How can a final court of Justice reverse it's own judgement.

Who told you that Supreme Court can’t reverse itself? It has happened before, this is not the first time. When there is clerical error or error in judgment, Supreme Court can reverse itself.

They know SC cannot reverse her own judgement except there is a constitutional amendment but they went ahead to file for review.

What told you Supreme Court can’t reverse her own judgment, it has happened before so, this is not the first time. If yuh read the judgement very well, you will see that the judge said that the lawyers failed to point out errors in the previous judgment. If you’re applying for review, you have to point out errors in previous judgment.

How they could separate deputy governor from governor on their judgement on Kogi of Audu/Faleke ticket but they could not separate deputy governor from governor on Bayelsa's Lyon/Bionarakuma ticket is still a wonder of Mary odili's influenced judgement

I’m not a Buhari supporter but I want you to understand that when something like this comes, FG has to employ delay tactics while they clear the legal bottlenecks back home here before allowing the money to come in. Court judgement is not what you just go and get immediately, that’s why FG alerted US rhat there is an agreement with the mule with FG (obj in 2003) so, they have to delay the repatriation of the fund until they clear the bottleneck.

You made mention that OBJ wouldn’t have let him go and I reminded you that OBJ gave him the deal in contention and also allowed him to go. Don’t tell me you’re not aware of that but my annoyance is you referencing OBJ to me that he wouldn’t allow him go if he was the one in charge currently? What is your intention? Buhari did nothing rather than letting US know that there is judgment at hand which prompted them to keep the money for now. These Abacha loots comes out anytime when the custody country wants to release it so, you don’t expect the FG to institute a case against Bagudu and get favorable judgement immediately. So they have to employ delay tactics while they work on it back home here. Bagudu is not the only mule used to launder money by Abacha, there many of them and FG is dealing with each of them based on the legal agreement reached with them with OBJ administration. I’m not a Buhari supporter and I don’t like him. Check my comments history but when the government does something well, patriotism demands that we applaud them. This one is coming from US, some have come from Switzerland, UK, Jersey, etc and FG dealt with them separately.

Besides what you wrote is what I told you exactly. The only difference is that while the US is asking Nigeria to make an official claim for the money thereby establishing it as looted funds and implicating Bagudu, Nigeria is claiming they can't do anything about it based on a 2003 agreement. Don't forget that even Bagudu has reneged on that agreement by not facing trial in Nigeria which was part of the initial agreement. Truth is the Nigerian govt is shielding Bagudu under a flimsy technicality. Malami and Bagudu are from the same state don't forget.

Exactly what the Buhari administration is trying to let US know that there was an agreement and looking at that agreement, OBJ administration violated and now he is a governor with impunity, that’s why the FG declined thus letting America put on hind the money for now. I wonder what is difficult there to understand?

Let me break it down to you in tiny pieces.

The US and Jersey indicated to Nigeria that they want to repatriate 141m to us.
Meanwhile there's an agreement (plea bargain) between the US, Jersey, Nigeria and Bagudu and associates that Nigeria will collect 163m and not pursue any further repatriation from the assets traced to Bagudu and associates and in return, Bagudu will come to Nigeria and face trial.
Nigeria, mindful of the 2003 agreement in 2018, approach Bagudu to allow them receive the 141m euros and pay him 98m out of it like another form of settlement.

US gets wind of this arrangement and refuses, claiming that Nigeria should seek to prosecute Bagudu for being an accomplice in the Abacha loots instead of looking to share the returned money with him.
Nigeria refuses, claiming there is an agreement in place that forbids them from prosecuting him which is not entirely true. Hope you get it now.

This is exactly captured in the article:

Buhari’s government explicitly said that it can’t assist the US because of the agreement in reached with OBJ administration in 2003. This is given US hint of what’s on ground back home because definitely once the money comes, Bagudu will definitely file a legal suit against FG.

When I won’t blame Buhari entirely rather, Buhari played Bagudu. Buhari knows if the money is signed to be released to FG, America will oblige and once that happens, Bagudu will file a lawsuit against FG for the transfer of the money to him basing his arguments on the 2003 agreement reached with OBJ administration. So to avoid all that, FG told America that the money should released directly to Bagudu (knowing fully well that America won’t accept that), the result is what we are seeing now which is good for the country. Otherwise, what stops FG from getting the money directly and then transfer same to Bagudu, of course after some egunje must have exchanged hands?

there no distribution company in the world that distribute 100%. even in developed countries. that is why you generate more than you need but right now we can't even generate 10% of what you need

Maybe you didn’t read the article very well. TCN transmission infrastructure can only accept 7,000 megawatts. Discos infrastructure can only receive 3-4K megawatts. So if foreign companies like Siemens comes in, they will take over Discos and as time goes, they can also generate. This means that Discos will be gotten rid of first. When Siemens add generation to their portfolio, TCN will stop existing because Gencos will start distributing what they generate too so, no need of transmitting to National grids again which is managed by TCN(FG). The reason why Siemens will take over distribution first is because they’ll have to build their own Generating plants and it takes time.

Discos are ever ready to generate more but they can’t be wasting money generating what TCN and Discos can’t distribute, that’s why they fourth sometime ago for FG to allow them distribute part of what they generate but FG refused.

and they are now even working to increase the generation to 79 ,000 MW .


Nigeria with more than 3 times that population generate only 13000. that 13000 may not be enough to give Lagos 24hrs light

Let us utilize the one we are able to generate before generating more. You don’t have the infrastructure to adequately distribute what you’re generating and you want to keep wasting money generating?

Generation is not the problem, the main problem is transmission and distribution. Gencos are currently generating 13,000 megawatts but can only transmit 7,000 megawatts to the National grids because of the poor state of the transmission infrastructure. Now FG which controls the the National grids in turn can only distribute 3,000-4000 megawatts to Discos because of the poor state of the distribution infrastructure. Gencos are ready to generate more power but the problem is that the one they are currently generating are not been utilized by TCN and Discos. You see where the problem is coming from now?

Another problem is suspect is that Discos don’t even want to invest in industry by upgrading and expanding their distribution infrastructure. They only rely on the outdated infrastructure inherited from PHCN/NEPA. Get anything they can from FG, distribute the ones they can, swallow/embezzle what they collect from consumers and then cry to FG that consumers refused to pay hence, they can’t pay the Discos. Now FG will listen to their cry by bailing them out. You that the problem is dishonesty of these Nigerians called Discos?

That’s why you see the real experts in the industry mange GENCOS, eg. Prof. Bath Nnaji while career criminals manage DISCOS, eg. Emeka Offor.

it was passed by 7/5 judges and she only has one vote. The judgement is passed based on majority vote and in this case, all of them voted for the same judgment.

Let me put this way, the review is just an academic exercise.....nothing is coming off it as regards to the situation of governorship seat.

The Supreme Court judgement is final. But the supreme court judges are humans, so they are prone to errors like every human beings. So there is an avenue to review their judgement if there is a public outcry like we have now. I think this is done in order to forestall using the judgment for future citation in similar cases.

But there has been some instance here the Supreme Court reversed its judgement after finding out that the earlier judgment was delivered in error so, it can still happen because the error in this case is very obvious. Read the case of Olorunfemi v. Asho (Suit No. 13/1999). Also the NASS need to ammend the constitution so that Supreme Court so they can review and correct their judgment if there blatant error just like the Imo case. But the review should be done only once if not, Supreme Court will be politicized very soon the way I’m seeing it and it won’t augur well for the country.

stop talking like s0me0ne who is sentimental. Is the epl n0t part of uefa? Does what affect uefa n0t also affect the epl and to large extents the game? They are trying to create a level playing field here. Same way rules pr0tect players on the pitch.

Even though EPL is part of UEFA and both under FIFA, they have different rules just like other country like La Liga and Seria A. That’s why transfer window is still open wirhing La Liga but closed in EPF. Each have their own rule even though they are both under UEFA.
