Ambode named Governor of the Year


A year into office, Lagos state Governor, Akinwunmi Ambode has been judged to be Nigerian 2015/2016 Governor of the Year based on a comparative analysis of Governors’ performance in Nigeria.

This is according to a sttudy conducted by the Centre for International Advanced and Professional Studies, CIAPS.

The study tagged CIAPS Governors’ Performance Index (CGPI) is a monthly performance review of what Governors across the country are doing in their offices and it is conducted by the Lagos based Centre for International Advanced and Professional Studies (CIAPS).

In a statement released by the Centre, the CGPI coordinator, Mr Olumuyiwa Ayoola explained that the variables used as indexes for performance were mathematically calculated and this end of the year’s variables included “Payment of Salary, Infrastructure & Health, Education, Security and Business Opportunity and Employment”. According to Mr Olumuyiwa Ayoola, the action of each state governor was monitored and studied from their first day in office and the findings were graded and compared to that of fellow governors across the country.

Over the past year, CGPI results show that Kaduna state performed more than any other state to create jobs and encourage business investments. Lagos state has done more than anyone other State for security and infrastructure.

Sokoto, Kaduna and Imo States were commended for their efforts on education.

The Governors of Adamawa and Bayelsa States continue to remain at the bottom of the list as all finished in the bottom places with not more than a score of 39%.
Commenting on the CGPI report, CIAPS Centre Director and CGPI Chair, Prof Anthony Kila stated that the “CGPI is a useful tool for democracy and good governance as it allows government to be objectively measured against their peers and compels all in power to be mindful of accountability”.

The variables used for measuring Governors performance this month after one year in office factors the limited powers of State Governors as well as what they can do.

awardKila further explained that he hopes that the CGPI monthly reports will allow governors to sit up, improve their performances during their tenure and even enter into healthy competition between themselves for the benefit of their states and the country as a whole. He advised that Governors rated as apoor to roll up their sleeves and improve governance rather than enter into a media war or words with observers.

And let's even assume for argument sake that CCT tries Tinubu again, what will it achieve, cos everyone knows CCT is just there to cut down peoples political ambition.

The main sentence here is a 10 year ban from holding political office. In some cases a fine and in a very severe case which is highly unlikely a minor jail term.

A political ban now will disgrace Saraki out the President of Senate and also out as a Senator. Now everyone knows Tinubu is satisfied as a God father and is seeking no elective office. So how does that hurt him.

CCT is basically for over ambitious people like Saraki and Melaye. If you're not a political office holder or not angling to be nominated as a Minister or Ambassador etc in the future, then sleep in Peace.

No matter how it goes... Saraki has all to lose, Tinubu has little to lose.

There is nothing like an Error in a Court sentence. If the Court indeed made an error on Tinubu then it will have to live with the error forever because once a pronunciation is made by a court only a higher can reverse that error.
In order words a particular court cannot try a particular case twice. In law it is called Double Jeopardy.
Thats why Tinubu can only laugh at those thinking he will be brought to trial again for exactly the same case by exactly the same court called CCT.

Let's remember that like every other Nigerians, the Fulani's have the right to live and do their business in any part of the country. The ordinary Fulani herdsmen are peaceful people and will never harm innocent Nigerians. The fulani's do not move around with weapons but sticks to guide their cattle. I observed most critics of this Bill are from the eastern part of the country. The igbos need to realize that the federal govt owns all the land and territories in Nigeria and it can decide on how it chooses to use every inch of its territory. The fulani's have every right to graze in the SE and there is nothing any one can do about it. It is their right as a Nigerian just like the igbos are the most travelled tribe doing business in every part of the country. We cannot decide to restrict all igbo traders to the east because of the attitude of few bad eggs amongst them likewise the Fulani's. Most Nigerians criticized the federal govt when they decide to create ranches and import grasses from Brazil to graze these cattles so the herder wont roam about. Now the FG is shifting plans to create a grazing site for the herders in every state which is not a bad move by all standards. We are one Nigeria and we must learn to tolerate ourselves and live in peace. We must shun the politics of hatred and tribalism. The Federal Government has no right to force people to sell their lands to the Fulani cattle men. When the ibos go to the north or Lagos to trade, they fund the shops and stores they buy with their own money. The owners of the Land be it 'Omonile or Idumota Landlords' have the option to agree to sell to the traders or not. The Federal Government doesnt give the ibo traders one kobo to enable them trade succesfully so why should my tax money be used to buy land by force for those cattle men.

If the Cattlemen want southern land to graze, let them raise money themselves and approach Nsukka or Asaba or Ughelli (etc) land owners and bargain for grazing land. Then Landlords or Land owners will either disagree or agree with (terms and conditions) if the money is ok for them.

Why should the Federal Government use oil money or tax money to buy land by force at whatever price they deem fit for a section of the country people and neglect others. Who gave them that legal or moral right. The ultimate plan here is to create fulani enclaves in southern Nigeria where they (the so called fulani herdsmen) will start building villages in the near future and invite their other folks in the north to come down to and reside. In other words we will have many populated and concentrated fulani villages and sttlements in southern nigeria. Soon they will start asking for their own local Government (All funded by the biased president).

It is not a suspension bridge but its a Cable Stayed Bridge. The first Cable Stayed Bridge in West Africa. And it costs 4 times more than it should because its not an ordinary bridge. Aesthetics was added to it to arrive at that cost.
A 3 bedroom bungalow can cost N5 million to build, can equally cost N50 million to build, depends on what you add to it.

Toyin Saraki contradicts husband, says secret assets solely belongs to her Toyin Saraki, wife of the Senate President, Bukola Saraki has said the controversial hidden assets her husband did not disclose belongs solely to her, and not her family estate.

The massive leaked documents from a Panamanian law firm, Mossack Fonseca, had revealed that the properties, hidden in secret offshore, were part of the assets belonging to the Senate President’s immediate family.

According to Premium Times investigation on Monday, April 4, 2016, Saraki failed to declare the assets among those filed with the Code of Conduct Bureau (CCB), as required by the Nigerian laws.

Saraki, through his Special Adviser on Media and Publicity, Yusuph Olaniyonu, however insisted that he complied with the provisions of the law.

He said the controversial assets belongs to his wife's family estate.

“It is public knowledge that Mrs. Saraki comes from a family of independent means and wealth with numerous and varied assets acquired over decades in family estates and investments,” Mr. Olaniyonu said.

But in contrary, the claims by the Senate President contradicts those by his wife’s lawyers who said the assets in question solely belongs to Mrs. Saraki.

The London-based law firm of Harbottle & Lewis, who are lawyers to Mrs. Saraki, in clarifying the legal position of the controversial assets, said its client solely own them.

“Our client is the sole shareholder in Sandon Development Limited. There are not and have never been any other shareholders in Sandon Developments Limited,” Harbottle & Lewis stated in a response to enquiries by the ICIJ in a letter dated March 19, 2016.

Also in the document obtained by Premium Times, Mrs. Saraki insists she is the sole director of Girol Properties Limited.

Ex-govs get fat pension as senators, ministers

State governments are spending billions of naira in pension payments to their former governors who are also drawing salaries from public purse as serving senators and ministers, Daily Trust reports.
There are 21 former governors and deputies in the Senate and President Muhammadu Buhari’s cabinet.
The Revenue Mobilization Allocation and Fiscal Commission (RMAFC) approves payment of 300 percent basic salary as severance allowances for political office holders on leaving office.
However, various state assemblies had approved a wide range of entitlements for ex-governors and their deputies.
Though the Code of Conduct Bureau (CCB) Act doesn’t prohibit the former governors from drawing dual remuneration simultaneously, there are concerns on the financial implications on the states.
Only recently, President Buhari said 27 states were struggling to pay salaries despite collecting N662 billion bailout funds from the federal government last year.
The former governors now senators are: Bukola Saraki (Kwara), Rabiu Musa Kwankwaso (Kano), Kabiru Gaya (Kano), Godswill Akpabio (Akwa Ibom), Theodore Orji (Abia), Abdullahi Adamu (Nasarawa), Sam Egwu (Ebonyi), Shaaba Lafiagi (Kwara), Joshua Dariye (Plateau) and Jonah Jang (Plateau).
Others are Aliyu Magatakarda Wamakko (Sokoto), Ahmed Sani Yarima (Zamfara), Danjuma Goje (Gombe), Bukar Abba Ibrahim (Yobe), Adamu Aliero (Kebbi), George Akume (Benue) and Isiaka Adeleke (Osun).
Former deputy governors in the Senate are Ms Biodun Olujimi (Ekiti) and Enyinaya Harcourt Abaribe (Abia) while Danladi Abubakar Sani was the acting governor of Taraba state.
Former governors now ministers include Rotimi Amaechi (Rivers), Kayode Fayemi (Ekiti), Chris Ngige (Anambra) and Babatunde Fashola (Lagos).


Largess for ex-governors
According to a Lagos Pension Law approved by former governor Bola Tinubu in 2007, a former governor will enjoy the following benefits for life: Two houses, one in Lagos and another in Abuja. (Property experts estimates such a house in Lagos to cost N500 million and Abuja N700 million.)
Others are six brand new cars replaceable every three years; furniture allowance of 300 percent of annual salary to be paid every two years, and a close to N2.5 million as pension (about N30 million pension annually).
He will also enjoy security detail, free medicals including for his immediate families.
Other benefits are 10 percent house maintenance, 30 percent car maintenance, 10 percent entertainment, 20 percent utility, and several domestic staff.
In Rivers, the law provides 100 percent of annual basic salaries for ex-governor and deputy, one residential house for former governor “anywhere of his choice in Nigeria”; one residential house anywhere in Rivers for the deputy, three cars for the ex-governor every four years; two cars for the deputy every four years.
His furniture is 300 percent of annual basic salary every four years en bloc. House maintenance is 10 percent of annual basic salary.
In Akwa Ibom, the law provides for N200 million annual pay to ex governors, deputies. He enjoys a pension for life at a rate equivalent to the salary of the incumbent governor/deputy governor respectively.
A new official car and a utility vehicle every four years; one personal aide and provision of adequate security; a cook, chauffeurs and security guards for the governor at a sum not exceeding N5 million per month and N2.5 million for the deputy governor.
There is also a free medical services for governor and spouse at an amount not exceeding N100 million for the governor per annum and N50 million for the deputy governor.
Also, there is a five-bedroom mansion in Abuja and Akwa Ibom and allowance of 300 percent of annual basic salary for the deputy governor.
He takes a furniture allowance of 300 percent of annual basic salary every four years in addition to severance gratuity.
The Kano State Pension Rights of Governor and Deputy Governor Law 2007 provides for 100 percent of annual basic salaries for former governor and deputy.
Furnished and equipped office, as well as a 6-bedroom house; “well-furnished” 4-bedroom for deputy, plus an office.
The former governor is also entitled to free medical treatment along with his immediate families within and outside Nigeria where necessary. It is same for deputy.
Two drivers are also for former governor and a driver for his deputy; and personal staff below the rank of a Principal Administrative Officer and a PA not below grade level 10. There is a provision for a 30- day vacation within and outside Nigeria.
In Gombe, there is N300 million executive pension benefits for the ex-governor.
In Kwara, the 2010 law gives a former governor two cars and a security car, replaceable every three years, a “well-furnished 5-bedroom duplex,” furniture allowance of 300 per cent of his salary; five personal staff, three SSS, free medical care for the governor and the deputy, 30 percent of salary for car maintenance, 20 per cent for utility, 10 percent for entertainment, 10 per cent for house maintenance.
The Zamfara version of the law, signed in 2006, gives former governors pension for life, two personal staff, two vehicles replaceable every four years, two drivers, free medical for the former governors and deputies and their immediate families in Nigeria or abroad.
The law also gives the former governors a 4-bedroom house in Zamfara and an office, free telephone and 30 days paid vacation outside Nigeria.
In Sokoto, former governors and deputy governors are to receive N200 million and N180 million respectively being monetization for other entitlements which include domestic aides, residence and vehicles that could be renewed after every four years.
Section 2 (2) of the Sokoto State Grant of Pension (governor and deputy governor) Law, 2013 states that “the total annual pension to be paid to the governor and deputy governor, shall be at a rate equivalent to the annual total salary of the incumbent governor or deputy governor of the state respectively.”

We breached no law –Ex-governors
Senate President Bukola Saraki (APC Kwara central) confirmed collecting the pension but said the money goes as scholarship for indigent students.
Speaking through his media aide, Mr. Yusuph Olaniyonu, Saraki said his monthly pension was being paid into a special account.
Yusuf said Saraki “directed that a special account should be opened into which the money should be paid and that it should be used for a scholarship and education programme to be administered by a Board of Trustees.”
Plateau State ex-governor, Senator Joshua Dariye (PDP, Plateau central), said he was collecting N600,000 as pension monthly from the state government.
“They are paying me N600, 000 plus but they have not paid me my severance benefit. What do you mean? Those people that retired in the army and are now senators, are they not collecting their pensions?
“Even retired civil servants that are senators are being paid their pensions. This is pension and not salary. We all know that it is illegal to collect two salaries at a time,” he said by telephone.
Dariye said his pension could not stop the state government from paying teachers and other civil servants.
Kebbi State ex-governor, Senator Adamu Aliero (APC, Kebbi central) said “There is nothing wrong for a former governor now serving as senator or minister to be collecting pension. It is consistent with the pension law and absolutely nothing is wrong.”
He however said he had not been collecting his pension because “my immediate successor (Sa’idu Dakingari) did not pay me. And also the present governor (Atiku Bagudu) is not paying me.”
Ebonyi State former governor, Senator Sam Egwu (PDP, Ebonyi north) said he was collecting N462, 144 monthly as pension.
Egwu, who sent a text message to our correspondent containing his pension bank alert, said “It is a constitutional requirement that somebody who worked and retried must be given pension. It was under my tenure that the Ebonyi pension law was amended but I allowed it to be this meager because my state is a very poor one.”
Plateau State Governor Simon Lalong told Daily Trust that pension law is not implementable because “the former chief executives left the present administration with too much debt.
“They left the state heavily indebted that the present administration is battling to pay, and cannot be shouldering the upkeep of the former chief executives at the same time,” Lalong said through his spokesman Emmanuel Nanle.
What senators, ministers earn
According to RMAFC, a minister receives an annual basic salary of N2 million, accommodation N4 million, vehicle loan N8 million, furniture allowance N6 million, utility N607, 920, vehicle maintenance N1.5 million, entertainment N911, 880 and leave allowance N202, 640.
The minister also receives N506, 600 for personal assistants, N1.5 million for domestic staff, N303, 960 for newspapers and N6 million as severance gratuity.
In addition, the minister is entitled to N35, 000 as duty tour allowance (DTA) per day. For foreign trips, a minister receives $1,000 per day.
A senator earns a basic salary of N2,026,400.00,accommodation, motor vehicle loan(400% of their annual basic salary), motor vehicle maintenance allowance (75% of annual basic salary), furniture allowance(300% of their annual basic salary), utilities allowance( 30% of their basic salary), and medical allowance.
Other benefits they are earning are newspaper allowances, special assistant (between Grade Level 12 and 14), personal assistant, two legislative aides, one senior legislative aide, entertainment allowance, wardrobe allowance, constituency allowance and severance gratuity.

‘Legally right, morally wrong’
Senior Advocate of Nigeria Mike Ozekhome said receiving double income is “morally and ethically reprehensible. You are either pensioned, or you are working. You cannot be both a pensioner and an active worker simultaneously.”
He said the former governors “must drop one income. Since they are actively working at the National Assembly now and earning income, they must forgo the pension money from their cash-strapped states, until they retire in the true sense of the word. They cannot eat their cake and have it, nor have their cake and eat it. They cannot approbate and reprobate simultaneously.”
Another senior lawyer Sebastine Hon said, “While this is morally condemnable, the ex-governors have breached no law. We are operating a federal system of government; and it is no secret that past presidents are also entitled to and are indeed benefiting from life ex cathedra benefits. Since former presidents are scooping these benefits, what stops ex-governors from also enjoying same?”
The lawyer however, said it was another ball game if any of the former state executives decided on moral grounds to waive his statutory benefits on account of the current poor finances of his state.
Barrister Esther Uzoma, national coordinator of Proactive Gender Initiatives (PGI), said with many states battling to pay the N18, 000 minimum wage, “double remuneration is criminal and unpatriotic. Culprits should be tried. Citizens must demand greater accountability we must interrogate the life style of the political class who somehow manage to flourish and bloom in this economic wilderness.”

What the law says
Section 2 (a) of the CCB law provides that a public officer shall not “receive or be paid the emoluments of any public office at the same time as he receives or is paid emoluments of any other public office; or (b) except where he is not employed on full time basis, engage or participate in the management or running of any private business, profession or trade; but nothing in this sub-paragraph shall prevent a public officer from engaging in farming.”
Section 4 of the law says “A public officer shall not, after his retirement from public service and while receiving pension from public funds, accept more than one remunerative position as Chairman, Director or employee of – (a) a company owned or controlled by the government; or (b) any public authority. A retired public servant shall not receive any other remuneration from public funds in addition to his pension and the emolument of such one remunerative position.”
Section 14 of the same law exempted lawmakers from the above provisions thus: “In its application to public officers –(a) members of legislative houses shall be exempted from the Provisions of paragraph 4 of this Code; and (b) the National Assembly may by law exempt any cadre of public officers from the provisions of paragraph 4and 11 of this Code if it appears to it that their position in the Public Service is below the rank which it considers appropriate for the application of the provisions.”
Despite the above law, a coalition of 40 Non-Governmental Organization (NGOs) had sued the 36 state governors, 36 state assemblies, RMAFC and the attorney general of the federation seeking to nullify the various pension laws enacted by some of the 36 States Houses of Assembly.
The suit which was filed at the Federal High Court, Abuja by the NGOs lead counsel, Barrister Chino Obiagwu, and seeking an order to recover any pension payments paid to ex-governor or deputy, saying the RMAFC law supersedes any law passed by the state legislatures.
The case was adjourned to April 12, 2016.

Power generation crumbles to 0MW for several hours


Nigeria’s power generation collapsed completely on Thursday at exactly 12.58pm to zero megawatt and this persisted for about three hours.

Data from the country’s System Operator showed that around 1pm on Thursday, no power generation company in Nigeria produced a single megawatt of electricity.

Industry operators told our correspondent that as a result of the complete collapse, no electricity distribution company received load allocation beginning from when the collapse was recorded up till around 3pm.

The SO stated that the 11 distribution companies got zero electricity load allocation during the period of the collapse, meaning that for about three hours on Thursday no part of Nigeria got power supply from the national grid.

Our correspondent, however, gathered that supply of electricity was restored around 3pm.

For instance, out of the 450MW that was due Abuja Electricity Distribution Company, the Disco only got about 50MW when the situation began to improve.
Before the collapse, AEDC got an allocation of 257.97MW and the nationwide generation level stood at 2,243.2MW.

Sources in the sector blamed the complete collapse in power generation on the extent of destruction of infrastructure and gas pipelines vandalism that had happened in the industry over the past years, as well as the poor upgrade of power installations across the country.

“The power crisis being experienced nationwide since Tuesday this week has worsened on Thursday with a total system collapse at exactly 12.58pm this afternoon. At that point, the nation went to ground zero, with all the Discos receiving zero MW allocation from the System Operator,” an operator in the sector told our correspondent in confidence.

Officials from the Federal Ministry of Power, Works and Housing as well as private investors, had attributed the never-ending fall in electricity generation to vandalism of gas pipelines and destruction of vital infrastructure in the industry by miscreants.

Fashola is 4 months old at his job, but i am certain he will do a yeomans job. He is a fantastic thinker with good attention to details. Some ignorant folks have accused him of increasing electricity tariff, but that is not is doing, the privatised discos signed a multi year tarriff order some years back with the FG, which implies gradual increase in tariff, the recent increment in tariff was due just before the 2015 election, but the then govt impressed it on the discos to suspend till after elections.

From my assessment of Fasholas in his 4 months , he has a draft roadmap for the power sector 2. he has persuaded the discos to suspend service charges on consumer bills 3. he has been able to settle out of courts the protracted legal case that made 300,000 pre paid meters redundant in a ware house.

this news also adds another feather to the cap of his achievements . There are definitely many other goodies in the pipeline, this is not the time to play politics of hate, national election is not holding until late 2018 or early 2019. Apc nd pdp will settle scores then.

He is not the first power minister with no engineering qualification, the likes of Bola ige, liyel imoke, segun agagu e,t.c were once power ministers, but they flunked at their jobs.

I bet that by the time he is 18 months on that seat, most Nigerians will say he was a round peg in a round hole.

How many kilometers of federal roads has he added to the ones he inherited . What of light, he has left it in a worse situation than he met it. Yet electricity bills have been increased fraudulently. My over rated Super-Minister Fashola, that attack Tinubu directed on Kachikwu ought to have been directed at you. Cos so far you have been the worst minister in this admnistration. All the 3 ministries you over see are a failure right now.

In terms of Power, you inherited 4500 MW but in the last 3 months now its been like 1500MW. Yet you went ahead to increase the electricity tariff fraudulently and without moral and legal justification.

In terms of roads, how many kilometers of federal highway have you added to the existing ones since you took over. Yet you cry for new toll gates across the nation. Do you think the Country will allow you duplicate the fraud you and Tinubu did in Lekki toll gate which has now been abandoned in Ajah.

The Minister of Power, Works and Housing, Mr. Babatunde Fashola (SAN), says the National Leader of the All Progressives Congress, Asiwaju Bola Tinubu, made the impossible happen by ensuring that for the first time in Nigeria’s history, opposition parties successfully merged.

Fashola said this in a video tribute to commemorate Tinubu’s 64th birthday.

The minister, who was physically present at the colloquium held in Tinubu’s honour in Abuja, on Tuesday, said Nigeria was falling apart under former President Goodluck Jonathan, adding that Tinubu steered Nigeria away from the course of destruction.

Fashola said, “It was dangerous for Nigeria to keep that administration for another term and the evidence of that was before us. The country was falling apart. You must salute the courage, the passion, the foresight of Asiwaju to reach across and say ‘let us forge a partnership to save Nigerians, to save ourselves’.”

The minister added, “On whether or not there could be a merger, everyone said it wasn’t going to happen, it had never happened in the history of Nigeria and as far as that was concerned, it (the merger) was a victory that the impossible had become not only probable but possible and that was due to Asiwaju’s self conviction and, as I said, his ability to mobilise people and materials behind an idea.”

A Minister with a record of meeting Electricity at 4500 MW and brings it down to 1500 MW in a couple of months despite trippling the amount Nigerians pay for electricity. Only God will save us.
