Visa huh huh As a Nigerian?
I know, that's the part I'm not sure of. . If Nigerian immigrations quiz you on how you came in then you'd have to mention expired passport. So then why isn't your passport renewed before returning to the UK?

Can you take a leave of absence from a new job. I've been there for less than a year and just passed my probation period of 6 months.
Find out about your HR policies.

Or get your doctor to provide a letter and take FMLA. It's federal govt protected leave, your job would be protected. I think FMLA is up to 12 weeks.

Find out about it

You have to be alive to work o. So pls put yourself first and get back to yourself biko.
The US makes you feel like you have to work till you grind yourself like crayfish lol.

Yes you can travel on expired passport.

However, if you want to return to the UK with a UK passport you would be asked how you entered without visa. That part I'm not sure

Most of the advanced treatments have failed but the fertility issues is not the reason I'm sad and lonely. In fact I fear taking additional responsibility in the name of kids given my physical and mental state. And to those who are asking why are turned irreligious. It's simple. I found out I wasn't gaining much from church.
Focus on you first, children can come later.

Consider volunteering..it's good cos it gets you out of your own head. Gratitude and helping others can do a lot when you're giving without expecting anything in return

About church, take small steps and just talk to God. One day at a time just talk

Hello nairalanders I know to a lot of Nigerians who have never left the country this may sound funny. But I'm indeed frustrated with my life in America. I moved to America as a student in 2016 for masters in an engineering degree and after about 7 years I obtained a U.S Greencard. I work a middle income job with the government and I'm here with my Nigerian wife. I have faced a series of health challenges since I got here and some have been resolved and some additionally ones have cropped in with the latest being depression and extreme fatigue. Currently I'm on antidepressants but I'm still depressed and frustrated. My job is not that taxing but I wish I could do more save for the extreme fatigue that the doctors have not been able to resolve. I wish I could hustle harder but my health is not allowing me to. I feel also very sad and lonely living in the U.S as it's only me and my wife and I dont really have any friends. Everyone here always mind their business and its tough building any meaningful relationships. I have toyed with the idea of moving back to Nigeria in my head since America has not been all I hoped it will be for me but my wife does not want to and she quickly reminds me of the employment suitation in Nigeria and how it is me that made her come here in the first place. She kind of prefers it here. We have no kids yet so that is one additional information. I'm just venting and frustrated and I hope maybe some Nairalanders can come to my aid. Additional information. I dont come from a rich family that has money sitting in the bank and its me and my own. We just bought a house on a 30 year mortgage so we pretty stuck with paying the debt for 30 years but I don't know how I'd live here for 30 years. Just looking for someone with experience to share ideas with since I have no one. I feel stuck. Please no insults
It's your life so you can be frustrated it's okay.

Can you take some time off, a leave of absence..a change of environment might help you think and reflect on what dreams you had that you never took up.

Extreme fatigue typically needs a break
.no pressure ..no pending commitments.
Start with 2 weeks or one month and be a child again .
Doesn't have to be anywhere expensive ..a resort where you can see sunlight regularly.

Your wife is responding from a place of fear so her discouragement is because she sees you moving as losing your security. So take that break with her.

The one time I had extreme fatigue I had experienced mild depression months before which I didn't pay attention to.

I was on a call and my speech just slowed down everything just slowed. I asked those on the call if I sounded strange. They called for help . Hospital checked everything and my vitals were fine. Yet I felt and moved like someone who was recovering from surgery.

In the end I cut down everything that day. Work Calls, Stress shut it all out. I learned from that.

Take a break and find you again.. remember the things you really enjoyed no matter how silly they are and do them. It will help reset you.
Since you're being treated for depression go on these breaks with someone and find some Sun

United States v. Wong Kim Ark, 169 U.S. 649 (1898), was a landmark decision[4] of the U.S. Supreme Court which held that "a child born in the United States, of parents of Chinese descent, who, at the time of his birth, are subjects of the Emperor of China, but have a permanent domicile and residence in the United States, and are there carrying on business, and are not employed in any diplomatic or official capacity under the Emperor of China",[5] automatically became a U.S. citizen at birth.[6] This decision established an important precedent in its interpretation of the Citizenship Clause of the Fourteenth Amendment to the Constitution.[4]

Partially agree with you but i think the case hinges on the last part. They had "permanent domicile and residence" in the United States. You could argue this does not apply to anyone here illegally or on temporary student/visitor visa. That's exactly how the EO is frame. I think SCOTUS keeps the 14th amendment but narrows its applicability to only those who have permanent residence visas in the US only.
I concur, that's where I think it does have merit
It would be monumental of SC decides this way

Sure bro. We have presented it and was accepted. Now been waiting for appointment date for the Mama.

Quick one bro, have been in the US for 2 months, got my SSN but my GC card haven't come out yet. I'm planning to travel out of the US, is it possible to go out? My immigrant visa is still valid.

And with what the current administration is doing, do you think it's not a problem?

@Taal17 and others, I also need your input please 🙏
Have you contacted USCIS
Did you pay for your green card? If you haven't then you need to. That's what delayed mine, fortunately I received a letter telling me I haven't paid. I got the card about 2 wks after
Check USCIS site
Also your address is it the same address they have for you.

DOS where border patrol sits may have some overzealous staff so even though you visa is valid for a year. I would have the GC first.

Do you have a job or training or schooling in the US Do you have ties including residence card drivers license. All these show you have established domicile.

The 14th Amendment is a complex piece of legislation, and any constitutional conflicts surrounding it can only be resolved through a ruling from the Supreme Court. Currently, the executive order signed by President Donald Trump is facing challenges in court, and we’re all waiting to see how that plays out. If you're already in the U.S., it's best to just take a deep breath and relax. Since the introduction of this executive order on the 20th of January, I've reviewed and contributed to various legal opinions. The 14th Amendment has been tested since 1884 and has stood firm despite challenges. The executive order overlooks established judicial precedents and the overarching authority of the Constitution.
the reasons for the amendment are not the same reasons in these times though., it's not a Civil rights matter
either of two things will happen the EO will be suspended till it gets to the supreme court or it will stay till it gets to the supreme court. Either way the judicial process will take some time.
Although Roe vs Wade is different, yet it was overturned after decades.

Jus soli is not even present in many countries of the world both developed and developing. Outside the Americas Jus soli is rare. Africa Asia Europe, UK and Oceania.

Its the arrest of 'illegal' immigrants in hospitals and religious places that I think states should face because that's just crazy, illegal is not the same as undocumented before ICE people start clearing people anyhow.

Bumping this up again, anyone waiting for their passport that did interview waiver

Hi everyone,

I wanted to share my timeline and ask for insights from others who’ve experienced this process recently.
• Document drop-off date: Dec 20th
• Case created date: Dec 23rd
• Case last updated date: Dec 27th
Status still reads Application Received
I’m scheduled to return to the U.S. on January 17th,but I’m still waiting for my passport from the embassy.

Has anyone been in a similar situation recently? How long did it take after the last case update to receive your passport? Any insights would be greatly appreciated!

Thank you!
Have ypu tracked ypur passport on OIS website?
To see if its there, if it is you can schedule appointment on OIS site for pickup

For those who need the text of the EO see here.

Its effective 30days from Jan 20.

For mother's already in the US. Don't be anxious whaats paramount is your safe delivery and the health of mother and child.

For those intending on coming for this reason Id advise caution.

Has anyone switched from interview waiver to an in person appointment, the processing for the interviewer waiver according to the Lagos Navigator is 2 months while the in person interview is 5 business days, do you know if i can switch and go for an in person inteview with a copy of my passport since they have it
2 months, 5 days ..are these timelines to get your passport back? Or to get date to submit passport/interview.

Won't you still need to get an interview date first for in person . Most ppl here who have shared are getting dates much later in the year.

The question is if anyone has ever filed for them and not if it was successful or not.

This trying to be smart by half will paint them in a bad light. A VERY BAD LIGHT.
Choose if this the hill you want to trip over.

A petition being approved is where immigration filing starts. Anything else is a false start imo

Am filling out DS 160 for my parent. Some years ago, I filed I-130 but the application was unsuccessful. On the DS 160 form, there is question "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?" Should we answer Yes? Hoping this won't give parent reason for denial although parent has visited me in US years ago before filing a I-130.
Since the petition was unsuccessful then the answer is no in my opinion
Your parents do not have an existing petition for them.

What advice do you want
It doesn't seem like you have admission into any school yet.
If the funds as you say are yours then apply to the school, get admission and pay your school fees. Sebi your uncle has the funds let him pay for the school.
That you are single or that you have been denied tourist visas before is not relevant since you are applying for study.
If your dad filed for you and the petition was not approved then you don't have an application with them. The answer is no.
Your father has passed our condolences, if they ask about him just tell them he has passed .
Since you said there are funds to cover your tuition, are there also funds to cover your living expenses? You need answers to that to get your admission.

Nobody can tell you whether you will get the visa or not. This is not betting na

Don't know if this is allowed here but I am truly sorry. Please I really need assistance or advice to help me finance my last semester as a master's student in the US, I'm in dire need of my tuition fees amounting to $8000 for the spring 2025 semester as things didn't go as planned, I will appreciate any help, resources or advice you could offer me to allow me graduate in May. I can provide my proof of enrollment if required, thanks.
Can you apply for student loans?
I guess you are eligible for OPT so you can pay back over time.

Do you have access to credit through your credit cards? As a student banks should offer credit cards.

Does your uni have any scholarship even the 500, 1000, type where you typically have to write an essay etc. it will help in paying back what ever loans you may have to take.

When they get in they can sort out nin and sim card at any Airtel or MTN office.

Hello guys! My sibling got a USA visitor visa. So she booked a flight for Jan 2025 but scheduled her return trip to 1st July 2025. I wish to enquire on the following;

- Is it advisable to schedule a return flight as far as between 5-6 months? Is this a safe option or does it pose any risk?
- What kind of questions would they ask at the US airport (JFK & Atlanta) ?
- when people travel to USA on visitor visa, how long should one usually schedule their flight arrangements - for both arrival date and return trip?
I'm pretty sure she didn't say she was staying six months on her DS160.

It's highly likely that at the border she will be asked how long she'll stay in the US for.
She better rebook her return for a shorter period quickly.
She can always extend the date later.

I'm not sure what her future plans are with the use..but note that the decisions she makes today will affect her future tomorrow. Be guided

If yes, what documents does she need
Aa you exit after you get your luggage you might see Airtel or MTN kiosk. He can ask there.
If it's to be able to contact people...just ensure his mobile is on for data that way he can use WhatsApp It might be pricey but it's better than being stranded. Roam your line.

Greetings friends. Please I need advise. I got my immigrant visa (F41) this December, and I'll be travelling soon. My petitioner stays in California, but I want a place with cheaper cost of living in the surrounding states (Nevada, Utah, Wyoming, Oregon, Washington, Idaho, etc).
Which area is better suited for a new immigrant to settle with wife, for work opportunities as a Psychologist and business-oriented person, safety and security etc.
Or any other suggested states?
Id say don't get too hung up on cost of living.
States like Cali maybe more expensive however their average salaries are way higher.

Business is not restricted to any state, the market for that business idea is more important than the state you live in.

First land in Cali because you'll need soft landing.
If you want to work as a psychologist then look for what certs you need to do that in your state. Remember you might still spend your first couple of months recertifying and understanding the work culture.

America is really large so the city in the state is probably more important than the state. Cities in one state can be like night and day.

Since you're coming with family consider other factors like community, accessibility. Cos this US driving na like breathing. Lol

Thanks everyone for the messages, the links shared and the suggestions provided. i really appreciate them all. My brother is already married to a USC so he's kind of sorted.

To answer your question, i see the confusion too and this is what happened.
After the filing in 2016, the first mail i received from nvc was in dec 2021 saying my status has been updated and that i should make payments and start submitting my documents which i completed in feb 2022 . When i was done with that, they sent a mail saying my case has been transferred to USCIS and that they will get back to me when they are done reviewing it. i didn't hear anything from them till now and in the recent mail they sent, i just saw that my petition was approved in 2020 which is news to me because i didn't know until now.

At this point I'm even tired, this journey has not been an easy one on me and right now, if it so happens that it get revoked then life goes on.
Then your petition was approved . You even got to submit documents on ceac site.
Did you get notice that you were approved?
Search for humanitarian reinstatement, like others said share your story on the Facebook site and on visajourney.com
I think you have a good case
Just search petitioner does after i130 is approved online
Google AI tool will tell you steps to do.
Just print and all records that show the petition was approved hopefully before your mum passed.

As you said though, you can always consider other ways of immigrating. Don't be concerned that you could be refused a visit visa. You want to visit family..the family you have and that's fine.

Hi guys
My story is sort of long but I really do need help, suggestions or assistance on what to do.

My petition is about to be revoked and I have been given 30 days to give good and sufficient cause to show why it shouldn't be revoked.

In 2016 my sister using my mum as the petitioner filed for myself and my brother. We didn't hear anything from nvc and we were hopeful. In 2019, my mum passed due to complications from covid in the US and I knew it would somehow affect our filing. In 2020, they said my petition was approved but I didn't get mail or letters from them until 2022 when they said Ishould submit my documents which I did. From nvc, my case was transferred to uscis and each time i checked for update, I was told to wait as they were gong through my documents and will get back to me. Now my sister just received a letter from uscis with the title NOTICE OF INTENT TO REVOKE. Just to add, my brother has been in the US since 2015 because he went through the study route while I'm the only one here in Nigeria but we are both still waiting for this filing to come through and we both received this letter of revocation.

They say humanitarian reinstatement is not available in instances where the petitioner has died prior to the approval of the petition and now they say we need to submit evidence in support of the petition and in opposition of the proposed revocation. I don't even know what other type of evidence to submit as I'm not there with them.

In this case where the petitioner is no longer alive and we only have our sister whos is the sponsor, what can we do and how do we go about it? Im so confused right now, imagine waiting alone for 8 years and not being able to see your family or even your only parent alive just to get this type of response.
Your suggestions will really be appreciated. Thank you
Your story is a bit confusing. Ypu initially said you were told your petition is approved. Do you have evidence of that? How did you know that you were apprived in 2020 when you did not receive any mail or letter
Why did they ask you to submit again in 2022
after you were said you intiallyapproved in 2020.

Your case rest on if you actually received an approved petition.

Hopefully the links shared can provide useful tips.

J
