It's fine to have two simultaneous immigrant visa petitions, but if your brother is a Legal Permanent Resident, he can't file for his siblings. Only U.S. citizens can file for siblings.

Level of education doesn't matter in family-based cases. smiley

You always put a smile on my face each time I read ur response to my enquiries....we ar just tryin to see how possible it is for me to be there on or before the end of march which is my wife's due date....
I WISH u will tell me "apply for non-immigrant and we will grant it"!!!!!!! (I KNOW!!!)
Anyway...am hopin we don't experience the delays we had durin d k1 process due to backlog and RFE (due to over looking a question...smh)...it is well

Hi VO,
My husband is an LPR and we are hoping he will get his citizenship by March next year.My questions are:
1) Is it better to file for me as an LPR now or wait till he gets his citizenship in March?

2) If he files as an LPR and later gets his citizenship,how do we go about notifying USCIS about the change of status of the petitioner?And will this cause additional delay in the process or will it reduce our wait time to that of a US citizen petitioning for his spouse?

No, there's no waiting period to file for a fiance or a spouse. For fiances, they're supposed to have seen each other in person at some point within the past two years before filing, though.

If he files now, you'll have an earlier priority date -- and then if he becomes a citizen, your case will become current immediately. smiley Just send an e-mail to USCIS with a scanned copy of the certificate of naturalization. It will definitely reduce your wait time!

While having a conversation with a frien bhd yesterday concerning joining my wife & my current AP issue at the US consulate,he asked me if I have ever applied for the US DV-Lottery in the past,to which i said yes,almost every year since i turned 18 years old.He also asked if I have ever applied as married to which i said no.He went further to say that "usually when the US consulate question a visa case its because they have certain information about bhi visa case which often is based on the information given in previous applications".
In 2009 some in my immediate family & myself applied for the DV-Lottery through an agent in a cybercafe whom i understood did some mistakes in our applications.My brother,who at the time had two kids,had his application submitted without his kids attached to his application.These kids were rather attached to my application.I even learnt that my cousin's daughter was even attached to my DV application for that year.With this huge blunder i decided never again to go through agents but to do-it-myself since i did the previous ones myself.In 2010 when i applied again this was corrected,as the previous ones before 2009.
Since yesterday I had this conversation,I have been brainstoriming & wondering if this was the reason why the consulate questioned my marriage & wanted to investigate.Well,if it is,i have nothing to hide.Like i said before & i'm reiterating that I have never been married b,efore i married my wife & what is more i don't have any child from any woman,if DNA test is neccessary to prove this my wife & I would resort to this,all I want is to be with my wife because I'm tired of this long wait,putting my marital life on hold.My question to you sir/madam is:Do you use past DV-Lottery applications that was never selected for further processing against visa applicants? I asked My petitioner(My wife) about the DS-260 confirmation page and she can not get it since it has been submitted online, and i just want to tell you its not part of the requirement on my interview Letter, i hope this is not a problem MA.

It's a problem. As the confirmation page itself states in big red letters: "YOU MUST BRING the confirmation page and the following document(s) with you at all steps during the application process..." We really, really need you to bring the confirmation page with you.

Invitation letters really aren't that important. What's important is whether the applicant can convince the officer that he or she plans to use the non-immigrant visa as intended, then return to Nigeria. It's a problem. As the confirmation page itself states in big red letters: "YOU MUST BRING the confirmation page and the following document(s) with you at all steps during the application process..." We really, really need you to bring the confirmation page with you.

Good Day!

My spouse recently had his medical test done in Lagos and was informed that everything came out okay except for the chest X-Ray, which was abnormal, and as a result, further testing has to be done which will require an additional 8-10weeks. My spouse is scheduled for an interview at the end of this month and I was informed by the medical staffs that he would be allowed to come in for the interview but decision won't be made until the result of the test is out. My question is, will he be allowed to come in for the interview or is he better off rescheduling for the next couple of months after they receive the result of the test? Secondly, how long does it usually takes for the consulate to make a decision after receiving the result?

Good morning! Yes, your spouse is welcome to come to the interview. Assuming everything else is fine, as soon as the panel physician clears him for travel, we can issue the visa.

The only other options would be an investor visa or an employment-based visa. http://travel.state.gov/content/visas/english/immigrate.html has information on all categories of immigrant visa.

If everything goes smoothly, yes, you'd have around three more months to wait. (The National Visa Center is experiencing delays lately due to a suddenly increased caseload, but they've almost conquered it, judging by all the new cases they keep asking us to take in December).

That's a normal waiting period. If you have an emergency, we can expedite the case, but we're very strict about what constitutes an emergency.
