Ibrahim Magu, suspended acting chairman of the Economic and Financial Crimes Commission (EFCC), has been sent back to area 10 force criminal investigation department (FCID) of the police in Abuja where he spent the night on Monday. A source disclosed this to TheCable, saying he was moved to detention at the end of questioning by the panel on Tuesday. He was arrested on Monday and whisked to the presidential villa in Abuja where the panel set up to probe the commission has been sitting. Some of the aides of the anti-graft czar had earlier moved his personal belongings out of his official residence in the Maitama area of the nation’s capital while security operatives raided his residence at Karu, still in Abuja. A family source said operatives of the Department of State Services (DSS) who carried out the operation found nothing incriminating in the house. Abubakar Malami, attorney-general of the federation (AGF), had asked President Muhammadu Buhari to sack Magu over some “weighty” allegations. Oluwarotimi Akeredolu, governor of Ondo state, has tested positive for COVID-19. Akeredolu disclosed his COVID-19 status on his Facebook page on Tuesday. The governor said he is already in self- isolation as required by the case management guidelines of the Nigeria Centre for Disease Control (NCDC) for someone who is asymptomatic. “Akeredolu tests positive for COVID-19. Earlier today, I got confirmation of a positive result for Covid-19. I am asymptomatic and not displaying any symptoms,” he said. “I am currently self-isolating and supervised home management will be administered by the wonderful team at our Infectious Disease Hospital. I ask that we all stay safe and be well.” Akeredolu joins a growing list of top public officers who have tested positive for the disease. The Court of Appeal, Lagos has affirmed the judgment of a Federal High Court, Lagosm which awarded about N5.959 billion in favour of the Musical Copyright Society of Nigeria (MCSN) against Multichoice Nigeria Limited as damages. The trio of Justices Ogbuinya Obande Festus, Gabriel Omoniyi Kolawole and Balkisu Bello Aliyu dismissed the appeal filed by Multichoice Nigeria Limited on ground of being unmeritorious. They noted that the appeal sought re- visitation and alteration of the judgment to reflect mathematical calculation of special damages against the appellant and that it was totally divorced from seeking a reversal of the entire judgment. The trial justices agreed that the application of the respondent has merit and succeeds and varied the special damages awarded by the lower court to N5,450,152,125:00. Justice M.B. Idris, now of the Court of Appeal, had in his judgment in suit number FHC/L/ CS/1091/2011 delivered January 19, 2018, dismissed the suit filed by Multichoice Nigeria Limited and granted reliefs sought by MCSN. The court agreed with the respondents that the claimant infringed/exploited musical works, which made up its repertoire, by communicating them for the public, upon a fee, through satellite and pay TV broadcasting, without licence from nor payment of royalties to it. He upheld claims by MSCN that it was the owner, assignee and exclusive licensee of body of some musical works over the Nigerian territory. The court held that the musical works were assigned to it by two international organisations, Performing Rights Society (PRS) and Mechanical Copyright Protection Society (MCPS), by dint of two reciprocal representation agreements. Dissatisfied with the judgment of the court, Multichoice Nigeria Limited filed an appeal on January 1, 2018 and an amended notice of appeal dated September 10, 2018. Multichoice sought an order of the appellate court setting aside the judgment of the lower court delivered by Justice Idris on January 19, 2018. The appellant also sought an order of the appellate court striking out and dismissing the respondent’s counter claims with substantial costs. The parties were represented by M.I. Igbokwe (SAN) and Norrison Quakers (SAN) for the appellant and respondent respectively. In the appeal number CA/L/188/2018, heard March 12, 2020, Multichoice distilled nine issues for determination of the appellate court while the respondent, MCSN, distilled six issues.. In their judgment, the three-man panel of the Appeal Court resolved the nine issues distilled by the appellant in favour of the respondent. According to them, “the lower court judgment did not occasion a miscarriage of justice and that it carried out a meticulous and thorough analyses of the evidences viva voce and documentary and attached deserving probative weight for the respective evidence offered by the parties.” The Appeal Court held that the lower court paid due fidelity to the law when it awarded the damages in the case. The upper court also held: “ That the evidence of the respondent, based on their qualitative nature, preponderated over those of the appellant and that the respondent proved its case.” They further held that the judgment of the lower court “is not antithetical to the pleadings and evidences presented before it by the feuding parties. “The lower court did not import alien/foreign matters into the judgment. It utilised the evidences of parties presented before it as adumbrated above. The findings do not, in the least, smell of any change of perversity leveled against it by the appellant.” They furthe held: “The fate of the appeal is obvious. It is bereft of any grain of merit and deserves the penalty of dismissal.” Consequently, they dismissed the appeal and affirmed the decision of the lower court. Addressing a virtual press conference on the judgment, MSCN Chief Executive Officer (CEO) Mayowa Ayilaran said the judgment of the Court of Appeal affirmed MCSN’s proprietary right in musical works and sound recordings and it should be duly compensated for the exploitation of the works by users such as Multichoice Nigeria Limited. Ayilaran stated that the judgment also affirmed the legal standing of MCSN and the right of action which it acquired long before the Nigerian Copyright Commission (NCC) was established or the enactment of the Copyright Act 2004. He said with the decisions of various courts, including “Suit Nos. FHC/L/CS/61/2007: Performing and Mechanical Rights Society of Nigeria Ltd/Gte (PMRS) vs. Nigerian Copyright Commission & Ors, delivered on 4th June 2007 and FHC/L/CS/1259/2017: Copyright Society of Nigeria Ltd/Gte vs. Musical Copyright Society of Nigeria Ltd/Gte & Ors., delivered on February 13, 2018, NCC and MCSN now have the opportunity to create the desired harmonious relationships in the administration and enforcement of copyright in Nigeria by working to harmonise the collective management of copyright. “MCSN with the support of the NCC shall take the first major step in realising this objective through a major project of deploying the desired technology in the administration of licensing, tracking, monitoring, collection and distribution of royalties in the coming few days”, he said. https://thenationonlineng.net/appeal-court-affirms-n5-9b-judgment-against-multichoice-nigeria-2/ |

Iran has issued an arrest warrant and asked Interpol for help in detaining US President Donald Trump and dozens of others over the drone strike that killed a top Iranian general in Baghdad. Tehran prosecutor Ali Alqasimehr said on Monday, June 29, that Trump and more than 30 others who Iran accuses of involvement in the January 3 strike that killed General Qassem Soleimani face "murder and terrorism charges", the semi-official ISNA news agency reported. Apart from Trump's name, Alqasimehr did not identify the other suspects. He stressed that Iran would continue to pursue Trump's prosecution even after his presidency ends. Alqasimehr also was quoted as saying that Iran requested a "red notice" be put out for Trump and the others, which represents the highest level arrest request issued by Interpol. Local authorities end up making the arrests on behalf of the country that request it. The notices cannot force countries to arrest or extradite suspects, but can put government leaders on the spot and limit suspects' travel, according to Al Jazeera. In January, the US killed General Soleimani, who oversaw the Revolutionary Guard's expeditionary Quds Force, and others in an air strike near Baghdad International Airport. The air strike came after months of incidents raising tensions between the two countries. Ahead of the planned reopening of its borders to international travelers on July 1, the European Union Commission has released a list of 54 countries that qualify for travels into Europe and Nigeria is conspicuously absent. Schengenvisainfo.com reports that citizens from Nigeria, Brazil, Qatar, the US and Russia would not be allowed to travel into Europe until such a time when the epidemiological situation in their countries with regards to COVID-19 improves. According to the report, the countries whose citizens have been granted permits into Europe include Albania, Algeria, Andorra, Angola, Australia, Bahamas, Bhutan, Bosnia and Herzegovina and Canada. The Association of Hospital and Administrative Pharmacists of Nigeria says cannabis is the most commonly abused drug with an estimated 10. 8 per cent of the population said to have used it in 2019 . The Abuja branch of the association, said on Friday that one in every five Nigerians who had used drugs in 2019 now suffered from drug use disorders. The chairman of AHAPN , Abuja branch, Abubakar Danraka , explained this in a release on the 2020 International Day Against Drug Abuse and Illicit Trafficking, under the theme, ‘ Better Knowledge for Better Care. ’ He said , “ In Nigeria , the 2018 United Nations Office on Drugs and Crime drug use report in Nigeria revealed that one in seven persons aged 15 to 64 years had used a psychoactive substance – a drug other than tobacco and alcohol for non -medical purposes in 2017. “One in five persons who had used drugs in the past year is suffering from drug use disorders. Also, cannabis is the most commonly used drug of abuse, with an estimated 10 .8 per cent of the population using it in 2019 . The average age of initiation of cannabis use among the general population was 19 years. “We use the platform to call on Nigerians to join hands with pharmacists and other health experts to understand the psychology of drug addiction . Nemesis caught up with the 26-year-old sales boy who for the past 12 months has taken turns to defile the 11-year-old twin daughters of his employer. He was employed as a sales boy in a restaurant but rather than concentrating his energy on serving customers, for a whole year, he was busy defiling the twin daughters of his employer right inside the canteen. Nemesis however caught up with the 26-year-old sales boy in Lagos, Chinedu Obi who for the past 12 months has taken turns to defile the 11-year-old twin daughters of his employer. His atrocity was exposed when his madam who had gone to Ijesha market in Surulere area of the state came back to the restaurant early and met him busy with one of the twins. She raised the alarm and invited the police who moved in and arrested the suspect. The state police command spokesman, DSP Bala Elkana who confirmed the incident said that the suspect was arrested on June 16, 2020 as soon the mother of the victims alerted the police. The mother of the victims (Names withheld) who owns a restaurant in Surulere told the police that the suspect who is her sales boy defiled her daughters repeatedly. She said she got to know about it when she returned from the market and overheard the twins fighting over the sharing formula of N200 given to them by the suspect. The twins confessed to her after much pressure. She told the police that the suspect was treated as part of the family hence the closeness to her children. Devil to blame A native of Umuaka in Imo state, Chinedu blamed the devil for his act. According to him, “Sometime in 2018, I relocated to Lagos in search of greener pasture. Luckily, I met one Calabar woman who owns a restaurant at Soluowu Street in Surulere. She employed me as a sales boy and the agreement was that she would pay me N400 everyday and feed me. I used to resume work around 6am everyday and close for the day at about 8pm. My whole life was dedicated to that job that I did not have the opportunity to toast a woman. “I am a man that has been sex-starved, that was why sometime in June last year I decided to try my luck with my madam’s daughters. She has twins and they are girls. They used to come to the shop to stay after school and during this Coronavirus period, they are always around. It all started sometime in June last year when they were in primary 5. “I was so close to the family that the children were free with me and take me as their elder brother. One day, they came straight to the shop and one of the twins not minding that I was there removed her school uniform and changed into another one. This was when the devil took over my senses. I have not had sex for so long time, so I was moved. I waited for an opportunity when she was alone and told her that I will be giving her plenty of money if she will allow me to have sex with her. I was surprised that she agreed without making noise, we quickly did it behind the counter; I cleaned her up and gave her N200. “I was shocked when her twin sister came to me and pulled up her dress. She said that I should do the same thing with her because she also wants her own money. I had no choice but to also have sex with her for fear that she will tell her mother. “All I did was to always divide the money into two and give to them. I even wanted to stop when my madam started suspecting that I was having sex with her daughters. The twins started bleeding and I did not understand what was happening to them. I thought it was because of the sex and asked them to use tissue or paper to clean the blood. My mother only gave birth to boys, so I did not understand that they have started their monthly menstruation. “When their mother noticed the blood she was surprised because they were only ten years then. She confronted them if they have started having sex and they kept quiet and she warned me to stop if that was the case. I denied it and that matter ended then. I actually stopped till the twins started throwing themselves at me again. Their mother doesn’t give them money so they were always coming to me. I became very careful because I knew that they could get pregnant. I started ejaculating on the floor because they are too young to get pregnant. I used to give them one drink to clear their system.” Abused and accused On how he managed to commit such evil acted undetected for a whole year, Chinedu said that the twins were taking turns to watch out for any person that might catch them while at it. “For the period, she did not catch us because the twins were working together. It is only in the shop that I can have sex with them, so what we normally do is that one person will be watching when we are doing it. As soon as I am done, they will switch. They will share the N200 I give. During this pandemic, I normally do it early in the morning when their mother had gone to Oyingbo market or later in the evening when customers no longer come. Then my madam must have gone home to prepare food for her husband. She will leave the twins with me to help me clean up, it is then that I will take advantage and have sex with both of them.” Wits end On how he was finally caught, Chinedu said that because of the lockdown he could rarely get the opportunity to touch the twins as their mother or a relative was always around. “Since the pandemic started, I rarely have opportunity to do anything. So when madam decided to go to the Ijesha market with one of the twins and left me with the other one and his son, I asked his son who is about seven years to watch outside the shop that we were busy inside. We quickly did it but unfortunately madam came back when we were about to finish. It was the boy that told her that his sister and I were playing inside. So the other twin who knew what we were doing rushed in and started shouting that she wants her own money. The twin with me refused and the noise attracted my madam’s attention. “She started beating the twins to tell her what the argument was about and they told her. I begged my madam to forgive me but she raised alarm and people gathered. This was how they called the police.” Plea for mercy Begging for mercy, Chinedu promised to stay away from the twins if set free. “I am very sorry. I was told that my madam has agreed to forgive me but the policemen that arrested me are insisting that they will charge me to court. After spending days in police cell, I now understand that what I did is bad. I will not allow anyone to defile my daughter. I don’t want to marry them because they are small but in the next seven years, they will be 18, that means that I can select one and marry. Nigerians have taken to Twitter to blast the FBI for a tweet where the bureau focused on the 6 Nigerians wanted for scam on a list where there are more numbers of suspects from other nationalities. The FBI shared photos of the 6 Nigerian fugitives on their wanted list and tweeted on Friday: "Help the #FBI find ?six Nigerian nationals wanted for their involvement in ? Business? email ?compromise (BEC) schemes resulting in over $6 ?million in losses. Read more about each defendant and submit tips at http://tips.fbi.gov. #FugitiveFriday." However, on the full wanted list, there are 20 Asians, 39 Arabs, 16 Russians and more. The FBI did not mention the other scammers and their nationality, even though they have a larger number, instead they focused on the 6 Nigerian scammers and this angered people. Nigerians took to Twitter to blast the FBI for continuing to further the stereotype that only Nigerians are fraudsters, whereas people from other nationalities do worse. Some pointed out that people wouldn't even know that there are fraudsters from other nationalities involved if they do not click the link to read further. The burial of Abiola Ajimobi, former governor of Oyo state, will take place on Sunday. Ajimobi died of COVID-19 complications in Lagos on Thursday. The burial was initially scheduled to hold on Friday, but according to Bolaji Tunji, special assistant on media to the governor, the event was postponed following consultations with the governments of Lagos and Oyo. In a statement on Friday, Tunji said the burial will be held in line with the existing protocol issued by the presidential task force (PTF) on COVID-19. “In close consultation with the governments of Lagos and Oyo States, the date for the burial ceremony has been announced. Barring any changes, his body will be interred at the Senator Ishaq Abiola Ajimobi Central Mosque at Oke Ado, Ibadan at 12noon on Sunday, the 28th of June, 2020, after the traditional Muslim prayers,” the statement read. “To ensure that strict COVID-19 protocols are adhered to and in light of the current circumstances of our national health challenges, the family appeals to the public to observe strict adherence to COVID-19 protocols in their participation. “Furthermore, details of the live media coverage of the funeral ceremony will be made public by tomorrow. “In the near future, details of a larger funeral gathering will be announced where a lot more of his well wishers will have the opportunity to pay him their respect.” Ajimobi was governor of Oyo from 2011 till 2019, when he completed his second term in office. Bulama stopped at the gate of the secretariat by police officers. The National Secretary of the Senator Ajimobi- led National Working Committee of the All Progressives Congress, Waziri Bulama, was among those prevented from entering the National Secretariat of the party, The PUNCH reports. Bulama, who arrived at the Secretariat about 10:50 am in a black Toyota Land Cruiser Sports Utility Vehicle with registration number Abuja, Abj-140DN, was stopped at the gate by armed policemen on duty. He stepped out of his vehicle, asked for the leader of the team, and later called the FCT Commissioner of Police. In a brief interview with reporters, Bulama said, “I came here this morning to resume work and met policemen who said they have instructions from above to seal the secretariat. “I have called the commissioner of police and he said he is sending a senior officer to see what is happening. “The workers of the secretariat are servicing over 16 million members of this party across Nigeria. Members of the All Progressives Congress (APC) national working committee (NWC) loyal to Adams Oshiomhole, suspended national chairman of the party, have rejected the invitation to attend the national executive committee (NEC) convened by Victor Giadom. Giadom had picked the presidential villa as the venue of the meeting, saying only NEC could solve the party’s crisis. President Muhammadu Buhari, who has thrown his weight behind Giadom, has promised to attend the NEC meeting. But in a statement on Wednesday, Hillard Eta, vice-chairman of the APC (south-south) and Waziri Bulama, acting national secretary, said an emergency NWC meeting held after Buhari declared support for Giadom. He said after the meeting which lasted for about four hours, they resolved that attending the NEC meeting will amount to “embracing illegalities and turning a blind eye to the infractions on the constitution of the party”. “We wish to unequivocally state that members of the National Working Committee (NWC) believe that the President was offered wrong advice or blackmailed into lending his weighty office to the illegality of the National Executive Committee meeting purportedly convened by one Victor Giadom on 25th June, 2020,” the statement read. “We hereby respectfully implore Mr. President to kindly avail himself with facts of the matter regarding the impasse presently experienced by the party so as to guide him in his assessment of the matter because we are sure that the President, if properly advised, would come to the conclusion that the meeting convened by Chief Victor Giadom bothers on illegality and criminality. “The National Working Committee (NWC) regrets to turn down the invitation to the illegal and unconstitutional National Executive Committee (NEC) convened by Chief Victor Giadom. We believe that attending such a meeting will amount to embracing illegalities and turning a blind eye to the infractions on the Constitution of our great Party.” When he featured on a Channels Television programme earlier in the day, Gaidom had said he was worried that some leaders of the party were not willing to surrender to the NEC . Ibrahim Tanko Muhammad, chief justice of Nigeria (CJN), has sworn in Monica Dongban-Mensem as the president of the court of appeal. At the swearing-in ceremony in Abuja on Friday, Muhammed asked Dongban- Mensem to live up to expectations by maintaining a cordial relationship with her colleagues on the court of appeal bench. The CJN specifically asked her to have regular meetings with presiding justices in all divisions of the court to enable her to understand the challenges that the court may be facing. He reminded the new appeal court president that the court has the largest number of justices in the country, hence the need to be diligent in her duties. “From my personal experience, workload in the court of appeal, especially in the divisions, is the highest,” the CJN said. “It is a home of work, it is a home of cooperation, but with your experience, hardwork, and zeal, you will not find your new status difficult.” The appeal court president assured Nigerians that she will do her best in ensuring that justice continues to prevail at the court. “I will build on the legacy left behind by her predecessors,” she added. Dongban-Mensem was acting appeal court president until recently when her appointment was confirmed by the senate following a request from President Muhammadu Buhari.
