RICKEY TARFA SUES MTN, EFCC, others for N5billion

Embattled Senior Advocate of Nigeria, Mr. Rickey Tarfa, has filed a fresh fundamental rights enforcement suit against telecommunications company, MTN Nigeria Communications Limited, for the alleged violation of his right to privacy.

Tarfa is seeking a court declaration that his right to privacy was violated when the call records/log on his phone with mobile number 08034600000 was allegedly accessed without his authority and made available to Sahara Reporters and other online news media without any reasonable cause or a lawful court order.

The Economic and Financial Crimes Commission had on February 5 arrested Tarfa and confiscated his two mobile phones and his Mercedez Benz SUV with Registration No. KJA 700 CG, on the allegation that Tarfa hid two alleged suspects of economic and financial crimes in his car to prevent their arrest.
Joined as respondents in Tarfa’s second fundamental rights enforcement suit  are the EFCC, its Chairman, Ibrahim Magu, Mrs. Rashidatou Abdou and Mr. Femi Falana (SAN).

He is urging the court to order the respondents to pay him N5bn for the alleged violation of his rights.

Ricky Tarfa is a shameless fool. EFCC, for ease of its investigation has the right to obtain private information of a suspect without his authority or consent. The man is just fooling himself

When the allegation came out, I was expecting a robust and vigorous denial from the SAN. Only for him to come out telling us he transferred money to the judge truly but it was a 'donation' by friends. What a laughable excuse.

When did a senior advocate become a chief burial coordinator for a sitting judge? ....and even a burial of the judge's father in law for that matter. How come he knows the bank account details of the judge?

They should scrutinize his call logs and bank accounts and let us know how many other burial 'donations' he has done to other judges.

By the way, I can see that he sued Femi Falana too. SAN v SAN....this man just wants to disgrace himself.

Tarfa must be feeling the heat and losing clients in droves to have sued for N5billion.
No matter how many SANs u have by your side,clients would run away from a lawyer like Tarfa because they wouldn't want to have the stigma of people feeling they bribed to get favorable judgement.There are other clients that would also no longer hire him because they wud feel no judge wud give him a favorable judgement to avoid their own image being tarnished.
Tarfa must now be feeling the grave negative effects of his indiscretions.His career is actually in turmoil now.

In everything you do and no matter the level of success you have attained in life,don't trade your integrity for anything.The Nigerian judiciary (bar and bench) is on trial.Imagine Rickey Tarfa suing Femi Falana. Only time will tell if credible lawyers will stand up and be counted in defence of their profession.

How will you prove that EFCC gave the information to sahara reporters? Were you there when the information was being given or exchanged. Efcc filed court papers with the information about Tarfa bribing a judge and papers filed in courts are public documents.

All what u saying can only happen in a sane society with morals and conscience. But in Nigeria we seem to have fallen deeply in love with corruption and all traces of morality has been eroded. Just watch how people rush to defend looters and thieves on social media

Lawyers know the law. They can easily find their way around it.

Telecom companies in Nigeria are so useless, there should be an element of privacy whenever one makes and receive calls, this same stuff happens during the last presidential elections wen the then president Goodluck Jonathan called the present president Buhari, the call was licked out to the public by same telecom company, to the extent that almost all and sundry recorded the conversation btw both parties, this is bad....

The first day i saw the logs.. I told my friend that he will sue. In this fight against corruption, everything must be done via due process or we stand a chance of loosing.

Media freedom have caused lay men like me to now tell a senior lawyer he knows nothing about how the law works.

The EFCC has no right to access someone's call log without the express permission of a law court. And even if a court issues the directive, the telecom company has the right to challenge it.

Unfortunately, some people are unaware of their right from their left. As is evidenced from the comments on this thread.

If some of you take time to follow the news, you will be well aware of the FBI Vs. Apple case. I am sure if it were in Nigeria, the FBI would have just gone ahead to arrest the CEO of Apple or raid their offices and force their engineers to unlock the phone they have been battling to unlock.

No matter how corrupt Tarfa is, the EFCC should not jettison the rule of law because they want to please the president in his 'war on corruption.'
