Prosecutions, is parading a fake West African School Certificate. But you must respect Adeosun’s decision to toe the path of honour, and resign as Minister of the Federal Republic of Nigeria. In resigning, she said, “As someone totally committed to a culture of probity and accountability, I have decided to resign…” She walked her talk, rather than whine. That this naïve woman, who however chose to act honourably, has set a precedent for others who may find themselves in such a catch-22 situation in the future is but a conjecture. –Twitter @lekansote1 Copyright PUNCH. |

NOW IF YOU ARE A PARTY AGENT YOU HAVE THE RIGHT TO BE AT THE POLLING BOOT HENCE INEC CAN NOT EVACUATE YOU ELSE YOUR PRINCIPAL CRIES FOWL PLAY. SO YOU CAN EASILY BUY PEOPLE VOTES SYSTEMATICALLY. They should simple adopt robust voting system it doesn't have to be rigid direct election at the inception. What about they make the vote be in two tier form. Direct and indirect. Yes it's possible to give like 40 percent power to indirect and 60 to direct or any other formula. So you can lobby and get people that are informed about the candidates to the Indirect election, while the part members go for the direct. It will help balance the system for the inception, then it can develop to a better system later |

First use your influence on osibanjo to get him to resign or at least get the your church and redeem church to castigate osibanjo if he fails to resign because he is also part of the system . So ,I was going on Sango ota road close to the bridge . Suddenly some SARS policemen accusted me and started giving funny directives.i having nothing implicating on me gently let them do Thier illegal search. After the whole terrifying search the SARS officer discovered I got just a headset with me, so he started by asking where is the phone. He said I am concealing the phone because I got fraud proves on it . To my surprise this guy just searched me and discovered I got nothing on me. To cut the story short, I was bundled with other people to Thier office. I had to call my parents to come secure my bail . The subject restructuring has always being part of our entity,from inception and will always be there . A society is a dynamic entity, it can't be on a stand still never . We have been restructured times without number and we are still doing that everyday. Every new policy introduce by a tenure is doing nothing but restructuring. However we have some major issues to address, namely , political character, economy structure and others . This major issues are also not constant, we have being moving on . We will get there but we only have to break it to correct it. We can't be playing with the ember of hatred and expect a sound society to ensue . Looking at our history every region have enough reasons to be careful when it comes to decisions like this . The north don't want to be dominated by the other regions , south east also is very weary of the regions, same with Southwest and south south. I think we all need to forget this regional and ethnicity problems we need to embrace through nationalism. We need to start seeing ourselves as first humans , then Africans, then Nigerians before ethnic division come in. Peace |

Even though nairaland specifically reserved the section for only Muslims what we always get is post from non Muslims insulting Islam. Please let's be honest to ourselves it's evident in all ways that the Muslims are seemingly more tolerant. Mind you this is not some post from some Muslim. This is an attempt to call attention of fellow Nigerians to how we got to where we are now , regarding the state of our federalism practice. It's very necessary to examine the process through which we got to this point , so as to learn from history. It's better to learn from others experience than to have First hand experience. We can get some good lessons from the history of our federalism. How did our founding fathers got it wrong or right , how did we got here ? Federalism in Nigeria refers to the devolution of self-governance by the West African nation of Nigeria to its federated states, who share sovereignty with the Federal Government. Federalism is a system of government in which governmental powers that exists in a country are shared between central government and component region.It is also defined as the system of government in which governmental powers are shared between the central government, i.e. the federal government and its components (state and local government). Federalism has been present in Nigeria since the former British colony was reorganized into a federation of three regions in 1946.Regionalism was introduced to the Nigeria system by the Richards Constitution. *Before and right after independence* Bernard Bourdillon the Governor-general at that time initiated and laid the foundation of federalism in Nigeria in 1939 by creating three provinces. He later handed over the constitution to his successor Arthur Richards and it became the Richards Constitution of 1946. At the beginning of formal British indirect rule in 1901, Nigeria was divided into two regions: Northern and Southern, both of which were divided into provinces. From 1901 to 1958, the number of regions was increased to three through both acquisition of territories and partition from existing provinces. However, while native-born chiefs and clerks were appointed to govern the provinces, the regions were governed by the British-appointed colonial authorities, and such regions were made dependent upon the colonial authorities for martial law, manpower and management of resources. With the approach of independence, power over the regions was given to Nigerian-born citizens, and regional legislatures were established. By the time that Nigeria had declared itself a republic and replaced the post of Governor-General with the post of President, a national bicameral parliament was established and the country was considered a federation of the three regions. The Mid-Western Region was formed from the Western Region in 1966, and Lagos, the capital, was effectively governed as an unofficial fourth region outside the bounds of the Western Region. It's important to mention that the regions we used to have were four , the northern region Southwest , southeastern and Lagos. This makes the regionalism a bit skewed to the southern part. The south has more regions , though each region was running independent government. First coup, counter-coup and the new states After the first coup and under the short-lived military government of Aguiyi-Ironsi, the country was reorganized under a central government(removing the federal character) Following the counter-coup which resulted in Aguiyi-Ironsi's deposition and assassination, Nigeria was reorganized as a federal country, with three of the regions being divided into newer entities and all first-level subdivisions being renamed as states: Eastern Region was divided into East-Central (Enugu), Rivers (Port Harcourt), and South-Eastern (Calabar) states; Northern Region was divided into Benue-Plateau (Jos), Kano (Kano), Kwara (Ilorin), North-Central (Kaduna), North-Eastern (Maiduguri), and North-Western (Sokoto) states Western Region was divided into Lagos (Lagos) and Western (Ibadan) states. Mid-Western and the states of former Eastern Region made a bid to secede from Nigeria as the states of Biafra and Republic of Benin, resulting in the Nigerian Civil War. In 1976, six years after the end of the civil war, the states were further reorganized: Benue-Plateau state divided into Benue (Makurdi) and Plateau states; East-Central state divided into Anambra and Imo (Owerri) states; Federal Capital Territory (Abuja) formed from parts of Niger and Plateau states; North-Eastern state divided into Bauchi (Bauchi), Borno, and Gongola (Yola) states; Niger (Minna) state split from Sokoto; Western state divided into Ogun (Abeokuta), Ondo (Akure), and Oyo states State boundaries and names were also reorganized. 1987/1989 Akwa Ibom state split from Cross River; Katsina state split from Kaduna 1991-1996 States of Nigeria from 1991-1996 Abia State split from Imo; Bendel State divided into Delta and Edo; Enugu State split from Anambra; Gongola State divided into Adamawa and Taraba; Jigawa State split from Kano; Kebbi State split from Sokoto; Kogi State formed from parts of Benue and Kwara; Osun State split from Oyo; Yobe State split from Borno. 1996-Till date Bayelsa State was split from Rivers; Ebonyi State was formed from parts of Abia and Enugu; Ekiti State was split from Ondo; Gombe State was split from Bauchi; Nasarawa State was split from Plateau; Zamfara State was split from Sokoto. Causes for, and effects of federalism Problems of Nigerian Federalism 1. Power Sharing:- Power sharing among the component unit poses a problem to the NIGERIAN FEDERALISM because it is not always properly defined 2. Corruption,Favouritism and Nepotism:- These are problems of the NIGERIAN FEDERALISM 3. Boundary and Disputes:- This has been a continous problem between states or local government and has been a threat on the coporate existence of the nation's state 4. Ethnic Disharmony:- There is distrust among the various ethnic groups in the country 5. Census:- For sometime in the affairs of this country there has been the problem of conducting reliable and acceptable census In summary of this write up , we can deduce that , from creation till date Nigeria is still striving with the idea of getting the federalism ideology correctly. From regionalism in the precolonial era Nd in the first republic to the first millitary coup that really did lot of injury to the course of federalism. It will be noted that it was only The Aguiyi Ironsi led military regime that did not implement the federal ideology. However after the counter coup, the north backed millitary regimes sorted to weaken the strength of regionalism and brought in the states system. Though the states system is a very viable federal system, it has not been fully optimized , which is why we have problems with our federalism. I will not want to suggest any solution to this problem with this write-up, has its meant to take us through the history of our federalism without any bias ..
