The governor and his deputy are principal witnesses in their case, and as such they'll appear. I closely followed the Governorship, State and Federal House election petition cases in my state, and I saw all the Defendants (including the already sworn in governor) mount the witness box as witness to testify

An election petition tribunal I think are special Courts set up for specific functions.

Section 308 insulates the Deputy Governor from court processes, appearances et Al...he can easily delegate same responsibility to someone to represent him.

Why are they legally represented at the Tribunal if the Court has no powers/jurisdiction to try them? The Section 308 you're referring to doesn't shield them from trial at the election petition tribunal. That's why an already sworn in governor, House member or President can be sacked by the Tribunal.

An Election Petition Tribunal can. Its a post election case, and not a criminal or civil case.
