The court issued an order for his release - fact. The surety’s obligation is to ensure that the arrested person attends court and that he loses his money or property(forgotten the term here) held or discharges his function if the person fails to attend court or flees lawful custody. Also if the surety does not inform the relevant authorities in a timely fashion. The court has bailed him. DSS are in contempt of court for failing to release him. The surety does not have to attend the DSS facilities to sign for his release because the court set bail conditions which were met. The courts say release forthswith and you are mentioning DSS policy to have someone sign him out? Is it a Eko hotel? Did they not receive and sign the court orders? And where in the court order does it mention he has to be signed over to someone personally? Sorry the law trumps policy here. Don’t call people idiots because they demand transparency and respect for the law from those in power. |

The issue here is his release from lawful custody of the DSS as ordered by a court of the land. Two court orders for his ‘immediate’ release. His bail conditions were issued by a court and has been signed. It is not compelling reason to simply state that his detention was continued because there was no one to accept his release from their custody? His lawyers attended and so did the court bailiffs so why did the DSS not release him to his legal representatives? Or is it that the DSS are not subject to the laws of Nigeria or the courts? It is a dangerous precedent set here and it will be wise to disavow such flagrant abuse of people rights and unlawful acts. |

Jodesky: Your ignorance stinks.... For your information, the moment a suspect is arrainged before a court, it's only that court that grants bail. In this instance, the court has granted him bail and the conditions attached thereto having been fulfilled, the DSS has no basis to hold him a day longer. Falana announced in open court that the release order has been served on DSS but they are still holding him for reasons best known to them. Couldn't have said it better myself. You are right and it is annoying reading comments from people who are so misinformed. |

This incident appears to be a civil dispute between members of public and customer representatives for the airline at the airport terminal albeit not airside. I do not think the customer service agents or manager have the power to ask any person to delete any footage and it is not part of their terms or conditions. It is a public place and restricting recording for security or hostile reconnaissance can be considered. It is unlawful in my opinion and I think the agents are ‘reaching’ however I am deferring to the knowledge of legal experts because this scenario is wary until we know the full ‘facts’ |

All rights can be derogated from. That's why a person who is entitled to Right to personal liberty can be imprisoned under s 35 constitution.
Same way a person can be shot to death by firing squad legally thus derogating from his right to life under s 33 constitution.
So even mere REASONABLE suspicion of committing an offence, can lead to your arrest and you cannot say your right to personal liberty was breached, neither is it false imprisonment.
