Like canceling 10 witnesses because they didn't make their statement on oath before hearing? Despite that they were subpoena witnesses? That is witnesses by order of court?

The judgement was already determined before hearing and there were rumours that it was written by Tinubu Presidential Legal Team.

My brother justice is dead. Let's just pray that life will be good for us no matter the show of shame and illegalities of the government.

Most of us are too much in a hurry to condemn seemingly underperforming players. The Giroud that we all condemned is he not still playing in CL? He left Arsenal to Chelsea and then to AC Milan. He has not dropped. Yet when he was with us we felt he was the worst striker. As it stands he has even broken Henry's France's record.

He played Euros and WC and he's not been spectacular in German shirt.
He has played numerous friendlies in German shirt and he hasn't been spectacular on most occasions.

I don't want to talk about his Chelsea's shirt cos anyone who followed his Chelsea's stint needs no epistle.

So please don't make it seem as if we bought one World class player that's just acclimatizing to arsenal's shirt.
A player that gets a call up for NT for Germany should be respected.

No. He will also need 25% in 24 states.

To be declared winner in the first election you need to have 25% in 24states and 25% in FCT.

Where no one achieves this, there will be a second election between the majority winner and the second person with highest number of states. This second election will be determined by a simple majority. Here no spread is required.

That's the simple honest interpretation of the section of the constitution.

If a candidate has 25% in Kano and another 25% in Imo, are they the same?

When the constitution says that a candidate must have the spread that's where 25% in FCT comes in. It has nothing to do with the value of the votes. It's simply a matter of spread.

INEC result cannot be blurred, it was the IREV that was downloaded that was blurred.

The court were simply telling him IREV was useless as it was secondary evidence, he should provide the result that was blurred on the IREV .
If you followed Adeleke Vs Oyetola you would know that IREV is primary evidence.

Even the justices yesterday affirmed it that those copies as long as they are certified by INEC remain primary. The flimsy excuse they used was that Obi didn't mention each of those 18088 polling unit as if it makes sense. How can anyone mention polling unit from a blurred unreadable document? Nonsense.

She tendered hard copy result from her Polling unit agent to show that the one declared by INEC is wrong and she was the winner of the election.

The results were recalculated and she was declared winner.
First of all are you saying that agent copy has a high probative value?

Secondly, for your information Peter Obi submitted 10000 hard copies of agent results. But the Tribunal used it against him. That if he was saying INEC results were blurred where did he get his own results from.

I believe you followed the judgement.

With what happened yesterday, I think appeal court in their wisdom played safe knowing fully well that their decisions, either for or against the defendant will have little or no impact in the case since the case will still end up in the supreme court and while the case is in the supreme court, they will still depend on the same government for their security and you know how the judges were delt with by the the Buhari administration.
The judges that can sack a sitting president and get away with it is the supreme court judges and not the appeal court judges.
From the embarrassment I noticed in the faces of the judges this is correct observation.

I will recommend you read the case of Oyetola vs Adeleke in Osun. Oyetola proved his case and succeeded at election tribunal but lost to technicalities at appeal and supreme Court for relying on INEC accreditation print out and not refer to BVAS.
If this case is your recommendation then know that the lawyer that won the case for Adeleke is Peter Obi's lawyer.

I don't need to make any other comment.

Who was optimistic? Not me.

We must appeal!

We actually want to waste our time and resources.

We also want the judgement to be set as precedence and there's no better place for precedence to be set good or bad.

We want the Supreme Court to say INEC can change the mode of transmission during election.

We want them to say Thuvb drug case was targeting his accounts and not him

We want them to say Guinean citizenship was not included initially

We want them to say IREV and electronic transmission is optional

We want them to say you can forge your certificate

We want them to say a political party cannot sue another whether pre or post election

We want them to say even if you supply INEC certify true copies, you still need polling unit witness and EC8s tendered

We want them to say you must prove polling unit by polling unit upto 100 thousand even if you have 2 months.

Once the Supreme Court upholds these dangerous precedence, then we can rest but we will not rest before then!

Charge and bail lawyer want more money. I will say this again. The only way to upturn president and governorship election at tribunal is to prove with an evidence that you actually won the election. That the candidate INEC declared as winner didn't win majority of valid votes. Any other grounds, certificate issue, past records e.t.c can only succeed as a pre election matter.
Help us by telling us what one needs to prove he won an election. What are the things needed to prove it?

If you think justice was served then I pity you because there will be no hope for any of us as long as election petitions are concerned.

I asked a simple question, tell me what Atiku or Obi could have done to prove they won.

For your information, Agent copies are secondary evidences. Primary evidence are INEC CTCs.

The trick the justices used was to ask Obi to calculate his results before petition. How can he do so...
1. INEC refused to release BVAS for inspection.
2. INEC cleaned the BVAS and asked them to use IREV.
3. INEC did not release the IREV copies until petitions were filed.
4. The IREV copies were unreadable

So in essence, the justices blamed Obi for what INEC did.

Apart from this, in order to ensure that the LP petition does not rope them, they knocked off witness statements of 10 of the 13 witnesses called including those on subpoena.

Jungle justice.

Are you asking based on the mutilated results in favour of TInubu or the blurred results by INEC. Which one?

If Obi presents agent copies they will say they are secondary evidence.

If he presents unreadable INEC CTCs they said he didn't calculate his scores.

Tell me what can Obi or Atiku do to prove that they won?

There's evidence that the judgement was leaked before today. If not explain why Peter Obi and Atiku were not represented and all APC stakeholders appeared in court laughing even at the time the addresses were being heard.

Besides, I already knew that justice isn't going to save Nigeria from criminal elements. You could even see how the APC lawyer was reprimanding the justices. grin

Human life is very cheap in Nigeria. While many inmates in Nigerian prisons were jailed for crimes they actually committed, some inmates were jailed or remanded wrongfully.

For the latter case, there have been a series of examples of people that were remanded or jailed unjustly, who regained their freedom, and their time in prison actually assisted them in achieving greatness later in life.

Wole Soyinka is a good example. When you visit Nigerian prisons, you hear different stories.

If some people weren't remanded or jailed, they could actually have died if they were free.

Sometimes, what a person sees as bad is not, and the converse is also true.

Funny enough, even some people, who think they're free because they're not in prison, are even in a much worse cage, the mental type, than those in a correctional center.

Nevertheless, crime doesn't pay, and for those scheming, plotting, and planning the downfall of others or how to defraud others, may the forces of the Universe make them "use their head to carry their evil plans", or nature or the law will catch up with them.

Lols, very funny. Islam is my religion of birth. I was indoctrinated and forced to engage in it from childhood.

If I had a choice and knew everything I know now as a child, I'd have remained an agnostic, which is the state of every human when they're born.

Fortunately, on reaching adulthood, I was lucky to interact with some highly intelligent people on Nairaland, which allowed me to research the history of the religion deeply and left it some years ago.

Now, I don't immerse myself in a specific philosophy, however great it's. So, yes, if I go deeper into Ifa and become initiated as an onifa (a priest of Ifa or babalawo), I'd still leave it later and become a freethinker.

But I don't really have the time or interest for such things. So, I don't immerse myself in a specific philosophy.

I read wide from diverse philosophies. Only a low-level thinker worships his mate as a god/God and immerses himself in that god's philosophy, which people call a religion, instead of creating his own philosophy to live by.

I don't worship any god/God. Now and in the foreseeable future, I'd always be a freethinker and an agnostic. Some people might call themselves pure atheists in the West.

However, I pity any freethinker in Africa that embraces pure atheism. It doesn't make sense and is a risky position to adopt in Africa.

Agnosticism, whether leaning towards theism, deism, or atheism, is actually the most reasonable position for freethinkers.

Some m.orons actually think my support for Otem means I follow his philosophy. But Otem himself knows I regard his works critically and put them through a test of scrutiny and logic.

Those that gave the book to him even urged readers to adopt this critical/skeptical approach as all of them were atheists and agnostics during their times on Earth.
