.Ade Adesomoju, Abuja A Federal High Court in Abuja on Friday affirmed in two separately rulings on Friday that the certificate of return issued to Uche Ogah by the Independent National Electoral Commission paving the way for him to be sworn in as Governor of Abia State, was valid. Justice Okon Abang ruled that the two separate judgments delivered on June 27, removing Onyechi Ikpeazu as Governor of Abia State and ordering Ogah to be sworn in his stead could no longer be stayed since the Independent National Electoral Commission had already issued fresh certificate of return to Ogah. He ruled that the judgment removing Ikpeazu remained valid until it is set aside by the Court of Appeal. The judge ruled, “The order of the court subsists until set aside by the Court of Appeal. “Therefore, the INEC lawfully issued Certificate of Return to Dr. Sampson Ikpeazu as it was in line with the judgment of this court.” The judge made this declaration in two separate rulings dismissing the motions for stay of execution filed by Ikpeazu and the Peoples Democratic Party with respect to one of the two judgments delivered on June 27. The June 27 judgments were delivered in two suits separately filed by Ogah and one Obasi Uba Eleagbara. While the court refused to hear Ikpeazu’s motion for stay of execution of the judgment with respect to the case numbered FHC/ABJ/CS/71/2016 which was personally filed by Ogah, the court dismissed a similar motion filed by the embattled governor and the PDP with respect to the suit, numbered FHC/ABJ/CS/1086/2014. With regard to the first case (filed by Ogah), the judge ruled that he could not go ahead to hear the motion for stay of execution since lawyers to the opposing parties (Ogah and Ikpeazu) had both submitted that the court no longer had jurisdiction to hear it because the appeal against the court’s judgment had been entered and appeal number issued. But the court dismissed the motion for stay of execution filed by Ikpeazu with respect to the judgment on the case filed by Eleagbara, on the grounds that it lacked merit. Though Ikpeazu’s lawyer, Chief Wole Olanipekun (SAN), sought to withdraw the application after the judge refused his request for an adjournment of the hearing on the motion, the judge held that the prayer for its withdrawal was belated since Ogah’s lawyer, Alex Izinyon (SAN) had been made to file a counter-affidavit opposing it. The judge held that since issues had been joined, the motion for stay of execution was deemed to have been heard regardless of whether it was formally moved in the open court. Justice Abang also held that since INEC had issued Certificate of Return to Ogah, there was nothing left to be stayed. |

The Ooni of Ife, Oba Adeyeye Enitan Ogunwusi, on Tuesday caused a major drama in Washington D.C while performing a traditional rite. The Ooni and his crew performed traditionally at the Smithsonian Museum of African Art. During the performance which involved fire, fire brigade stormed the Smithsonian Museum of African Art, after they were called in following display of fire and smoke. On their arrival, they found out that it was the Ooni of Ife and his crew, performing some traditional rites and left after they were sure it was not a fire outbreak.

At least 15 people have been killed in two days in ongoing war between members of two criminal gangs, the Baggars Confraternity and Mafians, a version of the Klans confraternity in Calabar, according to CrossRiverWatch. “The hostility between the Baggars and Mafians sources say, began last Tuesday afternoon along Palm street where a strike team of Mafians attacked and killed a member of the Baggars gang along Palm street with his skull carved open with a machete and slashes along his stomach and arms which infuriated his colleagues who later carried out a reprisal attack with at least two mafians gunned down in Goldie and Yellow Duke street axis of Calabar South on Wednesday,” CrossRiverWatch reports. “The killings continued Thursday, as 3 more were gunned down at Mbukpa, with 2 happening close to the Mbukpa market, 1 at Umo Orok near New Airport road and Bedwell, all before noon while a source said one more was killed at an undisclosed. “Another killing occurred later in the day along Palm Street by Mayne Avenue and 1 more was gunned down along Whitehouse street also known as Dan Archibong street, close to Nyong Edem street on Friday morning between 7:30 am and 8 am. According to sources, some Baggars Thursday, converged at the CRUTECH pavilion to plan an attack on selected targets in school only for a combine team of the State Anti Robbery Squad (SARS) and Operation Skolombo in about 6 siren blaring vans chased them away following a distress call from the school security network as no fewer than 3 CRUTECH students have been lost to the ‘wars’. “One other person was said to have been killed at Etta-Agbor by Akim. The brand new Bakassi Strike Force – a militant group who recently emerged, have condemned in totality the activities of the Niger Delta Avengers militants in blowing up pipelines. A group of new militants has emerged from the Akwa-Cross Region under the umbrella of Bakassi Strike Force, and has already spoken out in new video to condemn in totality the activities of the more popular Niger Delta Avengers blowing up pipelines. Speaking at Esuk Mba, in Akpabuyo Local Government Area of Cross River State, the leader of the group, Simple Benjamin, said these attacks on oil pipelines have a retrogressive effect on the economy of Nigeria, adding that the President Buhari-led Federal Government should listen to the agitations of the Niger Delta Avengers.According to him, there is no struggle without a reason and so, government should adopt the approach of the American Ambassador to Nigeria who is an advocate for dialogue as war alone cannot solve their problems in tackling the issue. We reported it here earlier today that the Niger Delta Avengers on Friday said that it has bombed yet another crude oil pipeline belonging to Agip ENI in Bayelsa State, Nigeria’s Niger Delta region. An explosion also rocked a pipeline operated by the Nigerian Petroleum Development Company (NPDC) at Sanomi Creek, in Warri, Delta State on Thursday evening but nobody has claimed responsibility for the blast. The Niger Delta Avengers, which has claimed responsibility for most of the recent attacks, on Wednesday, rejected an offer to dialogue with the Nigerian government.
