Can you not see the part that says" in such a manner"

That shows that wearing it isn't the crime but if they prove that the manner in which you did so is bad.


Don't forget also the law offers the option of paying a very small fine even if convicted.

Oga, Nigerian Soldiers no get right to embarrass Nigerian Citizens for wearing a camouflage. If they are educated enough, they will know it's very wrong to publicly un-dress a guy or a lady for putting on a camouflage. I've been to other West African countries, and I've seen the way they do things there. The soldiers should've arrested the lady and handed her over to the police.

This is section 251 of our constitution following and has nothing to do with uniforms. Constitutions generally do not list crimes.

251. (1) Notwithstanding anything to the contained in this Constitution and in addition to such other jurisdiction as may be conferred upon it by an Act of the National Assembly, the Federal High Court shall have and exercise jurisdiction to the exclusion of any other court in civil causes and matters -

(a) relating to the revenue of the Government of the Federation in which the said Government or any organ thereof or a person suing or being sued on behalf of the said Government is a party;

(e) arising from the operation of the Companies and Allied Matters Act or any other enactment replacing the Act or regulating the operation of companies incorporated under the Companies and Allied Matters Act;

(f) any Federal enactment relating to copyright, patent, designs, trade marks and passing-off, industrial designs and merchandise marks, business names, commercial and industrial monopolies, combines and trusts, standards of goods and commodities and industrial standards;

(g) any admiralty jurisdiction, including shipping and navigation on the River Niger or River Benue and their affluents and on such other inland waterway as may be designated by any enactment to be an international waterway, all Federal ports, (including the constitution and powers of the ports authorities for Federal ports) and carriage by sea;

(h) diplomatic, consular and trade representation;

(i) citizenship, naturalisation and aliens, deportation of persons who are not citizens of Nigeria, extradition, immigration into and emigration from Nigeria, passports and visas;

(j) bankruptcy and insolvency;

(k) aviation and safety of aircraft.

(l) arms, ammunition and explosives;

(m) drugs and poisons;

(n) mines and minerals (including oil fields, oil mining, geological surveys and natural gas);

(o) weights and measures:

(p) the administration or the management and control of the Federal Government or any of its agencies;

(q) subject to the provisions of this Constitution, the operation and interpretation of this Constitution in so far as it affects the Federal Government or any of its agencies;

(r) any action or proceeding for a declaration or injunction affecting the validity of any executive or administrative action or decision by the Federal Government or any of its agencies; and

(s) such other jurisdiction civil or criminal and whether to the exclusion of any other court or not as may be conferred upon it by an Act of the National Assembly:

Provided that nothing in the provisions of paragraphs (p), (q) and (r) of this subsection shall prevent a person from seeking redress against the Federal Government or any of its agencies in an action for damages, injunction or specific performance where the action is based on any enactment, law or equity.

(2) The Federal High Court shall have and exercise jurisdiction and powers in respect of treason, treasonable felony and allied offences.

(3) The Federal High Court shall also have and exercise jurisdiction and powers in respect of criminal causes and matters in respect of which jurisdiction is conferred by subsection (1) of this section.

Good. Now look at the part I highlighted. Since we're here to learn, can you tell me the difference, legally speaking, between a crime and an offence - a simple offence at that?

And by the way, why did you abridge the provisions in the quoted section. The Law supposedly prescribes a penalty of imprisonment for three months OR an option of what? ? ?

In countries where the military men are given the utmost respect, do u ever see where the military men are harassing civilians??

I was in a store in atlanta when a military wife asked if they offer military discount for the things she wanted to buy, another woman in front of her just asked the cashier to charge her for the woman's bill! She paid for everything the woman bought and let a note "thank u for ur service".

We here in Nigeria could never hols us guys in such regard because of the way u treat us!

The first part of the law to mention here is enforcement. It is not within the ambit of our law for the Army to act as law enforcement or prosecutors so assuming she had broken any law it is quite simply not the business of any INDIVIDUAL soldier who feels offended. At best he can COMPLAIN to the police. It amounts to criminality when he starts to strip her of the offending garment. That is criminal and actually carries an even heavier penalty than the criminal misuse of military uniform.

What do our laws say about military uniform?
It is specific in prohibiting wearing similar clothes where there is an INTENT in law (mens rea) to mislead one or more people into believing that the wearer is a military personnel. In short where there is no such intent there is NO CRIME. Once again no intent to deceive or mislead NO CRIME. And again in law even where such a person is prosecuted the intent must be proven. Where camouflage is worn in such a way that it is obvious the wearer is not a soldier etc then it is TOTALLY lawful.
The final thing to say is Camouflage is NOT UNIFORM and ideally should not be worn by soldiers in civilian public space. Its purpose is to camouflage in the bush . Many people are still quite young but camouflage is a new thing with the Nigerian Army . They have not always worn it. The Army should stick to their official uniforms and reserve camouflage for when they are in combat.

The other thing is none of this would be happening if the Army did not live in towns and cities with civilians. Taking buses and public transport. We have come to accept this as normal. It is NOT. We should not be seeing soldiers if the country is not at war.
It is a shame our education system is so bad people can not think critically about issues and that is why our politicians are out of control because the citizens are largely ignorant and unintelligent

I'm totally not in support of soilders stripping someone, but no matter what the law says about wearing camouflage, it's just not right to wear it. It sends the wrong message at a glance... And that girl really jonsed. She did not just wear the trouser, she also wore the top and tied the bandana. I mean was she expecting they would just wave her and pass or what undecided

If it was a guy, some of you won't be posting this , it's in the constitution, don't wear any soldier camouflage if you're not one of them.

Why can't they wear mopo, police or navy uniform if they so much love the Nigerian force?

Some of this people have been warn by friends or relatives about the implications of wearing this camo but they won't listen.
