Confusion as Kutigi swears in new CJN on Thursday
By Tony Amokeodo and Tobi Soniyi, Published: Tuesday, 29 Dec 2009

Kutigi.

There was confusion within the law community on Thursday as the National Judicial Council on Thursday confirmed that Justice Aloysius Katsina-Alu would be inaugurated on Thursday as the new Chief Justice of Nigeria.

Katsina-Alu was confirmed on December 16, 2009 as the incoming CJN and going by convention, he is expected to be sworn in by President Umaru Yar’Adua.

Yar’Adua is currently hospitalised at the King Faisal Specialist Hospital in Jeddah, Saudi Arabia and would not be available to carry out the duty.

But as the controversy on who should swear in Katsina-Alu heightened, the NJC through its Secretary, Mr. Danladi Halilu, said the out-going CJN, Justice Idris Kutigi, would perform the ceremony.

The NJC added that Kutigi would on the same day inaugurate Justice Isa Salami as the President of the Court of Appeal at 11am at the Supreme Court complex in Abuja.

But the Nigerian Bar Association and some promient lawyers differed on the propriety of a serving CJN inaugurting his successor, during separate interviews with our correspondents.

Those that kicked against the inauguration include the NBA, the President of the West African Bar Association, Mr. Femi Falana, and a Senior Advocate of Nigeria. Prof. Konyinsola Ajayi.

Speaking through its National President, Chief Rotimi Akeredolu (SAN), the NBA said swearing in Katsina-Alu by Kutigi would be illegal and could brew a constitutional crisis. The association also criticised the endorsement of the idea by the Attorney-General of the Federation and Minister of Justice, Mr. Mike Aondoakaa (SAN), adding that the stance of the AGF on the issue was fraudulent.

The AGF had reportedly claimed that Kutigi was empowered by law to do so , saying that the insinuations in certain quarters that he could not do so was not based on law.

He had reportedly said, “I am only concerned about the law and as far as the law is concerned, there is no vacuum in respect of the swearing in of Justice Katsina-Alu.

”The Oath Act, Second Schedule, is explicit on the person to take the oath and the person to tender the oath.

”Under TAC 01 Laws of the Federation of Nigeria 2004, either the President or the sitting CJN can swear in a new CJN. What is important is that the new CJN needs to take the oath before he resumes office.

”If that is the case, the outgoing CJN can swear in his successor by December 30 and leave by the midnight of December 31.

Akeredolu said, “It is not possible in law for the outgoing CJN to inaugurate the incoming CJN, as the country cannot have two CJNs at the same time. This is because the law is very clear. Going by the Oath Act, Second Schedule, the law provides that judicial oath is sacrosanct and it has to be administered by the President on the CJN while the CJN will administer it on other judicial officers.

“But these are based on two things. The CJN must be in office to administer oath on others. But he cannot swear in a new CJN when he is still in office. You are deeming to hold office when you take the necessary oaths of office. But what happens when Kutigi swear in Katsina- Alu and remain behind? Except they are saying that Kutigi will swear in Katsina – Alu few minutes to his bowing out and as soon as he does that he ceases to function as the CJN.”

For Ajayi, “The convention is that the President will swear in the CJN. It has never happened that the outgoing CJN will inaugurate the incoming CJN. If the President is indisposed, why not Vice –President Goodluck Jonathan to inaugurate the new CJN? It shows lack of sensitivity of those who are running the country to demonstrate that Jonathan is in charge. By asking Kutigi to the work of the President, it has shown that there is nobody in charge. It is unfortunate.

Falana said, “Justice Idris Kutigi’s retirement takes effect at 12 midnight December 31, 2009. Will the ceremony takes place at 1am? If he administers the judicial oath on the new CJN, Justice Aloysius Katsina-Alu during office hours on that day, it means there shall be two CJNs contrary to the letter and spirit of the 1999 Constition.

“It is hoped that the outgoing CJN will not lend his weight to the serial breaches of the constitution. There is no doubt that there will be legal action to challenge this unfortunate development.

But a former CJN, Justice Alfa Belgore, Chief Joe Gadzama (SAN) and Mr. Tayo Oyetibo (SAN) claimed that it was legal for Kutigi to inaugurate Katsina-Alu.

Gadzama said, “The practice is that the President will inaugurate the CJN. But that does not mean that Kutigi cannot inaugurate Katsina- Alu. I have not been able to lay my hand on the constitution because I have been in my village in Maiduguri, so I cannot say categorically what the law says on it.”

Oyetibo said, “It is legal for Kutigi to inaugurate Katsina-Alu as there will be a vacuum if katsina-Alu is not inaugurated. Nigeria has found itself in a precarious situation which demands a solution. Once he takes the oath, he (Katsina-Alu) becomes the CJN. If Kutigi can swear him in before his expiration, there is nothing illegal.”

For Belgore, who spoke with one of our correspondents on the telephone, the 1999 Constitution did not specify that a sitting president should swear in a new CJN.

He said, “The Constitution does not specify who should swear-in a new CJN. A justice of the Supreme Court can do it. Even ordinary judge of a high court can do it.

“Although it has become customary for the President to swear-in the CJN and governors to swear-in chief judges of states‘ high court, there is nothing wrong if another justice of the court does it.

However, an Abuja-based SAN, Chief Adegboyega Awomolo, said that after the Senate might have confirmed Katsina-Alu‘s appointment, the president must issue him with an appointment letter.

But he expressed the fear that since the president was indisposed, no letter of appointment could have been issued to Katsina-Alu.

According to him, the issue of inaguration is secondary, “as there must be a letter of appointment with the seal of the president and his signatrure before inauguration.”

Meanwhile, the main courtroom at the Supreme Court which is normally used for ceremonial purposes has already been prepared for the swearing in of Katsina-Alu on Thursday.

It was learnt that Kutigi ordered the preparation of the courtroom.

Before Yar‘Adua took ill, he had forwarded Katsina-Alu’s name to the Senate for confirmation in line with section 231 (1) of the 1999 Constitution.

The section states: “The appointment of a person to the office of Chief Justice of Nigeria shall be made by the President on the recommendation of the National Judicial Council subject to confirmation of such appointment by the Senate.”

Kutigi will bow out on Thursday, having attained the constitutional retirement age from the Supreme Court which is 70.

Katsina-Alu, 68, will become the 12th CJN. He will vacate office on August 28, 2011 when he will be 70.

The first Chief Justice of Nigeria was a Briton, Sir Strafford Foster Sutton, while Justice Ademola Adetokunbo became the first indigenous CJN. He was appointed to the office in 1958, two years before independence and remained until 1972 when he retired.

Valid arguments
However, having strong regions with a weak or absent centre will not lead to the disappearance of the current thugs. The current political thugs get away with their strategies because the individuals with intellect can not practise politics as currently espoused by the current political elite. Politics of intimidation, fear, kidnap, assassination, etc will not simply disappear.

We have all witnessed how far these people will go; why do you guys think that if it can be practised at the national, state and LG levels, it can not be practised at regional levels. How will prospective Igbo leaders who want to rule the eastern region tackle the Ubas? or that new guy in Ogun state, Kashamu? Or Ibori, Duke in South-South? If the thugs do not go away, how do you make them go away? Only the masses can put an end to this never ending circle of violence, thuggery, and intimidation and from what I have seen of Nigerians, they will not do that for obvious reasons.

But I agree with your points that the caliphate or any other power group would be almost powerless in orchestrating affairs in the regions. But that is ignoring the fact that candidates can be sponsored by godfathers in other regions. Remember Akintola in the 1960s.

This is just my opinion anyway.
Nobody said these political thugs will totally dissappear but there influence and numbers will drastically reduce

Most of the intellectuals cannot practice in this system because the system is highly flawed. This flawed system has been practised for a long time (since 1970) that that the low lifes ot the different regions have garnerd enough power and money to wield around.

Those vices will not toally disappear but they will surely reduce.

Are the Ubas not being tackled already despite the current flawed system? How much more when the Ubas will no longer have a whole lot of backing from the center,Was is not the long period we practiced this flawed system that the Ubas had the time to garner the wealth and power they are wielding at the moment?

The thugs would not want to go away for now because the system being [practised now encourages corruption.Put a situation that discourages corruption and take it from there,Why should i governor of maybe one of these unviable states hustle to get money to run my state when i can conveniently wait for allocation from Abuja?

Do not use Akintolas case as an excuse. Why wasn't there a similar case in the then eastern region?

In your heart of hearts do you believe that in an independent western region that Adedibu Akala and Fayose will have a say in region that prides itself of having intellectuals?Did they not wield power because of the power they got from Abuja?

hmm so who will buy this bitumen, when larger supplies can be found in India and Bangladesh hence driving the price down for these so-called resources?
Using your logic nigeria is ranked as the seventh largest producer of oil in which you insist can only be the economic driving force in nigeria.Only God knows what would have been the price of oil if nigeria is the largest supplier of that.

Palm oil was the one of the driving economic forces of the then eastern regional economy at a time that that region was regarded as the fastes growing economy in the world. When crude was discovered we went to sleep and malaysians came and took seedlings from there to their own country andused the to become the largest exporter of palm oil'

What am trying to say?Relevant authorities should get to work and start on the production and exploration of the resource and not wait till a time the resource becomes a bit irrelevant to the world just because we might not be the largest producer of the resource.Make hay while the sun shines and make adequate use of the money from the resource.

Its really not a good comparison. These countries have a highly educated class and complex economy. They can offer service products that people are willing to pay for.

I really am interested in knowing how other regions would be economically viable states. If someone could enlighten me on how one nigerian region can be self-sufficient I would be really grateful.
Bringing it to your doorsteps how did Awolowo run the former western region the way he did?

On the issue of highly educated class please do not tell me that nigeria does not have highly educated people. The problem is when nigeria's best brains are not residing or want to reside in the country.

No one is saying that corruption will disappear from Nigeria,If corruption can exist in UK how will it not exist in Nigeria? Why should I as Governor of maybe one of these unviable states be bothered about money to run the state when i can sit down and wait for monthly allocation from Abuja? We should create a system that discourages government  corruption  by that government being self reliant and generating its own revenue  than a system that encourages corruption by laziness due to the waiting of allocation from the centre.
