I will ask you a logical question, why was Justice Onmoghen's name sent at a time when Mahmud Mohammed tenured had expired? After recommendation's have been made before then.
You are still not getting it and typing unnecessary grammar. The prerogative of appointment is with the president. You cannot stampede him into a decision. He is is considering the nomination sent to him, at the right time, he will make an appointment as he deemed fit.

If the constitution does not want it that way, it would have expressly stated that the the most senior judge automatically becomes the CJN. You cannot whittle down the power and authority vested on Mr. President on the appointment of the CJN. Relax, there is nothing to be anxious about. The Acting CJN is doing well and will definitely get the appointment if the decision of the President goes in his favour.

Of course, we have always had Acting CJN. All such appointments are usually in Acting capacity until confirmed by the senate. Justice Dahiru Musdapher was also the Acting Chief Justice of Nigeria, CJN, for a while after nomination by President Goodluck Jonathan.

The president has the prerogative of choosing from names forwarded to him. Though by convention it is the most senior judge that is usually selected, but that is not a constitutional requirement. If the president decides not to appoint the Most Senior Judge, he has not run foul of any law. And if he also by convention chooses the most senior justice, it is all well and good.

Kindly be educated that any position that needs confirmation by the senate, who ever is appointed into that position pending the confirmation of the senate is in Acting Capacity.

That PMB is usually slow with his appointment is common knowledge, I'm sure he wont counter the nomination of the Justice Onnoghen. He is a very unbiased judge.

Also let me give you some history information. The last time we had a Southern CJN also coincide with the last time Buhari was in the saddle as Head of State.

Corruption and rascality among the elite has nothing to do with tribe and religion. When those guys meet to make plans, dubious plans that is at variance with morality and ethics, they don't care about religion and tribe, they get along pretty easily.

Its only on the internet or when crumbs is too be shared that tribe and religious disposition becomes important.

I wouldn't put all the blame on this government but on desperate politicians. Our politicians are just too desperate and always want to have their way. You see, decadence doesn't just happen once, its a gradual process.

Another reason is lack of effective control over state governments.

At the state level, the Houses of Assembly has failed in its constitutional mandate of check mating The Executive arm of state governments. 99% of the state Houses of Assembly in this country are just rubber stamps.

The state governments act with impunity with state funds. And because of the huge funds available to them, they have consistently deplored it at the judiciary and in the process entrenching corruption in the judiciary.

cheesy He is playing the cunny fox, its not his fault. Those moves were the order of the day under the previous CJN, obviously the new CJN wants to do away with all of those.

The new CJN wants justice to be the order of present day cases, and not the usual legal technicalities used in stalling cases.

Two things.
1. It does not give a "level playing field" since electoral college votes ARE DETERMINED by population. A situation where one state has
55 College votes and another has 3 is not a "level playing field"

2. Popular vote is not "secondary" to college votes > I think this exposes a fundamental misunderstanding of the problem. It is possible to win the election without winning the larger number of states or the popular vote.They are not binaries

The real issue is this: In every state it is a "Winner takes all situation" which I think is a huge flaw. A candidate who maybe wins California by 100 votes will get ALL 55 electoral college votes and that is the flaw. If it was a proportional arrangement that would sort out a lot of the perceived wrongs.
Because of this Winner takes all phenomena a candidate who wins by let us say a margin of 100 votes in the biggest 12 states will win the presidency even if he gets 0 votes in the remaining 38 and thus would have won fewer states and not have won the popular vote either. I will repeat this .A candidate who is able to win the biggest 12 states by electoral college votes even if he wins by a margin of 1 vote only in all twelve and gets 0 in the other 32 wins the presidency
It is a complex issue which we have sought to get aroung by insisting ,in our system, on a minimum 25% in 2/3 of the states thus ensuring that the issue of spread of appeal is addressed
That was exactly what happened when George Bush defeated Al Gore.

Al Gore also had more popular votes than George Bush.

Florida was in contention, at the end of the day, George Bush won Florida by I think around 500 or 900 votes and that gave him the simple majority lead that delivered all Florida's electoral college votes to Bush and invariably made him President.

So you mean to say Appeal court will rule on a matter and then hold back execution of such ruling?? Does it make sense? Then why expedite hearing and 'judgement delivery'on the matter??

After Appeal court gives its judgement, to stay execution of such judgement, the loosing parties has to approach the Supreme court.

You cannot rule in favour of someone and then tie the hands of the person from enjoying the fruits of the judgment. Its only a higher court that can do that.

That is the way they designed their own democracy. They are trying to give some leverage to the smaller states.

All the states in the US has 2 senators irrespective of population, while the members of the House of Representatives are determined by population of each state.

The electors in each state are determined by adding the numbers of senators of a state to the number of the Representatives the state has at the House.

This invariably gives some minute leverage to the states with smaller population.

It does not necessarily mean that it is Dangote group that will do the actual construction. They may in turn contract it out to a proper construction company.

No single supreme court judge of the era since 1999 till now is free of d corruption that has tainted that institution,d ones that are not charged are just lucky.
Onoghen knows he is one of d most lucky men alive,therefore we wud most likely be seeing more of d cerebral judgements for which d former SC pre 1999 was known for.
He has used this occasion to read the Riot Act to Lawyers and the so called SANs, that his Administration will not entertain circumvention of the judicial process.

This is a good sign and will go a long way in instilling discipline in our judiciary.

I just hope the expedited hearing that was granted this case will be extended to all other cases, and the new CJN will make this the norm.
