One of the reasons one must be truthful and open, when undertaking an insurance policy......... Your friend set herself up for a fall. .........

This case would be very difficult to fight, the other claimant, took massive advantage of the whole situation........

Your friend would have to pay up or go fight her case in court.........
Do you think he'll have a chance in court? Maybe to reduce the price at least?

The insurance shared with them the video evidence and it doesn't correspond with what they charged him for. They held the video evidence for more than 6 months claiming they've deleted it, only for them to release it when he told them we won't pay.
I can share the video and all the invoices they said they spent on the claimant's car, ko make sense rara.

He wants to know the implications of going to court with them, and is it even advisable to do that?

OP needs to clarify why his insurance was voided....... More to the story.........😂

Most of what you stated, is what your insurance company is supposed to do ........ But at the point of a claim, your insurance can run a DD check on the insured and void policy (if any discrepancy was uncovered)......
The Policy was cancelled due to driver using Provisional License and did not disclose the details of the accompanying driver during the first phone conversation with the insurance investigator as there were threats from the insurance and the claimant mechanic who was in custody of the car. However, she later got the details of the driver but the insurance company never admit to that as it was not disclosed during the first interrogation which was about 2months after the incident.

Good afternoon fams,
Trust ya'll are doing great. I greet everyone.

My friend needs help, kindly read and advise.

This incident happened in Sept 2022. Shortly after, My insurance company requested I pay £4,335 for repairing a car that I never had impact with, I reported to FOS a long time ago but lately, FOS claimed they do not have jurisdiction on the matter since the second Final response from the insurance company was not submitted within the “6months rule”.

The claimant presented a video that showed no damage to the said car. They canceled my policy and made me pay the remaining pro-rated amount on the policy which was 3 months old. I paid the remaining 9 months for nothing just to avoid issues. Only for them to come back after 1 month claiming they have settled the claim and I will be responsible 100% for the damages after they took the total policy charges.

I never had any impact with the car. They claimed a scrapping sound was heard in the video sent to me as evidence, but the details of the repair they did show otherwise. They said they replaced the car bumper and painted it, and how on earth will that be 4k+. While I was still in discussion with them, they passed the case to Debt Recovery which I explained I was not going to make any comment until the insurance company was able to present the video evidence. They later passed it on to a Law firm who contacted and I explained all that happened and why I was not pleased with the amount claimed to have been spent.

The law firm now are requesting £4,335 since the Financial Ombudsman has told me they do not have jurisdiction due to the 6-month rule. Just want to get advice on what next to do as I do not have the financial capacity to pay such an amount while the Law firm now threatens with a court case.

Did you pay more than 3600 in tax for that period?
I'm sure it'll be more than that. I pay 20% of my weekly earnings for 10months straight non stop. That's about 250-300 weekly if I'm correct.

Try this again, make sure you document, probably community via email if possible.

( Speak to the Company Directly. While they might not be legally obliged to allow you to cancel, they might be sympathetic to your situation, especially if you're experiencing financial difficulties.

Thoroughly review the contract to understand the terms of cancellation. There might be a provision that allows for early termination with a penalty fee. This could be more manageable than continuing the monthly payments.

As mentioned earlier, if the company isn't helpful, consider reaching out to the Financial Ombudsman Service. They can assist in situations where consumers feel they've been treated unfairly. Explaining the circumstances surrounding your wife's decision may prompt them to investigate further.

It's important to seek legal advice before taking any action. An attorney with experience in contract law will be able to provide guidance on the viability of this argument in a legal setting. The concept of "duress" in contract law generally refers to situations where someone is forced or threatened into agreeing to a contract. The attorney will evaluate if your wife's circumstances can be categorized as such.)

Lastly, my advice,

(First and foremost, I want to acknowledge how challenging this situation must be for both of you, and it's entirely natural to feel a mix of emotions. I understand your frustration and the strain this puts on your finances, especially at such a crucial time with the baby on the way.

However, I'd advise you to approach this with a calm mindset. It's essential to remember that everyone, including ourselves, can sometimes find themselves in tricky situations due to unforeseen circumstances or decisions made under pressure. This could have happened to anyone, even you, in a different form or manner.

I understand the weight of the situation, but turning things bitter or difficult for your wife isn't the solution. She's currently carrying your child and needs your support and understanding more than ever. You both are partners, and this is a hurdle you'll need to cross together.

In times like these, I believe in seeking guidance through prayer. While situations may appear bleak now, life has a way of presenting solutions when we least expect them. We've all faced various challenges before, and looking back, we see they've become a part of our growth story. Similarly, this too shall pass.

Imagine if you were in her shoes, having made an unintentional error. How would you hope she'd react? It's a chance for compassion, understanding, and support. Life often tests our strength and patience in ways we don't anticipate.

I genuinely hope you both can find a middle ground and a solution that works best for your family. Remember, time has a unique way of healing wounds and making things better. Stay strong and united, especially now. I pray that God guides you both during this time and makes the path ahead smoother for you.

Take care and be there for each other.
)
Thanks so much for your kind words. We sincerely appreciate. I've sent out emails to all the necessary bodies as suggested and I await response.

Unfortunately, you did not exercise your '' right to reject '', within the legal framework allowable by your consumer protection rights........

You are now stuck, that credit agreement would be your undoing...... Even if you went to a small claims court........

Your only choice - :
- Breach the agreement
- The name(s) on the agreement, would be blacklisted. Your credit report would have a massive red mark......
- When they take you to court, plus all court charges and administrative costs..... Expect them to add another £1500 (or close enough), to end balance..........

::::: View this experience as signing credit agreement lesson 101........
This was my only regret. I was just too mad to make the right decision or necessary step. I immediately told my uncle wife to come carry her pot and it led to a massive argument that night, she said since they've cooked with it, there's no going back, my wife also rang the dealer the next day and she said the same thing.

I should've brought the matter here or look them up online and give them a shout, I never did. I believe I my argument can be based on the fact that they lied that we can't return it when we had 14days cooling period to get out of the contract.

Note that the DD is on Wifey's account but I've been the one paying it.

So this salad master scam is still ongoing ? undecided

The pot they use for the "demonstration" is not the same pot that is sold to you. You will be given an entirely new set of pots.

What your inlaw has done is pretty mean and just utter wickedness.

£4200 for stainless steel pots (yes, salad master is nothing but glorified stainless steel?

How much is Le Cruset (cast iron) pot set?

My Mrs has indulged their nonsense and sat through their presentation three different times and she hasn't budged.

Why would anyone buy stainless steel pots using finance or pay £4200? undecided

I will suggest you lodge a formal complaint compliance@saladmaster.com and include keywords like pressure selling, vulnerability, no affordability checks, consumer duty, etc. I will also suggest you complain to the financial ombudsman service too.
Thanks for this,

Plus the potential or current bitterness you'll have towards your inlaws for years to come.

Your wife can manage without them when she gives birth. If you live with them pls move out.
Wife doesn't even have shifts to work sef

Like c'mon now 4200 quid for pots? POTS not a car .
We are not staying with them, we’re just 5mins away from one another. The lady who do this thing na my own Egbon wife o, not my wife. It’s crazy man.

How did they order the pot set and you are paying for it.
They have access to your cards?
How're they using it to cook do you live with them

If it's on your card I think it's too late.

Invariably your wife has paid for her 'COS'

This life sha
I believe my uncle's wife is a friend to the lady who supplies the pot, she works with a company who owns a franchise with salad master. So she brought the pot to her house when my wife was there and as standard, they have to use the pot to cook for you in your house to educate you on how it works and all of that. We moved it all to our apartment that same night.

We paid for our COS ni o, it wasn't even free.

On spot, you'll them set a DD for monthly payment. The pot itself if 2900 while the total payment after installment is 4200. I have been keeping mute just to avoid issues but it's getting choked.

Cos you didn't put your foot all the way down when it mattered. This story is kinda like Uncle held your hand and wanted to put it in a fire, I would have expected you'd yank your hands clear off. No disrespect in self-preservation. They bought it, they should pay it. I don't care if the uncle was part of those who gave me one of my names, I ain't gonna pay one pence! So you dey actually pay..lol. It is well.🤣
I had to give up because of Wifey's condition. The most painful thing was I later discovered that I could actually return it within 14days of buying it, but they lied because of the referral they wanna get. I just need a legal way to opt out. Otisumi
TravelRe: Living In The Uk-life Of An Immigrant (part 3) by yolkman20: 1:37pm On Sep 20, 2023
Hello everyone,
Please I need advice.
I'm in a situation and i need advice on how to opt out.
So my uncle wife took advantage of my wife because of too much respect. (wifey bleeped up big time). We recently moved close to them because she's the one who helped us with COS. She recommended a cooking pot (salad master) as we needed to set up the house and kitchen, but i declined immediately after i heard the price (4200 pound DD payment for 4years for 5pcs set.)
During the chat, i discovered she'll get about 500quid referral and thats why she's desperate for us to buy it. The discussion happend about 3 other times and my response was no. My uncle got involved at a point and he also supported her wife because that's what they use too but i insisted. Then she turned to my wife and start to convince her but we'd already discussed and it was a NO.
Fast forward to a month after, my wife was in their house sleeping, she then woke her up only for her to see the pot has been supplied, and they were already cooking with it for her induction and to use it. In the prescense of the supplier, my wife tried telling her we've already discussed this many times and we were not interested but she cut her and told her since they were already cooking with it, we cant opt out. She couldnt call me because she wasn't with her phone. She ensured all the paper works was done and DD was set before she let her near her phone. My wife has so much regard for her and that's why she couldn't say NO. Too much respect...

I got to know that day and i got mad at her, how can you let her lure you into a 4k financial engagement despite several discussions, she just dey cry and she was preggy....

I immediately told her to come take the pot but the supplier said no way, DD has been set and there's no going back)(dey don plan am.)
Bleep up i did was, i should've rang the company directly but i just gave up because i dont want issues between me and egbon.
Now, COS no get shift, there's no work in cardiff at all and all the load is on me. DD is 94quid per month and it's choking.

Here is my question, is there anything i can do to opt out legally? we're 6 months into the contract and it feels like forever, i dont mind losing 1k just to opt out, but i dont wanna do this no more... We can't afford with the all the bills and expenses we already have.

It's tiring...
I look forward to ya'lls suggestions

Hello house,

Please I need help. I moved to cardiff on April 12 this year and I immediately registered with Welsh water as they're the provider to that flat. They brought my bill and it says 92quid per month. I rang them and they said they can't do anything except I request for a meter. My uncle was the one staying in the apartment before I moved in and he was paying 33quid and he told me that meter can't work in that house because the connection is parallel.

They also said I can't change provider and I must pay the money as quoted. It's ridiculous and I can't afford it. What can I do please. I need advice.

Thanks

Her current visa expires in 1 week. Looking forward to your kind responses.
