[size=15pt]28 Nigerian soldiers petition UN over trial [/size] Written by Innocent Anaba Monday, 22 September 2008 The 28 Nigerian soldiers who returned from Liberia after serving in the United Nations Peace Keeping Operations, but are being prosecuted by the Nigeria Army for allegedly protesting over their unpaid salary arrears, have petitioned the United Nations, over their trial, arguing that they are being tried for exercising their right to freedom of expression. Counsel to the soldiers, Mr Femi Falana, in the petition addressed to Frank Lewy, Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression of the UN Human Rights Commission, called on the world body to prevail on the Nigerian Army to stop the prosecution of the soldiers and release them unconditionally. Said Falana: “I wish to draw the attention of the Rapporteur, to the “unlawful trial of some 28 Nigerian soldiers for peacefully exercising their internationally recognised human right to freedom of expression, and to urge you to urgently prevail on the Nigerian government to stop the trial and release the soldiers unconditionally, and to fully implement its international human rights obligations, including under the UN International Covenant on Civil and Political Rights to which Nigeria is a state party”. “Following a peaceful protest on 4 July 2008 in Akure, Ondo State, the Nigerian Army unlawfully arrested and detained the 28 soldiers and subsequently charged them with mutiny.” “The soldiers who returned to the country from Liberia after serving in the United Nations Peace Keeping Operations in that country were demanding the release of their unpaid operational allowances. Throughout the seven months duration of the mission, the monthly salary of US$1,048 per person paid by the UN was illegally withheld by the Nigerian Army. Unlike their counterparts in the UN Contingent, the Nigerian soldiers had to fend for themselves. They were even compelled to buy their uniforms and boots even though provisions were made for them by the UN. “We are seriously concerned that the soldiers who have been detained in dehumanising condition at the military barracks in Akure since June 5, 2008 are now being tried for a serious offence of mutiny, which attracts probable execution as prescribed by military laws in Nigeria simply for demanding their legitimate entitlements and human rights”. “We consider the unlawful trial of the 28 soldiers to be in violation of the International Covenant on Civil and Political Rights, which provides in its Article 19 that “everyone shall have the right to hold opinions without interference. Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice”. “We also believe that legal restraints upon individual freedom of expression should only be tolerated where they are absolutely necessary to prevent infliction of actual harm or to secure the liberties of others. [size=15pt]Quit ANPP, Ume-Ezeoke tells Buhari [/size] Written by Leone Usigbe Monday, 22 September 2008 There seems to be no end in sight in the feud between the hierarchy of the All Nigeria Peoples Party (ANPP) and its candidate in the last presidential election, Major General Muhammadu Buhari as the party has now indicated its wish for the former presidential candidate to leave the party. The National Chairman of ANPP, Chief Edwin Ume-Ezeoke who gave the hint yesterday in Abuja while on a visit to the national headquarters of the Progressive Peoples Alliance (PPA) however noted that even though Gen. Buhari had allegedly been engaged in acts detrimental to the ANPP, the party would not on its own expel him. According to him, “we will never expel anybody. The reason is that it is a political party. If he doesn’t want what we are doing, he will simply on his own walk away. But to expel him, not only him, anybody at all, we will never expel anybody from the party.” The party chairman advised the former presidential flag bearer of the party to take a cue on party supremacy from the incidents in the African National Congress (ANC) which recently ordered President Thabo Mbeki to resign and he obeyed. “No man is greater than his own party. However much the influence you have, if you decide to go into a political party, you behave according to the rules and regulations of that political party. Any time you don’t want any more, you wash your hands and you walk away. “You either form your own party or you go into another party but you cannot be there telling us who is where in a party that you know you have no interest,” Chief Ume-Ezeoke maintained. He recalled that ANPP’s reconciliation committee had written to Gen. Buhari on the possibility of coming to resolve his differences with the party but he snubbed the committee, adding, “of course, he said he wouldn’t like to see them or look at their faces, talk less of talking to them. How can the house be in order with those sorts of people?” The party chairman further remarked, “we are praying God that he may find another party or he may eventually decide to form his own party.” Gen. Buhari had maintained in a recent interview that Chief Ume-Ezeoke and a chieftain of the ANPP, former Zamfara State governor, Sen. Ahmed Sani Yarima were in fact members of the Peoples Democratic Party (PDP) and were thus, working for the interest of the PDP instead of the ANPP which they lead. Speaking yesterday on the claims by Gen. Buhari, Chief Ume-Ezeoke debunked the allegation saying that Nigerians did not need Gen. Buhari to inform them of his membership of the PDP as it would be obvious for them to see if indeed he had returned to the party which he left in 2002. He remarked that the former head of state had been calling him (Ume-Ezeoke) names ever since he as the national chairman of the party stood against an attempt to involve the ANPP in a mass action following the declaration of the 2007 presidential election results which gave PDP the victory. Gen. Buhari was also miffed by the decision of the ANPP to participate in the PDP-led Government of National Unity (GNU), a decision strongly defended by Chief Ume-Ezeoke. “Ever since I left PDP, I never wanted to have anything to do with them. Don’t forget the invitation to go to Government of National Unity was given by the President (Umaru Musa Yarádua) on behalf of the Federal Government. You have to draw a clear distinction. If it were PDP, I won’t go there,” he stated. On the visit to the PPA, he stated that it was in line with the ANPP’s determination to strengthen the alliance among the opposition parties towards unseating the PDP in power as he noted that the ruling party had failed to meet the yearnings of Nigerians. Also speaking at the occasion, the National Chairman of the PPA, chief Clement Ebri expressed the hope that the opposition could ignite a “political revolution” that would take over government from the PDP, saying that even though the PPA was in the GNU, the marriage had not been smooth. [size=15pt]Military not at war with MEND, say Defence officials [/size] From Madu Onuorah (Abuja), Kelvin Ebiri and Rose Ann Chikeruba (Port Harcourt) DEFENCE Headquarters yesterday dismissed claims by the Movement for the Emancipation of Niger Delta (MEND) that it has ordered a cease-fire, saying that it is spurious term, since as the Nigerian military was never in any war with it or any group within the country. Director of Defence Information, Brig. Gen. Mohammed Danjuma Yussuf, said in a statement in Abuja yesterday that if the group wants to be taken seriously, it should show it by laying down their arms "for the sake of national interest." According to the Defence Spokesman, "the attention of Defence Headquarters has been drawn to the claim by a militant group going by the name 'MEND' to the effect that they have declared a cease fire in their so-called 'oil war' in the Niger Delta region of Nigeria. "We want to categorically and emphatically state that the Nigerian Armed Forces is not at war with any individual or group and as such the issue of a cessation of fire or cessation of war as is being portrayed certainly does not arise. "However, if the restive youths in the region are actually serious about stopping their acts of brigandage, they should show it by laying down their arms for the sake of national interest." A top military officer told The Guardian that the military was unhappy that some Nigerians see its presence in the Niger Delta as meddlesomeness. This, he said, is because "in the first instance, as a sovereign nation, the military is expected to be deployed in every part of the country as a matter of routine. And with the crisis in the Niger Delta, the military's presence is purely to help in nudging forward the political solution including dialogue and guaranteeing security for infrastructure development of the area." Meanwhile, the Peoples Democratic Party (PDP) National Organising Secretary, Uche Secondus, has described militancy and youth restiveness in the Niger Delta as potential threats to the actualisation of President Umaru Musa Yar' Adua's seven-point agenda. MEND has expressed its willingness to meet with the members of the Ledum Mitee-led Presidential Technical Committee on the Niger Delta as part of efforts to find lasting solutions to the protracted Niger Delta crisis. Secondus was PDP Rivers State chairman under former Governor Peter Odili. Secondus, while addressing newly inaugurated local council party chairmen at the PDP secretariat in Port Harcourt yesterday, bemoaned the precarious security situation in the region, which has led to the abandonment of major construction projects like the East-West road by Julius Berger and others. Also, the wife of detained Henry Okah, Azuka, has called on the State Security Services (SSS) to obey an order earlier given by a Federal High Court, Jos that her husband be taken to hospital for treatment of his kidney ailment. Similarly, the National Association of Resident Doctors of Nigeria has expressed concern over the significant drop in medical care in the Niger Delta region because of the rising level of armed conflict within the region. The association said in a statement issued after its yearly General Meeting (AGM) held recently in Port Harcourt that, "health care indices such as infant mortality rate and maternal mortality rate will continue to grow at an alarming rate except something is done fast to stop the problems in the region". Pakistan, Afghanistan, Burma and India also figured among the countries so identified for fiscal year 2009 in a report sent to Congress by President George Bush under Foreign Relations Authorisation Act 2003. “A country's presence on the Majors List is not necessarily an adverse reflection of its government's counter-narcotics efforts or level of cooperation with the United States,” Bush said in a memorandum for the Secretary of State, Condoleezza Rice, asking her to send the report to Congress. Other nations on the list were: The Bahamas, Bolivia, Brazil, Colombia, Dominican Republic, Ecuador, Guatemala, Haiti, Jamaica, Laos, Mexico, Panama, Paraguay, Peru, and Venezuela. The number of drug couriers has been on the increase in recent times in Nigeria following the light court sentences on those brought before them. However, only Bolivia, Burma, and Venezuela were identified as countries that have failed demonstrably during the last 12 months to adhere to their obligations under international counter-narcotics agreements and take the measures required under US law. In the case of India, the presidential determination noted that the government "maintains a strong track record of regulating, monitoring, and curbing its illicit opium production and distribution process." However, the US continues to be concerned about illicit opium poppy production in certain areas of the country, such as West Bengal and the state of Uttaranchal along the India-China Border, previously thought to be free of such cultivation, it said. Nigeria is a corrupt country where anything goes. If the soldiers on the ground feel that co-operating with the militant will bring them money why not. After all their boss are very corrupt as well. why should the poor soldier waste his life for a course nobody care about. |
Both sides seems to have suffered losses, with mend on the receiving end. For every militant killed, 10 are ready to take his place. The readiness of the army to accept the cease fire suggest battle weariness, its a lose-lose situation I dont think the use of force can settle the Niger Delta problem. There are thousands of kilometres of pipeline spread all over the area with several installations, no army in the world can protect it. Any mad man can just walk into the bush and blow up the pipeline. Somehow you need to engage the people and find a political solution. The USA employs the same strategy in Iraq |
