Mayeldah:You seem to be out of touch with reality about the church and how things work. You appear to have chosen the wrong side of the divide and stuck to it. If the church does not draw members to it, how can the word spread and how can the church give to those who are in need? You are a Christian either because your parents are or that someone shared the message with you. Without coming under that roof, how do you expect to enjoy the benefits? Are you not aware that many sell their belongings to donate, as it was in the old days? No one compels anyone. They are moved of their own volition to do it. Do you understand what the word scam is? If the schools were “scam” as you said, how are they still functioning and dishing out quality education to students? Who has been defrauded. Are you not aware that all Christian schools award scholarships to the less privileged? If I freely give you money, should I go round to say that the same money still belongs to me, and arising from that I MUST have an entitlement from whatever you do with the money? If you have donated in your local church or given your offerings, whatever happens thereafter to the usage no longer is your business. If you want your children to attend the schools, then you must either pay the fees or go through the scholarship door. The early church brought schools, called missionary schools and all the fees were paid. Go and check please. Students paid schools fees, boarding fees and also for books. You may please ask the older generation around you for the fact. None of the schools were for free. And by the way, why are they still not for free today? Please go around and find out that the church gives employment, pays bills and gives plenty financial handouts daily. |

The Nigerian economy cannot in anyway be compared with the economies of the top countries. However that does not make Nigerians less givers than citizens of other countries. If our currency is at par with their, our giving will definitely match and surpass theirs. Let’s not abuse ours. The same purse into which members and others contributed, was opened to give away to people. If your church does not give assistance to indigent members, then it is either that you are not well informed or you have not been in the position to seek for help. Perhaps your church is small and not able to afford such requirements on a large scale. We have been told by several political leaders that education is expensive and not for the poor. Nothing has been done to them, yet we choose the church to accuse of making school fees very high. Do not forget that the church gives quality education and prepare the children for better future. The schools also are more secured and safer for children. That’s why there is a very high demand for such schools by people of all religious inclinations. Churches have scholarships for those who are not able to afford it. You can find that out on your own. All the churches do it. All the churches do giveaways daily. You make the mistake of wanting all that are done to be publicized. If you do not see publicity do not term it as a failure. The young man in the UK simply chose to blow the trumpet of the church - which he visited out of his lack - as against the truth of what happens daily in terms of giving by the church. By the way, nobody fleeces anybody. How you spend you money, is entirely your businesses. What you believe in, may work for you. It is therefore your choice to give your money in your church or religious organization. Lastly, I wonder why it is only “Christians” who say so much negatives and lies against themselves. I do not see Moslems (with due respect) or traditional worshippers doing the same. On this platform, the Islam pages are only for those who are of the faith, and I absolutely agree with that. There is plenty of respect, decorum and fear. |

BALLOSKI:The then majority leader of the Rivers State House of Assembly, Honorable Edison Ehie was declared suspended by Amaewhule. Over twenty members of the Rivers State House of Assembly allegedly supported the suspension. The House also suspended six other members including the House of Assembly members for Opobo Nkoro, Degema, Bonny. The speaker of the house, Martin Amaewhule who announced the suspension following confirmation by others supporters, accused Ehie and others of masterminding the burning of the Assembly Complex Sunday night. The House also announced the impeachment process of governor Siminalayi Fubara, a position which provoked the supporters of the governor and leader of the House to go on rampage forcing members to leave the Assembly Complex. Governor Fubara who later arrived the Assembly Complex after the twenty-four members had left, described everything executed by the Speaker of the House of Assembly and some other members as null and void. Following the above, Ehie became a factional speaker and led the group of four. Amaewhule and his other group, comprising of the other supposedly suspended six, who became the famous 27 decamped to APC. You may ask now, if Ehie was legitimately suspended, how is it that the other 6 suspended along with Ehie were reabsorbed unceremoniously into the famous 27, now known as former lawmakers? Where then is the technicality? Again, now that they have lost their seats constitutionally, what else is there to do? We are waiting for INEC to do the needful, otherwise we will hold it that APC has clearly chosen to set aside the constitution. |

Jackiedemie:Nooo bros, it is not. Background: It is important to stress how the Constitution views candidates nominated on a political platform and those elected to office. The power to sponsor candidates in an election is the sole preserve of a political party and the power cannot be challenged by the Independent National Electoral Commission. However, this power must be exercised under laid down rules and regulations considering the amendment to the Electoral Act and recent judicial decisions. Therefore, the votes gotten by any candidate in an election are those of the sponsor, which is the political party. The Implication The Nigerian constitution is clear on what to follow when members of the State House of Assembly defect to another political party. The Constitution in section 68(1) states that “a member of the Senate or the House of Representatives shall vacate his seat in the House of which he is a member if – (g) Being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected; Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored.” The question to ask then is whether the PDP in Rivers state or at the National Level has been factionalized or what indeed constitutes a division in a political party. Worth mentioning, however, is that the PDP in a statement signed by its National Publicity Secretary, Hon Debo Ologunagba, demanded that “the Speaker of the Rivers State House Assembly immediately comply with the provision of the Constitution by declaring the seats of the 27 former lawmakers vacant.” What constitutes division in a political party? In the case of Sunday Ifedayo Abegunde v Ondo State House of Assembly & Ors, the Court of Appeal in its ruling stated that “the person defecting to another party must prove that the party he is leaving has been divided into two or more. That is to say, the party must be so polarized as to have two chairmen, two or three different Boards of Trustees each claiming to be the authentic one and each still bearing the same party name. That is the type of extreme division envisaged by the Constitution. The defector would also be covered by the proviso where the party has split into two whereby one of the factions is bearing another name and he chose to join the faction of the party with the new name.” To avoid any ambiguity, the Appeal Court also held that “A community reading of sections 221, 222, 229 of the Constitution as well as section 80 of the Electoral Act, clearly shows that the division envisaged by section 68(1)(g) of the Constitution refers to division in the party at the top or centre not division at the State or Local Government level. Since a political party is recognized as one corporate entity, the division must affect the entire structure of the political party at the centre, i.e., the national leadership of the party. A political party has to be looked at as a whole and not piecemeal.” Considering the tendencies, and even excesses of Nigeria politicians, where members seeking to defect from a party could themselves instigate a division, the Supreme Court held in FEDECO v Goni that the act leading to the defection must not have been caused by the defecting legislator. Way forward The 27 lawmakers in Rivers State cannot benefit from an act of illegality. Being lawmakers themselves, they must hold themselves to a higher standard and tow the path of honour: to vacate office and seek re-election. |
Meanwhile Fubara has left the court eviction battle of the now 26 members to PDP and INEC. I wonder which house seats and how the now resigned commissioners will return to their positions. |
Jackiedemie:You have not understood it. See, the moment the lawmakers decamped, they lost their seats. That's the law. The only exception is a division in the party. That's the law too. Once the 27 decamped, a vacuum arose in the house. The four elected the speaker and continued the business of the house. Be ause they got the order from a court of competent jurisdiction in Rivers State, all actions they took were termed legal. As the speaker recognized, the actions of Ehie were valid. Now you must ask why the 27 went to court to stop the four along with INEC and PDP from ensuring that they do not return to the house. The matter presently remains in court. |

Lawmakers make laws and they should abide by the same laws. Decamping instantly removes them from the house, except in the grounds of division in their party. Is there any division in PDP Rivers State? No is the answer. There is also no division at the national level. Rivers State faces s constitutional problem. What's on ground is greater than Tinubu's advice. The 27 have not reverted to PDP and now PDP is in court trying to ensure that they never return. Certainly the 27 have their right to justice where possible. However the law is the law. They are gone. In this case, who is greater. The existing 4 or the none existing 27? |

OP, as it stands, it is a constitutional matter. The issue is in court, with PDP insisting that the 27 seats have become vacant by reason of the decamping. Once again, note that the agreement was not in anyway binding on any of the parties. By the constitution, it remains incontrovertible that the 27 resigned. Ehie acting in his then position as the speaker recognized by a court order. All actions taken by Ehie in his then capacity as the speaker, therefore, are termed legal. |

More so do not forget that even the APC itself has been factionalized at the state level. When a party is factionalized, you find the positions in two or more different factions. Can you say that was the case in Rivers state? Certainly not. PDP is already in court over the matter of the decamping of the 27. The constitution is clear on what should happen to them. |
