Christianity Etc › Re: Shari'ah: The Great Brain Robbery by usermane(op): 4:37pm On Dec 13, 2014
Worst still, a Muslim doesn't have to admit to apostasy before he is condemned by the clerics. For instance, according to the schools of law of orthodox Islam, refusal to perform Salat beyond 3 days amount to apostasy and the offender may be executed. Denying certain tenets of orthodox Islam, opposing the clerics could earn you apostasy and execution under Shari'ah.

Despite no justification for this oppressive law in the scriptures, despite the Qur'an insistence on no compulsion in religious matters, mainstream Muslim clerics and scholars can reject the penalty of death for apostasy.

In secular states like US or Nigeria, apostates are seldom killed thanks to secular laws preceding beyond Shari'ah. In Shari'ah states like Saudi A. or Iran, apostates are killed.
Christianity Etc › Re: Shari'ah: The Great Brain Robbery by usermane(op):
APOSTASY

According to Shari'ah, a Muslim who leaves Islam must be killed. Some scholars opin that he should first be demanded to repent while others insist no repentance is acceptable and the apostate must be killed outright. This is in line with the following Hadith(oral tradition);

Narrated 'Abdullah: Allah's Apostle said, "The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims."

---Sahih Bukhari 9:83:17
Contrary to the deceptive claims of apologists, apostates do not have to declare their disbelief, proselytize or oppose Muslims to be executed under Shari'ah. That is why the Shari'ah court of Sudan detained and sentenced Mariam Ibrahim to death exclusively for apostasy earlier this year.

Death for apostasy is the most controversial side of Shari'ah. To kill a man for changing his belief is not only cultish and violate basic human rights but contradict God 's principle of freedom of beliefs through out the scriptures.

SOURCES OF SHARI'AH

A. QUR'AN
This is the mother Book in Islam, the only legacy of the messenger of God left after his death. Hence, it is the only definite source of Islamic legislation. But ironically, less than 5% of Shari'ah emanate from the Qur'an and even then, this 5% can only losely be classed as Qur'anic due to distortion by clergy.

2. HADITH
These are oral traditions compiled 150-400 years after the messenger and said to explain the Qur'an. These traditions constitute over 70% of Shari'ah. Although it is regarded secondary and not as definite as the Qur'an, orthodox Muslim sages have espoused that it abrogate verses of the Qur'an.

3. IJMA
This is concensus of the scholars of the previous generations, particularly the first 2-3 generations after the messenger. There are two major sects of orthodox Islam; Sunnis and Shiites. Each sect has her schools of law that seek to interprete and broaden the laws in the Qur'an and Hadith. Consequently, these schools of law derive additional laws that constitute about 20% of Shari'ah.

The aim of this paper is to critically analyze Shari'ah and prove that Shari'ah is far from a just, humane and equity law that can better substitute secular laws. It will be proved that those proposing Shari'ah are greatly robbed of their brain; either their reasoning or conscience. We "ll be treating only Shari'ah penal code for apostasy, adultery and theft.

However, it is essential to briefly to cover the sources of Shari'ah law before delving proper into the topic.
Christianity Etc › Shari'ah: The Great Brain Robbery by usermane(op): 4:25pm On Dec 13, 2014
Of the hottest discussions among mainstream Muslim clerics today is Shari'ah. For overwhelming majority of Muslims, shari'ah is an immutable, divine and utopian law that must precede over all the affairs of mankind. In this light, orthodox Muslims promote shari'ah and enforce it.

In most Muslim countries, shari'ah is actually the national constitution like Iran or markedly modifies the constitution in secular states like Turkey. To realize the significance of shari'ah to mainstream orthodox Muslims, one only need to see how strong the campaign for shari'ah has been in the Muslim minority Western world. The Islamist insurgencies whether ISIS or Boko Haram always insist that full implementation of Shari'ah is their major goal.

Despite these, very few orthodox Muslims can discuss shari'ah, it sources and decrees. If they do, then over 50% of them wouldn't even be advocating it in the first place.

I 've been waiting for a response to my last post. Can't believe that no Muslim have stepped up to it for over 12 hours. But yet they swear by God that terrorism and aggression has no bearing with their theology.

Good evening. Please explain the following hadith(traditions) to us.

Sahih Bukhari Volume 1, Book 8, Number 387 :

Narrated by Anas bin Malik Allah's Apostle said, "I have been ordered to fight the people till they say: 'None has the right to be worshipped but Allah.' And if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us and we will not interfere with them except legally and their reckoning will be with Allah."

Narrated Maimun ibn Siyah that he asked Anas bin Malik, "O Abu Hamza! What makes the life and property of a person sacred?" He replied, "Whoever says, 'None has the right to be worshipped but Allah', faces our Qibla during the prayers, prays like us and eats our slaughtered animal, then he is a Muslim, and has got the same rights and obligations as other Muslims have."

It was narrated from 'Abdur-Rahman that:

A man's father or mother - Shu'bah (one of the namators was not sure) - ordered him to divorce his wife, and he made a vow that he would free one hundred slaves if he did that. He came to Abu Darda' while he was praying the Duha, and he was making his prayer lengthy, and he prayed between Zuhr and 'Asr. Then he asked him and Abu Darda' said: "Fulfill your vow and honor your parents." Abu Ad-Darda' said: "I heard the Messenger of Allah (ﷺ) say: '(Honoring) one's father may lead one to enter through the best of the gates of Paradise; so take care of your parents, (it is so, whether you take care of them) or not. "
Sunan Ibn Majah » The Book of Divorce

That is another tradition of yours that may compel the man in question to divorce his wife. In all honesty, how on earth can you claim to follow sunnah and yet you give your brother an opinion that contradict sunnah?

I wount drive further than this. Those curious to get to the root of Islamist terrorism are recommended these;

Also, here is an enlightening video to download, which defend Islam and present a stronger argument against extremists like ISIS or Boko Haram than the apologists and clerics;

The whole picture of terrorism in the Muslim world is not as simple as many Muslims think. For long, Verses and traditions have been used to condemn groups like ISIS but it did not change much. Islamist insurgents groups continue to swell with recruits/sympathizers and multiply worldwide. In the 90s, all we heard was Al Qaeda and Bin Laden, today we have others like Al Shabaab, Boko Haram, ISIS, Taliban emulating Al Qaeda inspite of the fatwas by the so called Islamic scholars.

Although this is an honest attempt to clear Islam of the charges of terrorism, it is futile if you ask me. It failed to address the theological position of ISIS whilst persuading the readers with a number of verses or traditions. If you are won over by the writer based on this skeletal presentation, you may be won over by ISIS based on their presentation. ISIS is not just a band of thugs killing and pillaging. They also present verses and traditions to support their stands.

I have discussed the problem of copying and pasting from webpages without due investigation. I did this 3 weeks ago when ignoring the degree of misorgyny, restriction of women in the 'Sharia compliant' Muslim states today, an article was copied and posted in this section, boasting of women empowerment in mainstream Islam. Islam › Re: 23rd Anniversary Of The Demise Of Ayatullah Khomeini by usermane(m): 5:08pm On Nov 29, 2014
Iranian revolution nevertheless wasn't the success it promised. Even Khomeini 's original successor Ayatollah Hussein Ali Montazeri confirmed this before he was fired;

"The denial of people's rights, injustice and disregard for the revolution's true values have delivered the most severe blows against the revolution. Before any reconstruction [takes place], there must first be a political and ideological reconstruction... This is something that the people expect of a leader."
After taking the seat, Khomeini crushed all his opponents either with threats, force or withdrawing their rights. For instance, Women contributed massively to the revolution, but Khomeini withdrawn virtually all the rights they had enjoined before the revolution. He banned newspapers, radio stations and other outlets for criticising him and his vision for Iran. Dissatisfaction and opposition to Khomeini lingered even years after the Khomeini was enthroned during which arrests, assaults and execution of leftists striving for rights and opposing Khomeini 's regime weren't uncommon. Khomeini would accuse them of apostasy, enmity to Islam, conniving with the West or sympathizing with the Shah and justify their persecution under these.

By 1998, Khomeini found the ultimate chance to flush out all his opponent for good, exploiting the after math of the Gulf War, he arrested, incarcerated and executed thousands including Women and children on baseless charge of treason.

So bloody was the whole event that Khomeini fell out permanently with his original successor who evidently had had enough of Khomeini 's 'religious tyranny'.

Yes, Khomeini was a great shiite, cleric, a prominent figure in Iranian revolution, the first Ayatollah Ruler of Iran. But Khomeini, a spiritual figure in Islam? The Muslim community need to wake up.
Islam › Re: 23rd Anniversary Of The Demise Of Ayatullah Khomeini by usermane(m): 5:06pm On Nov 29, 2014
In anticipation of the 35th anniversary of Khomeini 's assumption as the Supereme Ruler of Iran(1979), am reviving this thread.

Of my faintest memories are '90s Muslim newsletters on Khomeini in my family home. Hailed as a great sage, saint, revolutionary, messiah and ruler, Khomeini was a Muslim household name in the old days.

Who was Ayatollah Ruhullah Khomeini?

Fast forward to present, i find a very different figure in Khomeini from whom he is often espoused to be. The Iranian revolution was neither purely Islamic nor masterminded by Khomeini and his cycle of clerics. Aside the theocrats and ultra conservatives, leftists including moderates, liberals, secularists, feminists, marxists and communists drove the revolution, each group having its top figure. The common goal of ousting the Shah merged all the groups into one heterogenous mix.

Although accepted as the face of the revolution, to the leftists, Khomeini was to be a spiritual leader and not a political or supereme leader which he would later turn to. Khomeini must have smelt this, but he led them along for the sake of the revolution, possibly bidding his time. To earn their full vote, he promised a lot but he would later eat his words to their dismay. Like, throughout the revolution, Khomeini repeatedly affirm his disinterest in ruling Iran even if appointed, but after the revolution, his tone was reversed.

Khomeini wasn't a Man of the People. This wasn't apparent during the revolution when all efforts were channeled against the Shah. However, it became apparent when the coast was clear, even within his cycle of clerics, Khomeini faced oppositions.

After the revolution, Khomeini turned a different; replacing his soft spoken, spiritual and theological persona with a hard-nosed, militant and political one, violating several of his words that originally earned him crucial support of the leftists.
