DUBlog: The National Drug Law Enforcement Agency in Nasarawa State on Friday apprehended the 60-year-old village head of Koje community in Nasarawa Eggon Local Government Area of the state, Mr. Samuel Agu, for allegedly cultivating and harvesting 12kg Indian hemp otherwise called cannabis sativa in his farm land.
Parading the suspect at the command office in Lafia, the state capital, the NDLEA commander in the state, Mr.Sumaila Ethan, said, “On March 4, 2016, we arrested Mr. Samuel Agu, the village head with bags of cannabis sativa weighing about12 kg.
“The village head confessed that he had been getting the supply of the cannabis seeds from a Fulani herdsman, the weed seized from him was the remnant of what he harvested from his farm.
“The village head, who is expected to live an exemplary life style that is worthy of emulation, was the same person selling cannabis for consumption.”
He, however, expressed worry on how those entrusted with the responsibilities of deterring criminality in their various domains end up getting involved in it, describing it as ungodly and unfortunate.
“It is pertinent to alert the people of the state and the whole world that, there is an alarming increase in the activities of illicit barons in the state particularly those entrusted with positions of leadership in our rural communities,” he added.
Ethan also said that from January 2016 to date, the command had arrested 28 suspects in the state and about 460kg of narcotic drugs and psychotropic substances were also seized.
Out of the number, seven drug barons were successfully prosecuted and convicted at the Federal High Court, Lafia while 10 others were successfully rehabilitated. Other cases are ongoing at the Federal High Court, Lafia,” he said.

kahal29: The Senate President, Dr. Bukola Saraki, says he has lost count of the records of charges of false asset declaration instituted against him before the Code of Conduct Tribunal.
He also said facts about the charges were no longer fresh in his memory because they bordered on offences which he was accused of committing between five to 14 years ago.
Saraki stated this in an affidavit, which he personally deposed to in support of his fresh application seeking the quashing of the charges against him at the CCT and discharging him of the alleged offences.
“The facts relating to these matters are no longer fresh in my memory quite apart from the fact that I have lost many of my records pertaining to them,” he stated in the affidavit.
Saraki’s fresh application, which was dated and filed on March 4, 2016, seeks to halt his trial that had been validated by the Supreme Court through its judgement delivered on February 5, 2016.
He was arraigned on 13 counts of false asset declaration before the CCT on September 22, 2015.
A seven-man panel of the Supreme Court, led by the Chief Justice of Nigeria, Justice Mahmud Mohammed, had in its judgement, dismissed Saraki’s objection to his trial.
The apex court, in the said judgement, affirmed the competence of the 13 counts filed against him and the jurisdiction of the tribunal to hear the case.
In the charges instituted by the Federal Government, Saraki was accused of making false asset declaration in his forms submitted to the Code of Conduct Bureau on assuming office and leaving during his two terms as Governor of Kwara State between 2003 and 2011.
The Senate President, who was said to have submitted four asset declaration forms, allegedly “corruptly acquired many properties while in office as Governor of Kwara State, but failed to declare some of them in the said forms earlier filled and submitted.”
He also allegedly made an anticipatory declaration of assets upon his assumption of office as governor, which he later acquired.
Saraki was also accused of sending money abroad for the purchase of property in London and maintaining an account outside Nigeria while serving as governor.
But in his fresh application, Saraki said the charges were not in the interest of justice, but politically motivated and filed in violation of due process as well as his right to fair hearing.
He also stated that the charges could not be valid since they were filed in the name of the Attorney-General of the Federation.
He said he was denied fair hearing as neither the CCB nor the Attorney-General of the Federation confronted him with any infraction in the four assets declaration forms.
He said he declared his assets first on assuming office as Governor of Kwara State in 2003 and on completing his term in 2011.
He said he subsequently made another asset declaration and submitted the form to the CCB upon his reelection in 2007 and on ending his second term in 2011.
He said had he been informed of any inconsistencies in his asset declaration forms, he would have corrected them.
He said, “I am not aware of any petitions challenging my declarations, and the bureau (CCB) has never drawn my attention to any. I would promptly have corrected or explained (the reason for) any alleged discrepancies or inconsistencies in my asset declaration had my attention been drawn to them.”
His prayers in the application include, “An order quashing and/or striking out the charges contained in Charge No: CCT/ABJ/01/2015 by the complainant/respondent against the applicant.
“An order pursuant to Paragraph 1 above, discharging the defendant/applicant herein.”
Saraki’s new lead counsel, Mr. Kanu Agabi (SAN), who led five other Senior Advocates of Nigeria and about 60 other lawyers in the Senate President’s legal team on Friday, is also challenging the jurisdiction of the tribunal to entertain the case against his client.
Saraki’s trial, scheduled to commence on Thursday, following the judgement of the Supreme Court validating it, was stalled on Friday.
The trial was stalled after Agabi introduced his client’s fresh application and insisted that it must be heard before the matter could continue.
But the lead prosecuting counsel, Mr. Rotimi Jacobs (SAN), described the motion as “a deliberate attempt to stop the trial from going on.”
“The defendant keeps saying that there is no case against him and that he is being persecuted; why doesn’t he let the trial start so that the whole world can see the persecution?” Jacobs asked.
The prosecutor, who said he had not been served with the motion, insisted that by virtue of the judgement of the Supreme Court delivered on February 5, which validated the trial, the day’s business was for the prosecution to open its case.

In another development, a campaign themed #FreeYellowNow has begun online and popular in Kano, advocating for the release of the suspected abductor. One of those championing Yunusa's case is a lecturer at the Bayero University Kano, Dr. Audu Bukarti, a lawyer who is expected to represent the suspected abductor next Monday in Yenagoa. Speaking on #FreeYellowNow, Bukarti said, "Many thought Yunusa was not represented by lawyers when he was arraigned yesterday. The truth is that he was represented by the 4 lawyers we have hired for him in Bayelsa. We asked them to represent him because we knew the only thing that would be done yesterday was to read the charges and take his plea.
"Yunusa has denied all the 5 charges framed against him. If Yunusa went to court alone, perhaps, he would have pleaded guilty because he might not understand the meaning and implication of what was read to him. But he was properly guided because there were lawyers with him. We have filed an application for the bail of Yunusa. The application has yet been taken. The matter has been adjourned to Monday, the 14/3/16 for hearing even though our contacts say hearing may not commence on that day. I and other lawyers are planning to be in court on Monday even though we are yet to finalise our plans. We may not be in court on Monday if hearing will not commence on that day. A Court of Appeal three-man panel led by Justice Datuk Tengku Maimun Tuan Mat sentenced Abuchi Ngwoke, 31, to 20 years jail and 10 strokes of whipping after convicting him for possession of 251.66 grammes of methamphetamine. The court unanimously allowed Ngwoke's appeal to set aside a Melaka High Court's decision to convict and sentence him to death for trafficking in the drugs at the Melaka General Hospital between 5am on May 23, 2012 and 2.50pm on May 25, 2012. Tengku Maimun said the court found there were merits on the issue raised by Ngwoke's counsel, Hisyam Teh Poh Teik relating to the chemist's evidence.
The panel which also included Court of Appeal judge Datuk Ahmadi Asnawi and High Court judge Datuk Kamardin Hashim ordered Ngwoke to serve his jail sentence from the date of his arrest on May 23, 2012. According to the facts of the case, Ngwoke was arrested by the police after he was found breaking into Batik Selat House MITC in Melaka and drank a bottle of ink. He was brought to the General Hospital where 27 capsules allegedly containing methamphetamine were removed from his stomach. In his defence, Ngwoke claimed that he swallowed "precious stones" which were wrapped, with soup after a man named Chibike told him that it contained precious stone gold dust which was used in jewellery-making in Malaysia. He claimed he was drunk when he followed Chibike's instructions to swallow the capsules which he believed contained precious stones, before leaving for Malaysia.
In the appeal today, Teh submitted there were infirmities in the chemist's evidence with regard to her analysis of the drugs because there was no evidence she had read her written statement on her analysis in open court under oath. He also argued that Rozieyati Abdullah's written statement was inadmissible because there was no notation that she had identified her written statement and also no record that her statement was marked by the court. He also said the High Court judge erred when he descended into the arena of conflict and crossed-examined Ngwoke relating to the issue of his consciousness which was prejudicial to his client. Deputy Public Prosecutor Nurshafini Mustafha said there were no infirmities in the chemist evidence, adding that her evidence on the analysis of the drugs was sufficient.

mile12crises: ABUJA – The Department of State Service, DSS, on Monday, told a Federal High Court sitting in Abuja, that it has uncovered plot by some pro-Biafra agitators, to invade the court and forcefully free the detained leader of the Indigenous People of Biafra, IPOB, Mr. Nnamdi Kanu.
The security agency made the allegation on a day the federal government was to open its case against Kanu who is facing a six-count treason charge alongside two other pro-Biafra supporters, Benjamin Madubugwu and David Nwawuisi.
Nnamdi kanu The Director of Public Prosecution, DPP, Mr. Mohammed Diri, told trial Justice John Tsoho that the DSS has already commenced investigation on the planned invasion. Meantime, following the inability of the federal government to produce any of the eight witnesses scheduled to testify before the court, the defendants, through their lawyer, Chief Chuks Muoma, SAN, applied to be discharged and acquitted of the charge against them.
They predicated their application on the provision of section 351(1) of the Administration of Criminal Justice Act, 2015. Earlier, the DPP informed the court that the witnesses said they would not appear to testify against the defendants unless the are allowed to wear masks or their identities shielded from both lawyers and people observing the proceeding. ‘My lord this is because they are already receiving threats from associates of the defendants that they will be dealt with. The witnesses said they love their lives and requested that their identities be shielded from people who are coming to witness the proceeding’, Diri added.
He said DSS operatives also billed to testify in the matter, made similar request on the basis that they are investigating terrorism cases and would not want their identities exposed. Justice Tsoho had on February 19, refused an application by the federal government which sought leave to mask the witnesses. The application was vehemently opposed by counsel to the defendants who urged the court not to allow ‘masquerades’ to testify before it. Meanwhile, the parties are still exchanging arguments on the application for the charge to be quashed and the defendants discharged and acquitted.
Kanu who was hitherto the Director of Radio Biafra and Television, has been in detention since October 14, 2015, when he was arrested by security operatives upon his arrival to Nigeria from his base in the United Kingdom. The defendants were alleged to have committed treasonable felony, an offence punishable under Section 41(C) of the Criminal Code Act, CAP C38 Laws of the Federation of Nigeria. FG alleged that they were the ones managing the affairs of the IPOB which it described as ‘an unlawful society’.
Specifically, Kanu was alleged to have illegally smuggled radio transmitters into Nigeria, which he used to disseminate “hate broadcasts”, encouraging the “secession of the Republic ofBiafra”, from Nigeria. The accused persons however pleaded not guilty to the charge on January 20, even as the court ordered their remand at Kuje prison in Abuja.
