Please you bloggers should stop being STUPID just to attract traffic to your disgustingly senseless blogs. Only three offences attract the death penalty nationally; murder, armed robbery and treason. Some states have added kidnapping recently. No one can be sentenced to death for stealing. Please learn from your carelessness.

Exactly. Op is not giving the public the true story to this case. Someone must have been killed in the process of collecting the phone. Op is seeking public sympathy and condemning the judge.

No sane judge as you just stated in this world would get the young man sentenced to death just for stealing phone. Op should bring out the charge papers herein for public discourse.

Exactly. I felt bad the way nairalanders troop out here criticizing the judge for condemning the young man to death without finding out from the op of this subject what actually happened.

The op is drawing public sympathy for the young man, but has failed to state herein the actual offense committed by the guy.

The judge can't pass such hash sentence without death involved. Do not be surprised that the guy was armed and must have attacked his victim with a weapon that could have sent his victim to his grave.

Court sentences 23-year-old to death by hanging for stealing

From Godwin Tsa, Abuja

A High Court of the Federal Capital Territory (FCT) has sentenced a 23 years old Tope Abiodun, to death by hanging for stealing an android LG phone valued at N87, 000.

The court also sentenced a teenager, Godfrey Emmanuel, to 14 years imprisonment for the same offence.

Another suspect, Samuel Egbe 24-year-old trader at Wuse Market, Abuja, who was charged with dishonestly receiving the LG phone from the 2nd accused (Tope Abiodun), with knowledge that they were stolen, was, however, lucky, as he was discharged and acquitted by the court.

The court was amazed by the ingenuity deployed by the convicts in carrying out the robbery attack on the owner of the LG phone, Jacob Habila, who they attacked with a knife before disposing him of his handset.

According to the prosecution counsel, Assistant Commissioner of Police Simon Lough, the convicts had, on October 3, 2013, at about 9:21pm, positioned themselves half naked, at Impresist junction, Karmo, Abuja, and upon sighting the victim with his LG android phone, approached him to allow them make a distress call to their brother.

They told him they were victims of a robbery attack and would need his assistance to call their brother to bring some clothes for them to put on.

The unsuspecting Habila was touched by their story and in the process of dialling a number that was given to him, the 2nd convict (Godfrey Emmanuel), brought out a knife and stabbed him on the head, while Tope Abiodun escaped with the phone.

With blood dripping from his face, the victim raised the alarm, shouting “thief, thief” which led to the arrest of Emmanuel.

The matter was swiftly reported at the police and Abiodun was arrested a few days later.

The convicts were slammed with a three-count charge by the Commissioner of Police, for armed robbery, contrary to section 6(b) of the Robbery and Firearms Special Provisions Act, Cap R11 Laws of the Federation of Nigeria, 2004.

The convicts were represented by Nnamdi Nwiwu, who made frantic but failed legal efforts to get them off the hook.

The lawyer, however, succeeded in saving the teenage robber (Godfrey Emmanuel) from the hangman’s noose by pleading with the court, after he was found guilty of the offences, to consider the provisions of the Child Rights Act, particularly section 221 and section 405 of the Administrative of Criminal Justice Act and reduce his sentence to 14 years.

After evaluating the submissions of counsel, including exhibits and documentary evidence before her, Justice Chizoba Orji found the 1st and 2nd accused persons guilty as charged.

She held that from the totality of evidence before her, the prosecution had successfully established the case of armed robbery against The judge ruled: The 1st and 2nd accused person.

“This court is convinced that there was robbery. PW4 gave cogent evidence of the incident and how the 2nd defendant snatched his phone and ran away and the defendants confessed that they used knife to rob.

“PW4 arrested the 2nd defendant some few days later and took him to the police, while the 3rd defendant was arrested with the stolen phone.

“All these are cogent and direct evidence of conspiracy. I find that the offence of criminal conspiracy to commit armed robbery have been proved beyond all reasonable doubts against the 1st and 2nd defendants.

“The prosecution has tendered exhibits, including the picture of the victim showing head injury, his shirt, which was soaked with blood. He needs not tender the knife in evidence where there is overwhelming evidence of the commission of the crime by the defendants.

Except the case was an armed robbery case where someone died.... this report is false. The penalty for common theft in Nigeria is not the death sentence.

Good, they robbed a guy while armed. That is robbery. They stabbed their victim and made away with his phone.

Op is trying to convince nairalanders here that it was just a phone they stole. Their victim was stabbed with a knife and that is a pure armed robbery case and therefore, they were been punished accordingly.

Op should plead for the death sentence to be commuted to life imprisonment and not to provoke the judge and the Supreme Court to confirm his death sentence because of this post.

ok...I am Confused here...Cos it is stated in the criminal code that stealing is punishable with 3 months imprisonment..while armed robbery is 14 years imprisonment to life depending on the facts surrounding the case and if murder occurs during armed robbery then it will be treated as a murder case too which attracts life imprisonment or death sentence....so how can an offence of stealing alone result to death sentence...Hmmmmmmm....an FCT court for that matter...i understand the north make use of the penal code but the punishment for stealing alone is NOT death sentence in the penal code too....contact me

They stabbed their victim and left him to die and he managed to raise alarm. They were armed with knife which they stabbed their victim with.If you read his case, you will not pity him.

Only the victim or his relative will narrate his experience, pray you don't come across them.
That politicians go scot free doesn't mean criminals too be sentenced lightly.
Corrupt officials too should face lenghty sentences.

One was sentenced to death for stealing #6000 while the other was given two months jail term for stealing #170 ...

Meanwhile that Adamawa governor was given the honor of choosing whichever prison he wants and I'm even hearing that he is seeking bail when he's been convicted.
