PHILOSOPHY OF NOTHINGNESS

For those of us 'schooled' in philosophy; especially under the tutelage of our very dear "professor's Adeniyi... Dada... Olajide... Ogundare... to mention but a few"__"Reality is infinitesimal."

Naive Realism, for instance, holds that the physical world exist... even if no one perceives it. The crux, therefore, for professor Olajide...is that...."Life doesn't care..."... It is, to him, essentially a body of mass... Far removed from us, our achievements, sorrows...and whatever we think of it."

MEANINGLESSNESS
All men would like to be happy. The problem is that we are not quite sure what happiness is. At times we feel better than at other times. There are times when we feel great.

But, even then we are not quite sure if this is all there is to happiness. It seems to be an elusive dream of total satisfaction, but it often stays just out of reach, leaving us feeling empty and dissatisfied.

We want to find some significant reason to live and it seems to boil down to a few things. We imagine that these things must surely deliver on the promise for happiness, else so many people would not keep on seeking happiness in these things.

To have a dream and then to pursue that dream seems to be the main reason for our existence. The dream is for riches, popularity, or prestige. To have other people acknowledging our importance is what life is all about, because we often have a hard time convincing ourselves that we are as important as we want other people to think.

We want to think that we fit in and are considered meaningful to others. We entertain the thoughts of the ages on how to get people to acknowledge our significant contribution to meaningful existence.

The odd thing about our chosen pursuits is that even in these things there seems to be an underlying futility. The very things we hope to give us meaning and satisfaction bring a crop of problems we had not anticipated or dreamed.

So, the dream of life is always just out of reach. It is like striving after the wind.

It is vexing to the soul.

Right when we think we have captured the things that will give us a sense of total meaning and satisfaction, we are presented with a whole new set of problems that tend to take away at least a little of the total satisfaction. Is this elusive dream for total happiness unreasonable? Why does life seem so futile?

What I need to understand is, is the Law universal? I had thought each country has her law and cases which are particular to a her, how then can someone study law in another country and practice it in another.

Hi bro... av read the responses to your question... they are not quite correct!.

There basically two types of legal systems. Civil Law and Criminal Law... most countries, if not all, are divided under both (dont know much about the muslin countries)....

However, the UK is the Source of the Common law. Since they colonized us. We literally inherited their law. So Like the US, Ghana, Australia, New zealand etc... we all operate the same legal system. Common law.

What makes it distinct is the 6 Modules(courses) that you have to do during your underG. So once u do it. U get to qualify to practice under any common law jurisdiction even in the US... and bak tu d oda responses. U wil av to learn the particular cases and distinct practice of the individual country.

However, if u studied in a civil law jurisdiction like...Italy or France. U wont be able to sit for a bar exam in Nigeria neither practise... Because U wudnt av done the Qualifying law degree l(6 modules)

Disclaimer: This is just a little write-up 'intended' to educate and probably sentisize the PUBLIC about the absurdity in Nigerian Law of Robbery and a call for reform!

INTRODUCTION

Yesterday, I was at the library when I overheard two of my Nigerian colleagues lamenting a 'Death Sentence' Penalty imposed on a man who supposedly stole #14,570.

Regretably, I never knew we are still hoodwinked by the assumption that Death Penalty constitutes adequate detterent to Offenders.

WHAT IS CAPITAL PUNISHMENT

It is the Lawful infliction of death as a punishment for Serious Crimes such as Murder, Terrorism, Robbery, etc. A sentence of death may be carried out by one of five lawful means: electrocution, hanging, lethal injection, gas chamber, and firing squad.

LEGAL ISSUE

The Question is whether Armed Robbery is as felonious as deserving a Death Penalty.

THE LAW OF ARMED ROBBERY

Under the Criminal Code Act and the Robbery and Firearms (Special Provisions) Act, applicable in all southern states, armed robbery or robbery resulting in harm to a victim carries the death penalty.

Armed Robbery in Nigeria, like its UK counterpart, is
Theft or Stealing
+ the Use of force/apprehension of force, before or at the time of stealing
+ the possesion of a firearm or immitation of a firearm.

Breakdown for the Layman. CRIMINAL CODE ACT Part IV_ to the end.

Actus Reus (The Guilty Act)

1. Stealing... Approriation of A property belonging to another person.

Mens Rea (The guilty Mind)

Stealing... With an INTENTION to permanently deprive the person of His 'property'...

This little breakdown becomes
2. ROBBERY if there is a Use/Threat of Force

and it becomes

3. ARMED ROBBERY and punishable by DEATH SENTENCE according to s1 of Robbery and Fireamrs Act 2004,

If the offender is armed with any firearms or any offensive weapon or is in company with any person so armed or if the offender wounds or uses any
personal violence. See HENRYOTTI V STATE (1991)


FACTS

As of September 2013, there were at least 1,233 individuals on death row across Nigeria. At least 141 death sentences were imposed in 2013.

Four death row inmates were executed in 2013. However, Nigeria had not carried out an execution since 2006.
All four individuals reportedly still had appeals pending when executed, which is a violation of Nigerian and international law.


COMMENTS

It is common-place to argue that the DEATH SENTENCE is a reflection of the Principles of culpability and responsibilty which posits that all individuals be Liable for the harm they have caused to serve as deterrents to others.

However, this is hardly proportionate. How can a. Competent judge impose a death sentence to an offence that did not lead to a loss of life?

of course the law does not care. Even if you did not use the weapon at all... Death Sentence is imminent.

I am no fan of armed robbers, espexially those who exhibit a flagrant disregard for human life. But I am no fan of Unjustifiable retributions either. My reasons ;


Applied Unfairly
1. There is much concern that the legal system dosnt always provide many accused people with Good lawyers.

2. Innocent people are not given enough time to prove their innocence and are wrongfully Killed.

3. It is Cruel, at least in this case, and Inhumane.

4. Justice system is Supposed to be Corrective, not Vindictive.

5. Many Civilized nations have adopted more effective methods to punish criminals, ie Rehabilitation programs.

6. We should not forget that Criminals are also Citizens, with basic Rights to Fair trial and treatments.

It is my opinion that those in places of authority should move for an urgent reform. There should be an hierarchy to offences and only the MOST serious crimes ie Terrorism, High Treason,Aggravated Murder and GOVT POLITICIANS that embezzles our money, should, if necessary, be subjected to such punishment.

In September 2012, the High Court of Lagos State declared that the mandatory death penalty was unconstitutional in James Ajulu & Others v. Attorney General of Lagos. However, its only in force in Lagos.

It is highly suggested that other states follow suit!..

My Horrible Experience

Wow.... All I can say is Thank God.

I was travelling for the first time 8th October during the night to Manchester through Amsterdam, and then we started to experience this heavy turbulent.

Immediately... I started calling Jesus Jesus!... Funnily... the Guy(man) beside me... was busy Snoring.. and the Oyinbo dude close to the window adjacent to me was Fast asleep(na so he even open mouth down) Unconcerned.

First I thought it was normal as I have read flight experiences here on Nairaland and other sites. Reality began to dawn on me when the Hair hostess abi na Host(i no even know in name) annouced that every when should fasten His/her seat belt. O boy...see as fear grip me.

I sey...so na true sey..."ti omode ba de ibi eru, eru a ba( if small pikin rich were fear dey... fear go catch am)

As i just look through the Flight tracking... I see sey we dey on top the mediterrenean sea.

What came into my mind was just to start asking for forgiveness of sins.... chai!... (all the bad tin wey i don do oo) praying fervently...

One of the hostess noticing my uncommonly fear... decided to scope me with a near-death life. In a dustch accent..she said.." Sorry sir, is this your first flight" ... I sey Yes... "She said oh.. its just a minor THUNDERSTORM, the plane can take it".

Mehn..as she land finish I sey... Thunderstorm Minor?... wey i dey see lightning for window like this?...


But God be praised... After about 3 hours of the turbulence.. We arrived Amsterdam.

I just give all the Glory for the Journey mercies.

througly... if the Lord does not watch over the city, the watchmen worketh in Vain.

Kudos...to KLM airways... they are truly good.

Pleasant mornin bros and sis'

I will be travelling out of the country a week before my POP for further studies(an opportunity I dont want to lose).

I'd thought the Pop would be on the 3rd of Oct. so I scheduled my journey for the first week of Oct.

However, to my dismay, the POP was fixed for 15th.

I really can't wait a week more as I had earlier written to the school to give me a grace of late arrival.

I just want advice from people who may have passed through this ordeal before(more germanely) or who has an idea of what should be done.

Note: I have tried reaching out to my LI...bt notin really productive is forth coming.

You don't even need cash at all while travelling, as far as you can make your way to your destination.

Chances of survival lies in your pocket, there's a lot of food shops around. Most with delivery

Yes students are still allowed to work 20hrs a week during term time and full time during summer holidays. Though only university students. Not the same with college students
