AFRICANGLOBE – Ten U.S. Senators, led by Chris Murphy (D-Conn.) have called on President Obama to exclude Uganda and Nigeria from the African Growth and Opportunity Act (AGOA) program that allows duty-free exports of some products to the U.S. as punishment for restricting homosexuality in the two countries. The senators in a letter dated July 14 to President Obama wrote in part: “We are deeply concerned over a growing trend of laws and proposed legislation targeting LGBT individuals in Africa, which violates the standards set forth in the African Growth and Opportunity Act. We therefore ask that your Administration review Nigeria and Uganda’s eligibility for AGOA’s trade preference and, if it is determined that those countries are not ‘making continual progress’ in meeting the statute’s requirements, that you take steps to revoke AGOA eligibility to Nigeria and Uganda. We believe that the discriminatory anti-LGBT laws in those countries represent a clear violation of human rights and hope that the inter-agency process charged with AGOA’s annual review will make this recommendation.” Authorized in 2000, AGOA offers tangible incentives for African countries to expand trade, stimulate economic growth, and integrate into the global economy. To be eligible for AGOA a country is barred from engaging in “gross violations of internationally recognized human rights.” Both Uganda and Nigeria have enacted “harsh and inhumane LGBT policies that violate internationally recognized human rights protecting LGBT people. These laws and policies severely limit an LGBT person’s access to health care, housing, and education, as well as freedom of expression,” according to Senator Murphy. Other senators signing on to the letter are: Tammy Baldwin; Martin Heinrich; Richard Blumenthal; Barbara Boxer; Al Franken; Kirsten Gillibrand; Edward Markey; Sherrod Brown; and, Mark E. Udall. Most African presidents will be attending the U.S.-Africa Leaders’ Summit next week hosted by President Obama in Washington next week. These laws, combined with the growing public vitriol by government officials and the media, threaten to usher in an era of widespread oppression of the LGBT community in many African countries. We believe the enforcement of these laws would be a human rights abuse in violation of the standards set forth in the African Growth and Opportunity Act (AGOA). Already this year, both Nigeria and Uganda have enacted laws that impose harsh penalties for homosexual activity and activism on behalf of LGBT people. Despite strong opposition from the United States and many other nations, Nigeria enacted the Same-Sex Marriage Prohibition Act in January, and one month later, Uganda’s President signed into law the Anti-Homosexuality Act. In Nigeria, the legislation immediately triggered an outbreak of violent anti-gay attacks. As you know, Uganda and Nigeria are among the countries eligible for AGOA, which has allowed for duty-free treatment of certain imports from sub-Saharan African countries since 2000. Congress passed this law with a clear intention to make the benefits of this non-reciprocal agreement contingent on these countries’ commitment to human rights. AGOA states that a country is only eligible for preferential trade status if that country “does not engage in gross violations of internationally recognized human rights.” The jurisprudence in the area of international human rights supports respect of sexual orientation and gender identity as human rights. We therefore ask that your Administration review Nigeria and Uganda’s eligibility for AGOA’s trade preference and, if it is determined that those countries are not “making continual progress” in meeting the statute’s requirements, that you take steps to revoke AGOA eligibility to Nigeria and Uganda in accordance with 19 U.S. C. §2466a(a)(3). We believe that the discriminatory anti-LGBT laws in those countries represent a clear violation of human rights and hope that the interagency process charged with AGOA’s annual review will make this recommendation. We further ask that you not restore eligibility until these beneficiary countries have taken steps to eliminate harsh penalties for LGBT persons. As the International Trade Commission (ITC) correctly stated when AGOA was first passed, “Congress never intended AGOA to be a blank check for all African countries, without regard to performance. It was meant to offer tangible incentives for African governments to improve their political and economic governance, not to underwrite poor policies.” Some of the leaders who promote the benefits of AGOA in their respective countries, including Uganda’s President Yoweri Museveni, are the same leaders now presiding over the deterioration of LGBT rights in Africa. By revoking AGOA eligibility, the United States will be sending a clear message that countries must choose between enjoying the benefits of AGOA and violating the human rights of LGBT individuals. The world of football transfers is mysterious and murky, rotten and ruthless. Millionaire players, demanding managers, extravagant owners and wily agents all make up the cast of the game's summer soap opera. Fans find it fascinating and frustrating but are often left angered and confused by the veil of mistruths and rumour that drive the world of transfers. This summer has been a case in point. It has been the summer of the saga, the summer of Luis Suarez,Wayne Rooney,Gareth Bale and Cesc Fabregas. More than ever it has been a battle for public good will and a fight for hearts and minds, as each camp pushes their agenda in search of the deal that suits them. Some players and agents stay quiet. Others brief constantly. And some just wait for the right moment to make their move. The days of managers exchanging brown envelopes at motorway service stations have gone. But the modern-day Premier League transfer is a highly complicated game of move and counter-move, played by clubs and agents. All parties have their own tactics to shape the way the public view a situation, all have their own agendas, all want the result that is best for them as the fans battle to search for the facts. Here we attempt to unpick the secrets behind the transfer window and explain how and why things happen the way they do. THE RESEARCH The most organised clubs work as much as 12 months ahead of time, sometimes even longer. Clubs will scout players relentlessly, both in person and by using computer programmes, such as Scout7, (external) which allow them to watch any game in the world at any time and which store statistical data on every professional player. Once they have drawn up a list of targets, some of the biggest Premier League clubs employ consultants to undertake due diligence on the players in question. These consultants talk to former team-mates, family members and friends to establish what kind of character the player is. Does he drink? Does he smoke? What is his relationship status? Does he have any skeletons in the cupboard? In one case, a Premier League club decided not to pursue a transfer when they were told a player, who had just captained his club side in a convincing defeat by their bitter rivals, had been spotted out drinking and joking with friends a few hours after the game. It was decided, for good or for ill, that this player lacked heart and commitment and that the fortunes of his team simply did not mean enough to him. The club passed and moved on to a different target. Each report on a player will come back with three results: green, amber and red. The final decision, however, is always taken by the club. And even if the report comes back red, a manager may feel talent makes it worth the risk. THE DEAL Football Association Premier League rule K5 (external) states that 'a player under contract shall not directly or indirectly make any approach to another club without having obtained the prior written consent of the existing club to who he is contracted.' The reality of the 21st century transfer deal is that no club bids for a player until they have made contact with their agent to gauge the player's interest in the move. You might say that is tapping up, but clubs often use agents as intermediaries or go-betweens to distance themselves from direct contact with the player - it is one of football's many open secrets. No club wants to go to the trouble of agreeing a fee with a rival, only to find the player has no intention of joining them - it could lead to public embarrassment and criticism. Once a club has established a target's interest in joining them, they can approach his club knowing that a deal is realistic. Recently, a Premier League club actually flew a player and his agent over to England before the clubs had agreed a fee. A source close to the deal said "it is the way of the modern transfer deal. Often the last thing that is agreed is the fee between the clubs." THE HITCH A transfer deal can be fraught and fragile, it often doesn't take much to make the whole thing collapse. The deal for Willian was the prime example. Over the course of a weekend, Liverpool grew increasingly optimistic that they had landed him from Anzhi Makhachkala. But his agent, Kia Joorabchian, wanted to secure the best possible deal for his client, both financially and in terms of his career. Spurs then hijacked the move, outbidding Liverpool. Willian passed a medical at Spurs, but there was to be a twist. Chelsea owner Roman Abramovich intervened. They matched Spurs' offer, offered even more lucrative terms and the lure of Champions League football and the deal was finally done. It was an example of why it is hard to be certain of anything in the transfer window and just how quickly things change. On one deadline day, a leading international striker had been sold from one Premier League club to another in a multi-million pound deal. What neither club had bargained on was the player falling asleep at the airport and missing his flight and therefore the medical. With the deadline fast approaching, the deal was scrambled over the line with the help of the trusty fax machine and a friendly pilot. It happens. THE LEAK The simple answer is often because one of the parties wants it to. Everyone has an agenda in a transfer window - clubs, players, agents. Perhaps a player wants to tell the world he wants to leave a club but doesn't want to go as far as releasing a statement in case he ends up having to stay? Perhaps a club wants it to be known they have rejected an offer for their star player to start an auction? Perhaps an agent wants his player to be rewarded with a new contract? Even managers are not immune from using the media. The journalist's job is to weigh up all the information that comes their way and assess what can be trusted and what might be leaking out to drive an agenda, rather than being based in fact. Some managers, agents, players and even football clubs do not always tell the truth, however. In one instance during this transfer window, an agent made contact to say a foreign club had approached a Premier League defender. The English club confirmed, off the record, that the story was true. The next day their manager denied an approach had been made. In another situation, a club confirmed a story, again off the record, that ultimately ended up being incorrect. It can be a viper pit of mistruths. THE PLAYER This summer has shown that players approach things in very different ways when they want out. Suarez went public with an explosive interview that only hardened Liverpool's resolve not to sell him to Arsenal. Wayne Rooney said nothing, but he didn't need to as sources close to the player indicated he was "angry and confused" about his status at Manchester United and wanted to be allowed to join Chelsea. Gareth Bale and his advisors have been altogether more careful. There is no doubt that they were frustrated by the protracted nature of his potential world record move to Real Madrid, but they kept their counsel throughout. Bale did, however, miss training, although sources at the club disagree on whether he was ever expected to report with his future in doubt. It isn't easy for clubs to ride out these sagas, but this summer's transfer window has shown, if nothing else, that players don't always get their way. Suarez agitated and went public with his frustration but Liverpool owner John W Henry stood firm and refused to accept that he had to sell to a rival club, Arsenal, simply because his star player wanted to leave. Likewise, Manchester United did the same with Rooney. Both are strong examples of clubs wrestling some power back from their players, but the biggest deal of the summer did see Bale granted his wish to join Real Madrid. All clubs have three categories of players in their squad - those who are not for sale under any circumstances, those who would be sold for the right price and those they are actively seeking to sell. Often players who are the subject of bids are taken out of training by the selling squad. Often injury will be blamed but in many occasions the club wants to protect their value and prevent a last-minute injury damaging a deal. THE AGENT Football agents have a bad name and are often portrayed as greedy, cut-throat operators who cause trouble and are simply out to make money. The truth is that there is a broad spectrum of agents in the game, but in a general sense they are there to either look after the interests of a player, or to act for a buying or selling club to broker a deal. The most thorough agents will look after a player's commercial interests, their financial planning and their public image. Agents normally take around 5% of a player's salary and sponsorship deals. Clubs deal with agents in very different ways. Some Premier League clubs now pull out of deals over agents' fees and commission. One club signed a player who broke their transfer record this summer but simply refused to pander to the agent. When the player checked in at his hotel ahead of the medical, no room was booked for the agent. No flight had been booked. Their deal was with the player. I joined him out of sheer respect and civility, although the channel is nowhere near one of my preferred channels. But as always, there is some good and some lesson in everything. The film was essentially about two young men who left the village to try and make good in the city. In the course of their wanderings, they met Sugar Mummies who took care of them. They soon grew a large appetite and gradually began to dupe these women — the fingers that were feeding and clothing them. Then they wanted one big haul that would set them up for life and didn’t care if that could cripple their Sugar Mummies. They succeeded in fleecing these women and headed for the village. They probably would have gotten away with it if they had not taken so much from their benefactors or if they had lived wisely and invested the money in some slow yielding but long lasting venture. No. They envied the fast, flamboyant lifestyle and wanted it all. They threw parties and caroused young girls. As it now happens everywhere in our society, the village elders saw money and threw principles and traditions to the wind. They made these young men chiefs and elders and accorded undeserved respect to them. Those who protested were loudly shouted down. Meanwhile, the Sugar Mummies felt embittered by the money they had lost and the manner they lost it and vowed to pursue their toy boys. Unfortunately, the lavish lifestyle of the two young men gave them away easily and they were caught. The story ended when they were being led disgraced and in handcuffs, into a waiting Police vehicle. For me, the story depicts so much of what is happening in our society today. From the morally depraved Sugar Mummies – one of whom was in her husband’s house – to the morally depraved village elders who now had eggs thrown on their faces, to the thieving, greedy young men who would now spend time behind bars. Except of course there probably would be a twist in real life if they still have some money left. With money in our society, they probably would settle the Police who would declare shamelessly, that they had escaped along the way, or failing that, the Magistrate who would find a technical ground to free them. Some society. A society where those who were supposed to investigate NEPA and fuel subsidy allocations turned out to also need investigators because they had soiled their hands; where those to administer pension funds became daylight robbers; where justice is becoming cash and carry; and where people of low character have ascended high judicial offices preferring to support rather than admonish criminals( the likes of Dr T. Elias must be turning in their graves); where high profile thieves are given Presidential pardon; where our word is no longer our bond. A society where oil, which is supposed to be a blessing either in its crude or refined form, seems to stain everybody it touches in Nigeria. And it has touched a lot people including ministers we thought would make some difference on account of age, education and exposure but have turned out to be as bad, if not worse than their predecessors. The conclusion seems to be inescapable that what we have as leaders – in politics, business and the civil service – are common thieves in high places. The rot is so deep that it is now in the family system, in the religious system; even in friendly, social clubs. Everybody is looking for somebody else to steal from. And we wonder why PHCN can not give light; why the rail way is still in planning stages several years after; why contracts award is the most interesting duty of our executives( both in public and private); why partnerships don’t work; why businesses don’t outlive their founders; why brothers fight brothers over properties they didn’t work for. Its all for this thing called money. And what do we do with the money we maim and kill for? Someone I know came for holidays after a long stay in Canada and was feted by his close friend. When he saw me after the outing, he exclaimed ‘you people are mad in this country. Imagine a bottle of champagne costing 150,000 naira. You people are mad’. He repeated. I didn’t have the heart to tell him there are more expensive bottles at some clubs. I just smiled and said ‘that is part of where the stolen money goes’ Yes. We steal so we can buy exotic cars and liquor; so we can buy houses we don’t need and keep some for grandchildren who are yet to be born. We steal, so we can celebrate anniversaries with millions of naira and give our sons and daughters away with more millions, throwing parties that don’t make sense to any rational person in a rational country. We don’t steal to impact lives or set up industries. Oh no. Instead, we steal to indulge. Sometimes, I think we steal just because its there to be stolen. The day our leaders decide they don’t need James Ibori’s kind of wealth or Cecilia Ibru’s kind of property acquisition, that a good name is better than material acquisition; and that leadership at the end of the day, is about people and leaving a place better than you met it, is the day Nigeria will begin a positive walk into sanity and propriety. By Obinna Akukwe Dieziani Allison Madueke is Nigeria’s oil minister under the presidency of Goodluck Jonathan. This woman has become the second most controversial woman in the history of Nigeria, second to Mrs Turai Yar’adua, wife of the late president Umaru Yar’adua. Hajia Yaradua took over the apparatus of governance while her husband was hospitalized in Saudi Hospital and through the use of a cabal, wrestled the acting capacity of the Goodluck Jonathan until human rights activists, Save Nigeria Group and others helped returned the constitutional mandate back to him. Dieziani Madueke, a former Director in Shell Multinational Corporation was appointed a minister under the presidency of late Yar’adua. She was among the two lists from then Vice President Jonathan whom Yaradua brought in as ministers. Therefore, the relationship between the duo preceded his presidency. During her tenure as Minister of Works, there was no evidence that she left the deplorable roads in Nigeria better than she met it. When Jonathan ascended the throne of Nigeria where food bill is N1 billion naira annually, she was transferred to the ever lucrative Petroleum Ministry. Yet there is no evidence that she has turned around the rot in the industry. Therefore, it is proper to assume that she is a bundle of stagnancy in the discharge of official functions. Despite the above, this woman who had maintained her attractive figure and superlative dress sense, is known to have the ears of Nigeria’s president Goodluck Jonathan. A lot of close watchers in Aso Villa knows that Dieziani has lots of favors with Jonathan. All the efforts by those nicknamed “agents of darkness” to cause Jonathan to remove her or assign her a less lucrative portfolio has fallen on deaf ears. While the activists, professionals and bureaucrats are calling her incompetent and corrupt, Jonathan sees her as efficient. Therefore it would not be out of place to refer to her as Sweet Dieziani. How efficient is Sweet Dieziani. That story is for another day, however, even the First Lady has been forced to realize that respect and tolerance for Sweet Dieziani is the beginning of Wisdom. Thus her initial venomous attitude and “garagara†towards the oil minister has died naturally. Therefore, it could be conveniently said that this woman controls the sweet crude of Nigeria because a sweeter Goodluck is behind her. All these things are quite irritating to me because governance is to be run with utmost selflessness and patriotism devoid of sentiments but since we are still mortals, sentiments sometimes come in. However, it seems that this controversial woman gave her children some sort of home training and soberness in the midst of opulence. I remarked that during the fuel subsidy riots, pictures of her son Ugonna with some friends, half naked women and bundles of thousands of dollars, in reveling display at a private jet and a stretch limo, was circulated on the internet. This picture further infuriated the protesters and raised national angst. Shortly afterwards, this pleasure loving son apologized to the Nigerian people, saying that the pictures was not meant to destroy the already battered psyche. This action from this man caught my fancy. According to the Ugonna “I sincerely apologise to my family and the Nigerian public for any hurt, anger or embarrassment that might have been caused by these pictures, which were taken completely out of context. I will endeavor to ensure that all my actions in future will be sensitive to the plight of allâ€. This is the first time that a son or daughter of the embezzlers of Nigerian common wealth apologized to a traumatized public. Children of looters of Nigerian funds will naturally scorn at those criticizing their profligacy describing them as ‘Homo Sapiens whose impoverished ancestors kept in their sorry state’. Sweet Dieziani should expand this sober act of her son or step son, towards her relationship with the president and display sensitivity to the plight of Nigerians. It is time for Sweet Dieziani to convince the president that the process earlier started by late president Umaru Yaradua which led to the revocation of some illegally acquired oil blocks be resumed so that a few people do not control Nigeria, with excess funds to sponsor terrorism. Can Sweet Dieziani convince the president that importation of petroleum products from outside is not beneficial to Nigerian economy, despite the fact that some powerful persons in government are benefiting from it. Can Sweet Dieziani convince the President to support institutionalized transparency in the oil industry so that all these billions of dollars lost to oil theft annually can be blocked? Can Sweet Dieziani convince the president that a situation whereby all our oil savings is shared between the three tiers of government without reserve is another brand of voodoo revenue allocation, capable of putting the nation in trouble if there is sustained fall in oil price? Can Sweet Dieziani convince the president to dedicate more funds to poverty alleviation and job creation and reduce amount spent on frivolities, fighting opposition governors, and related matters, and leave a lasting legacy for the Jonathan presidency. It is obvious that a lot of sycophants, boot lickers and liars whose selfish interests are suffocating have held the president hostage and the man needs fresh air himself. It is discernible that the way Jonathan’s friends and inner cabinet are handling opposing opinions and actions, there might be no Nigeria by the time he finishes his tenure in 2015, 2017 or 2019, whichever one providence allows. Therefore, Sweet Dieziani could bridge the gap and let the President know that he must behave as father to all Nigerians, shun partisanship and take firm action when national cohesion is threatened. I believe that Sweet Dieziani can do all these if she rises beyond mundane attachments, rids herself of praise singers, shuns corrupt entrapment and uses the same spirit she used to caution her step son who was partying while the nation was burning. In the Ministry of Petroleum resources, the fear of Dieziani is the beginning of wisdom. All the oil hawkers who hitherto turned the ministry into an annex of Arewa House have all scampered back to their villages effectively ending the tenure of few northern cabals in the place. Can she use the same influence to reduce corruption in the Petroleum Industry and save the future of hopeless Nigerians who depend on oil revenue for survival? Queen Esther in the Bible used her influence to stop the first planned genocide on Jews in the history of the world. Everyone must give account of how he used his or her position to God ,Dieziani inclusive. Nigerians are facing economic genocide due to the fact that government has abandoned the art of providing for its citizenry and wasted billions of dollars on politics. The EFCC, ICPC, National Assembly and all organs assigned the constitutional duties of checkmating profligacy and corruption in the system, are themselves partners in the corrupt chess pool. Therefore, the hopeless Nigerians has nobody to enforce their rights to dignified existence through equitable allocation of resources. Based on the foregoing I have no option than to hope that this most powerful woman in Nigeria at the moment can heed the clarion call, use her position and favor with President Jonathan, whichever way it came about, to advance Nigeria in the right direction and stop further economic genocide on unfortunate citizenry. It is not her duty to influence all these but I believe that Sweet Diezani can mobilize other women in that place including Okonjo Iwuala, Stella-Oduah, Joy Emordi to quietly pressurize for a radical change from Sweet Goodluck towards the realization of the promised transformational agenda. The man, whose name could not be ascertained was discovered to possess a full grown pair of breasts, which dangled from his chest, just like those of a young woman. An angry mob was going for the kill when security operatives were quickly drafted to the scene. Their (mob) grouse was that it was strange and unacceptable that a man would possess dual sex organs. Young men near a filling station at the Sapele-Warri/New Road junction tore the man’s clothes, and revealed a very small male organ, allegedly with no scrotum – which to them suggested that he was a hermaphrodite. Saturday Tribune gathered from some onlookers who claimed to know the man that he had been seeking spiritual solutions to his problem by moving from one church to another. It was further learnt that at one of the churches, he started manifesting some strange behaviours while for some time he hid his male and female sexual organs from church officials who later found out his status as a hermaphrodite. The voice and face of the man were masculine even as he was said to also have female reproductive organs. Men of the Nigeria Police in Sapele, and the other security operatives who were drafted to scene, quickly dislodged the irate mob, who were taking turns to fiddle with the man’s sex organs, ostensibly to further confirm their suspicions that the man was really a freak. He was thereafter spirited away by the police to the Sapele Police Station for protective custody and investigations....very sad
