A former Argos security guard from North London is set to become the president of Gambia in an unprecedented upset for president Yahya Jammeh who had pledged to rule for a billion years. President Jammeh, who has ruled the tiny West African nation for 22 years since he staged a coup, conceded defeat to opposition leader Adama Barrow, the chairman of the electoral commission on Friday morning. "It's really unique that someone who has been ruling this country for so long has accepted defeat," Alieu Momar Njie told reporters. Gambian state television told AFP that the 51-year-old head of state, who seized power in a coup in 1994, would make a statement later in the day to congratulate Barrow. Jammeh was running for a fifth term with his Alliance for Patriotic Reorientation and Construction (APRC), while Barrow ran for eight political groups who united for the first time to field a single candidate. Barrow, a previously unknown businessman, once worked as a security guard at Argos on Holloway Road, North London. On Thursday, after voting with his wife in the capital, Banjul, President Jammeh predicted a decisive win. "This will be the biggest landslide in the history of the country," he said, but Barrow correctly predicted Gambians were ready for change after more than 20 years of the Jammeh regime. "He is not going to be re-elected - his era is finished," Barrow said. Jammeh came to power in a coup in 1994 and then swept elections in 1996, 2001, 2006 and 2011 after a 2002 constitutional amendment removed presidential term limits. Critics say those elections were not free and fair and accused his regime of corruption and flagrant human rights abuses. The president's supporters praised his efforts to boost economic development in the small country that is dependent on tourism and agriculture. More than 880,000 voters were registered to participate at more than 1,400 polling stations, where they were asked to place a marble in either a green, silver or purple drum depending upon their choice. The African Union sent a handful of observers to this country of 1.9 million but there are no observers from the European Union or the West African regional bloc ECOWAS because the Gambian government did not grant them accreditation. Jammeh said before the vote that he would not allow even peaceful demonstrations, dismissing them as "loopholes that are used to destabilise African governments." In a statement Thursday, rights groups criticised the circumstances under which the vote took place, especially the cutting of internet services and international calls. The naira on Tuesday, November 22, dropped N5 at the parallel market to trade at N470 against the dollar, while Pound Sterling and Euro exchanged at N565 and N495 respectively. According to currency traders, the uneasy calm in the market had prevailed due to the raid by officials of the Department of State Security in some parts of the country. Dollar to Naira Officials of the DSS raided the parallel markets in Lagos, Abuja and Onitsha last week over alleged arbitrary sale of forex. But unfortunately, the raid has worsened dollar scarcity, forcing the naira to settle at N470 to a dollar. However, the Central Bank of Nigeria (CBN) has endorsed the crackdown on parallel market forex traders. The CBN Governor, Godwin Emefiele, disclosed this while addressing journalists at the end of its Monetary Policy Committee (MPC) meeting in Abuja on Tuesday, November 22. According to Emefiele, the foreign exchange regulation in the country forbids trafficking in currency. He said that the SSS had the right to enforce the law and make sure that currency hawkers were forced out of the “illegal trade.’’ The governor, who said it was demeaning for traders to hawk currency on the streets, urged the traders to legitimise their business by applying for Bureau De Change (BDC) licence. That is to say he is one that is prepared to sacrifice everything and anything for his beliefs, his people and his cause. “Like the great Scottish freedom fighter William Wallace I have no doubt that if he deemed it necessary he would go as far as to sacrifice his very life in the struggle for freedom and independence for his Igbo people from the Nigerian state and from our internal colonial masters and for the establishment of his beloved Biafra. “Not all may agree with him on that course but they must respect his determination, passion and courage. “Very few Nigerian leaders have that level of selflessness and commitment to any cause and, simply put, I admire it. “I looked deeply into his eyes as we spoke and I touched and weighed his soul. “I can tell you, without any fear of contradiction, that he is a profoundly good man who loves his Igbo people deeply. “He is also well-educated and widely-read and he is a formidable intellectual. “We may not have agreed on everything but I can tell you this much: we share an aversion to the spread of radical Islam and terror in Nigeria and indeed throughout the world. “We also share deep concerns about the oppression of our people by the state, the vicious persecution and desperate attempt to silence all the voices of the opposition in our country, the marginalisation and suppression of the good people and ethnic nationalities of the south and the Middle Belt, the implementation of a plainly racist and apartheid-like agenda by our government, the regular and consistent practice of genocide by our security forces, the rise in power and increasing callousness and brutality of the Fulani miltias and herdsmen in our midst, the not so hidden agenda to Islamise our nation and violate the secularity of our state, the violation of court orders, the brazen intimidation of the Judiciary and the resort to the most barbarous and hideous form of gestapo tactics, tyranny and human rights abuses by the Buhari administration. “I can also tell you that he feels and shares the pain of the Igbo and he yearns for their liberation and emanciption from an increasingly hostile and oppressive Nigerian state. “He is not a politician in the true sense of the word but rather a freedom fighter and a charissmatic leader who has managed to inspire millions of Igbo youth all over the world to once again have faith in themselves and their collective cause and aspirations. In my view that is a good thing. “I can also tell you this: he is a man of great faith and conviction and his rise to prominence is not ordinary but instead prophetic. “He cannot be destroyed or silenced by any government or man born of woman because the Lord is with him and He is using him. He is using him to say and do the things that many believe but that are too scared to say or do. “Other leaders have had their time in the past and now this is his. He is paying a very heavy price right now for what God will use him for in the future. “I recognise that fact and I sincerely hope and pray that his Igbo people will come to appreciate him and do so as well. “Very few leaders can or would be willing to take the pain and make the kind of sacrifice that this man is making today. “I am a very cautious and circumspect person and it takes me a while to warm to people or for them to win my confidence. Yet this case was different. “Nnamdi and I, rather like Che Guevera and Fidel Castro at the beginning of the Cuban revolution, connected immediately and he won my trust, respect and admiration. “If there is anyone that can truly build the much needed bridge between the south-west, the south-south and the south-east it is Nnamdi Kanu. “This is because he is pragmatic and sincere. It is because he is respectful and accomodating of alternative points of view and dissenting opinions and he speaks from a position of knowledge and strength. It ibecause he is very proud of his Igbo heritage and he would never betray his people or prostitute his principles. “The truth is that he is not just a combination of Owelle Nnamdi Azikwe and Dim Emeka Odumegwu-Ojukwu: he is a combination of Azikwe, Ojukwu AND Major Kaduna Nzeogwu all rolled into one. “The fire of revolution and the yearning for fundamental and equitable change burns in his blood and resides in his bones. “He has spoken up for, defended and fought for the preservation and dignity of his people just as those other three leaders did in the past at different times in our history. “He also serves as a rallying point for Igbo nationalism, the fight for self-determination of the people of the east and the establishment of the sovereign state of Biafra. “His love, remarkable courage and sheer passion for his people and their cause is boundless and unfathomable. “The Igbo is blessed to have him as one of the most respected and reverred leaders in our entire history as a nation. “They would do well to appreciate him more, pray for him, stand up for him, line up behind him and insist that the government honors the numerous court orders that have granted him bail and release him from prison. “Why? Because he bleeds and suffers for their collective cause and he is sacrificing all to remove their shame and lift their pain. “What a man he is. What a mighty spirit. What a beautiful soul. What a braveheart. “Permit me to conclude this contribution with the following observations. “All over the world today the concept of political correctness has been discredited and rejected. Consequently right-wing nationalist and ultra-nationalist groups and political parties are rising up and regaining credibility and power. “In the United Kingdom we have the Nick Farage’s of this world and his UKIP whose magnificent efforts resulted in Brexit. In France we have the Marie Le Pen’s and her National Front. In Hungary we have the Viktor Orban’s and his Fidesz party. “In the United States of America we have the Donald Trump’s and his new and redefined Republican party. “We also have plain-speaking and honest men like Michael Flynn, who has just been appointed as Trump’s National Security Advisor. “Political parties with a similar ideology and that are led by equally strong-willed, focused and charissmatic figures are also making great waves and slowly gaining more power and relevance in Italy, Germany, Austria, Holland, Greece, Belgium, Hungary, Russia, the Phillipines, Israel and indeed all over the world. “Thankfully Nigeria has not been left out. 15 NOVEMBER 2016 • 9:51AM A busy stretch of road in the Japanese city of Fukuoka has been reopened just days after the sudden emergence of a giant sinkhole which threatened to topple nearby buildings. The massive hole – which was roughly half the size of an Olympic swimming pool – opened up during construction work on the city's underground network. In typical Japanese fashion, an earnest apology was issued immediately for the disruption, and a group of men put to work around the clock to clear up the mess. Just two days later, there is barely any sign that the sinkhole ever existed, construction workers having filled it in with generous amounts of cement before painting over the tarmac. Soichiro Takashima, the mayor of Fukuoka, even claimed the street was now 30 times stronger than before and said a panel of experts was being called in to establish what went wrong in the first place. We’re very sorry for causing great trouble," he added. The busy street where the hole emerged was reopened for traffic at 5am on Tuesday morning, with a fresh set of power and gas lines installed beneath it. It marks the latest example of Japan's remarkable efficiency in fixing problems with infrastructure – something that did not go unnoticed by British users of social media on Tuesday. Republican president-elect Donald Trump has said he will not accept a salary for being president. Questions have swirled concerning what'll happen to Trump's income in the wake of his winning the 2016 US presidential election, CBS News reported on Friday. Trump said at a September 17, 2015, event in Rochester, New Hampshire: 'The first thing I'm going to do is tell you that if I'm elected president, I'm accepting no salary, okay? That's not a big deal for me.' Someone on Twitter asked Trump in a Q & A session, a video of which was posted on Trump's Twitter account on September 21, 2015: '@realDonaldTrump, will you forgo the presidential salary if elected?' Trump answered: 'As far as the salary is concerned — I won't take even one dollar. I am totally giving up my salary if I become president. In the same video, Trump said he was 'totally self-funding' his campaign and said that he 'won't take money other than the small stuff'. However, he later started fundraising for both himself and the Republican National Committee, Business Insider pointed out. As of Friday, Forbes estimates that Trump's net worth is $3.7billion. Herbert Hoover, who made millions of dollars in mining before becoming president in 1929, and John F. Kennedy, who came from a wealthy family and became president in 1961, both donated their presidential salaries to charity. The US Code says on its website: 'The President shall receive in full for his services during the term for which he shall have been elected compensation in the aggregate amount of $400,000 a year, to be paid monthly, and in addition an expense allowance of $50,000 to assist in defraying expenses relating to or resulting from the discharge of his official duties.' "As the sixth largest economy in the world, California is more economically powerful than France and has a population larger than Poland. Point-by-point, California compares and competes with countries, not just the 49 other states," the campaign's website said. The #calexit name stems from the successful "brexit" campaign in Britain to leave the European Union. While the Yes Campaign has been considered a fringe movement in the past, it began trending on social media Wednesday night attracting more mainstream notice. Supporters are proposing a referendum on the issue in 2019. From eight glasses of water a day to protein shakes, we're bombarded with messages about we should drink and when, especially during exercise. But these drinking dogmas are relatively new. For example, in the 1970s, marathon runners were discouraged from drinking fluids for fear that it would slow them down. Now we're obsessed with staying hydrated when we exercise, not just with water but with specialist drinks that claim to do a better job of preventing dehydration and even improve athletic performance. Yet the evidence for these drinks' benefits is actually quite limited. They might even be bad for your health in some instances. So how did sports drinks come to be seen as so important? Much of the focus on hydration can be traced back to the boom in road running, which began with the New York marathon in the 70s. Sports and drinks manufacturers spotted a growing market and launched specialist products for would-be athletes. The first experimental batch of Gatorade sports drink cost £28 to produce but has spawned an industry with sales of around £260m a year in the UK alone. And consumption is increasing steadily, making it the fastest-growing sector in the UK soft drinks market in recent years. What started life as a mixture of simple kitchen food stuffs has become an 'essential piece of sporting equipment'. The key behind this huge rise in sports drinks lies in the coupling of science with creative marketing. An investigation by the British Medical Journal has found that drinks companies started sponsoring scientists to carry out research on hydration, which spawned a whole new area of science. These same scientists advise influential sports medicine organisations, developing guidelines that have filtered down to health advice from bodies such as the European Food Safety Authority and the International Olympic Committee. Such advice has helped spread fear about the dangers of dehydration. One of industry's greatest successes was to pass off the idea that the body's natural thirst system is not a perfect mechanism for detecting and responding to dehydration. These include claims that: 'The human thirst mechanism is an inaccurate short-term indicator of fluid needs … Unfortunately, there is no clear physiological signal that dehydration is occurring.' As a result, healthcare organisations routinely give advice to ignore your natural thirst mechanism. Diabetes UK, for example, advises: 'Drink small amounts frequently, even if you are not thirsty — approximately 150 ml of fluid every 15 minutes — because dehydration dramatically affects performance.' Drinks manufacturers claim that the sodium in sports drinks make you feel thirstier, encouraging you to consume a higher volume of liquid compared with drinking water. They also claim these drinks enable you to retain more liquid once you've consumed it, based on the observation that the carbohydrates found in the drinks aid water absorption from the small intestine. This implies that your thirst mechanism needs enhancing to encourage you to drink enough. But research actually shows natural thirst is a more reliable trigger. A review of research on time trial cyclists concluded that relying on thirst to gauge the need for fluid replacement was the best strategy. This 'meta-analysis' showed for the first time that drinking according to how thirsty you are will maximise your endurance performance. On top of this, many of the claims about sports drinks are often repeated without reference to any evidence. A British Medical Journal review screened 1,035 web pages on sports drinks and identified 431 claims they enhanced athletic performance for a total of 104 different products. More than half the sites did not provide any references – and of the references that were given, they were unable to systematically identify strengths and weaknesses. Of the remaining half, 84 percent referred to studies judged to be at high risk of bias, only three were judged high quality and none referred to systematic reviews, which give the strongest form of evidence. One of the key problems with many of the studies into the benefits of sports drinks is that they recruit highly trained volunteers who sustain exercise at high intensity for long periods. But the vast majority of sports drink users train for very few hours per week or exercise at a relatively low intensity (for example walking instead of running during a race). This means the current evidence is not of sufficient quality to inform the public about benefits deriving from sport drinks. Even more importantly, as sports drinks rise in popularity among children, they may be contributing to obesity levels. A 500ml bottle of a sports drink typically contains around 20g of sugar (about five teapsoons' worth) and so represents a large amount of calories entering the body. But endorsements by elite athletes and claims of hydration benefits have meant sports drinks have shrugged off unhealthy associations in many people's eyes. One study found more than a quarter of American parents believe that sports drinks are healthy for children. That's not to say hydration research into different drinks isn't useful. For example, it could help identify which drinks help the body retain fluids in the longer term. This would be of real benefit in situations where athletes have limited access to fluids or can't take frequent toilet breaks. They carry garbage, but they are not there to dump the cargo. Instead, they deliver it to the plant’s special ovens, which burn it, providing heat to thousands of local homes. “The only fuel we use is waste,” says Christian Löwhagen, a spokesman for Renova, the local government-owned energy company operating the plant. “It provides one-third of heat for households in this region.” Across Sweden, 950,000 homes are heated by trash; this lowly resource also provides electricity for 260,000 homes across the country, according to statistics from Avfall Sverige, Sweden’s national waste-management association. With Swedes recycling almost half (47 percent) of their waste and using 52 percent to generate heat, less than 1 percent of garbage now ends up in the dump. “Sweden has the world’s best network of district heating plants” — essentially large ovens that use a variety of fuels to generate heat, which is then transported to consumers’ homes through a network of underground pipes — “and they’re well-suited for use of garbage,” says Adis Dzebo, an energy expert at the Stockholm Environment Institute. “By contrast, in many other countries the heat and electricity infrastructure is based on gas or other fossil fuels, so it’s not economical to start building plants that utilize garbage.” Here’s the problem: Swedes (as well as Germans, Danes, the Dutch and Belgians) have become so good at recycling that there’s no longer enough garbage to meet the heating plants’ needs. Sweden now has to import the trash that most other countries are trying to dispose of — some 800,000 tons in 2014, up from 550,000 tons in 2010, according to Avfall Sverige. Last year Renova brought in 100,000 tons of foreign garbage, mostly from Britain, in addition to the 435,000 tons supplied by Swedish municipalities. In Stockholm, energy provider Fortum also imports garbage, and in the southern city of Malmö, the Sysav energy company brought in 135,000 tons of waste from Norway and Britain last year, according to the company’s communications director, Gunilla Carlsson. That’s an almost 100 percent leap from the year before. “We try to stay up to date on where well-sorted garbage is available,” says Löwhagen. “We only use waste where all recyclable bits have been taken out. Militants vow to declare Niger Delta Republic on August 1 14:38 18/07/2016 Port Harcourt - A militant group in the Niger Delta, Adaka Boro Avengers (ABA) has said it had concluded arrangements with other militant groups to declare the Niger Delta region an independent republic on August 1. The militant group also gave the Federal Government an ultimatum to withdraw its personnel and establishment from the region before the date of its declaration of independence. It also ordered all northerners and people of the South West to vacate its territory. ABA in a statement issued on Sunday by General Edmos Ayayeibo, its spokesperson, mandated the Federal Government to use the three weeks’ notice to “move out all military personnel and all government agencies out of the Niger Delta,” and warned that “failure will lead to destruction of military barracks and personnel.” “We, the Adaka Boro Avengers and all the freedom fighters in the Niger Delta region have met and come to a conclusion that we are declaring the Niger Delta Republic three weeks from today July 18, 2016. “So we are by this notice calling on the Nigerian government to move out all military personnel and all government agencies out of the Niger Delta. Failure will lead to destruction of military barracks and personnel. There is tension in Abia State over who occupies the governorship seat. Dr. Uche Ogah is laying claim to the seat, having been issued a certificate of return by the Independent National Electoral Commission (INEC) following the verdict of the Federal High Court. But Dr. Okezie Ikpeazu insists he remains the governor having appealed the judgment. How can the stalemate be resolved? ADEBISI ONANUGA asked lawyers. All eyes are on Abia State to see how its political logjam will be resolved. It began with last Monday’s judgment by Justice Okon Abang of the Federal High Court in Abuja. He ordered Governor Okezie Ikpeazu to vacate office for allegedly giving false information in the form submitted to the Independent National Electoral Commission (INEC) by the Peoples Democratic Party (PDP) nominating him as its candidate for the April 11, 2015 governorship election. Justice Abang, in two separate judgments, ordered Ikpeazu to immediately vacate office. In one of the two suits before the court, the judge directed INEC to issue a certificate of return to the plaintiff, Uche Ogah, who was the first runner-up in the PDP governorship primary of December 8, 2014. The judge held that Ikpeazu lied on oath as regards payment of his personal income tax in the three years preceding the primary as required under Article 14(a) of the PDP Electoral Guidelines. He disqualified him as the PDP candidate on the basis of perjury. The court ruled that all votes credited to Ikpeazu in the primary by virtue of his non-qualification were wasted. The judge made a consequential order removing Ikpeazu from office and declaring Ogah as the validly-elected governor. Ikpeazu kicks Ikpeazu, through his legal team, headed for the Court of Appeal to challenge the judgment. He is praying the appellate court to set aside Justice Abang’s judgment. Despite the appeal, INEC issued Ogar with a certificate of return. The commission said it was obeying Justice Abang’s order. Ikpeazu obtained another order restraining the Chief Judge or any other judge from swearing in Ogah as governor. Justice Chibuzo Ahuchaogu of the Osisioma Ngwa High Court in Abia State, stopped the Chief Judge, the President of the Customary Court of Appeal and any other judiciary officer from swearing in Ogah. The judge was ruling on a Motion ex-parte filed by Ikpeazu through his counsel, Mr. O. O. Nkume, pursuant to Section 143 (1) & (2) of the Electoral Act 2010 (as amended) and pending the determination of the motion on notice filed by the applicant. The court also issued an order of injunction restraining INEC from issuing a certificate of return to Ogah while the claimant, Ikpeazu remains in office in accordance with Section 143 (1) & (2) of the Electoral Act 2010 (as amended). He said the order will last for 10 days and fixed Friday for the claimants and respondents to return to the court. Ikpeazu is insisting that he remains the governor until his appeal is determined. There is also a pending motion for stay of execution of the judgment. INEC’s position INEC admitted that it received a notice of appeal from Ikpeazu. At first, it said it issued the certificate of return to Ogah because it received no notice of appeal from the governor, who responded immediately that the commission did indeed receive the notice. The two documents were said to have been signed for by Saleh N. Ibrahim, Senior Clerical Officer at the Legal Services Department of the commission’s headquarters, Abuja, who stamped the notice of appeal and motion for stay of execution with the commission’s official stamp by 12.50pm on Wednesday, June 29, 2016. Clarifying INEC’s position on the issue, its spokesman, Nick Dazang, said Ikpeazu’s failure to provide a stay-of-execution order left the commission with no choice than to issue Ogah the certificate of return. He said since Mr. Ikpeazu’s notice was not deemed sufficient, it had to, as a matter of policy, execute the judgment of the high court. “I discovered that INEC received Mr. Ikpeazu’s notice. However, it did not contain a motion or order of stay of execution. In the circumstance, and in deference to the previous court order, INEC as a responsible regulatory (body) has no recourse than to issue Mr. Ogah the certificate of return. “By law, a certificate of return is supposed to be issued within one week. Also, the commission has decided as a matter of policy to obey all subsisting court orders. That means if the court were to issue a contradictory order, INEC has no option than to obey.” Abia State Attorney-General Umeh Kalu said the governor’s legal team included the notice of stay of execution order with the appeal notice delivered to INEC. He said: ”It’s unfortunate that INEC said that it was not served. But the truth is that they were served. I have a proof to that. “It is now clear that the commission had no reason or cause to proceed with their dangerous action of issuing a certificate of return to Dr. Uche Ogah when it was clearly in receipt of a notice of appeal and stay of execution expressly forbidding it from taking any further action on the judgment of Justice Okon Abang of the Federal High Court pending the determination of the appeal in the case. “It is rather surprising that the commission could lend itself to be used for an act capable of destabilising a state in Nigeria with the attendant consequences for anarchy and breakdown of law and order.” What is the way out of the situation? Lawyers speak Senior lawyers, including Sylva Ogwemoh (SAN), Dr. Joseph Nwobike (SAN), member, Ogun State Judiciary Commission, Mr. Abayomi Omoyinmi, activist-lawyer Mr. Ebun Adegoruwa, Chairman, Nigerian Bar Association (NBA), Sagamu Branch Mr. Adebowale Oduguwa and former Chairman, NBA Ikeja Branch, Monday Ubani said the court should be allowed to conclude its adjudicatory process. Ogwemoh, however, argued that the fact that an appeal was filed does not translate into a stay of execution of judgment of a lower court. He said: “It is the law that an appeal does not operate as a stay of execution of a valid judgment of a court. “But where an appeal has been filed challenging the judgment rendered by a court or tribunal, and an application seeking a stay of execution of the judgment is filed and served on all the relevant parties, no step(s) should be taken by any of the parties to dispute to render the appeal nugatory.” The lawyer explained that on the other hand, the Electoral Act, 2010 (as amended) has provision in section 143 dealing with stay of execution of a judgment of a tribunal or court. Ogwemoh said: “The Act allows a period of 21 days for an appeal to be filed where a tribunal or court determines that a candidate returned as elected was not validly elected. The person against whom the judgment of the tribunal or court has been made and who has appealed against the judgment is by virtue of Section 143(1) of the Act allowed to remain in office pending the determination of the appeal. Even where the person in office declared by the tribunal or court as not validly elected has not appealed, he shall by virtue of Section 143(2) of the Act remain in office pending the expiration of the period of 21 days within which an appeal may be brought”. Ogwemoh said Ikpeazu took the right step by approaching the high court in Abia State for interpretation of the provision of the Electoral Act in order to avoid anarchy and chaos in the system, adding, “We should not forget so quickly that Section 143 of the Act was introduced to avoid the experience in the past under the old law where there was no provision to address this kind of situation where a candidate in office is declared not validly elected by a court or tribunal and another candidate is immediately sworn in, and when the judgment of the tribunal or court is upturned on appeal, the person returns to office and claims to be entitled to a fresh term of office. To Omoyinmi, INEC is right to have carried out Justice Abang’s order. He noted that the order of the court from the judgment is that Dr. Ogah should be issued a certificate of return with immediate effect and INEC is right in carrying out the order of court to that extent. “However the notice of appeal filed by Dr. Ikpeazu before the Court of Appeal does not operate as a stay over the judgment. Where there is no order for stay of execution, the INEC is right to have obeyed the court and all parties must obey the court decision. Nevertheless the Abia State High Court may have been placed with facts to show that a notice of appeal against the decision of Justice Abang has been filed, and consequent on that issued an interim order which I believe is invalid in law considering the fact that the Abis State High Court is of coordinate jurisdiction with the Federal High Court.” While admitting that Ikpeazu, under the law is entitled to file an appeal and subsequently and statutorily remain in office pending the determination of his appeal, Oduguwa also stated that an appeal does not operate as a stay of execution of judgment. According to him, INEC requires a specific order of stay of execution to stop it from issuing the certificate of return, more importantly that the court specifically ordered that the certificate be issued. He argued: “It will be contemptuous on INEC to ignore the issuance of the certificate nothwithstanding that an appeal has been filed. INEC has a duty to comply with the valid and subsisting order of a court of competent jurisdiction. But Dr. Nwobike reasoned that Justice Abang should not have made those consequential orders directing INEC to issue a certificate of return to Mr Ogah in view of the clear and mandatory provisions of Section 141 of the Electoral Act, 2010. “Again, having filed an appeal and applied to stay the execution of orders of the Federal High Court, I believe that a prudent INEC should have awaited the decison, one way or the other, regarding that application for stay of execution. “Granted that an application for stay of execution does not amount to the stay of execution of the orders, INEC should have, in view of the provisions of Section 143 of the Electoral Act, awaited the complete determination of that application before proceeding to issue the certificate of return to Dr. Ogah. “I also believe that INEC should have given due consideration to the fact that, apart from the fact that the orders emanated from pre-election action, Dr. Oga never participated in the governorship election that it conducted on April 11, 2015. Putting the foregoing on a scale, it does appear to me that the haste with which INEC issued the certificate of return provides validity to possible charge of bias or bad faith”, he further argued. In respect of the order made by the Abia State High Court, he said it appeared to have been sought for to prevent the breakdown of law and order. “I cannot, with any modicum of certainty comment on its propriety until I read the substantive reliefs”, he said. Adegoruwa argued that once a party who lost a case has filed an appeal and an application for a stay of execution of the judgment, that judgment cannot be enforced until his application has been decided one way or the other. “There is no controversy in this matter at all. We have evidence that INEC was duly served with both the notice of appeal and the application for a stay of execution of the judgment. In that regard, the commission was clearly in error, to have proceeded to execute the judgment that was already on appeal, by issuing a certificate of return to Chief Ogar, thus precipitating and provoking the current tension and confusion in Abia State”. Adegoruwa said the appropriate thing to do now is for INEC to withdraw the certificate of return that was issued to Ogar in error, and await the determination of the appeal. “The crisis that is to follow is better imagined. If Ogar is sworn in now and Ikpeazu eventually succeeds on appeal, then Ikpeazu will be sworn in again and that monumental confusion will continue until the case is finally decided by the Supreme Court. There is no need for this drama at all. Parties should be patient and await the final determination of this case by the Supreme Court”, he said. Ubani argued that since INEC has issued Dr. Ogah with a certificate of return, the next thing is for the Chief Judge of Abia State to swear him in as governor. He argued that the order of the Abia High Court restraining the Chief Judge from swearing in Ogah into office is invalid in law as “it did not emanate from a higher court but from a court of coordinate jurisdiction and does not in any vitiate or invalidate the earlier judgement of the Federal High Court in which the Chief Judge of Abia State was ordered to swear in Dr Uche Sampson Ogah. Only a higher court, in this case, Court of Appeal, has the jurisdiction to reverse the judgement of the Federal High Court”. He added: “The appeal of Dr Okezie Ikpeazu before the Court of Appeal does not operate as a stay over the judgment of Justice Okon Abang. In the absence of any express order of the high court or the court of appeal ordering stay of execution, the judgement of the Federal High Court delivered on the 27th of June, 2016 should be obeyed by all the parties”. Way out Ogwemoh said it is also important at this stage of the crisis for the Chief Law Officer of the Federation to make a pronouncement on the issue, ‘’which I think should be in support of allowing the appeal process initiated by Governor Ikpeazu to be exhausted to enable us have the benefit of an appellate court decision on the matter. Dr. Nwobike and Omoyinmi agreed with Ogwemoh on the need to allow the matter go through the appellate court. Nwobike said, “I think that the Court of Appeal should quickly intervene, upon the application of any of the parties, by ordering the maintenance of status quo before the orders of Justice Abang pending the determination of the appeal. Omoyinmi added that the way out is for the Higher Court to be allowed to make a pronouncement on the matter be it at the Court of Appeal or Supreme Court “after all if Dr. Ogah emerge victorious, his four year term will commence on the date of his swearing and he would have ultimately lost nothing as to the number of years for his tenure in office”. Oduguwa suggested that in view of the conflicting orders of the Federal and State High Courts on the swearing in issue, “the most ideal thing to do and which we seem to have adopted is to allow the appellate courts to consider the appeal if any so that all the issues in controversy including the appeal can be dealt with once and for all. My advice is that the CJ should allow the judgment to be tested on appeal. “If Dr. Ogah wins on appeal, his tenure will commence from the date he is sworn in. The Nigerian Navy said on Tuesday that the naval Maritime University in Ibuza, Oshimili North Local Government Area of Delta, would soon commence academic work. The Chief of Naval Staff (CNS), Vice-Adm. Ibok-Ete Ibas, made the disclosure when he visited the Nigerian Navy Ship (NNS) Delta in Warri. Ibas said that the process of obtaining the required approval for already constructed institution was being concluded. The naval chief said the proposed university was initially conceived as a Navy College. Ibas explained that the university was established in order to close academic gap which had necessitated the Nigerian Navy sending its personnel abroad to acquire some special skills. ”The moment the Federal Executive Council (FEC) grants the approval to commence operations, the university will start academic activities. “It is true that the Navy is in the process of obtaining the necessary clearance to have it converted to a university that will serve the navy as well as members of the public. “You will recall that the Navy undertakes a lot of its courses abroad in some civil institutions. ”So what the Navy has done is to go into partnership with some foreign partners who will assist us in establishing a school that will cater for the needs of the Navy in some areas we are currently deficient. “The process of getting the university licence is still on-going, we are contacting all the relevant agencies of government for approval,” he said. Ibas also attributed the relative peace in the Niger Delta region in respect of insurgency to the dialogue approach adopted by various organs of the government. ”You will recall that different organs of government have been dialoguing with the militants concerned, while the military maintains its posture of ensuring that militant activities are curtailed. ”For us as the Navy, in peace and war times, our duty is to ensure we police the general maritime areas and ensure that legitimate business thrives,” he said. The initiative by Basel cafe owner Daniel Haeni and allies has scant chances of victory but public interest in the matter is huge, far beyond Swiss borders. Supporters said introducing a monthly income of 2,500 Swiss francs (£1750) per adult and 625 francs per child under 18 would promote human dignity and public service. Opponents, including the government, said it would cost too much and weaken the economy. Campaigners tried to gain international attention by creating a poster bigger than a soccer field asking 'What would you do if your income was secure?' and showing it in Geneva and Berlin, and, via a video of the performance, in New York. They had also handed out free 10-franc notes to passersby. Switzerland with its system of direct democracy is the first country to hold a national referendum on an unconditional basic income, but other countries including Finland are examining similar plans. Polling stations in most places opened at 10.00 am and were set to close at noon, but most people in the wealthy Alpine nation vote in advance. In Geneva for instance, 47.4 percent of eligible voters had already cast their ballot on Saturday evening, according to the regional voting service. Several other contentious issues are also being put to the vote under Switzerland's system of direct democracy on Sunday, some of which have a better chance of going through. A recent gfs.bern poll indicated that 60 per cent of voters are in favour of a government proposal to speed up the country's asylum process. The aim is for most cases to be handled within 140 days or less, compared to an average of around 400 days at the moment. The Swiss will also vote on whether to allow genetic testing of embryos before they are inserted in the uterus in cases of in vitro fertilisation where either parent carries a serious hereditary disease. No screening would be permitted for things like gender, hair and eye colour, but that has not stopped opponents from dubbing the initiative the 'eugenics law'. The Federal Government Thursday scrapped the conduct of post Unified Tertiary Matriculation Examinations (UTME) for candidates seeking admission into higher institution. The government explained that all tertiary institutions were at liberty to conduct screening for candidates seeking admission into any school. Minister of Education, Mallam Adamu Adamu, said this on Thursday in Abuja after declaring open the 2016 Combined Policy Meeting on Admissions to Universities, Polytechnics and other higher institutions in Nigeria. Adamu, expressed confidence in the examination conducted by the Joint Admissions and Matriculation Board (JAMB), adding that there was no need for other examination to be conducted by universities after JAMB. He said: “As far as I am concerned the nation has confidence in what JAMB is doing. The universities should not be holding another examination and if the universities have any complain against JAMB let them bring it and then we address it. “If JAMB is qualified enough to conduct tests and they have conducted test then there will be no need to conduct another test for students to gain admission.” The Minister also asked the JAMB to stop extra charges on several categories of changes on admissions such as the change of course, change of school and others. Meanwhile, the JAMB has pegged the cut – off mark for admission for 2016 at 180. The 180 benchmark, applies to all universities and higher institutions in the country, including polytechnics, colleges of education, and others. JAMB’s Registrar and Chief Executive Officer, Prof. Dibu Ojerinde, after a long debate with delegates from various institutions, told journalists that no institution would go below the 180 cut-off set by the board. He said: “180 is given, no institution will go below 180 this year, And some universities can go above it, I know University of Ife will not go below 200 and University of Lagos will not go below 200 and also UI. All these ones stand but 180 as bench mark for others. “This year we have more than enough candidates, we have over 1.5 million candidates so we will get enough candidates to take in all the schools if they are serious.
