PaChukwudi44: You are too childish.Thank God you said you are not a lawyer.Justice Tanko led the NJC panel that recommended the sacking of the former CJ of Abia state for the same offence he just committed. So how could he caim ignorance of what he did? Dont let us resort to name calling, i will let this one slide. Is there anywhere i implied or insinuated Mohammed should claim ignorance? Mohammed himself would be dumb if he claims ignorance neither am i dumb to say he should claim ignorance. What he did was a result of an exparte order right or wrong, the responsibility is not his to bear. That is not feigning ignorance. As a Judicial officer he abided by an order to avail himself as the most senior. NJC should fault the exparte order if they like, squash it or do whatever, he obeyed the law. If he had refused, Buhari will also petition him for refusing to obey an order of a lawful court. We are all partisan in one way or the other but we try to find a balance between our allegiance and the common sense. I suggest you try to leave you partisanship out of National issues. |

In my opinion, NJC will avoid further dragging the Judiciary into the mud by ratifying Onnoghens suspension and recommending Mohammed's appointment.
Yes, PDP and their cohorts will shout but there is a way out.
In the case of Abia state, which is used as precedence, the CJ was removed and the new CJ's was appointed without NJC, story ends. The vacuum was without the complication of an exparte order we are seeing in this CJN case.
In this case, it is a suspension and there is a vacuum, while there are cases in both the Appeal court and the CCT where the determination is the one creating the vacuum of CJN.
The NJC in this case would have to first of all declare if the CCT has jurisdiction over Onnoghen's case or not before they can decide if Mohammed was right or wrong. If CCT acted right, then Mohammed acted right, if CCT acted wrong the Mohammed was wrong. Either way Mohammed couldn't have known which way the NJC prefered so he had to fill the vacuum created until when all parties resolve their issues. I was his responsibility to do so and if the next judge was in his shoes, would have done same.
Mohammed can also claim to be under the CCT's exparte order just like the president is also claiming. The order had the part where the president should act and he as the most senior judge will also act. If the NJC doesnot agree, then the CCT is the one responsible not the President nor Mohammed.
If the NJC wishes to put an end to the whole issue, they would obviously recommend what the president could accept. I also think they would after considering Onnoghen's reply, forward the petition against him to the CCT as the appropriate body to deal with his case. If they do that, it means they have ratified the earlier suspension and killed whatever case is in the appeal court.
This is my opinion, am not a lawyer. |

PaChukwudi44: Lol the supreme court or appeal courts will also make recomendations to the president? The courts will deliver a consequent order which will take effect immediately.
BTW the power to sppoint the CJN does not lie with the president Court orders dont take effect by themselves, they are obeyed or disobeyed by the executive which enforces law. That power does lie with the president whether you agree or not. The president is not bound to obey the recommendation of the NJC nor virdict or order of the supreme court. In appointing a CJN, the NJC forwards names of senior judges to be appointed, the president can reject and ask them to renominate. At the end, its the president who approves and swear into office the CJN. Even with a supreme courts virdict, enforcement is the responsibility of the excutive especially with regards to this case. Judiciary dont enforce law, they adjudicate law, the NA makes laws and the excutive enforce law. No one can act or be the CJN without the president putting the person in office. For someone who knows law you argue in a partisan way. Partisanship has blinded you from the truth. I just hope you didnt study law, cause i would be ashamed for saying or even implying these insinuations. |

All public officers are allowed to declare or update previous declaration within 3 months of being sworn into a new office and then every 4yrs in office and lastly immediately after leaving office. He has spent over 2 yrs in office without doing it, so he cant. 3 months after being sworn in as CJN without updating his previous declaration, his old declaration is automatically entered as the current and any contravention would become a criminal offense. That update window has closed long ago. |

PaChukwudi44: Lol see hypocritical lawyer.See as you were quoting law for the removal of the CJN letting is know that the NJC or senate could only recommend to the president. 1. You did not whoever show us the section that gave the president the power to suspend the CJN.
The section of the CCT law you quoted had a clause. It says the CCT can recommend the removal of a public official UPON CONVICTION.Now was the CJN convicted by the CCT? Do you even know the meaning of the phrase "exparte order"?
Now to your point that Tanko will not be sacked by the. president if the NJC recomends it.Well that also is possible.2.But Tanko will only remain a judge in title alone and will never adjudicate upon any case until the president finally sacks him or he attains the statutory retirement age. 1. Show me the part of the Constitution GEJ used to suspend Sanusi as CBN governor and i will show you the part Buhari used to suspend the CJN. 2. The power to be appointment as the CJN rest with the president and no one else. NJC cannot usurp that power by creating a vacuum in the position of the CJN. The president can ignore all the NJC's recommendations and they will remain a toothless bulldog. Even the senate cant do anything. Lastly, i really do not care what illegality the CCT did to get the required justice. As far as i am concerned, they saved the Judiciary from beig dragged down the mud by Onnoghen. Call it a doctrine of necessity or whatever you may wish. Thank God the CCT judge knew the difference between an exparte order and an order and chose the one that suit the removal of the embattled CJN. |

That guy is gone, he should just bid farewell also Funny, you guys dont know jack. Look at this scenerio, if NJC after receiving their responses and decides to recommend suspension for both Onnoghen and Tanko Mohammed. Ask yourself, who is their recommendations going to; BUHARI!NJC has no power to suspend, or remove the CJN. Their power is to recommend to the President. Even the National assembly with their 2/3 vote has no power to suspend or remove the CJN. They can only by that vote recommend the suspension or removal of the CJN by the President. See A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances–
(a) in the case of –
“Chief Justice of Nigeria, President of the Court of Appeal, Chief Judge of the Federal High Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja and President, Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate. The actual power to suspend or remove the CJN rest with the president, NJC or the senate can only recommend. At the end of the day, if Bubari wants Tanko to remain, no one, i repeat no one, i repeat again no one has the power to remove that CJN, not until May 29th if Atiku becomes president, then he has that power. That power to remove or suspend exclusively rest with the president. Dont forget GEJ went ahead to ignore the NJC's recommendation by sacking the appeal court president after NJC cleared him. This is no different. Onnoghen has been a goner since when Buhari suspended him. On the side, let me also inform you if you dont know, one other body that has the right by the constitution to remove any public officer from office by way of ex parte order is the CCT 11. Failure to declare your assets as required under the provisions of paragraph 11 of the 5th Schedule of the Federal Constitution shall attract on conviction any or all of the following; (a) Removal from office, (b) Disqualification from holding any Public office, (c) forfeiture to the state any property acquired in abuse of office or dishonest Onnoghen's removal by PMB is completely legal, however, the speed with which the order was procured was the real issue. Even with that, i dont blame Buhari since Onnoghen also procured a very strange and quick order too from the appeal court. The game was 1-1 but Buhari's goal was a away goal. |

If you have a corrupt case against him, you take it to court. The court would address those who deposited money into those accounts through BVN/evidences
Eg: having a job of N50k/month but could afford a car of N1m through other means does not make you corrupt. You are as ignorant as the CJN himself. A public officer is restricted in various ways such that even recieving gifts is prohibited. They are restricted to activities like farming but cannot register a company. 11. Lukgaf: Applying the above principle to the case under review, it is clear that the man in the eye of the storm has two capacities: he is a judicial officer and also a public officer, but yet he is one person: Hon. Justice Walter N. Onnoghen, CJN.
Two questions are pertinent to raise in this circumstance: Does the Hon. CJN’s duty to declare his asset arise from his being a judicial officer or from being a public officer? The other questions is: the man standing trial before CCT in what capacity is he being dragged to the tribunal? As the Chief Justice of Nigeria, as a public officer or as both? In my opinion, the two capacities are interwoven. The CJN has a duty to declare his asset because he is a public officer, but lest we forget, he actually became a public officer on the strength of being a judicial officer, and this is where the Shariah-devised instrument of tanqih al-manaat becomes handy. Through what is known as a process of isolating probable effective causes of an event, one can safely argue that the overriding reason why the Hon. CJN is being charged before the tribunal is because he is a public officer and not because he is a judicial officer. And this explains why non-judicial officers are also tried by the same tribunal in their respective capacities as public officers, the Hon CJN’s trial, being a public officer and fifth in the hierarchy, should therefore not be an exception. After all, not quite long ago the number three citizen and the President of the Senate of the Federal Republic of Nigeria was also tried by the same tribunal. What is more, Para 5, Part II of the Fifth Schedule to the 1999 Constitution categorically mentioned the CJN as a public officer “for the purposes of the Code of Conduct” (Emphasis mine). The underpinning principle in this case is therefore to recognize the fact that while all judicial officers are public officers, not all public officers are judicial officers; that the Hon. CJN is a public officer because he is a judicial officer, but not a judicial officer because he is a public officer, and the only court with an exclusive jurisdiction to try public officers “for the purposes of the Code of Conduct” is CCT as expressly provided for in our Constitution.
Going by the word and spirit of our grundnum, the Constitution, the proper thing as envisaged therein is for public officers to be exclusively tried first by the CCT in matters of non-compliance with the Code of Conduct, after which relevant laws applying to them in their various capacities can then take effect. Anything different from this order will amount to putting the cart before the horse, or even worse still may qualify as a device to deprive the CCT of its constitutionally guaranteed jurisdiction. For instance, with due respect to those calling for the CJN to be investigated/tried first by NJC, what of if NJC finds the CJN indictable and subsequently recommends his removal from office, what justification is left for the CCT to exercise jurisdiction over someone who has ceased to be a public officer?
The call may also, in my humble opinion, be tantamount to inventing a back door immunity from criminal prosecution for the CJN without any constitutional backing. Let the CCT exercise its jurisdiction in this matter as its affects a public officer, in this case the Hon. CJN, and thereafter the NJC to weigh its options to either remove or keep as its head someone that has been tried and indicted or discharged and acquitted, as the case may be. This appears to be more in tandem with the law, sound reasoning and morality.
Prof. A. A. Alaro is of the Faculty of Law, University of Ilorin, Ilorin, That has been my first position in this matter. An illegal and backdoor way to give judges an unconstitutional immunity. |

Most times the affected is the floor tiles or floor drains. Imagine the amount of water that goes into a small hole in between tiles. This admits water to underneath the tiles and gets to the walls where capillary action will damp the walls adjoining the bathroom. Even if you hide the dampeness, you can still smell the dampeness. |

Politics › Re: Cable EDITORIAL: Recall Onnoghen And Allow Him To Step Aside by adanny01(m): 8:18pm On Jan 27, 2019 |
Clerverly: The suspension of Walter Onnoghen as the chief justice of Nigeria (CJN) by President Muhammadu Buhari has predictably generated furore within and outside the country, a situation that is less desirable a few weeks to the 2019 general election.
The process leading to Onnoghen’s suspension, beginning with the petition by a civil society group against him over an alleged non-declaration of assets, has been assailed by many commentators, lawyers and activists who argue that due process has not been followed.
In the avalanche of judicial pronouncements and interpretations of the laws, however, there seems to be an emerging consensus that the government could have handled the Onnoghen case better and within the confines of the statutes.
As a public officer, the CJN has already indicted himself by admitting that he forgot to declare certain assets, and there is no protection in law for this. There is also suspicion that he cannot reasonably account for the value of the transactions that have been carried out on some of his bank accounts. This inevitably points to the fact that he might have a case to answer, and this is definitely not good for a custodian of public trust in the temple of justice.
Nevertheless, the rule of law and legal procedures need to be followed in order not to create the impression that democratic principles are being willfully bypassed in the Onnoghen case. The government can still achieve the same end result by following the procedural path.
While TheCable is fully persuaded that there has been no fidelity to laid-down procedures in the treatment of the Onnoghen case, there is no doubt that the CJN himself is not smelling of roses in the whole affair.
To break the logjam, therefore, we call on Buhari to immediately recall Onnoghen from suspension. This will save his government from further accusation of dictatorship.
In the meantime, Onnoghen can save the entire country the whole trouble by stepping aside as CJN as soon as he is reinstated by Buhari. This will allow him to clear his name. It is only fair that he cannot be expected to head the judicial arm of government while he is being investigated.
We also call on the National Judicial Council (NJC) to step into the impasse and do the right thing by subjecting Onnoghen to a transparent investigation. He should be put on administrative leave while investigation lasts as he cannot be a judge in his own case.
If Onnoghen is found to have committed an infringement, he should be appropriately disciplined so that the Code of Conduct Tribunal (CCT) can proceed with his trial within the confines of the law. For now, his innocence has to be presumed until guilt is established.
The CCT, on the other hand, has to come under a new leadership because of the ongoing corruption case against the chairman, Danladi Umar. He has also conducted himself less creditably in the Onnoghen case. He who comes to equity must come with clean hands.
TheCable calls on all sides of the divide to put the nation’s interest first. The allegations against the CJN are grave and no matter the temptation to play politics, the interest of the country must never be downplayed.
It is in the interest of Nigeria for state institutions to be allowed to do their jobs unimpeded and it is the responsibility of our leaders to make sure processes and procedures are not subverted no matter the political atmosphere.
https://www.thecable.ng/editorial-recall-onnoghen-and-allow-him-to-step-aside/amp?__twitter_impression=true I support Buhari 100% on this matter. The cable is saying recall and allow the NJC to place the former CJN on administrative leave. We all know that is impossible because the convener of the NJC is the CJN, he had before now postponed the NJC meeting scheduled for 15th January indefinitely. If called back no one other than the CJN can call the NJC to a meeting, whiich we know the CJN will not call them back to have them place himself on administrative leave. The reasonable thing was for the CJN to step aside but he has shown he will never even consider that. Buhari should not go back on this. |

But when it comes to appointment especially the CJN, the NJC nominates 3 of the Senior judges that have considerable time before retirement where the president can choose 1. This one was one of such cases, the president cant just pick anyone, it has to be the most senior irrespective of where he comes from. Our laws have been turned upside down and loopholes have been found and created everywhere around the constitution. The president who enjoys very detailed immunity from the constitution is not protected against criminal prosecution but Judges want to prevent themselves from all prosecution whether criminal or otherwise. Its wrong, the section of the constitution the judges are using to shield the CJN doesnot intend to give such kind of immunity to any Nigerian. How can the CJN admit to a crime but is defended by Nigerians. Have we sold our conscience for tribalism and political affiliation? For me, I would never support corruption or a corrupt individual. |

spiceeamiee: Good evening house. So I and my husband started a small building project recently. In fact the foundation just commenced this week and the building contractor who was recommended to us by my brother in law said that people no longer dig foundations to be very deep again, thag what they do is raft foundation. We decided to go with his suggestion as he seems to know what he is doing. However my dad and my father-in-law went to the site and has been bombarding us with calls saying the guy does not know what he is doing and that the house will soon collapse. In fact that the guy needs to dig really deep as the place is slightly water logged. My husband called his friend who is a civil engineer and they friend also confirmed that the raft foundation is what should be done but thag it should be done for 4feet as against the three fee our contractor wanted to do. However the level of calls from my dad and my father in law is worrying. They both have two houses in Lagos each and i know my dad is very knowledgeable about buildings and constructions but he is in his 70s and may not be privy with latest building advancements that why I said let me come and ask the people that can simplify this thing for me. Is digging deep the way to go or is the rafting the way to go? Structure is a one storey building. Soil should not be generalized, the particular nature of your land cannot be known remotely. Prescribing a particular type of foundation or depth remotely is a bad practice. Only consider suggestions from people who have visited the site. However, some professionals who are familiar with the area may over kill it in a bid to be safe. For example, raft foundation recommended for water logged area does not mean the soil is bad, hence, the raft foundation could be an over design and lead to wastage of resources. The 1 foot difference may or may not be important but the raft foundation will help to eliminate cracks in your building and will not stop settlement entirely. The bad type of settlement associated with raft foundation is tipping. If your land is uniformly level and the soil type uniform too, i guess the 3 ft should not cause much concern due to less risk of tipping. This way if the house will settle, it will do so uniformly and not cause structural stresses that will be alarming. |

infocabal: All of u saying Nonsense above should think if she was your daughter oh.. Cos u see ogbuagbu u begin defend am like say u dey Dere. I do infact have a daughter. I expect my daughter to slap the man who touches her breast. If he slaps her back, twist her arm, threaten or do anything further, it is rape. If my daughter allows a man to touch her breast with no protest, remove her pants, penetrate her and continue doing so for several hours, i will not have a rape case against the man especially if she is over 18. If she is under 18, there are different names to call the case but not rape. Statutory rape is for having intercourse with a minor. |

HumphreyGspot: A 36 -year old man, Alex Ogbuagu, has been arrested for handling and sucking a 16-year old girl’s breasts and tricking her into sex in Isheri area of Lagos where the suspect resides with the victim’s parents.
It was gathered that Ogbuagu returned early from work and lured the victim into his apartment and confused her with words. He then allegedly fondled and sucked her breasts and she became more confused before he penetrated her in the romp that lasted for several hours.
The victim later regained herself after the act and reported to her parents that she was raped by Ogbuagu.
The matter was reported to the police in the area and Ogbuagu was arrested and transferred to the Gender Section of the Police Command.
It was gathered that during interrogation, Ogbuagu insisted that he did not rape her claiming that the victim consented to the act.
However, the victim denied her consent and claimed that she was forced into the act after he touched her breasts and got her confused.
https://www.hgsmediaplus.com.ng/2019/01/he-confused-me-by-touching-my-breasts.html?m=1 Hey hey hey! Lets slow down a little and redefine rape before we proceed with this case. For now, let men det carry consent forms at all times. Nigeria is such a shit hole. Rape is a type of sexual assault usually involving sexual intercourse or other forms of sexual penetration carried out against a person without that person's consent. The act may be carried out by physical force, coercion, abuse of authority, or against a person who is incapable of giving valid consent, such as one who is unconscious, incapacitated, has an intellectual disability or is below the legal age of consent. Which part of this Wikipedia definition of rape is comparable with this case. Probably the girl is intellectualy disabled, then i agree it is rape. |

You buy car, dealer told you na 1st body, 3 months later potty the size of your fist go fall from the fender. Na scam be that.
You go buy car, engine sounds ok but before you reach house, engine don knock. Meanwhile the dealer mixed engine oil and cement to make the engine quiet or poured 6 cans of thick oil treatment. That one na maga scam. |
