Politics / Re: What The Electoral Act Really Says About Unsigned Ballot Papers by yemex04(m): 7:56pm On Sep 24, 2023
Kukutente23:

Unfortunately, allegations of ballot papers stuffing is not like before. It is not about calling witnesses.
Refer to 1 above. INEC educated everyone about how to know fake ballot papers from the originated original. There are watermarks, seals and embellishments on each ballot paper. Apart from that, the ballot papers allocated for each PU are serially marked. It is also a requirement of the Electoral Act section 42. So if a ballot paper does not match a serial number allocated to a PU, it is automatically fake.
If it is within the serial number, the question of ballot paper snuffing no longer arise as long as total votes does not exceed accredited voters on BVAS.
In any case, it is farfetched to claim that a state ruled by APC was rigged against APC in the presence of security agents controlled by same APC govt.

The bolded ref.

You will agree with me that a ballot paper itself can be very original & yet its vote not valid. The ballot paper might have been original & even for the polling unit & yet the vote casted on it not valid.. How? Thugs can come, hijack clean/unused ballot papers, steal the ballot boxes, thumbprint the snatched ballot papers, bring them back & get counted.. Now it is easy for the Petitioners to prove such irregularities since the resultant clear over voting due to BVAS accreditation which will be lower to the vote cast. Any ballot not signed by the Presiding Officer will be definitely invalid.. if 166k of them go to a particular party, then. it is easy to prove

The petitioners case was made weak because the election umpire cunningly denied to provide sufficient documents for them to prove their case. They could only bank on disqualification of BAT and INEC Guidelines.
So in their final addresses they dwelled on peripherals rather that the election itself.

A serious minded Petitioner who truely wants to win a litigation at the Tribunal will not depend on the Respondents in the same suit to give him evidence to argue his case.. It just doesn't make sense..

I had the privilege of seeing the final written submissions & responses of both the Petitioners & the Respondents, if I were a Judge who wishes to adjudicate on the merit of the cases based on evidences presented & from the point of Laws, I will throw out the Petitions and award cost against the Petitioners.. they proved nothing.. I marvel at the ignorance of many when shout a "stolen mandate" because the Petitioners never argued about a certain "stolen mandate" their Arguments were basically on technicality most of which have been resolved. In fact, it will amount a miscarriage of Justice if the judgement goes against Tinubu, It must have been that the headless mob succeeded in the blackmail of the Judges

How did you arrive at this correlation between number of children and level of poverty?..

Father & Mother who give birth to children they are not able to properly cater for in terms of feeding, sheltering & education is an invitation for poverty.. In Nigeria, we have this category of family plenty, that is the multiplicity of poverty! It's that simple.

My father had eight children and we're all doing good. And he was just a middle class.

Your father a middle class, was able to educate you & that's why you can definitely say "we are all doing good" Moreover I didn't say " All"parents rather I said " There's nothing wrong in giving birth to 50 if you have the capacity but how do we determine who & who have the capacity.

I'm not a northerner but I don't think anyone has any right to tell me how many children I should have if I'm not begging him to cater for them.

Many aren't begging directly to cater for the many children they gave birth to, but what can't be denied is the obvious facts that many are indeed giving birth to children they can't properly cater for in terms proper Nutrition, Shelter, Clothing & Education. You see these categories of Children looking manourished, wearing clothes next to Rags(These are true reflection of poverty)& become serious security threats to the society & yet we all blame the Government for every of such ill. Most of such family believe it is their right for Government should feed, school, health care & shelter their [b]football team of a family for free. Politics / Hear The Immortal Words Of Justice Niki Tobi JSC, In Buhari V. Yar'adua (2007) by yemex04(m): 11:32am On Aug 20, 2023
"The Court of Appeal cannot collect evidence from the market overt; for example from the Balogun market, Lagos; Dugbe market, Ibadan; main market, Jos; Central market, Kaduna; Central market (former Gwari market), Minna; Wuse market, Abuja. On the contrary, the Court of Appeal, has to wait for evidence, as the court did, in the court building duly constituted as a court qua adjudicatory body. Courts of law being legal and sacred institutions do not go on a frolic or on a journey to collect inculpatory or exculpatory evidence. On the contrary, they deal only with evidence before them which is procedurally built on arid legalism. For the avoidance of doubt, I am not saying by this judgment that all was well with the conduct of the Presidential Election conducted in 2007. What I am saying is that there was no evidence before the Court of Appeal to dislodge section 146(1) of the Electoral Act.

It is sad that so much has been said in the newspapers of this country on the case. The new technology of internet reporting has added to the comments, some of them doubting our integrity to do justice according to law. I regard them as blackmail and I will not succumb to blackmail, I swore on that eventful day as a High Court Judge to do justice to all manner of persons without fear or favour. I have never departed from that oath and I will not, God helping. It is too late in the day to do so. Nigeria is a country where suspicion of wrong doing is the past time of the citizens. Nigerians should realise that some public officers should be trusted to do the right thing. Why not the Judges!

Nigeria is one vast and huge country made up of so many diversities in terms of tribes, cultures, sociology, anthropology and above all, quite a number of political parties (some large, some small). These diversities, coupled with the usual aggressiveness of Nigerians arising particularly from the do or die behaviour in politics; there must be irregularities. Courts of law must therefore take the irregularities for granted unless they are of such compelling proportion or magnitude as to “affect substantially the result of the election.” This may appear to the ordinary Nigerian mind as a stupid statement but that is the law as provided in section 146(1) of the Electoral Act and there is nothing anybody can do about it, as long as the Legislature keeps it in the Electoral Act. The subsection is like the rock of Gibraltar, solidly standing behind and for a respondent to an election petition. I am not saying that a Presidential Election can never succeed in the light of section 146(1). No. It can if the petitioner discharges the burden the subsection places on him.

The way politics in this country is played frightens me every dawning day. It is a fight to finish affair. Nobody accepts defeat at the polls. The Judges must be the final bus stop. And when they come to the Judges and the Judges in their professional minds give judgment, they call them all sorts of names. To the party who wins the case, the Judiciary is the best place and real common hope of the common man. To the party who loses, the Judiciary is bad. Even when a party loses a case because of serious blunder of Counsel, it is the Judge who is blamed. Why? While I know as a matter of fact that in every case, the Judge makes an additional enemy, if I use the word unguardedly, I must say that the Judge does not regard the person as his enemy. The Judge who has given judgment in the light of the law, should not be castigated in the way it is done in this country. That is a primitive conduct and I condemn it. It is a conduct that does not help the promotion of the administration of justice. It is rather a conduct that is likely to affect adversely the administration of justice in this country. I feel very strongly that Nigerian Judges should be allowed to perform their judicial functions to the best of their ability. I should also say that no amount of bad name-calling will deter Nigerian Judges from performing their constitutional functions of deciding cases between two or more competing parties. Somebody must be trusted in doing the correct thing. Why not the Nigerian Judge?

In sum, this appeal fails and it is dismissed. Accordingly, Alhaji Umaru Musa Yar’Adua and Dr Jonathan Goodluck are the President and Vice President of the Federal Republic of Nigeria, respectively. I make no order as to costs.

A minister, especially the one with a good portfolio

Minister heads a ministry..

They steal through inflated costs of projects..

A senator is just there depending only on his income ..

As a minister if 200Billion is allocated to your ministry annually, there is chances you will corner 50 billion then use the rest to work..

But a senator depends on their 36 million naira monthly salary and 1.2 billion naira annual constituency allowance.. Unless if you are a Senate President..

Infact all of them are criminals!! undecided

@the bolded.
The OP asked a good & innocent question.. why not answer the question without the assumption they would steal, just purely on the job description of the two offices.

@OP... I think the executive arm of Government part of which is a federal minister in case of FG is more influential given the fact that the minister represent the President in ministry for implementation of Govt policies which will have impact all through the whole Nation... A senator as an individual may not be as influential as a Minister.. Senators are influential more only when they take a decision as "Nigerian Senate". My take
