Cooly100:
What is happening in SE not what anyone should be proud of...but it did not start today...and can be resolved politically.

Infact, SE largely used to be the most peaceful region in the country...

This all started from 2015, emboldened by Operation python dance.

I remember people warned that this would escalate if not properly handled...and now it has.

So now it is going to head..and the best solution would have been for the FG to engage the leaders of the region and seek a political solution to end the impasse...

However, I have seen ground swell of people particularly from SW all over the place, demonising the people and leaders, calling them cowards... as if nothing like that has happen in the country before..

When the Yorubas pervasive they were oppressed after 1999 election, they formed OPC, alias Oduduwa Liberation Front to do the the same thing the group in the east are doing, now.

The atrocities of OPC was worse than anything going on in SE..

See...

1. In mid July 1999, there was a major clash between Hausa and Yoruba in Sagamu, Ogun State. Scores of people were killed. The violence began following an argument over customs observed during the Oro festival, an annual Yoruba event which had not been disrupted by any disputes either before or since 1999. Yoruba and Hausa had agreed to respect a traditional night-time curfew usually observed during the festival. However, according to local residents, a fight erupted between the Yoruba and the Hausa after a Hausa woman was killed by a group of Yoruba because she had broken the curfew. The fighting escalated and the OPC intervened to support the Yoruba. Both sides were armed. At least sixty-eight Hausa were killed, including three boys between the ages of ten and fifteen; some were killed with guns, but the majority were killed with cutlasses. A number of Yoruba were also killed, including one of the Oro leaders. Some people were burnt inside their houses

2. By the time the violence reached its peak in the second half of 2000, hundreds of people had been killed, many by the OPC, others by other groups. Some of the most serious incidents are described below. A journalist commented: "Around 2000 was the worst period of OPC violence [...] The police were incapable of controlling it. The OPC could shut down a whole street [...] Every other week there were clashes

3. A Hausa man in Sagamu told Human Rights Watch that after the violence, "the local government gave us forms to fill in for compensation, but nothing happened. Even the Seriki's [Hausa leader] house was burnt. The president, who came here on the Monday, promised there would be compensation, but there wasn't. There was an investigation but nobody was arrested. The governor of Ogun promised to rebuild the Seriki's house, but didn't.

4. On November 25 and 26, 1999, scores of people were killed when the OPC clashed with traders in Ketu / Mile 12 market in Lagos. The exact number of victims has not been confirmed, but is estimated to be more than one hundred. A senior police official who was at the scene said he saw an estimated two hundred bodies, but that others had already been buried in mass graves.

5. There have been several other incidents in which OPC members attacked people on the basis of their ethnicity, particularly Hausas, other northerners, and people suspected of being sympathetic to the Hausas. A Hausa trader in Lagos told Human Rights Watch how, during violent clashes at the Agege abattoir on the outskirts of Lagos, in late 2000, the OPC had targeted anyone suspected of being a Hausa: "They killed Alhaji Zubairu, a father of three from Kogi State. They asked him where he was from. He said Kogi. They said he was a Hausa man, and killed him. Actually he was a northerner, but not a Hausa.

6. One of the more recent incidents of ethnic violence involving the OPC took place in Idi-Araba and surrounding areas in Mushin, Lagos, on February 2 to 4, 2002. Clashes between Hausa and Yoruba claimed more than seventy lives. Human Rights Watch spoke to many residents of the area and eye-witnesses of the violence, including members of the Hausa and Yoruba communities, and people from other ethnic groups who found themselves trapped by the violence.

There are many more...atrocities by the Yorubas on non indigenes...back then and till today as well.

At this point the SW leaders could not reign in their youths.. for more than 3 years...as the killings, burning, macheting lasted.

It's okay if this write up & mindset give you Guys the justification about the mayhem in the South East.. afterall it also happened in the Southwest so no big deal right? Okay, bring it on! let it reach that stage of OPC that year..

If INEC ever issued a notice before the election that it would not use electronic transmission of vote results during the general elections, why then did it use electronic transmission of vote results in all the elections, except for the presidential election, but gave excuse of GLITCH for not using electronic transmission of vote results for presidential election?

Actually there was no electronic transmission of Results in that election...Snapping of polling unit results & upload of same on IREV is not the same as electronic transmission of result.

I don't understand why some people think because LP and PDP didn't follow the normal process of calling up witnesses from polling both that they do not have the polling both results and didn't tender it to the tribunal.
With the time allotted for the parties to make their case, that would be a waste of time. Those polling both evidence is contained in their written address. Angelfrost:
Well said... APC did a great cover up job using INEC as a willing tool!

My own issue is that such cases should have been expedited and concluded before handover!

It's always known that after swearing-in, the tribunal becomes a mere formality at the level of Presidency!

We don't have a Judiciary truly independent to act and remove a sitting President! This is a national disgrace!!!

If we even had a truly independent electoral commission as seen abroad, there would have been no need for a tribunal, as those losing wouldn't be in doubt about who actually won the election!

We'd better get it right fast, before dissenting voices turn into full rebellion and parallel governments! This vicious cycle of fraudulent elections followed by circus shows of tribunal hearings may not be condoned forever!

Even if the bolded is entirely true, the Petitioners had a very watery case & their presentations & witnesses were all flawed.

Enemyofpeace:
I can see that some Batists and even LP supporters do not understand what just played out over the last month in court.

To break it down so it's clear.

These are PO n Atiku's prayers.

All the prayers will be DETERMINED in the FINAL JUDGMENT.

(Brief Summary of prayers pleaded in court) :

1. Eligibility

That It be determined that:

A) At the time of the Presidential Elections, 2nd & 3rd Respondents (Tinubu & Shettima) were unqualified to contest

What was tendered in court.

- BAT has multiple nationalities. Atiku's witness presented his Guinean passport - *Fact*
Derisively BATs lawyer contended it had expired. Nationality does not expire with passports.

- BAT committed perjury by submitting a Chicago University degree that was shown to be forged - *Fact*
- Tinubu Bola A. Who was admitted to CSU for a degree was shown to be a woman and American citizen - *Notarized document shows the Tinubu Bola A. Is a woman and American citizen*
Let the courts decide

Shettima was shown to have been nominated as VP, 4 days before he withdrew from the senate nomination.
- *Most people who are unaware point to the Supreme Court Judgment in May 2023. That merely threw out the case on a technicality*
The technicality was that PDP challenged it, as a pre-election matter (can only be done by a fellow APC candidate. PO n Atiku can only challenge it as a post election matter.
Let the PEPT tribunal decide this incontrovertible fact.

B) All the votes recorded to Tinubu were wasted due to qualification/disqualification of Tinubu and Shettima

- See above

C) On the basis of the remaining votes (after discountenancing Tinubu and Shettima) , Obi scored majority of the lawful votes cast in 2/3rd of the States And the FCT, therefor met the requirements to be declared winner

*This proof was submitted in the documents and evidence filed before the PEPT. That was why INEC and APC fought their own CTC documents*
LP lawyers submitted their written arguments n are not required to plead it in court. That's why you never heard much about it. They only submitted INEC CTC of the forms EC8A, EC8B, EC8C,and EC8D to the burtress their asertions.
In addition, PO challenged the results of 32 states, including Abuja, where his votes were under counted.
*Once these votes are fully allocated to him, and votes removed from BAT, it will become apparent he won the popular vote and met the spread requirements*

2) 25% in Abuja
That it be determined that Tinubu failed to score 25% in the FCT and hence ought not to have been declared winner.
- *Supreme Court in 2007 held that 25% of Abuja is a sine qua none. Thus, BAT n Atiku can not be declared as winners*

3) In Alternate, a Fresh Election

Order the cancellation of the elections and order INEC to conduct a fresh one that Tinubu & Shettima shall not participate in

- *This will only happen if BAT is disqualified and PO can not be declared absolute winner due to PO not meeting the spread (25% in 2/3 states).*
Atiku can not be declared winner since he didn't get 25% in Abuja*

4) Alternatively, they get elected by the majority of lawful votes cast

That it be determined that

A) That Tinubu was not duly elected by a majority. Therefore, his declaration as winner is unlawful, unconstitutional, and of no effect

B) Based on the valid votes cast, Obi scored the highest number of votes in 2/3rd of the States and the FCT and ought to be declared winner

C) An order directing INEC to issue Certificate of Return to Obi as duly elected President be issued

In Further Alternative to 1-4 Above:

5) Void

A) That the Presidential elections conducted on Feb 25th, 2023 is void on the grounds that it was not conducted in accordance to the Electoral Act 2022 and the Constitution of the Federal Republic of Nigeria 1999 as amended

- *This was shown by INECs shenanigans*

B)Order the cancellation of the Presidential Elections and order INEC to conduct fresh presidential elections.

*Only comes in if PO can not be declared absolute winner. Only LP n PDP will contest this*

I've taken my time to explain all this, as I can see most people are actually ignorant of what happened at the PEPT.

Regards

I also can't see anything along the lines of "otherwise declared null and void".

If Peter Obi's retinue of lawyers had proof that figures were falsified enough for the elections to favour them, do you genuinely think they will be focusing heavily on this electronic transmission of a thing after 2 weeks at the Tribunal?

Why do they need to play the video of the INEC personnel saying something and then call as witnesses, journalists to confirm what was said in the video?

Time wasting tactics, I commend the Judges for their patience in tolerating such. However, only one thing will end up happening when Judges are indulge you in this manner, your case will eventually be struck out and you will be asked to pay damages to the other party.
