Thanks for the wonderful job you are doing here by sharing poe experiences here.
I need your advise. I got a US visa to attend a conference OTC conference in Houston Texas but couldn't make due to delay in my return from ofshore job. Now i intend to visit a cousin in charlotte NC or Nashvillein Tennessee, what possible questions should i expect at poe? I'm yet to buy my return tickets though.

I will suggest you share this question with the main U.S Visit visa section and my advice is that it's better you use the visa for what it was issued for which is B1 before using it for visit or tourism.

A visa grants you access to show up at the POE and request access into the US (or any country).., the length of stay granted each time you present yourself is at the discretion of the CBP at the POE.
So if you have 1 month left on your visa, you can show up at the POE. Wether the CBP stamps you in for 6months or less is at his discretion but staying for 4months is NOT illegal.
The length of stay granted at the POE is not dependent on the time left on the visa.

Lolz! When it's time to be official and doing your job, you better be. And when it's time to be unofficial and of duty, you can be someone else. While doing my job and you come across as someone I need to see later, I sure will, somehow, someway, but I have got to do my job.

This almost happen to my colleague, the V.O was going crazy over her... she almost gave him her number because she's single..

The reason I referenced them was the case of re-applying before expiration of visa.

For her to be allowed into the US she will declare how long she's staying. If she lies about this and isn't granted the hoped-for 6 months, that's where her wahala will begin. Let's say they approve month's stay for her which of course won't be enough for birthing, her last resort then will be to ask for an extension of the days approved for her (she remains in status till application is determined), whether granted or not, as long as she stays a day more than was approved at the POE she's automatically disqualified for dropbox in the future. If her extension application on US soil fails, she has to leave the US at the time set without delays at all. She stays more than the date given in this case she goes out of status and that is grave with grave consequences too.

I may not have answered her question the right way but I've learned so much from this ( Especially not knowing it's for birthing purpose) and I think she should be grateful for this. I rest my case, thanks @Omobendel

Yes they did, they have less than 3 months left on their visa.

Seye my broda, they don't extend visas, they can allow you stay in the US (180 days at the most at POE by CBPP if on B1/B2) more than the validity left on your visa but not more than left on your passport. Also, you can extend this time approved for you to stay in the US, but that is the one that if you do, disqualifies you for dropbox.

Sorry I mean stay.

Will help out here.... Even if you arrive at the front of a CBP Officer a day to the expiration of your visa, it's not illegal. Just have a reasonable purpose of visit. Our sister that asked this question here today actually wants to go birth in the US.

My take on this in the light of recent happenings is that if she has previously used the visa for the purpose for which it was issued, she

1. Can go ahead and make the trip before visa expiration arming herself with the famous "burden of proof". Worse case scenario, she will be stamped in till the date on her ticket's return leg instead of the normal 6 months which of course isn't even bad as long as travel plans made are tight/concrete.

2. Can first be sure of, and prepare her "burden of proof". Do her dropbox application indicating B2 specifically as her reason for application, use the doctor's name for her "contact person in the US", and then hope she won't be called in for an interview, and even if they did, she should go with her prepared "burden of proof" and ace the interview hopefully.

3. Can just give all this up, schedule an interview appointment and of her own accord go in for the interview as one going to birth and state it all as it is, backing this up with her prepared "burden of proof".

However, if the expiring visa wasn't issued for birthing and hasn't been used for the purpose of issuance, don't even try doing 1 above, the risks and likely punishments ain't no joke.

Number 3 normally is the best thing to do, but times are different. So, if you know you have the capacity to birth in the US but are only afraid of the interview and ain't exactly sure your prepared ""burden of proof" will cut it at the embassy interview, please do number 1, that's if your previous visa has been used appropriately. By this I mean for instance, some people can easily cough out the required $15-20k for birthing in about a month, but their 6-Month bank statement if faced with an interview will mess them up.

So, why take the interview risk right now when you are actually not doing anything wrong? Why not just go birth now and prepare your burden of proof for the future renewal? Most important is to be truthful at POE to the CBP Officer, it will be on record!

My question is this, What will happen if nothing was done to her visa at POE (No stay extension) can she stay in U.S legally till Jan meanwhile her visa will expire in Nov.

When your colleagues were invited did the VO ask them why they stayed beyond the validity of the travel Visa?

They asked them why they didn't wait till their visa expired before reapplying and asked them few random questions before re-issuing them the visa.

It was not a false conclusion I only advice you based on my experience, What I know is that even if your stay is extended at POE, you maybe invited for interview when next you applied for renewal through dropbox because you need to explain why you stayed a day extra after expiration of your visa in U.S,it's left for you to explain yourself.

You just said it that the CBP's may not always stamp you in for 6 months and what if they refused her entry due to number of months remaining on the visa? Or is it not possible...
I tried to reduce risk as much as possible especially for Nigerians (And you know why this is special for Nigerian)... since beginning of this year almost everyone I know who re-apply for renewal of U.S visa via dropbox (Before expiration of their visa) have been invited for interview.

Uncle Seye...I think you were a little harsh on her. It is NOT illegal but it is risky. Many have done it and renewed their visas without issues.

I also do not agree that if one applies before expiration one will be called for interview. There are many reasons why people renew before time and it is usually not an issue.

I don't think I'm harsh... it's illegal to stay on an expired visa (Even though she's hoping it will be extended at POE) what if it was not extended?
I've renewed 2-3 visas of my colleague (Who visited twice and did not stayed in U.S for more than 12 days) before they expired and they were called for interview so from my own little experience I think it's advisable to wait till after expiration.

You should know that it's risky traveling on a visa with less than 2 months validity and still want to stay till january... you self think am now.
My advice is that you should wait till your visa expire and re-apply through dropbox, if you re-apply before expiration of your visa, you might be called for interview.

I need your assistance and suggestion and would be delighted to have them.
My wife intend to visit the US for a period of 4 weeks this July. After filling her DS160 and submitted it was time to pick a date for her appointment, unfortunately the whole appointment date was booked till Nov. Her travel date filled in the DS160 is 27th July to return 26th August. As it stands now getting an appointment date for her travel date is not feasible. What do you suggest we do?

I was told it might be complicated explaining to the guys at Dulles, dat it is better I go through same POE which is NYC.
At NYC , they didn’t even ask me bout my family, I guess maybe because our initial 6months is still valid.
