I'll speak strictly from a legal point of view. There is something called "bona fide purchaser for value without notice". This is a concept deeply rooted in the garment and firmament of our laws from time immemorial. The basic gist of this concept is that if someone obtains a defective title to a property without knowing that the title of the previous owner is defective, and having done every thing within his power to ascertain the defect, the law would allow him keep such property. For example, if Mr. A sells his land to Mr B. and Mr. A has colluded with the officials of the land registry in issuing wrong papers to Mr B. If Mr B should sell the land to C and C goes to the land registry, conduct a search and discovers everything is okay. The law would allow C. to keep the land because he is a bona fide purchaser for value without notice (of the illegality)

Applying this principle strictly to what we have on ground, the custom officials, in my view, won't have the right to permanently impound the vehicle. He has conducted a search in their office and everything looks fine. So he has no fault since he wasn't the one who bribed the custom officials but his predecessor-in-title.

Based on this report and assuming everything reported is true, This case will be thrown to dustbin and the defendant will be discharged and acquitted. The surprising thing is that when the defendant is acquitted, people will be shouting that justice is only for the rich, the judge has been bribed bla bla bla. This is not so.

The Nigerian Law is anchored on a core principle - He who asserts must prove! And this matter being a criminal case, must be proved beyond reasonable doubt. In order words, if there is any reasonable doubt as to whether or not the accused committed the offence, he'll be discharged and acquitted.

Just take a look at the evidence of the prosecution witness.. just imagine how crazy. "I examined the pubic area, noticed a whitish discharge but I didn't not conduct a test on it". This alone can make the prosecution lose the case. The defense may say that "yes the victim may have been raped but there is nothing linking me to the rape. That the whitish discharge belongs to someone else and not me." Now the whitish discharge has gone and it can't be re-examined again. So the prosecution would not have any evidence to say that this whitish discharge is yours and yours alone. Furthermore, since everyone is presumed innocent, the court will not have a choice than to discharge him.

The defense could also raise the fact that the witness is NOT credible. Lol, you all have to pay me in order to tell you why I said so. ...

In all, this case is badly prosecuted and I won't be surprised at all if the prosecution fails to secure a conviction.

OP things are more complicated than you think. I have lived in Lagos for a huge part of my life and I can authoritatively say some things about their politics. Besides, I have friends from Lagos and whose families are into politics.
First of all, All politics is Local and Ambode made a very big mistake. Probably because he was an auditor for Badagry LG, be knew where the loopholes are in the Local Government and where the LG chiefs are getting their pay. On becoming governor, he blocked ALL the avenues for making money by the LG. For example, he took all the money meant for capital projects by the LG and he executed it on their behalf. In he 20 LG and the 37 LCDA in Lagos state, he constructed two roads. This infuriated the LG chiefs because executing projects is one of the means of getting money. As such, they're vexed.

Also, most of these LG chairmen were put there by the Godfathers in their area. So since they were unable to generate returns for themselves, how could they possibly grease the arm of their pay masters thus annoying the "Party Elders".

Finally, The APC in Lagos is factionalized with various groups. The Mandate Group has been the dominant group since the inception of AD and it controls close to 3/4th of the membership of APC in Lagos. The leaders of this group is fiercely loyal to Tinubu. So be it as it may, Tinubu holds the balls of the APC.

And for those advising Ambode to defect. That'll be his undoing. Apart from the fact that Tinubu has invested in the media, the APC controls the Federal Government. All the LG chairmen are in APC and these guys are the ones that influence election. Almost all the thugs in Lagos belong to Tinubu camp. The traditional institutions and all is sympathetic to Tinubu. I doubt if he will ever survive it.

As if we knew such a thing will happen. When China struck the Muslims, our other brothers were jubilating unbeknownst to them that their cup will soon full...

I just pray China stops this human right abuse against Muslims, Christians and the Tibetans.

Hey bro..thats not how the judicial system around the world works. "Justice is rooted in confidence" goes a popular legal maxim..How can u have faith in a person you believe he isn't going to be fair to u? The standard practice is that once you accuse a judge, the judge will step aside irrespective of what the NJC says.
Besides, Judges are humans. How do u expect a judge you've accused of being a thief handle your matter pending before him..it's just pure logic. Hope u grab the rationale for the NJC opinion?
