Please use the documents attached to the e-mail. We find e-mail more reliable and quicker than regular mail. smiley

Yes, all cases must wait for their priority dates to become current before they are sent to post. (The only exception is Immediate Relative [IR] cases, which are always automatically current.)

It depends. It's possible that the field investigation answered all our questions, but it's also possible that we're waiting to hear back from other sources as well. Sorry I can't be more definitive. But, in general, if the field investigation is complete, chances are good that you'll hear from someone very soon.

You'll need to see one of our panel physicians for your medical paperwork. http://photos.state.gov/libraries/nigeria/487468/pdfs/PANELl_Phys_handout_Applicant.pdf has their contact information.

Hospital birth certificates aren't acceptable for immigration purposes, generally speaking. We prefer to see birth certificates issued by a government office, which in Nigeria typically means the NPC.

Based solely on what you've written here: It sounds like the ineligibility would be under INA 212(a)(6)(C)(i), material misrepresentation. The application for a waiver is the I-601, and in my experience USCIS is typically generous about granting waivers for situations like the one you've described. I can't guarantee that, of course, but it does sound like you have a good chance of success.

I wasn't going to ask this until much later. But I might as well now before you leave for good. Sadly.

Been married over 10 years. Wife and kids are all USCs. But only filed late last year (don't ask me why. Let's just blame procrastination).

My documemts are at NVC. May be another month before they get in touch.

What I need to know is, would I need to go through that whole hoop of getting and printing photos of marriage, engagement, etc?

We already have marriage certificate, plus kids' birth certificates. Plus our house in the US has both our names on.

I'm just trying to do the minimum possible as I'm not the most organized person in the world and I really do not want to go digging up old pictures if I don't have to.

It's a good idea to bring evidence to the interview -- but the most important thing will be the interview itself. As long as your wife can reasonably discuss your relationship, a lack of photographs shouldn't really count against anyone. The fact that you have children, plural, together is pretty good evidence that you two have an ongoing relationship. So, if your photos aren't easily accessible, I wouldn't worry about that too much, personally.

Someone told me that laminated original certificates may not be accepted or allowed for verification during interview.

We accept laminated documents. It's true that we prefer to see them unlaminated, but we know that many people choose to laminate them to keep them safe, so it's not a disqualification or a strike against the applicant.

The wait time for F4s (sibling visas) is running around 12 years. It's fine to use your non-immigrant (tourist) visa while you have an immigrant petition pending -- no problem at all.

It generally takes only a few weeks for the laboratory to send the results to post. But after that happens, it can take another week or two for post to contact you. Embassies and consulates get a lot of mail, which has to be sorted -- then the cases have to be pulled and matched with the results -- results scanned into the relevant computer records -- cases reviewed by an officer -- and only at that point can the applicants be contacted for follow-up. So, unfortunately, it's not instantaneous. But we know families are eagerly waiting to hear from us, so we do it all as quickly as we can.

You should bring two passport-sized photos with you to your interview. smiley

Here's my story smiley

Im a US citizen and I had applied for my son's immigration in 2009. Last week, I got a packet from the National Visa Center. The PAOSF welcome letter indicated that we now need to take this forward submit fee etc.

In the past few years, my son's status has changed. We weren't able to update his application with so much happening. He got married and got divorced. He has not children and he's been traveling as well for work. Meanwhile he also got a Canadian PR so now he's living in Toronto. He hasn't applied to visit us in the US yet, but was planning to. Obviously, with his country of birth Passport, he would need a visa even as a Canadian PR. We were told to not apply for a visit visa as this would automatically potentially disqualify him for a visit visa. Now with the PASOF NVC letter, where does that leave us?

With what little we were able to ask around, we were told that we should proceed as stated in the letter. Select agent (myself - father), pay fee. On the DS260 I can update all my son's info including address, marital status etc. He will be required to submit a copy of his divorce decree together with his other civil documents. Since his residence is already in Canada, he may include a short letter requesting that he be interviewed at the US Embassy in Canada. Of course with proof of residency.

Sounds legit! And, since your son is now divorced, from our point of view his marital status is "unmarried," just as it was when you filed for him. So it doesn't matter if you didn't keep NVC updated; you can just list him as divorced in the DS-260.

It is more difficult to qualify for a non-immigrant visa when there's an immigrant petition pending, but it's not impossible. If he wants to come visit you in the meantime, there's no harm in applying for the non-immigrant visa; the worst thing that can happen is that he'll be refused. But that wouldn't adversely affect his immigrant petition in any way.

We've been dating for almost 2 years now, and met each other 6 times already in different countries (he is visiting me in italy right now), been talking every day and taking pictures, so we have a lot of proofs of our relationship.
The problem is that on July 1st I was refused a F1 visa, based on 214(b)-lack of ties with my country- (because I travelled a lot in the past 3 years), to go to the USA for 2 years to study.
My concern is not much the refusal, but the fact that when I was asked who "Austin Bleep" was (my by now fiancè, and boyfriend back then) , I answered "a friend", and then I was asked "just a friend?" and I said "yes" because I was so nervous and I thought that having a boyfriend there it would have been a reason more to have the visa granted.
The reason why they knew his name, was because when in December I went to visit him on an ESTA, I told I was there to visit my boyfriend, and I told them his name when asked. I didn't remember about this at the F-1 interview.

Now, my problem is: when AND IF i will be at the interview, and I will be asked "why I said we were just friends", could I say "because I was nervous and scared"? What would be the consequences? I feel so dumb about what I said..but I would rather admit the truth now. But I really don't want to be banned from the USA, I want to be able to be with my Fiancè...
What do you recommend?

Greetings! Personally I think that "because I was nervous and scared" is a perfect answer in this situation. We know that people want to visit their fiancés, and that they often don't tell us they're engaged because they're afraid they won't get a visa. But that's not the sort of misrepresentation that leads to a permanent ineligibility. Based on what you've written here, I wouldn't worry about being banned. We save bans for violations that are a little more serious than what you describe. smiley

Technically this is a question for the non-immigrant visa thread. But I think you can just write what you've written here, that the officer said you didn't show strong ties.

My wife's priority date is in September 2014 and I think the visa bulletin's cut off is still in Nov 2013 but I just got a mail from NVC telling me they have started processing her case.

They asked me to start the six stages of the process of which I have already put my name as her agent.

Does it mean she will be through before her priority date or what? I'm happy but confused about it.

It sounds to me like they're working to get the petition approved and the case documentarily complete, so that it will be ready to schedule as soon as the priority date becomes current. smiley

Your priority date is the date that your petition was filed with USCIS. But as an IR2, you don't need to worry about your priority date. As soon as your petition is approved and your case is documentarily complete, it will be scheduled for the next available interview. Immediate Relative (IR) cases are always current -- no waiting period.

Please I need you to help me with this question even though it's a non immigrant question though, my sister want to adopt my niece she is 11 years old because my brother who happened to be her father died 2 weeks ago and there's no one to take care of her again because the mom is not with her too.
Now, she is thinking of inviting her first for visitation and then go back to nigeria to start the adoption process.
Now, my question is Wil she attend interview since she is just 11yrs old or is it drop box that should be done for her? Awaiting ur answer ma'am.

My condolences for your loss. In this case, your niece will definitely need to attend an interview. Even if she were otherwise eligible for dropbox, in this situation the officer will want to speak to her in person.

If a post rescheduled a Diversity Visa Interview without the request of the applicant , and later after the rescheduled interview was conducted , the post found out that the visas slots reserved were gone cause of not being used at the time scheduled originally by KCC , what can the post do at this stage .? This doesn't sound like a situation that would arise in Nigeria, and I can't speak for any other post. I'd e-mail the post directly and ask them for guidance.

Yes, that's right, she'll have to wait until her case is current before it can be scheduled for an interview. The good news is that because you're an LPR, the child can be included as a derivative in her case -- you wouldn't need to file a new petition (and wait for it to be approved, etc.). That's one of the few advantages LPRs have over U.S. citizens.

Not sure if you're still answering questions but I need answers so I'll just ask. I am a DV winner from NBO (principal applicant) with a husband and a daughter and a child on the way in November.we're current but was shocked that they found a small scar on the husband's CXR. He has been asked to undergo sputum testing which requires 2 months culture. That means his result will be out around 10th of October 10 days after the 30 September deadline.
In such a case will our visas be issued except his or do none of us get it?
Or can the Embassy issue the visas and detain all our passports until his TB clearance comes in. In case the sputum comes back positive, they can cancel the visas without prejudice? This is because clearance can only come in 2 weeks after end of dv 2015.
