Good Morning to the Daddies and mummy in the house, i sincerely need your contribution on this, help me.

We got a land valued at around 70M to 100M last year may/june, CofO,survey and the rest showed that the land is legit but when we went to secure the land, we discovered that there's a serious litigation on the land.

Government claimed the lands in the area (prime location) from a family back in the 90s without compensating the family, only for the government to end up reselling such land to friends (private people) which we later got it from.

We've done a serious back and forth since last year and it's been hellish (Land wahala) and refund is no longer forthcoming because we sealed the deal already.

Now, the lawyer representing the family made a request yesterday that we should bring 10M  to offset the bills they've spent on the case and to settle the family members and that when the case finally fall in their favour, they will give us a preferential treatment (Maybe we will forgoo part of the land or we will rebuy the land)

NB: on all angles, it might take time but the case is in the family's favour just like the Magodo vs LASG recent case.

We coughed out everything on this land and we've spent blood,sweet and resources on this case since last year, i have a feeling paying the money they demanded won't solve anything even if they should eventually win the case, i don they think am sinceeee.

If there is an Idemnity clause in your favour, you have every right to press legal charges against the person who sold the land to you and get your money back.

I bought a land from a real estate firm around April. They told me the survey plan would be ready in 3 months(july). It is October now and I am yet to get the survey plan. Does getting a survey plan take this long? What should I do pls? I have the deed.

If you have the Deed of Assignment, was the survey plan not quoted in it? Confirm that what you have is a Deed of Assignment and not a Contract of Sales.

On one hand, the reason the survey plan isn't ready is that the real estate company does not even have a registered survey plan of the parcel of land in their name. What most of them do is to buy a large parcel of land from Omo-onile on credit and remit to them as they sell. The only document they have at this point is the Contract of Sales.

It is until they have finished paying for the land before they can execute a Deed of Assignment and a survey plan in their name.

Until this happens, you can't get a physical allocation of your land and necessary documents such as the Deed of Assignment and Survey Plan (which you are worried about).

On the other hand, it might be a case of land without an appropriate title.

You need to find out which is applicable.

After this thread, it will be nice to also open a thread on how most car dealers are rogues and their nefarious activities.

It was after you guys got married you became a financier of the project.

Based on the above, his parents won't believe you have financial input in the building project.

Since he started the project alone, why ask for financial input from his wife as the project progresses? Cos your money in the project is a major stumbling block on how he will handle this issue with his parents.

You can only demand a refund of what you have contributed so far and you guys start another building project together. In this new building project, your name and husband's name will be on the land documents and every other documents relating to the building project.

I understand that the construction of the house was co-financed by you and your wife. So it is insensitive to have involved your parents in the construction of your house.

How do you expect them to feel that you are building your own house when they still leave in a rented apartment? Don't be surprised that they have hatched this plan of moving into this house the moment you got them involved in your building project.

What is the way forward? If you are not the only child of your family, rally around your siblings and see how you can build their own apartment for them.
