Following this rule, EFCC will have to arrest all the corporations that trade with Forex. First of all, there are seasons where the bank itself does not have enough naira to change to dollars. It happened this last Christmas, people had dollars but the band did not have sufficient naira. Secondly, every business man buys dollars beyond the normal amount from BDC, even Buhari's son in-law. If they want to arrest him on that they should be ready to arrest and investigate owners of at least 40% of the corporations in Nigeria. Let them be impartial.
What do you mean by this?

Nigeria has laws but weak institutions. In saner climes drug barons pay heavily to clean up money. Here we pay small money to make it light so it could disappear.

The fact that it is a norm to exchange large fx on the street does not make it lawful. The fact that i have done it and have not been caught does not mean you should do it and you should not be caught.

When Nigerians like you speak like this, i lose hope that Nigeria will ever be great. Its either we dont know the law or we know it and still flaunt it with flagrant disregard.

I hate when someone says they should be ready to arrest everybody.

I believe in 99days for the their 1 day for the owner. The fact that 40 percent of FX deals are illegal does not repeal the law. One day, the law will catch up but no one should say since Mr A was not caught Mr B should be free if caught.

We have so many kidnappers but one notorious one called Evans was caught, should we set him free because his entire gang was not caught.

Your line of thought is clearly partisan holding forth for corruption and blaming our weak institutions. People like you are the reason Nigeria will never progress.

Even a typical individual account does not have a transaction limit in the real sense. Reporting requirements for certain categories of transactions is not the same thing as transaction limit.

If Arthur Eze chooses to transfer N5b to me via my savings account, as merely a goodwill gift, what does the law say about that? Does the law forbid anyone from giving a monetary gift to another person beyond a specified limit? What if I refuse to upgrade the account to a current account or a corporate account? Am I obligated to do so in order to be qualified to have a certain amount?

With that N5b in my savings account, what if I choose to 'dash' my brother, friend, or anyone else N1b via a transfer to their own savings account? Really, I need clear answers on the illegality in these kinds of transactions. We can't assume they're not possible or 'reasonable'. Man was not made for the law. The law was made for Man.
I like the way you wish to understand. The bolded i assume to be your main question.

The fact is all the transfers in the case are not illegal. They are perfectly within the legitimate right of the individuals except for the BDC part of the transactions. The BDC part of the transactions violated money laundering act because of the limits. The fact that part of the whole sum of money is involved in money laundering will get the entire sum to be treated as such. These are all the issues the court will handle but the charge sheet will read money laundering plus other offences EFCC will put together.

If Authur Eze wishes to transfer such an amount to you. EFCC will investigate you but will probably just keep tabs on you behind the scenes until you make a dick move probably for being a JJC. You only earned yourself a spot on their watchlist.

Your dick move could be using a BDC to change N100m to $ cash. That is money laundering and the net will swing on you.

I would rather remain in dollars. The naira equivalent makes you guys think is big money. A hundred thousand dollars is about 36 million naira so a hundred and forty one thousand dollars is actually less than 70 million, So you are arresting a business man for changing to naira money he can use to buy 3 luxury cars for his company, where the car dealer would want the naira equivalent or to build one luxury building still for his company where all the workers would insist payment in naira.
The thing with EFCC is the outrageous claim they keep making. They are charging someone for having 164.4 million dollars (that is about 60 billion) yet you are saying he changed only 141 thousand to naira and tried to change the rest but couldn't.

And bro, the 5000 dollars limit is for people not corporations.

I also know that around that time in question banks where having trouble changing dollars to naira due to the demand for naira after the festive period.
BDC is designed to serve people not corporations. The official point of call for cooperations are the mainstream banks.

I hope you read where EFCC said they recovered......

BDC all round limit is $5,000.

That BDC transaction is main offence. The other transfers are linked to the fx.

Hmm, yes they do, a lot. The thing with the law is that your facts must be beyond reasonable doubt. And since I have known EFCC, the only evidence they bring is bank statement. Concrete proof involves members of the company testifying against the owner with records to back his testimony is concrete proof. Any case with airtight evidence cannot be lost on a technicality.

Please what evidence did they present other than their bank transactions? Did they get any of the staffs of both companies to deny the transaction? Did they arrest him because he transferred the money to his personal account? Did they investigate and not see an invoice? Not once did EFCC say any of that. The only thing they are presenting is a bank statement of a limited company. In Warri that is not a corporate hub, they can find at least 10 companies that have that amount of transaction in a Month. So you expect the son in-law of Atiku to do business in thousands? Eh you would have told us Idimi's son that married Buhari's daughter should also do business in thousands. You tell me what evidence they provided.
We are talking about over 60billion naira. I needed to mention that so you will appreciate what we are talking about.

Secondly, i am loosing steam with the poor reasoning you guys choose to exhibit. We are talking about money laundering. If you know, you know, if you dont know, you should read.

Let me bring your attention to this since you don't want to do your home work. According to BDC operational guidelines of 2015 (dont know of there is a current one)
7.5 The maximum amount per transaction for a BDC shall be determined from time
to time by the CBN with respect to business and personal travel allowances.
The maximum amount currently for PTA and BTA per quarter is $4000 and
$5000,respectively.
How much did the BDC change in the OP? $141,000! What law did they breach? Money laundering act.

A person is not responsible for a limited company. If it is a person that the money is transferred to, the person himself can be arrested immediately. But if it is a limited company, the books of the company has to be checked first, and the laundering linked to the owner before he is arrested. If direct arrest was possible, why do you think USA has not arrested all the drug lords in their country.
Know the difference. The investigation to indict the owner of a company is much more harder than one needed to indict a person.
As far as it is a limited, the acts of the company cannot be placed on the owner without proof. The company itself can be closed down to force an investigation of it's books, but no owner of a company can be arrested without thorough investigation done on the records (both sales, services rendered, LPOs, invoices) of the company.
For EFCC to arrest the owner, they have to prove that the money was not for services rendered, after which they have to prove that the transfer was instigated by the owner. It could have been done by the manager, secretary or accountant. EFCC has not gotten proof that the money was not for services rendered, not to talk of proof that it is the owner that instigated it. Without any of the proof, they can and should do nothing.
To get those proof though is not a two months investigation. It sometimes take years. Why did they not show the company account since its inception so we can compare what they have been having with what they had in the three months. Or are they telling us the company was established in January 2019?
I think am lazy.

Seeing this post, i am at lost how to reply you. I asked you to read section 19 only, but obviously you didnt.

19. (1) Where an offence under this Act which has been committed by a
body corporate is proved to have been committed on the instigation or with the connivance of or attributable to any neglect on the part of a director, manager, secretary, or other similar officer of the body corporate, or any person purporting to act in any such capacity, he, as well as the body corporate where applicable shall be guilty of that offence and shall be liable to be proceeded against and
punished accordingly.
All the other guys arguing on this matter will not even think to follow this line of thought you are going.

Go back and read the story again. Atiku's son in-law, the lawyer, the BDC operators were all arrested but they are all owners of the companies in the case.

Dont forget Babachir, the former SGF was sacked and has been charged to court for awarding a contract to himself. He didnt actually awarded to himself directly but he probably forgot that the company he awarded the contract to has his name as a director.

Don't be lazy and click on the link. Must I spell it all out for you? You said questioning can take days and EFCC can detain in the process of that questioning. Detention should not exceed 2 days. That is the law. Ideally, there is even no need to detain. I said before that EFCC can get search warrant, freeze accounts, go to people's offices to question them instead of detaining them. The truth is that detention is used as a tool of psychological torture to break the will of suspects so that they can admit to a crime.
EFCC is allowed to detain for 2 days but no need to detain. How does this sound to you.

Search warrant, freeze account which one is applicable to this context.

Next, you mean EFCC should take their office to the suspect's office to take his statement. Besides why is it that you dont know what a statement is that you think you can write it at the comfort of your own office.

Are you aware that a statement is officially a part of the case and admitted in court. An EFCC case officer should leave his office to all the cases on his table. If there are 10 cases he handles a day, he will be in 10 different offices to take their statements. Please next time think of the implications before making comments.

Next time the court session will hold in Atiku's pocket.

Next time my house is burgled, i will invite the police to come and take my case.

Next time also, advice Atiku's son in-law to invite the EFCC to his office when he thinks he has a case.

And I can choose not to say any gaddem thing at all, so that they would charge me to court and tender their 'suspicion' as evidence! The primitive model used in Nigeria is to arrest you first and expect you to supply them with 'confession' that would be used to nail you in court. Madness.

You see why Nigeria is not a serious country? Which serious country would waste its resources in arresting people without substantial evidence and charging them to court on thin and watery charges? To what end?
Now we are talking.

These things affect all of us but become a matter of concern if it affects the political elite. The way we as ordinary Nigerians come in defence of the elite rightly or wrongly makes us even more vulnerable to the intrigues of the elite.

Back to the facts, you are bound (not legally) to write a statement if you are invited as a suspect. It is your choice to ask for a lawyer or not.

You can only refuse to write a statement if you are a witness.

When you dont say anything, that means you are uncooperative and that can be used against you even in court (not like an evidence). Judges dont like uncooperative suspects because the judge also needs you to open up so he would understand the case better. Any judge would easily give arrest warrant, search warrant, deny or give high bail conditions etc if you are uncooperative. It is better you ask for a lawyer who will guide you in the statement writing so as not to implicate yourself.

How then do you know it is without economic justification?
The justification is the reason why interrogation is carried out.

“Also the team recovered the said $1.6million USD but already $141,000.00 USD had been exchanged to Naira at N358/ per dollar which amounted to N50,500,000.00 while the balance of $1,459.000.00 USD could not easily be exchanged due to the Naira scarcity in the market.
Any reason that will cause Naira scarcity in Nigeria means the CBN is either not doing its job or something wrong is going on.

If you have $5,000, why would you change it to Nair? If you want to build a house in Nigeria for instance, you need Naira, if you want to capitalize on the FX market and the exchange rate favours Naira, you change. Etc

You need a reason to change such huge money or even move it around. EFCC will investigate these reasons and determine if its legal or not then take necessary action such as going to court or discarding the case.

Is it a crime for one to do business? Or are you guys allergic to good money? Funds passed through the account could be for legitimate business purposes.. Was that account flagged for suspicious transaction(s)?

Poverty is really a disease
Honey, its not a crime to do business. However, you are automatically a suspect once you do a transaction far beyond your means.

In other words, business get level. Its no easy to jump from one level to another without attracting attention.

Yes the funds could be for legit business, he has to explain and EFCC has the right to ask or interrogate.

Of course it was flagged for suspicious transactions. Check the main story again, they changed FX to Naira and it mopped Naira out off the market. These kind of large exchange can upset monetary control mechanism of CBN especially if done outside the main financial providers system. Black market is not meant for such transactions because they have limits and their limits upsets the market. No government will fold its arms while such kind of money is moving around from hand to hand. Some economies will crash with movements of such magnitude.

If Atiku's son in-law was buying a bank worth 150m Euro, he would just pay directly to the owner but not pieces it to several companies.

Say, your boyfriend is jobless and doesnt have rich relatives, you would be irresponsible to see no problem if he buys an expensive house today, an expensive car tomorrow, expensive gifts and trips. You will ask him how he got it and you must be convinced else you become an accomplice.

Government is responsible for money moving around to maintain control over the economy and even crime.

You initially said its a crime now you say it is suspicion that EFCC is investigating. Your new position means we no more have a disagreement. EFCC has to prove that the funds are proceeds of crime. They have to prove this beyond reasonable doubt. That is the burden of proof for criminal prosecution.

But why arrest before thorough investigation? You can visit persons of interest and question them but arresting people without having hard evidence of commission of crime is wrong. As we speak, EFCC has not told us that they have evidence that the monies are proceeds of crime.. The rule of law particularly fundamental human rights should not be trampled upon. Visit for questioning and arrest when you have a case against them. That's what is done in sane climes
You are turning in circles.

Suspicion of what? Money laundering. What is money laundering? Crime or not?

From what i know, a lot of the arrest we claim in Nigeria may not be but we use the language to describe presence in the police station, barracks, or in this case EFCC.

What EFCC does is to invite you for questioning and it can take days and they could also detain.

Check out how Daily trust puts it
A top EFCC source told Daily Trust that Abdullahi is being detained by the anti-graft agency to shed more light on the movement of the fund, said to be in foreign currency, 150 million Euros.

It went via the banks, through all govt checks, why tag it laundry when it could have been a silent investigation if need be?
You dont sound like you know what money laundering is. It doesn't have to be govt funds. Infact for the mere fact that they dont know the owner of the funds is saying the source is criminal.

When you buy a N400m house and your business is worth 1billion, the govt wont even investigate you.

But when Atiku's son in-law is at the centre of 150m Euros, and his business is not worth 1million Euro, he should expect EFCC to be on his heels.

If Atiku comes out to say the money is his and the movement is for this or that legit business, do you think EFCC will keep Atiku's son in-law?

Lastly, you want silent investigation, dont have any reason to go to EFCC at all. There are reporters at EFCC gates, EFCC officials leak some insensitive info that can tarnish any ones image. The best thing is to have clean hands.

My former boss was invited by EFCC. He had a construction company and a chain of filling stations. Being a PDP guy and a close ally to a former governor, when the former governor had an EFCC case, his properties where suspected to belong to the governor because of the sudden way my boss became rich. All he had to do was come with all documents of all his properties showing they bear only his name and none of the former governor or his relatives. Off he went. Nope.. It merely raises a suspicion and a presumption which needs to be proven. Banks are obliged to report such financial activities to EFCC but it does not constitute a crime simply because it raises suspicion. You should quote the section of the law in full and not in part so the import can be fully understood by readers.
It raises suspicion which the EFCC is still investigating, at the conclusion which they will take the matter to court citing exactly the section of the act which has been contravened.

Why the outcry when the matter is still under investigation.

Of the €67.9m, Uyi’s account received 26,050,00million Euro between January 9th and 28th, 2019. Babalele is expected to account for 41,900,000 Euro.
Besides, what is suspicion? Is it not based on suspicion that a person becomes a suspect who can be arrested? Being a suspect should not be reduced to merely.

1. If you are a public office holder (governor/president), your wife is not expected to be pregnant throughout your stay in office.

2. You can't contest for public office while you are occupying a public office. You must resign first before being qualified to contest. For example if you are a president and wants to contest for second term you must resign first. You can't stay in the office and contest.
The second one is supposed to be "you cannot hold a political party membership while holding a permanent and pensionable employment with the government.

This means that you cannot contest for any elective public office while being a civil servant or public servant where your appointment is permanent and pensionable.

Having a contractual appointment with the government will certainly forbid partisanship too, and so one would breach his contract by participating in elections where party membership is required.

We Igbos have faced reality already. Nobody can disappoint us.
U guys need to face reality too.
Wow. The zeal with which you believe the latest propaganda by the PDP is the same zeal you guys have used to convince yourselves that Atiku will when when clearly the odds were against him. One thing is certain, with this propaganda you are peddling, its a dare situation where the north will surprise you.

But guess what, WHATEVER THE NORTH DOES IN 2023, IT WILL NOT BENEFIT THE SE or SS. You can take my bolded letters to the bank.

You guys did not learn anything from GEJ and Atiku's failure. The North knows it cannot hold unto power forever. They also know who they do not trust with that exalted seat and wont let them have it. You guys are just too bitter so you assume the worst when actually the worst is something else.

I had since 2015 elections predicted the only time the SE maybe considered for president is 2039. Before then, power will rotate between North and SW. 2 of my predictions have come to pass already.

smile. I hate tribal arguments but let me make it clear to you that I have never in my life seen a tribe so jittery, jealous and pretending like some people in the south west- Apologies to the true ones among you. Why is it when a political moves involving the southeast emerges, some of you place it like a crown on your head-you feel bittered for the ibo tribe for no good reason. An average IBO man don't see anything wrong with your Osibanjo as the vice but your clouded imagination thought it was all about him. I could remember vividly the Yoruba elders cautioned your likes against Buhari but you kept a deaf ear and your hearts clouded with sentiments. Hunger don reset your memory card, u de vex against the IBOs.

Imagine the north where much violence was expected yet none, unfortunately some sponsored thugs from the south west are taking it personal. Spit!

If I may ask, has the powers been held in the north for years changed anything? No!
I know you won't love to hear that Southeasterns will never cease to excel in their endeavors even if power is been held for eternity by other. Even if we are thrown to the ocean, we will make it habitable for your likes to come collect Owo Omo onile. grin

Whether the south in general agrees or not, the south will be under the north for years. I got my information from a reliable source, please go get get yours.
Shame on you. You are the real tribalist since you concluded from my post that i am yoruba. Guess what am from the north.

An average Hausa man will not fight for what belongs to him? I really doubt that. If it is not settled in the Court, it will be settled in the mosque and if not in the mosque, then it will be in the caucus of the Fulani elders.

Any ways, the fact remains that Hausa-fulani will teach the south how to play the game of politics this time. Obasanjo played the game well when he placed Goodluck to be the vice of late President Yaradua. This time, Tinubu successfully attached the pastor vice to President Buhari in case there is any eventuality; but the president has shown how strong he is over these few months. INEC has declared Buhari President for the second term, now the north is ready to show how skillful they are in the game of politics.

Take it or leave it, either Atiku gets his mandate at the tail end of Buhari tenure or he contests again to be rigged in and the North remains in the corridor of power.
For the south whether Yoruba or IBO getting power so soon, hmm, I doubt.
Many times I just chuckle when I hear the Yorubas and Ibos using words against each other-the game is between the North and the South not between two tribes who just want the less effective position of the Vice.

What Buhari is doing right now is to place his puppets in the oil rich states of the south for the enrichment of the north hence his interest in Lagos, Rivers, Delta, Akwaibom others will include Bayelsa. Wondering why he hardly visit other states in the south?
You guys are pathetic.

The SS and SE used hate to hang themselves politically. Now that the loss has been confirmed, you want to drag the SW into it so that the entire south can look marginalized.

You said it all, the Hausa fulani are the masters of politics and they know how best to relegate someone. They will surprise you guys by giving power to the SW and you will continue to cry till the SW does 8yrs and the north does another 8yrs.

You think they are fools. Keeping the seat only for themselves especially in 2023 will only bring them more trouble. They will hand it over, but guess what its going to be the SW.

Keep miscalculating Hausa/fulani politics, you will be doomed forever.

Dont forget that Obj became president as a concession, same will happen 2023. Imagine from prison to President. He was chosen by the North and they will choose someone to hold it for them again.

Jumping from one political miscalculation to another is what the PDP is known for right now. They miscalculated in 2015, spending money like tomorrow no dey, even crashed the economy but failed. Used very stupid propaganda in the build up of 2019, it crashed. The 2019 election, they miscalculated heavily thinking campaign turnout and social media polls will give them victory, now they convinced themselves falsely in one of the freest and fairest elections of Nigeria so far to be a rigged one. Unfortunately, they began miscalculating 2023 already.

Ngige warning them was a scam message we we all knew.. No major political party will zone their presidential candidates to SE in 2023 ( It's glaring).

Omo-agege is too rascal to me. Lawan is not a bad choice ( Experience is there).

But with your submissions, nothing for SE , are they Gabonese? Abi se no longer one Nigeria Ni?
They made their choice by hating anything APC and this is an APC government.
