The second phase of this topic is here; Shari'ah II: Phantom Heaven |
lafflaff123:Welcome |
Throughout the Qur'an, cases of disbelievers ridiculing, desecrating or defaming the Qur'an or the Prophet are mentioned numerous times(Qur'an 15:6 17:47 34:8 37:36 68:51). Not even in one instance is a punishment prescribed for the blasphemers. At most, what the Lord expect of the righteous is to admonish the blasphemers(Qur'an 6:68-69). In short, Shari'ah is not the law of God. It is the law of mortals attributed to God. TO BE CONTINUED |
DESECRATION Tombs, shrines, altars or temples are sanctified public places that ought to be protected like other public spaces as Banks, Markets e.t.c. Desecrating such places certainly cannot go unpunished. However, the bone of contention is that Shari'ah goes overboard. Last month, a young Pakistani couple were killed by Pakistani Muslim mob after a Qur'an copy recovered from a public refuse dump was traced to their door. All their pleas and cries of innocence did not slow the mob in casting them into a kiln. It doesn't matter whether this killing was legislated by a Shari'ah court or not. It remains that even a Shari'ah court could have had the couple executed. Confirm I do not relish repeating horror tales about the Muslim world. But i have heard too much to be silent or politically correct. The Qur'an repeatedly states that it belongs to mankind, not Muslims alone. Anyone may own a Qur'an copy and no possessor of Qur'an copy can be held accountable before another man except God over his copy. Except the desecrated Qur'an belong to someone else, it is injustice and overt intrusion of personal affair to penalize the desecrator if the Qur'an copy is his personal item just as penalizing a man for confiscating his radio set is. |
Remember Raif Badawi the Saudi blogger and activist serving 10 years imprisonment and 1000 lashes for criticising clerics, Saudi state and "Islam"? Confirm Last decade, an ex-orthodox Muslim Ayaan Hirsi Ali faced death threats for suggesting that if Muhammad lived today, he would be charged for pedophilia since he is reported to have slept with Aisha; a minor. However, Ayaan 's suggestion cannot even be deemed defamatory since she was merely invoking a tradition of mainstream Muslims::: Narrated 'Aishah:It is indisputable that mainstream Muslims are the biggest Islamophobes since their own books of tradition are full of slanders against Muhammad. Luckily, Ayaan got away, thanks to being in a secular society. Under Shari'ah, it would have been bloodier. Aasia Bibi, a Pakistani Christian is paying the price today for allegedly making a derogatory remark about Muhammad in response to derogatory remark on her religion by Pakistani Muslims. She has been in prison since 2010. With the Shari'ah court bent on death sentence, her future may be grim. Attempts to bail her in the past has ended in assassinations of a Minister and Politician who condemned the blasphemy laws. Confirm |
^^^^^ It may be justifiable to penalize persons for insulting or cursing revered or venerated figures but to stone, decapitate or slaughter like a goat as sanctioned by Shari'ah in the light of the above traditions is criminal. See, here is another troubling thing about Shari'ah. Even mere polite criticism or disapproval of the religion is ruled as blasphemy by Shari'ah authorities and punishable by death. In fact challenging, debating or probing 'Islam' is crime in Shari'ah states. |
DEFAMATION Abu Dawood (4361) narrated from Ibn ‘Abbaas that a blind man had a freed concubine (umm walad) who used to insult the Prophet (peace and blessings of Allaah be upon him) and say bad things about him. He told her not to do that but she did not stop, and he rebuked her but she did not heed him. One night, when she started to say bad things about the Prophet (peace and blessings of Allaah be upon him) and insult him, he took a short sword or dagger, put it on her belly and pressed it and killed her. The following morning that was mentioned to the Messenger of Allaah (peace and blessings of Allaah be upon him). He called the people together and said, “I adjure by Allah the man who has done this action and I adjure him by my right over him that he should stand up. The blind man stood up and said, “O Messenger of Allaah, I am the one who did it; she used to insult you and say bad things about you. I forbade her, but she did not stop, and I rebuked her, but she did not give up her habit. I have two sons like pearls from her, and she was kind to me. Last night she began to insult you and say bad things about you. So I took a dagger, put it on her belly and pressed it till I killed her.” Thereupon the Prophet (peace and blessings of Allaah be upon him) said: “Bear witness, there is no blood money due for her.” (Classed as saheeh by al- Albaani in Saheeh Abi Dawood, 3655) |
INTRODUCTION::: This is the second phase of my paper on Shari'ah. In the last phase, i dealt with apostasy, adultery and theft. It should not puzzle you that despite all the injustice, cruelty and human right violations that results of of implementing Shari'ah in the Middle East, more Muslims continue to push for this law. The advocates of Shari'ah believe that implementation of full Shari'ah will revert their society to a heaven on earth. This heaven is only a PHANTOM HEAVEN, as earlier stated, majority of Shari'ah advocates are vastly ignorant of the law they wish for! This phase of my paper will deal with; 1. Blasphemy(Defamation and Desecration) 2. Religious coercion 3. Civil matters Let 's go! |
@talibilm, I do not agree with your explanation of Jizya. After reading mainstream Islamic literature, i have realized 'Jizya' in Shari'ah context is a levy that Christians and Jews must pay in return for practising their faith in the caliphate. Remember that under Shari'ah, Zoroastrians, Jews and Christians have 3 options; accept Islam, pay a periodic levy or face death. While atheists, agnostics, pagans may either accept Islam or die. Please read: The Puzzled 's Guide To Jizya |
juman:It is not bad government. It is Islamist insurgency. I think that is very important to note. |
The thing is, am highly skeptical of two things; 1. The authenticity of this news. No mainstream media outlet has has reported it. So maybe it is too early to post. See, here is another thing; there is not a single Muslim organisation that that voted for this, whereas, i see 2 or 3 Christian organization on the list above. 2. The calibre of refugees taken in. First, it is unjust to help only the Muslims and forget Christians. I don't need to elaborate on this. Secondly, if care is not taken in the selection, US will be admitting thousands of Islamists(not Muslims) who are in fact bitter enemies of western civilization and will plot, conspire and contribute to the Islamofascist agenda of the Muslim Brotherhood. As a side note, what has the Shari'ah states in the middle east done for these refugees and victim of ISIS? |
I think maainstream Islamic theology suck at times in interpreting Verses. As with Qur'an 5:38, clear metaphors in several cases ignored, while bizzare literal interpretation are chosen. For instance, look at this verse; Qur'an 17:45Here is the exegesis on this verse by Ibn Kathir, mainstream Muslims' foremost authority on Quran exegesis: Ibn Abi Hatim said that his father and Abu Zur`ah both said that `Abdullah bin Az-Zubayr Al-Humaydi told them that Sufyan informed them that Al- Walid bin Kathir related from Ibn Tadrus who reported that Asma' bint Abi Bakr said (Perish the two hands of Abu Lahab and perish he) !) was revealed, the one- eyed Umm Jamil bint Harb came out wailing, and she had a stone in her hand. She was saying, `He criticizes our father, and his religion is our scorn, and his command is to disobey us.' The Messenger of Allah was sitting in the Masjid (of the Ka`bah) and Abu Bakr was with him. After reading the verse and the next verse, any educated person should know that "barrier" here is mental barrier that hampers the understanding of the disbelievers NOT their sight. The next verse confirms this. This clearly show how irrationally literal mainstream Muslim clerics and their ancestors interpret the Quran for their sworn followers. They would not read the Quran rationally and yet they won't let others read rationally. Qur'an 39:29 |
^^^ The truth remains the truth. Ignorance or Malice cannot obliterate it. Those who interpret 'cut off' in Qur'an 5:38 as 'amputate' will have a hard time differentiating that from 'cut off on opposite sides' as in Qur'an 5:33 and 26:49. Qur'an 5:33I believe the adjective; 'on opposite sides' differential literal hand cutting(5:33) from metaphorical hand cutting(5:38) in the Quran. |
^^^ Another thing, you insist that the theif is to be pardoned if he repents. This is fallacy that appeal to the ignorant and apologists. According the traditions of Shari'ah advocating Muslims, the repentance and plea of a theif is not acceptable: Sahih Muslim 17:4190Anyone who tells you that Shari'ah permit amputation only for multiple offense(habitaual stealing) and pardon theives who plead guilty or repent is saying so for deceptive purposes. I have many evidence to prove this. |
The way you look at it is not how Shari'ah is applied in the Muslim world, gatiano. Shari'ah enforcers don't care for your police record to decide whether it is your first or second offense. The theif 's hand is amputated out right. Here are two examples; 1. Sahih Bukhari 8:81:791'An' or 'a' in the above indicate one offense, not multiple offense. 2. Theif To Have Hand And Foot Amputated |
AlBaqir: "And We have sent down unto you (Muhammad) al-Dhikr (i.e the Quran) that you may explain clearly to mankind what is sent down to them." ~Qur'an 16:44The word 'bayyina' which you wrongly translated as 'explain clearly' mean 'make clear' and can also mean 'manifest' or 'express' as in Qur'an 16:39, 92, 5:15 24:18. Nevertheless, your conclusion on this verse undermine several verses where God repeats that He makes clear His revelation(e.g Qur'an 4:176 24:18). What is the need of clarifying what has already been clarified. I won't be treating this verse again, especially when it is coming from an Islam section agent. Thank You. |
Weah96:Yes, leftists and liberals like George Galloway in the West support Islamists in fighting for Shari'ah. They have succeeded markedly in several states of Europe, notably UK. |
Regarding my metaphorical interpretation of Qur'an 5:38, please read more here; http://misconceptions-about-islam.com/cut-off-hands-theft.htm For the sake of time, i had refrained from elaborating extensively on this verse in this thread. I have met individuals who understand Arabic far more than many orthodox clerics today, and they interpret this verse metaphorically. lanrexlan: Your explanations do not hold water and laughable, it's your personal thinking which should be thrown into the dustbin.I wholly disagree with you on this. A critical study of your own tradition imply that several cases of theft were dealt with during the the Prophet 's time and people even stole after losing one hand. Here is a sample: Narrated Jabir ibn Abdullah:That, according to your traditions happened in the Prophet 's days, in the Islamic state where Zakat distribution and amputation for theft is enforced, supposedly serving as measures to eliminate theft. How come all these barriers or measures didn't deter or prevent the same man from stealing again and again(5 times) until all his limbs were amputated and he eventually had to be killed? I don't know how it is possible for a man steal after losing both hands and feet, but thank God i no longer buy hadith, otherwise like you, am left with no choice but to believe this ridiculous fable. Mister, the knowledge of the scriptures is not in the language. It is in the reasoning. Qur'an 10:100 It is not for a person to acknowledge except by God's leave. He casts the affliction upon those who do not reason. Qur'an 17:36 Do not uphold what you have no knowledge of. For the hearing, eyesight, and mind, all these are held responsible for that. Qur'an 39:18 The ones who listen to the word, and then follow the best of it. These are the ones whom God has guided, and these are the ones who possess intelligence. |
CONCLUSION If you consider Shari'ah academically, morally or spiritually, it is utterly bereft. Yet it get the vote of 90% of Muslims, non-Muslim leftists and liberals, most of whom are ignorant of Shari'ah decrees. Make no mistake, this is just the tip of the iceberg. There is more to the injustice and oppression in Shari'ah than death for apostates, stoning adulterers or amputating thieves. In my next article; Shari'ah II: Phantom Heaven, i will delve further into other areas of Shari'ah. |
gatiano: Surah 5:38poor translation there, "addicted" is not in the verse. Do your homework, Mister. Shari'ah punishes theft on first offense. Why don't you test that? |
Of course, the Qur'an 5:38 commands that thieves' 'hands' be 'cut'. But contrary to the exegesis of orthodox Muslim scholars, 'cut' and 'hands' may be metaphors in Arabic. You can't understand the Qur'an if you treat all the verses literally. Parables, Metaphors and other figures of speech can be found in the Qur'an. The word 'cut' in the above verse is 'iqtaa' in Arabic, occuring in 14 other instances in the Qur'an, of which 12 imply non physical or metaphorical cutting. Again, the word 'hand' in the above verse is 'aydi' in arabic and is used often as metaphors for power, means or resources. Keeping all these in mind, it is more appropriate to interpret 'cut their hand"; the penalty of theft as cut their means or resources. This may be applied by imprisonment which translate as cutting their time, or fine which translate as cutting their wealth, or labor which translate as cutting their strength. This is in tune with modern secular laws and captures the Qur'anic spirit of proportionality and moderation regarding penalty or retaliation. |
Because this penalty for theft is unethically excessive. It violates the moral and scriptural principle of equity and moderation in handling criminal. Amputating a thief is just as good as burning down a car simply because the driver violated parking rule. It fair well as a deterrence, but it falls short of justice. To ensure equity and balance in dealing with thieves, the value of the item(s) stolen have to be considered. That is why our first inquiry on learn of a theft is; "what was stolen?". Shari'ah failure to take this into account lead it to decree amputation for any thief, whether the stolen good is a gallon of gasoline or a motorcycle. Of course, a thief is a thief, but to penalize one who stole a piano and one who stole a van equally by amputation is injustice and disproportionate. In the end, having lost academically, Shari'ah advocates begin invoke the scriptures. |
You see, the penal code exist also to protect life of criminals, not merely to penalize criminals. Those turned of by "jungle justice" in rural parts of underdeveloped nations. Penal codes also exist to ensure criminals pay equitably and proportionately for their crimes, not negligibly or excessively. Shari'ah law fails in this regard. Too much focus is laid on deterrence while justice or redemption for criminals is totally forgotten. If you amputate a thief, you render him handicapped forever. Daily, he suffers for a crime even long after he has repented. Theft victims eventually recover or replace their belongings but a thief loses his hand permanently under Shari'ah. How can this be justice? Once a thief is not always a thief. Secular laws that mostly imprison thieves captures the spirit of the scriptures better than Shari'ah. The toll of the penalty is temporary, reversible and offers thieves a second chance to make to set things right. Shari'ah law condemn thieves to misery forever. |
THEFT As earlier stated, Shari'ah advocates have no logical or moral defense for the draconian penalties of Shari'ah. Their usual defense has always been on the basis of "deterrence". Yet, they have been able to win even non-Muslim liberals to their side. Qur'an 5:38As you already know, the penalty of theft under Shari'ah is amputation. Theft of any item beyond a fixed monetary value is punished by amputation. For this reason, Shari'ah advocates can boast of lower incidence of theft in Shari'ah compliant states. At face value amputation seem to be the ultimate measure to eliminate theft, but when we bore deeper, there are loopholes. |
fr3do:thanks for the reasoning. In a society where apostates are threatened with death, many believers are actually closet disbelievers waiting for the freedom to open up. |
To be continued.... gatiano! U need to stop trolling |
Speaking from the Qur'anic viewpoint, the stoning of adulterers can be debunked very easily. It is a man-made tradition plagiarized from the Bible and not Islamic. Throughout the narration of the Qur'an, those who stone are always the disbelievers. Never is it mentioned that believers stoned or were commanded to stone anyone. The penalty for adultery in Islam is flogging a hundred lashes(Qur'an 24:2). Where the adulterers are slaves(as in the middle ages), the penalty(100 lashes) is to be halved(Qur'an 4:25). Even upon letting aside its absence from the Qur'an, stoning to death cannot be the penalty for adultery because going by the Qur'anic stipulation, it is impractical to halve where the adulterers in question are slaves. |
If the Shari'ah advocate continue to proffer stoning adulterers as a measure to minimize infidelity or promiscuity in secular societies like the West, perhaps we may demand the abolishment of stoning adulterers in Shari'ah states as a step in eradicating honor killings. If you look at most Muslim communities over the World, particular the Shari'ah compliant ones, honor killing is a typical trend. Confront any Muslim in such communities about the draconian stoning penalty for adultery, their response never change. They insist on stoning adulterers because in their understanding, adultery is so corrupting and filthy that the only way to purge it from the society or expiate the sin of the adulterers is by stoning them to death. This dogmatic and superstitious view on adultery in turn generated rejection and stigmatization of whatever they consider near to adultery, like ladies having boyfriends or chatting online with males. This ultimately lead to honor killings. |
Individuals of married status are stoned to death for adultery under Shari'ah states and this has been in effect in Iran, Pakistan, Saudi Arabia and most of the Muslim world. When you consider the argument for stoning adulterers, it mainly cashes on the high level of infidelity or promiscuity in regions where adulterers are not stoned, like the West. Of course, this may seem to have won the Shari'ah advocates a point, but it really has not. There are a thousand and one ways to fix a fault. Infidelity and promiscuity may be minimized by more humane and bloodless measures beside stoning. The level of promiscuity and marital infidelity may be alarming in the West, but this is rather due to the fact that adulterers are not brought to book, not because adulterers are not stoned. |
ADULTERY We admit that adultery is a grave offense that leads to broken homes, unwanted pregnancies and health infections. It is however too much of a stretch to justify stoning adulterers on ground that it serves as a powerful deterent for potential adulterers. Yet this is a decree of Shari'ah derived from Hadith; Sahih Muslim |
